PUBLIC FEARING. 5 6 7.1 John Lovelette, 320132 d Avenue NE Requests for Building a New Home: (a) Square 7 Footage Variance, (b) Lot Width Variance; (c) Floor Area Ratio Variance 8 9 Chair Stromgren opened the public hearing at 7:04 p.m. 10 11 Ms. Hall stated that John and Joan Lovelette are requesting three variances,which are required 12 for the construction of a new home located at 320132 d Avenue Northeast. She provided the 13 Commission with an overview of the variance requests stating that it is their plan to demolish an 14 80-year old home currently located on the property and build a new two-story, 2,783 square foot 15 home. She noted that the property measures 50 x 175 stating that the variances necessary to 16 complete the home include a square footage variance because the property's lot size is under the 17 minimum lot size of 9000 square feet, at 8,750 square feet. She stated that the petitioner is 18 requesting a 250 square foot variance for this requirement. She stated that the minimum lot 19 width is 75-feet noting that the property lot width is 50-feet, which would require a 25-foot 20 variance. She stated that the third variance is for floor area ratio noting that the floor area maximum is 30 percent of the lot. She explained that the proposed home would exceed the floor area ratio requirement by 99 square feet and reviewed with the Commission. She stated that the 23 variance to meet the City's floor area ratio requirement would be in the amount of 99 square feet: 24 She noted that there is a discrepancy in the square footage from the Building Official figures and 25 the plan stating that the basement level and garage square footages are excluded from the FAR 26 calculation. She stated that the petitioners are not in agreement with the City's calculations and 27 references the attached application for Commission review. 28 29 Mr. Lovelette reviewed the elevations and access points to the property with the Commission. 30 He noted that the approach to the drive comes off 32nd Avenue Northeast into the garage area. 31 He reviewed the setbacks noting a 5-foot setback to the right of the house and 10-foot setback to 32 the left. He reviewed the rear area of the lot and deck noting that the deck would not have a 33 railing system as it is less than two feet off the grade line. He reviewed the drainage flow with 34 the Commission. 35 36 Chair Stromgren stated that based on the preliminary review the application does not meet the 37 pervious requirements and asked Mr. Lovelette to review the layout of the structure. Mr. 38 Lovelette provided the Commission with a brief overview of the floor plans of the proposed 39 structure. 40 41 Chair Stromgren asked Mr. Lovelette to review the front and south elevations. Mr. Lovelette 42 provided the Commission with an overview noting that the front elevation shows a hip roof on home. He reviewed the construction materials that would be use for the front porch stating that 44 the siding colors would be a bit different from the standard grays or tans. He stated that they are 45 still in the process of deciding on the colors. He stated that the shingles would be architecturally Planning Commission Meeting Minutes May 18, 2004 Page 3 1 designed and reviewed the rear elevation noting that it too would show a hip roof with a small 2 gable off the sunroom. 3 4 A resident asked for further clarification of the floor area ratio variance and percentage 5 calculations. Ms. Hall explained that it would be based on the actual lot size and reviewed the 6 calculations with the Commission. Chair Stromgren further clarified that the variance request is 7 to allow the adjustments to meet the FAR ratio requirements. 8 9 Russ Anderson, neighbor, asked for further clarification of the drainage flows. He expressed 10 concerns and asked where they plan to drain the water from the back area of the property. Mr. 11 Lovelette stated that the surveyor did note on the plan that his lot seems to be the catch all area 12 for all of the drainage water that comes from the home to the north as well as to the east. He 13 explained that it is his intention not to build the lot up further to where it would cause any effect 14 to other neighbors. He reviewed the current and proposed elevation and water drainage flows 15 with Mr. Anderson. He noted that ponding does occur from time to time in the back portion of 16 the property because the lot is lower than the surrounding lots. He stated that even with the 17 proposed changes his lot would still be lower than the surrounding lots and would not impact or 18 change the current drainage flow in the back. Mr. Anderson agreed that it would probably not 19. cause any long-term harm from the drainage or water collection adding that he has no issue with 20 the proposed home, he just wants to be sure that the drainage would be addressed. Leif Thorson, 3215 32nd, referenced the 30%requirement and asked, if the lot would have been 23 75 square feet, would the home have met the requirement. Chair Stromgren confirmed that it 24 would and reviewed with the Commission. Commissioner Jenson noted that the exact figure 25 comes out to 31.1% over stating that this would be a 1.1% variance request. 