25 Council Meeting Agenda of September 23, 2014.

29 11. PROCLAMATIONS AND RECOGNITIONS.

31 Councilmember Roth recited the proclamation designating Friday, September 26, 2014, as St.
32 Anthony Kiwanis Peanut Day.

34 Mayor Faust introduced Kiwanis Club of St. Anthony Village President Rick Dunn and
35 President-elect Tom Miller.

37 Mr. Miller thanked the City for its support of Kiwanis and stated that the Kiwanis Peanut Day is
38 their #1 source of fundraising and enables them to sponsor K -Kids Club at Wilshire Park,
39 Builders Club at the middle school, and the Key Club at the high school, as well as the AKTION
40 Club for adults with disabilities. He stated this is the 43`d year of their fundraising drive in St.
41 Anthony and he thanked the community for its support of Kiwanis Peanut Day.

43 Mayor Faust thanked the Kiwanis Club for its ongoing support in the community and wished
44 them the best on Friday.

D. Consider Resolution 14-061; a Resolution Appointing the Election Judges for the 2014
General Election.
Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve the Consent
Agenda items.
Mayor Faust pointed out the City is going to issue a cigarette and tobacco license to Smoke4less
at 3809-3811 Stinson Boulevard, which is the location of the former hookah lounge and asked if
Smoke4less is aware that the City Council recently passed an Ordinance regarding electronic
cigarettes as well as an Ordinance pertaining to drug paraphernalia.
City Manager Casey replied that all current and prospective cigarette and tobacco license
holders, including Smoke4less, have been sent a letter regarding the Ordinances.
Motion carried 4-0.

A. Presentation on Fire Prevention/Education. Captain Chris Fuller and Firefighter Mattie
Jaros presenting.
Captain Fuller advised that Fire Prevention Week is held annually during the week that October
9s' falls to commemorate the Great Chicago Fire in 1871. He stated that nationwide in 1977
there were 1,098,000 structure fires and in 2013 there were 487,500 structure fires representing a
reduction of over half, but despite this decrease there were still 3,240 civilian deaths, an increase
of 13.5%, with home fires accounting for 79% of fire injuries and 85% of fire deaths. He stated
the Fire Department works with schools and preschoolers on fire prevention/education and have
developed specific curriculum per grade including EDITH (Exit Drills in the Home), poster
contests, station tours, and CPR training. He stated the Fire Department also works with local
businesses and provides hazardous materials training, fire extinguisher training, and CPR
training, and the Fire Department has become more involved with apartments and senior
buildings on fire safety. He stated the Fire Department provides free home safety inspections for
residents and noted these inspections are intended to provide recommendations and do not
include code enforcement; in addition, the Fire Department offers free CPR classes, station tours,
and general fire safety for the general public.
Firefighter Jaros announced the Fire Department annual open house on Saturday, October 11 `s,
from 1:00-4:00 p.m. She stated the open house is a great opportunity to learn about fire
prevention and the open house will include tours of a fire truck and ambulance, an obstacle
course, and vehicle extrication demonstration, and there will be hot dogs and chips for everyone.
Mayor Faust expressed the City Council's thanks to Captain Fuller and Firefighter Jaros for their
presentation and also extended the City Council's thanks and appreciation to everyone on the
Fire Department.

