CITY COUNCIL MEETING AGENDA

PR O C L A M A T I O N
WHEREAS, the Minnesota Crime Prevention Association, AAA of Minnesota and the St. Anthony
Village Police Department are sponsoring a statewide crime and drug prevention
program on August 4, 2015, called "Night to Unite"; and
WHEREAS, this is the “7th Annual Night to Unite” in Minnesota and it provides a unique
opportunity for St. Anthony Village to join forces with hundreds of other communities
across Minnesota in promoting cooperative, police-community crime and drug
prevention efforts; and
WHEREAS, City of St. Anthony Village plays a vital role in assisting the St. Anthony Village Police
Department through joint crime and drug prevention efforts in St. Anthony Village and
is supporting "Night to Unite 2015" locally; and
WHEREAS, it is essential that all citizens of St. Anthony Village be aware of the importance of
crime prevention programs and the impact of their participation can have on
reducing crime and drug abuse in the City of St. Anthony Village; and
WHEREAS, police and community together promote neighborhood safety, awareness and
cooperation, are important themes of the "Night to Unite" program.
NOW, THEREFORE, the St. Anthony Village City Council, do hereby call upon all citizens of
City of St. Anthony Village to join us in supporting the 7th Annual “Night to Unite” on August 4,
2015.
FURTHER, BE IT RESOLVED, the St. Anthony Village City Council, hereby proclaim Tuesday,
August 4, 2015, as "NIGHT TO UNITE" in the City of St. Anthony Village.

II. PROCLAMATIONS AND RECOGNITIONS. 30

A. Presentation of 2015 VillageFest by Julianne Hunter. 32

VillageFest Chair Julianne Hunter presented a schedule of events and stated VillageFest will 34
begin on Friday, July 31st, and end on Sunday, August 2nd. She stated the parade will be on 35
Friday followed by the street dance at the St. Anthony Shopping Center. She stated there will be 36
entertainment all day on Saturday ending with fireworks at Central Park. She stated the St. 37
Anthony Chamber of Commerce has decided not to do the golf tournament this year and instead 38
will be hosting a happy hour celebrating small businesses in St. Anthony and this event will be 39
held at the Village Pub on Friday before the parade. She stated the Kiwanis will be hosting a 40
lunch at the high school on Sunday beginning at 11:00 a.m. and they are looking for vendors for 41
the arts and craft show. She stated that further information regarding VillageFest can be found at 42
www.stanthonyvillagefest.com. She expressed thanks and appreciation for the generous 43
donations from many of the City’s businesses and thanked the major contributors including 44
Stinson Electric, Anona Gourmet, St. Anthony Mobil, and Fitness Crossroad. She also thanked 45
the Police and Fire Departments and the Public Works staff for all their help during VillageFest. 46

Mayor Faust expressed the City Council’s thanks and appreciation to Ms. Hunter and all the 48
volunteers for their work on VillageFest. 49

A. Resolution 15-044 a Resolution Denying a Variance from the Required Rear and Side 17
Yard Setbacks and Denying a Variance to Lot Coverage in Order to Construct a Pool and 18
Pool Decking at the Property Located at 2926 Armour Terrace. Bob Foster, Planning 19
Commissioner, presenting. 20

Planning Commissioner Foster stated the applicant has requested a variance from the required 22
impervious surface maximum of 35% lot coverage in order to construct a pool and pool deck and 23
expansion of the patio area. He stated the property is currently at 45% impervious surface 24
coverage and the applicant revised his plan to provide 50% impervious surface coverage, an 25
increase of 5%. He advised that the applicant has now submitted a plan that conforms to the 26
setbacks and impervious surface coverage and the Planning Commission has recommended that 27
the variance requests be denied. 28

Motion by Mayor Faust, seconded by Councilmember Brever, to adopt Resolution 15-044 a 30
Resolution Denying a Variance from the Required Rear and Side Yard Setbacks and Denying a 31
Variance to Lot Coverage in order to Construct a Pool and Pool Decking at the Property Located 32
at 2926 Armour Terrace. 33

B. Resolution 15-045 a Resolution Approving a Conditional Use Permit to Allow for an 36
Establishment Primarily for the Sale of Beverages for Consumption on the Premises 37
Located at 3701 Stinson Boulevard. Bob Foster, Planning Commissioner, presenting. 38