26 27 Mr. Thorson clarified that they are building a single-family home. He stated that he supports the 28 petitioner's request noting that many of the smaller homes in the area are being sold and replaced 29 with newer, larger homes. He agreed that, for the most part, it does improve the values of the 30 homes in the area adding that his biggest fear is people purchasing the smaller homes and making 31 additions to them. He stated that the addition tends to be more of a detriment as it usually does 32 not fit with the style of the current structure. 33 34 Chair Stromgren clarified with Mr. Lovelette that he and his family would occupy the residence. 35 Mr. Lovelette confirmed that the home is intended for their residence. 36 37 Chair Stromgren closed the Public Hearing at 7:21 p.m. 38 39 Chair Stromgren stated that they are considering a very small percentage and reviewed the lot 40 and structure size with the Commission. He stated that what is being proposed is not excessive 41 considering what is typical of the current market. He stated that he is impressed the garage size 42 is kept down, when it could be larger given the garage sizes these days. Planning Commission Meeting Minutes May 18, 2004 Page 4 1 Vice Chair Hanson agreed stating that he is impressed with the proposed home. He stated that it 2 fits well with lot and that it would be an enhancement to the neighborhood. He stated that he has 3 no problem with the variance requests. 4 5 Commissioner Tillman agreed stating that the house does fit very well with neighborhood. She 6 stated that they did a good job in designing the home and fitting it to the lot. 7 8 Chair Stromgren noted that the minimum floor area requirement,per current City Code, is a 9 1000-square feet for a home. He stated that the current structure is less than half that 10 requirement noting that any improvement to the structure or lot would have triggered a variance 11 request. 12 13 Motion by Commissioner Tillman, seconded by Vice Chair Hanson, to recommend granting a 14 variance for the lot size and existing house as it is below current standards. The circumstance 15 has not been created by the owner and the variance would not alter the locality. Economic 16 considerations are not a basis. 17 18 Motion carried unanimously 19 20 Motion by Chair Stromgren, seconded by Commissioner Tillman, to recommend approval for the minimum lot width variance to 8,750 square feet from the required 9,000 based that this condition predates the owner, the size creates a hardship for the property today, and the property 23 could not be put to reasonable use without the variance. 24 25 Motion carried unanimously 26 27 Motion by Chair Stromgren, seconded by Commissioner Tillman, to recommend approval of the 28 floor area ratio variance for a maximum 2%ratio allowed based on hardship caused due to the 29 width of the lot, which is the deciding factor for the variance ratio. The parcel predates the 30 zoning code. 31 32 Motion carried unanimously. 33 34 Chair Stromgren stated that City Council would consider this request at their May 25, 2004 35 Regular meeting. He suggested that the Mr. Lovelette be present to answer any questions the 36 Council might have. 37 38 VIII. CONCEPT REVIEW 39 40 8.1 Silver Lake Village, LLC, Silver Lane to the north; Silver Lake Road to the east; Soo 41 Line Railroad Right-of-WE to the south; and Stinson Boulevard to the west; Concept 42 Review/Final Review for Housing Portion. ,+4 Perry Thorvig, 3112 Townview, City Planning Consultant for Silver Lake Village provided the 45 Commission with an overview of his role in the project noting that the PUD for the concept plan Planning Commission Meeting Minutes May 18, 2004 Page 5 1 for the project and the final plan for commercial was approved last year. He stated that the 2 building for the commercial area has begun and reviewed with the Commission. He stated that 3 the purpose of the presentation this evening is to bring the Commission up to date on the 4 residential portion of the project. He explained that the residential portion of the project is a two 5 part project shared by Dominium and Pratt Ordway. He reviewed the respective developments 6 with the Commission stating that it is Dominium's hope to get their request onto the June 15th 7 agenda for Commission review and go to Council for approval at the June 22, 2004 City Council 8 meeting. He explained that they have a closing deadline with Pratt Ordway for the end of June. 9 10 Mr. Thorvig reviewed the location of the development with the Commission noting that 11 Dominium is just north of the Soo Line railroad tracks and west of the proposed Walmart store. 12 He stated that the building location and lot coverage remains the same noting that the density has 13 increased from 220 units to 260 units. He reviewed the changes with the Commission noting that 14 the units would be a mixture of affordable units, senior housing and general public. He noted 15 that the senior units would be located at the west end of the building and reviewed with the 16 Commission. He stated that the parking spaces are project to be 415 total spaces noting that the 17 zoning code would require 520 spaces and reviewed with the Commission. 