COUNCIL MINUTES
SPECIAL MEETING
Aug. 2, 1976
The meeting was called to order by Mayor Miedtke at 7:35 P.M.
Present for roll call: Miedtke, Haik, Stauffer, Sundland.
Absent: Sauer
Also present: Jerry Dulgar, City Manager
Jim Fornell, Adm. Asst.
Mayor Miedtke explained that the purpose of the meeting was to
have the third reading of the proposed zoning ordinance, make
any changes deemed necessary and if possible take a vote on the
adoption of the ordinance. He could.not guarantee any action
would be taken on Mr. Hedlund's request for a public hearing on
a proposed P.U.D.
Councilman Sauer arrived at 7:45 P.M.
The Council discussed several areas of concern in the zoning
ordinance: power transmission towers and their being subject
to height restrictions, voting for radio transmission tower permits,
traffic visibility regulations, maximum density and maximum structure
height in PUD's, the amount of commercial land use permissible in
a P.U.D. , the amount of performance bonds for P.U.D.'s, driveways
next to property lienes and the "Purpose" statement contained in
several sections. Changes were to be incorporated into the final,
adopted draft.
Motion by Councilman Sauer, seconded by Councilman Stauffer to adopt
Ordinance 1976-006,as modified.

AN ORDINANCE RELATING TO ZONING; AMENDING
SECTION 300 OF THE 1973 CODE OF ORDINANCES
Motion carried unanimously.
Mr. Gordon Hedlund,1255 Pike Lake Drive, New Brighton, presented
his proposal for a P.U.D. on Silver Lake Road between 39th Avenue
N.E. and Silver Lane. He wanted the City Council to schedule a
public hearing on the proposal as soon as possible.
Mayor Miedtke raised the question about the need for variances
if Mr. Hedlund's proposal were to be approved. He felt, however,
that the comprehensive planning required by the P.U.D. was a positive
element.
Councilman Sundland was concerned about what would happen to the

land on which the retirement home is to be constructed if financing
and/or a developer for the home is not obtained. He indicated the
only use proposed in the P.U.D. that he didn't particularly care
for was the Country Kitchen Restaurant.
Councilman Haik felt that the proposal was not particularly unique
and did not seem to fit the intent of the P.U.D. section of the
zoning ordinance in trying to foster creative land use.
Councilman Stauffer felt that some of the uses proposed in the P.U.D.
were acceptable to her and felt that some compromise was probably in
order.
Councilman Haik left the meeting at 9:35 P.M.
After discussion on the merits of Mr. Hedlunds P.U.D. proposal and
request for a public hearing, the following motion was made:
Motion by Councilman Sauer, seconded by Councilman Sundland to
direct the Planning Board to hold a public hearing on the proposed
Hedlund P.U.D on August 31st.
Motion carried.
Motion by Councilman Sundland, seconded by Councilman Sauer to
adjourn.
Motion carried. Meeting adjourned at 9:40 P.M.
