RESOLUTION 14 -088
A RESOLUTION APPROVING THE CONSENT ORDER IN THE FEDERAL COURT
MATTER CAPTIONED UNITED STATES OF AMERICA v. CITY OF SAINT
ANTHONY VILLAGE, MINNESOTA AND THE CONTINGENT SETTLEMENT
AGREEMENT IN THE FEDERAL AND STATE COURT MATTERS CAPTIONED
ABU - HURAIRA ISLAMIC CENTER AND MUXAMEDRASHID ALI v. CITY OF ST.
ANTHONY
WHEREAS, the United States of America ( "United States ") filed a complaint against the City
under the Religious Land Use and Institutionalized Persons Act of 2000 in
Federal District Court.
WHEREAS, the Abu - Huraira Islamic Center and Muxamedrashid Ali (together, "AHIC ")
initiated related actions in Federal and State District Courts.
WHEREAS, representatives of the United States, AHIC and the City participated in a
settlement conference on December 11, 2014, before Federal Magistrate Judge
Jeffrey J. Keyes and agreed, in principle, to a settlement of all matters contained
in the above referenced matters, subject to (i) approval of the settlement by the
City Council and (ii) required subsequent procedures required under the City's
zoning ordinances.
WHEREAS, the terms of that settlement are recited in the Consent Decree and Contingent
Settlement Agreement that are attached as Exhibit A to this Resolution.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saint Anthony
does hereby approve the following:
1. Consent Decree; and
2. Contingent Settlement Agreement.
BE IT FURTHER RESOLVED, that the Mayor and City Manager are authorized to execute the
same on behalf of the City.