18 19 Mike Moorhouse, Dominium and Gary Vogel, BVK presented. Mr. Moorhouse stated that the 20 project has grown in the number of total unit noting that after a preliminary market study showing a high demand for senior housing they decided to change from an all rental focus and reviewed with the Commission. He explained that some of the units were made a bit smaller, 23 which allowed them to add more units. He stated that this was done to address the senior mix. 24 He stated that affordability units would be based on qualifications for the units and reviewed the 25 process with the Commission. 26 27 Gary Vogel BVK,provided the Commission with a brief overview of the proposal. He reviewed 28 the proposed site plan noting the separation between the commercial and residential areas. He 29 noted the main entrance road off 39th and reviewed the connection at 38th Street. He referenced 30 the access points to each residential area and reviewed with Commission. He stated that 31 conceptually the site plan is very similar to what was'originally provided for the Planning 32 Commission review. He referenced the angular areas of the site noting that conceptually it has 33 remained basically the same. He explained that the idea of the layout is to generate the 34 plaza/courtyard area, which is the focal point of the project. He stated that the common area 35 would include a fitness center,party rooms and leasing offices. He stated that it would also 36 include a swimming pool, spa, and fire pit noting that the amenities would tie in the entire area 37 and both developments. He reviewed the drive through, which is currently Apache Lane stating 38 that it leads into the.surface parking lot at the south side of the building. He stated that they.have 39 approximately 415 total parking spaces on the site and indicated that 230 of the spaces would be 40 in the underground parking area. He stated that the entire building footprint has one level of 41 underground parking and reviewed the parking requirements and needs with the Commission. 42 Commissioner Jenson asked for further clarification of the separation between the senior areas 44 and the general public. Mr. Vogel provided an overview of the separation areas to the 45 Commission. Planning Commission Meeting Minutes May 18, 2004 Page 6 1 2 Commissioner Jenson noted that in most senior developments the units are separate whereas here 3 they are adjoined. He asked how the senior area of the structure would be isolated from the 4 noise. Mr. Vogel explained that at the separation there would a set of security doors that only the 5 seniors would have access to. He stated that the general occupancy would not be able to get 6 through those doors. He stated that it would help to limit the traffic flow in that area of building. 7 8 Commissioner Jenson asked Mr. Vogel to review the access points to the senior section of the 9 building. Mr. Vogel referenced the site plan layout and reviewed the access points for both the 10 building and garage with the Commission. 11 12 Commissioner Jenson asked if the underground parking for seniors is also separated or blended 13 with the general populace. Mr. Vogel clarified that there is no physical separation between the 14 seniors and the general populace parking. He stated that all underground parking spaces would 15 be assigned and reviewed with the Commission. 16 17 Commissioner Jenson clarified that there are only two access points to the underground parking 18 area. Mr. Vogel confirmed stating that one is located at the southwest corner and the other is 19 located in the middle of the building. He stated that there is also pedestrian access at the 20 southeast comer entrance to the garage. He reviewed the tenant access points with the Commission including all handicap entrances. 23 Commissioner Jenson asked Mr. Vogel how many buildings of this size has his company has 24 built that has less parking. He asked if any of the other developments have had parking issues. 25 Mr. Vogel explained that his company has done several similar projects,with less parking ratio 26 than this development and have had no parking issues. Mr. Moorhouse confirmed and reviewed 27 the various developments with the Commission. 28 29 Commissioner Jenson noted that most if not all of the senior residents would probably want 30 underground parking and asked if this would be an issue. Mr. Moorhouse reviewed the shared 31 parking structure process with Commission. 32 33 Commissioner Jenson clarified the total number of reserved units for the senior portion totals 79 34 and asked if others qualified for the affordable units would this also be made available to seniors. 35 Mr. Moorhouse confirmed stating that the remainder of the units would not be age restricted. He 36 provided the Commission with an overview of the affordability unit ratio stating that it was 37 expressed that affordability units should be made available throughout the building. 