Planning Commissioner Foster stated this property is the former I-Hop and the site was issued a 40
CUP in 2010 to allow a restaurant within 250’ of a residential area. He stated the applicant 41
intends to use the existing building in a similar manner as the previous tenant but wants to 42
increase the intensity of use to include the sale and consumption of alcohol on the premises. He 43
reviewed the criteria for issuing a CUP and advised that the proposed use will not be detrimental 44
to the health, safety, and welfare of persons living or working in the vicinity and the proposed 45
use will provide a service or facility in the interest of public convenience. He stated that all of 46
the conditions in the previous CUP will remain in effect and the remodeling of the site shall 47
conform as closely as possible to The Village of St. Anthony design standards and PUD 48

documents. He advised that outdoor seating is not permitted under this CUP and if the applicant 1
desires to have outdoor seating they will have to come back to the City Council to request 2
outdoor seating. 3

045 a Resolution Approving a Conditional Use Permit (CUP) to Allow for an Establishment 6
Primarily for the Sale of Beverages for Consumption on the Premises Located at 3701 Stinson 7
Boulevard. 8

VI. GENERAL BUSINESS OF COUNCIL. 11

A. Resolution 15-046 a Resolution Approving the Joint Powers Agreement with Columbia 13
Heights for the Stinson Boulevard Project. Mark Casey, City Manager, presenting. 14

City Manager Casey presented a resolution approving the Joint Powers Agreement with the City 16
of Columbia Heights for the Stinson Boulevard road reconstruction project. He stated that both 17
City Councils are currently studying the feasibility of this project and the Joint Powers 18
Agreement outlines the roles, responsibilities, cost allocations, administration, construction, and 19
other work associated with the proposed project and Columbia Heights will pay St. Anthony 20
95% of the estimated costs after the official bid is awarded. He advised that the feasibility report 21
will come back to the City Council later this year. 22

046 a Resolution Approving the Joint Powers Agreement with the City of Columbia Heights for 25
the Stinson Boulevard Reconstruction. 26

B. Ordinance 2015-03 an Ordinance Amending Chapter 112.15 to allow 4 On-Sale Liquor 30
Licenses Within the City. Mark Casey, City Manager, presenting. (Final Reading and 31

City Manager Casey presented the Final Reading of the Ordinance amending the City Code to 34
allow four on-sale liquor licenses. He advised that since the time of the First Reading, the City 35
has received no calls or letters regarding the proposed Amendment. 36

Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Final Reading 38
and Adopt Ordinance 2015-03 an Ordinance Amending Chapter 112 to Change the Number of 39
On-Sale Liquor Licenses Allowed in the City. 40

C. Resolution 15-047 a Resolution Approving the On-Sale Liquor License for FSA, Inc., 43
Located at 3701 Stinson Boulevard. Mark Casey, City Manager, presenting. 44

City Manager Casey presented the Resolution to approve an on-sale liquor license for FSA, Inc., 46
located at 3701 Stinson Boulevard. He stated earlier this evening, the City Council approved a 47
Conditional Use Permit for this restaurant and adopted the Ordinance to change the number of 48

on-sale liquor licenses to four and this resolution is the final step in the process for issuing a 1
liquor license to the applicant. 2

15-047 a Resolution Approving On-Sale Liquor License for FSA, Inc., Located at 3701 Stinson 5
Boulevard. 6

D. Ordinance 2015-04 an Ordinance Amending Solar City Code. Mark Casey, City 10
Manager, presenting. (Final Reading and Adoption) 11

City Manager Casey presented the Final Reading of the Ordinance Amending the City’s Solar 13
Code and stated the proposed amendments reaffirmed and validated the City’s sustainability 14
goals and provide clarification on the definition of flush mounted systems, clarify and expand the 15
purpose of the Ordinance, allow solar panels in residential districts, require a Conditional Use 16
Permit for all commercial installations, require proof of structural integrity, allow freestanding 17
solar energy systems in rear yards of residential properties with applicable standards including 18
double side yard setbacks, add standards for light poles, and add design and performance 19
standards for solar energy systems. He advised that since the time of the First Reading, the City 20
has received no comments or calls regarding the proposed amendment. 21

Councilmember Jenson commended the Planning Commission and City staff for all their work 23
on this Ordinance. 24

Reading and Adopt Ordinance 2015-04 an Ordinance Amending Section 152.008 Definitions 27
and §152.187 Solar Energy Systems to Update Provisions Pertaining to Solar Energy Systems. 28

VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 32

City Manager Casey reported that the Fire Department recently conducted a haz mat training 34
exercise with North Suburban Haz Mat and the Civil 55th and this exercise provided an excellent 35
hands-on opportunity for the Fire Department and this training will be done on an annual basis. 36
He also reported on his attendance at the League of Minnesota Cities annual conference where 37
the City was recognized for its sustainable efforts and participation in the GreenStep program. 38
He stated the City will begin a pilot for Step 4 in the near future and further information 39
regarding the GreenStep program is available on the City’s website. 40

Councilmember Jenson reported on his attendance at the League of Minnesota Cities annual 42
conference in Duluth on June 24-26. 43
