RESOLUTION 14-058
A RESOLUTION APPROVING THE AGREEMENT FOR RESIDENTIAL SOLID WASTE AND
RECYCLING COLLECTION SERVICES IN SAINT ANTHONY VILLAGE BETWEEN THE
CITY AND THE CONSORTIUM OF REPUBLIC SERVICES, WALTERS RECYCLING AND
REFUSE, AND WASTE MANAGEMENT AND AUTHORIZING
THE MAYOR AND CITY MANAGER TO EXECUTE SAID AGREEMENT
WHEREAS, the City of St. Anthony Village (the "City') currently has an open solid
waste collection system with three (3) residential solid waste collectors
licensed in the City in 2014: Allied Waste Services of North America, LLC
dba Allied Waste Services of the Twin Cities - Eden Prairie // Republic
Services of the Twin Cities - Eden Prairie, a Delaware limited liability
company; Walters Recycling and Refuse, Inc., a Minnesota corporation;
and Waste Management of Minnesota, Inc., a Minnesota Corporation
(collectively, the "Haulers'); and
WHEREAS, pursuant to and in accordance with Minnesota Statutes section 115A.94
("Organized Collection Statute"), the City and the Haulers have engaged
in exclusive negotiations to develop a proposal whereby the Haulers, as a
consortium, will collect solid waste and recyclables from designated
sections of the City; and
WHEREAS, as a result of the negotiations between the City and the Haulers, the
Haulers have submitted a proposal for the organized collection of solid
waste and recyclables that meets the criteria required by the Organized
Collection Statute ("Proposal"), along with a Draft Agreement for
Residential Solid Waste and Recycling Collection Services in Saint
Anthony Village ("Draft Agreement"); and
WHEREAS, the City Council received the Proposal and Draft Agreement at a Special
City Council meeting held on June 30, 2014; and
WHEREAS, the City Council discussed the Proposal at the July 8, 2014 City Council
meeting and asked City staff to meet with the Haulers again regarding
certain requested revisions to the Proposal; and
WHEREAS, City staff subsequently met with the Haulers to address the City
Council's requests, and the Haulers addressed these requests in a revised
Proposal ("Revised Proposal"); and
WHEREAS, the City Council received the Revised Proposal at the August 12, 2014
City Council meeting and directed City staff to schedule a public hearing
in accordance with the Organized Collection Statute; and
WHEREAS, City staff and the Haulers revised the Draft Agreement to align with the
Revised Proposal and have otherwise finalized the Draft Agreement and
prepared it for the Mayors and City Manager's execution ("Agreement");
and
WHEREAS, the City held a public hearing at its September 9, 2014 City Council
meeting, in which the City Council gathered public input and
subsequently voted to implement organized collection as detailed in the
Proposal, Revised Proposal, and Agreement, and as outlined in the
Organized Collection Statute.
NOW THEREFORE BE IT RESOLVED, that the City of St. Anthony Village City Council
approves the Agreement for Residential Solid Waste and Recycling Collection Services in Saint
Anthony Village between the City and the Haulers and authorizes the Mayor and City Manager
to execute said Agreement.