38 39 Commissioner Tillman asked for further clarification of the qualification process. Mr. 40 Moorhouse stated that they are currently working with the City on bonding. He explained that 41 the process limits the amount of rent charged based on median income. He reviewed the 42 calculations with the Commission stating that in order to afford living in this development they would have to have a base income of at least $27,000 to afford one of the units. Commissioner 44 Tillman clarified her understanding that in exchange for the bonds, to help with the financing, Planning Commission Meeting Minutes May 18, 2004 Page 7 1 they in turn work with the City on the affordable program and rent reduction process. Mr. 2 Moorhouse confirmed and further clarified. 3 4 Commissioner Tillman asked what cost would be for the most expensive unit. Mr. Moorhouse 5 stated that the 3-bedroom apartment flat or loft unit would be approximately$2000.00 a month. 6 7 Commissioner Jenson noted that the square footage for all of the one bedroom units are about the 8 same. Mr. Moorhouse acknowledged that the senior units are a bit smaller than the other units. 9 He reviewed the changes with the Commission stating that the floor plan sizes are mixed 10 throughout the building. He offered to provide the Commission with a tour of one their current 11 buildings/projects. Commissioner Jenson asked him to provide the Commission with addresses. 12 He stated that he would prefer to drive through the area on his own first and then contact for a 13 tour. Mr. Moorhouse agreed stating that driving past the projects would give them a good feel 14 for the building styles and material quality. 15 16 Commissioner Tillman asked if the urban townhomes and flats would have indoor parking 17 facilities. Mr. Vogel confirmed that indoor parking would be available. 18 19 Chair Stromgren asked for an overview of the main building entrance locations. Mr. Vogel 20 reviewed the building access points with the Commission. Mr. Moorhouse also noted that the new buildings would also utilize and FOB security access system that would control access to certain parts of the building and reviewed with the Commission. 23 24 Commissioner Jenson asked for an approximate square footage of the studio units. Mr. 25 Moorhouse stated that the average studio unit would be between 700 square feet, the one- 26 bedroom units would be between 800 to 1000 square feet; the two bedroom units would be 1050 27 to 1150 square feet; the townhomes would be 1500 square feet; the three bedroom flats, 1500 28 square feet; and the four loft units would be approximately 1300 square feet. He indicated that 29 there are approximately 25 different floor plans. 30 31 Ms. Hall asked Mr. Moorhouse to review their construction schedule. Mr. Moorhouse stated that 32 it is their hope to begin construction in mid-September/early-October and would last 33 approximately 14-16 months. He stated that the development project would be done in phases 34 and reviewed with the Commission. He stated that the first phase would be the common areas 35 and leasing office; the second phase would be the general populace down to the senior area; third 36 phase would be the senior area. 37 38 Mr. Vogel provided the Commission with an overview of the exterior design. He discussed the 39 construction materials noting that the first feature that would be seen would be the drive under 40 component. He reviewed the brick elements stating that all units would have a deck or patio 41 area. He reviewed the clubhouse location noting the view would overlook Central Park area. He 42 indicated that the break and exterior treatment would be slightly different stating that they plan to use a different type of siding for each grouping (senior and general occupancy) and reviewed 44 with the Commission. 45 Planning Commission Meeting Minutes May 18, 2004 Page 8 t Vice Chair Hanson asked how large the staff would be that would manage the property. Mr. 2 Moorhouse stated that staff would include a manager, an assistant manager, a maintenance 3 supervisor, maintenance technician, one/two caretakers and one/two part-time leasing agents. He 4 stated that they plan to staff the building seven days a week noting that typically one to two of the 5 employees tend to choose to live onsite. He provided the Commission with a brief history of the 6 company noting that they have 140 different apartment locations throughout the Midwest. He 7 stated that their management group consists of approximately 70 people who are based in the 8 Twin Cities area. 9 10 Chair Stromgren asked what they plan to do for a visual buffer for the northeast units facing 11 Walmart. Mr. Vogel stated that they are currently working with Walmart regarding the 12 landscaping and screening requirements and reviewed with the Commission. 13 14 Mr. Thorvig stated that Mr. Dan Hunt, President of Hunt Associates, is present to provide an 15 overview of the Pratt/Ordway condo portion of the project. 