ANTHONY HOUSING AND REDEVELOPMENT AUTHORITY MEETING 4 5 MAY 25, 2004 6 7 CALL TO ORDER. 8 Chair Hodson called the meeting to order at 7:59 p.m. 9 10 ROLL CALL. 11 Commissioners present: Chair Hodson; Commissioners Stille, Thuesen, and Faust. 12 Commissioners absent: Commissioner Horst. 13 Also present: Executive Director Michael Morrison. 14 15 16 1. APPROVAL OF MAY 25, 2004, H.R.A. AGENDA. 17 Motion by Commissioner Thuesen, seconded by Commissioner Stille, to approve the May 25, 18 2004, Housing and Redevelopment Authority Agenda as presented. 19 20 Motion carried unanimously. 21 22 11. CONSENT AGENDA. 23 Motion by Commissioner Stille, seconded by Commissioner Faust, to approve the Consent Morrison responded one of the contingencies of the conditional use permit was that the City 16 attorney, City engineer and staff approve the lighting and landscaping plans and they would be 47 sensitive to the remarks made at the last meeting. Claims. 27 28 Motion carried unanimously. 29 30 Ill. PUBLIC HEARINGS. 31 None. 32 33 IV. GENERAL POLICY BUSINESS OF THE H.R.A. 34 None. 35 36 V. STAFF REPORTS. 37 Executive Director Morrison reported a hearing date for the week of July 12, 2004, was set for 38 the Tires Plus lease condemnation. He indicated he would be attending the hearing with staff 39 attorneys from Dorsey and Whitney, adding it was hoped the other three properties would have 40 negotiated settlements. 41 42 VI. H.R.A. COMMISSIONER COMMENTS. 43 Commissioner Thuesen asked if the concerns discussed by residents at the May 11, 2004, 44 Council meeting regarding the new Tires Plus location were being addressed. Mr. Momson stated he agreed. Commissioner Faust suggested the timing as it related to the tax-exempt status of the property should be discussed and some leverage should be used to keep the process moving forward or the City should refocus on a different project. Mr. Morrison responded he agreed and asked for a motion from the HRA. Motion by Commissioner Faust, seconded by Commissioner Thuesen, to approve placement of said property back on the market if not closed by June 30, 2004. Discussion: Commissioner Stille stated the City could negotiate if LaNel wanted to retain control of the property. Mr. Momson responded LaNel could ask for a 30 -day extension and the City would then "have a hammer over them," noting the City did want to be accommodating if it knew something was going to happen. Commissioner Faust suggested the City could enter into a Purchase Agreement with earnest money, at which time there would be honest brokerage on both sides. VII. INFORMATION AND ANNOUNCEMENTS. None.