B. Resolution 14-062; a Resolution Approving Redpath and Company as the City Auditor
for Auditing Years 2014 and 2015 and Authorizing the Mayor and City Manager to
Execute Such Contract. Mark Casey, City Manager, presenting.
City Manager Casey stated that for the last two years, the contracted price for audit services was
$47,225 annually and this price included preparation of an annual Audit Management Letter. He
stated staff is proposing to eliminate the Audit Management Letter because much of the
information is a restatement of the CAFR information and is incorporated in other documents.
He stated the proposed price for the 2014 and 2015 audit is $47,000 and $49,000, respectively,
and the 2015 price includes GASB No. 68 regarding pension liabilities.
Councilmember Jenson asked if it was correct that the City has a long history working with
Redpath and has had no issues with the State as a result of the audit services performed by
Redpath.
City Manager Casey replied this was correct and stated the City has been satisfied with the
services performed by Redpath and the number of reported deficiencies has significantly
decreased.
Motion by Councilmember Roth, seconded by Councilmember Jenson, to adopt Resolution 14-
062; a Resolution Approving Redpath and Company as the City Auditor for Auditing Years 2014
and 2015 and Authorizing the Mayor and City Manager to Execute Such Contract.
Motion carried 4-0.
C. Ordinance 2014-04; an Ordinance Terminating a Moratorium on the Creation,
Establishment or Operation of Businesses that Sell Electronic Cigarettes and on the
Sampling of Electronic Cigarettes and Related Products in Businesses. Mark Casey, City
Manager, presenting.
City Manager Casey stated that on November 12, 2013, the City Council adopted an Ordinance
to enact a moratorium on the creation, establishment, or operation of businesses that sell
electronic cigarettes and on the sampling of electronic cigarettes and related products. He stated
that staff worked on amendments to the Ordinance that treated these products similar to a regular
cigarette and prohibiting their use in indoor public places, and the City Council approved
relevant amendments to the City Code so the moratorium is no longer needed.
Motion by Councilmember Roth, seconded by Councilmember Gray, to adopt Ordinance 2014-
04; an Ordinance Terminating a Moratorium on the Creation, Establishment or Operation of
Businesses that Sell Electronic Cigarettes and on the Sampling of Electronic Cigarettes and
Related Products in Businesses.

City Manager Casey reported there has been some confusion about this year's street
reconstruction project as it relates to trees and tree replacement. He stated there were 23 ash
trees removed during this year's project and the City is replacing all trees and the trees will be
planted 8' behind the curb in the City's right of way and will be treated as boulevard trees with
the City responsible for the trees. He added that there were other trees in the right of way that
needed to be removed and for each tree removed, the City will plant a tree in its place.
Councilmember Gray — no report.
10 Councilmember Jenson reported on his attendance at the September 11 th Community Services
11 Advisory Committee meeting and the Touch a Truck event on September 131".

16 reported that he recently attended the 90`h birthday party for Mr. George Wagner and stated he
17 was grateful for everything that Mr. Wagner has done for St. Anthony Village.

Mayor Faust invited residents to come forward at this time and address the Council on items that
are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.

Mayor Faust encouraged residents to attend the Fire Department Open House on Saturday,
October 11`h, from 1:00-4:00 p.m.

Resolution 14-065; a resolution authorizing a Joint Powers Agreement between the City of
Minneapolis and the City of St. Anthony
REVIEW:
The City has received a request from the City of Minneapolis to formalize the existing arrangement
for billing certain Saint Anthony properties for utility services. There are 32 parcels which border and
receive their services from the City of Minneapolis. A formal Joint Powers Agreement allows the City
of Minneapolis to certify to taxes the delinquent utility amounts owing. This is an efficient collection
method employed by local governments. The City of Minneapolis request is reasonable and I would
recommend that the City of Saint Anthony entered into the JPA.