16 17 Dan Hunt, President of Hunt Associates, stated that his group is currently working with Pratt 18 Ordway on the condominium development. He indicated that the plans have undergone some 19 minor changes over the last week and reviewed the changes and locations of the buildings with 20 the Commission. He stated that the buildings are all very similar in appearance and layout except for the clubroom change on the first building. He reviewed the garage layout and access with the Commission. He indicated that all units would have one parking stall and that they could 23 purchase additional garage space at their discretion. 24 25 Mr. Hunt referenced the detailed site plan for the first building noting that the first and second 26 floor would be the clubroom. He reviewed the elevator locations with the Commission noting 27 that all units are flats, one, two or two plus den, from 830 square feet to 1700 square feet. He 28 provided the Commission with an overview of the various floor plans for the units and indicated 29 that some of the units would have sunrooms, an open patio or a screened porch. He stated that 30 they are trying to achieve a more stately appearance to the front of the building as it is next to a 31 retail development off the main street. He stated that they are experimenting with the lighting 32 concepts for the building noting that it is their plan to carry some of the lighting from the retail 33 into and throughout the area. He stated that the exterior would be a mixture of brick and stucco 34 and reviewed with the Commission. 35 36 Commissioner Tillman asked how they determined the base costs for the units. Mr. Hunt 37 reviewed the calculation process with the Commission noting that the numbers are based on 38 $200.00 per square foot with the minimum price of a unit starting at approximately$160,000 to 39 $400,000. 40 41 8.2. City of St. Anthony, Electronic Monument Sign - Review Concept Plan 42 Susan Hall stated that the topic of a city electronic reader board goes back a few years noting that �t4 the City Council has now identified this issue as a City goal for 2004. She stated that Council 45 would like to see a sign installed this summer. She provided the Commission with a brief history Planning Commission Meeting Minutes May 18, 2004 Page 9 1 noting that in late 2000 a subcommittee was formed and provided recommendations for location 2 and second the city would need to amend the ordinance to allow the sign noting that the steps 3 were made. She reviewed the locations considered noting that the preferred location 4 recommended by the subcommittee was the area in front of the tennis courts near the intersection 5 of 33`d Avenue and Silver Lake Road. 6 7 Ms. Hall stated that on June 19, 2001, the Planning Commission held a public hearing to amend 8 the City ordinance to allow for electronic signs, as a conditional use, in areas zoned recreational 9 open space on city and/or school owned property, for public information purposes only. She 10 stated that Council did eventually adopt this with conditions and considerations to be given to 11 safety and aesthetics noting that the public hearing brought a lot of discussion about what the 12 sign would look like. She reviewed the recommendation and conditions the Planning 13 Commission made to the City Council noting that it included flashing and animation is 14 prohibited; hours of operation; message changeability; sign aesthetics that include color, size of 15 the reader board and sign, construction materials and landscaping; safety issues;purpose of the 16 sign should be for public services only. She stated that given today's circumstances that include 17 the addition of the Fire Station to Silver Lake Road, Staff recommends that the sign be placed in 18 the island area between the City Hall/Community Center front parking lot and the Central Park 19 parking lot. She stated that Staff believes this is the best location as it provides adequate space 20 and offers the best site lines.. She stated that a Concept Site Plan has been provided for their review. i 23 She reviewed the dimensions of sign noting that it would be necessary for the City to request a 24 variance of 30 square feet. She indicated that this is the minimum size for the sign in order to be 25 readable from a distance. She stated that staff would work to outline the criteria and use for the 26 sign for Commission review. 27 28 Commissioner Jenson stated that the recommended location is probably the best they could find. 29 He stated that it is an excellent spot as it is not too close to the intersection and is still within the 30 City campus. Ms. Hall agreed noting that the trees would have also affected visibility along 31 Silver Lake Road. 32 33 Commissioner Tillman stated that it was the original task force that recommended the first site 34 location. She expressed concerns about the proposed location stating that the original location, 35 by the tennis courts,would be much easier and safer to see. 36 37 Chair Stromgren asked if Public Works could place posts to indicate the proposed location. He 38 stated that this would help the Commission visualize the sign at this location. He suggested 39 doing this at both locations to offer comparison. 40 41 Ms. Hall asked if the original task force had recommended the two-sided sign. Commissioner 42 Tillman confirmed that it was a"V" shaped two-sided sign and explained that the recommended location would have been just to the center of the tennis courts. ,t4 Planning Commission Meeting Minutes May 18, 2004 Page 10 Chair Stromgren asked if the size of the sign is based on the recommendations received from the 2 sign company. Ms. Hall clarified that the size of the sign is currently being discussed at the Staff 3 level noting that nothing has been decided. Chair Stromgren suggested working with the sign 4 company as there are federal guidelines that would have to be followed. He suggested asking the 5 sign company to provide the MnDOT standards for text type and size. Commissioner.Jenson 6 clarified that the letters would be approximately 9-inches high. 7 8 Chair Stromgren asked for more information on the materials from the sign company and to also 9 include their,landscaping proposal for Commission review. 10 11 Commissioner Jenson asked if they plan to match the colors with the bricking. Ms. Hall stated 12 that she thought they would adding that they would get more information on the materials for the 13 Commission to review. She reviewed the design of the sign with the Commission. 14 15 Ms. Hall suggested that the Commission review the information and site location this next month 16 and consider scheduling a hearing for their July meeting. 17 18 IX. PUBLIC INPUT. 19 20 Patricia Grimes, 3201 Townview, St. Anthony Housing Group stated that they have been 1' working with the Dominium group and the City, trying to encourage workforce housing as a part of the Silver Lake development. She stated that they are very disappointed that all of the 23 affordable units are going to be dedicated only to seniors. She stated that she has had several 24 discussions with the Planning Commission and City Council noting that there is a huge need to 25 provide housing for the labor force in St. Anthony. She stated that it was their hope that the 26 affordable units would be made available not only to the seniors but the labor force as well. She 27 asked the City to consider requesting that the Developers try to address this concern as it is very 28 important for workers who do not make a lot of money but provide services to the City. She 29 noted that this project would receive Federal, County and TIF funding, which are all consider to 30 be taxpayer subsidies. She stated that because of this there should be more affordable housing 31 available for the labor force,not just seniors. She suggested including some of the `For Sale' 32 units as a part of the affordable housing process and reviewed with the Commission. She stated 33 that Mr. Moorhouse builds beautiful development projects like Emerald Gardens adding that it is 34 too bad that units are not available to for the workforce housing. 35 36 Commissioner Jenson clarified that the affordable housing units would be a mix of both senior 37 and general occupancy and reviewed with the Commission. Ms. Grimes asked for more detailed 38 information on the affordable housing and the numbers available. 39 40 Commissioner Tillman noted that the comments in the meeting packet contradict what was 41 discussed this evening. Commissioner Gray agreed and clarified that the changes were made 42 after the packet had been forwarded for their review. ,H Brian Thuesen, City Council Member, clarified that the proposal came before the Council noting 45 that affordable housing would be only for seniors. The golden brown logo accent pieces are not illuminated. Currently, deep plum and golden brown are not acceptable colors for the St. Anthony Shopping Center's Comprehensive Sign Plan. The petitioner states that the letter returns will be natural aluminum in color. Per the Comprehensive Sign Plan, "All letter returns shall be formed from aluminum in minimum thickness of .040 inches. Depth of channels shall be 6 inches. All interior surfaces must have a splash coat of white for reflective purposes. Outside color will be Dupont 4296d7 99 Cream." The addition we are proposing would put our structure within 33 feet of 32nd Avenue. CURRENTLY: The structure we currently live in was built in 1961, and has been carefully maintained and updated for over 40 years. It is difficult to argue that the property cannot be put to "reasonable use"without an addition when it has been so efficiently utilized in the past. Yet, we are finding the house lacking in many important respects. First, there is a need for a larger, more useful, and efficient living space on our main floor. Second, we need more storage space. Our closets are small, the basement is small and crowded, and the attic is unusable for storage. Third, we need a room that would function as a home office space. As a math teacher, I have a need for additional space at home for my library, files, and desktop computer. PROPOSED: The proposed 15x25 foot addition would include a main floor family room, a basement office, and a basement bedroom. Modifications in main floor layout would allow for more efficient use of our dining room and kitchen. Additional storage would be accomplished through built-in cabinets and shelves in the new family room and modifying the basement layout. We believe this addition would not alter the essential