JOINT POWERS AGREEMENT
BETWEEN
THE CITY OF MINNEAPOLIS
AND
THE CITY OF ST. ANTHONY
THIS AGREEMENT is entered into between the CITY OF MINNEAPOLIS, a
Minnesota home rule charter city and the CITY OF ST. ANTHONY, a Minnesota statutory
city, herein after collectively referred to as the "Cities".
RECITALS
A. Minneapolis sells utility services, such as water or sanitary sewer services, to
customers in St. Anthony (see Exhibit A for addresses served).
B. The Cities wish to provide additional remedies for the collection of charges from
customers who live in St. Anthony, but receive one or more utility services from Minneapolis.
C. Minnesota Statutes § 471.59 authorizes two or more governmental units to enter
into agreements to jointly or cooperatively exercise any power common to the contracting parties
or any similar power.
NOW, THEREFORE, the Cities agree as follows:
1. PURPOSE. This Agreement shall establish the responsibilities of the Cities
concerning assessment against real property in St. Anthony of utility charges incurred by
customers receiving Minneapolis utility services at their St. Anthony property who have not paid
their applicable Minneapolis utility bill.
2. SALE OF UTILITY SERVICES. Minneapolis will continue to provide the
applicable utility service to customers in St. Anthony in accordance with existing practices and
agreements, except as modified herein. Usage of Minneapolis utility services by St. Anthony
customers shall be subject to the same usage rules imposed upon Minneapolis residents.
3. BILLING. Minneapolis will bill customers in St. Anthony for utility services
Minneapolis provides to customers in St. Anthony. The billing rate will be the Minneapolis rate
established for outside city customers. If the customer fails to pay a bill, Minneapolis will notify
St. Anthony. Upon receipt of such notification, St. Anthony will certify the unpaid bill to taxes in
accordance with Minn. Stat. Chapter 444 or other appropriate authority. St. Anthony shall
promptly transmit the proceeds to Minneapolis after they are received in the normal course of
property tax settlements.
4. TERMINATION. Either party may terminate this Agreement upon 24 months
advance written notice to the other party.

A RESOLUTION TO SUPPORT THE ST ANTHONY- NEW BRIGHTON SCHOOL
DISTRICT 282 REFERUNDUM FOR THE REPLACEMENT OF THE CURRENT
OPERATING LEVY AND A CURRICULUM AND TECHNOLOGY
CAPITAL PROJECT LEVY
WHEREAS, in, 1959, the University of Minnesota recommended establishing a high school in
District 282 for the St Anthony students; and
WHEREAS, by this expansion in 1961 it built, located, and operated a kindergarten, primary,
middle and high school in St Anthony Village; and
WHEREAS, this school district has, over the many years, been the recipient of scores of
awards for excellence in education, sports, and cultural activities; and
WHEREAS, in these intervening years it has became an essential asset and community partner
with the civic, business and governmental entities; and
WHEREAS, the collaborative spirit exhibited by ISD 282 throughout the years by actively
contributing to the overall well being of the community; and
WHEREAS, residents move here for the school but remain here for the community; and
WHEREAS, this is an integral ingredient in the enhancement and sustainability of our
community and property values; and
WHEREAS, with its tenacious enthusiastic fidelity to education, sports and civic activities for
the betterment of society as an entirety.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony that
we encourage and whole hardly support the passage of both referendum questions on November
4`h 2014.

A RESOLUTION ACCEPTING THE SOUTH ST. ANTHONY REGIONAL STORM WATER
TREATMENT SYSTEM PROJECT PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS
WHEREAS, the engineering firm of WSB & Associates, Inc. has prepared plans and specifications for the
South St. Anthony Regional Storm Water Treatment System; and
WHEREAS, the City of St. Anthony has received grant financing for this project from the Mississippi
Watershed Management Organization; and
WHEREAS, this project will remove pollutants from storm water runoff and improve the quality of storm
water discharged though Minneapolis and into the Mississippi River.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony Village that:
1.) Such improvements are necessary, cost-effective, and feasible.
2.) Such plans and specifications are hereby approved.
3.) The consulting engineering firm shall prepare and cause to be inserted in the official paper and in
the Finance and Commerce, an advertisement for bids upon the making of such improvements
under such approved plans and specifications. The advertisement shall be published for two times,
shall specify the work to be done, shall state that bids will be opened on or about December 17,
2014, and bids will be considered by the City Council. Any bidder whose responsibility is
questioned during consideration of the bid will be given an opportunity to address the Council on
the issue of responsibility. No bids will be considered unless sealed and filed with the Clerk and
accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City of
St. Anthony Village for Five (5%) percent of the amount of such bid.