character of the locality, noting that neighboring properties along 32nd Avenue are set back similar distances from the curb and that potentially problematic sight lines from the streets to the addition are blocked by a large pine tree. HARDSHIP: It is our belief that the side yard is the only viable option for the proposed addition. Visually, the side yard along the street seems to be large enough for the addition. If this side yard were adjacent to another property, we would not need a variance. However, city code indicates that for comer lots, a distance of 45 feet from the street be maintained. Could the addition be put in rear yard, where no variance would be needed? We believe a rear addition would: 1) likely result in the loss of a mature shade tree (40 year old basswood); 2) ruin the character and functionality of our landscaped rear yard; 3) reverse recently corrected watershed problems due to the slope toward the house; 4) exacerbate water runoff problems for our north neighbor at 3204 Skycroft Drive. LeRoy Sign Company has set up mock signs/banners at the two potential locations for the Planning Commission to study a few days prior to the June 15 meeting. For the tennis court location, the banner size is 8' h X 12' w. Please drive by and take a look. This should aid in the determination of site selection. As far as justification for the variances, the biggest reason the signs got larger was because it had to incorporate the city logo. The city logo is dimensionally difficult to reduce to make the sign copy surface area smaller. The city logo cannot be sized any smaller than shown on the drawings to work. While the city logo takes up half the space on the sign, it is necessary, per City Council goals and objectives for uniform communications. Landscaping was inadvertently omitted on the sign drawings. It will be included on the final sign plan for the public hearing in July. As you may recall, it was discussed that the tennis court sign could be elaborately landscaped onto the side of the hill. On July 20, there will be a public hearing for the conditional use permit. Conditions should be set to cover at least the following: (1) flashing and animation prohibited; (2) hours of operation are limited and shall be between the hours of 6 a.m. and 10 p.m.; (3) message changeability should be minimum required to accomplish the purpose of the sign; and (4) sign aesthetics such as color, size of reader board and sign, construction materials, and landscaping; (5) consideration should be given to safety issues; and (6) purpose of sign should be for public services only. Also on July 20, there will be a public hearing related to the variance(s) noted above, given the selected location/sign. As far as content, staff has drafted the attached sign policy. The City Council will be approving the policy to go with sign implementation. It is attached for informational purposes for the Planning Commission. Dr. Sheldon Weschler, of the School of Optometry at the University of Houston has studied the subject of visual acuity in reference to signs. He has been interested in establishing optimum standards for sign Size and sign visibility. Sign visibility is directly related to visual acuity and other principles of vision and suggests that minimal sign standards could be applied to signs, especially those intended to be read by the motoring public. Signs, after all, must be readlble by the largest number of viewers possible in order to be effective advertising. Table 8 presents ilie minimum size at which letters can be read at varying distances and by people with different measures of visual acuity- Weschler qualifies the numbers listed in this table in the following statements: "Snellen letters are most often used as the pat- terns for visual acuity measurement. The record- ing method is written as if the measure of visual acuity is a fraction (e.g., 20/20), although that is not the actual case. The upper figure is merely a notation of zhe distance from the _eye to the visual task (the letter). The lower figure repre- sents the size of the visual task. This minor point becomes important in understanding, for in- stance, that 20/40 visual acuity is not SO°io vision but merely a shorthand notation relating to the distance at which a measurement is made (20 feet) and the size of Snellen letter (.35 inches) that is just recognizable at that distance . . The standard visual acuity for a `normal' eye is considered to be 20/20. The standard frequently used as vision requirement for driVers is 20/40. But the 20/40 standard is a visual acuity level to be attained at the time of licensure, During the four-year period between. drivers license Visual acuity measurements the visual acuity of drivers frequently drops to lower levels. Two important influences, the fac, of motion arld the influ- once of color, are not taken into account in tables of normal visual acuity. 3'his implies that letter sizes suggested by the statistics on visual acuity may not be adequate for a sign in the environment. One other factor needs to be considered: letters on a sign form words and words are more immediately recognizable than separate, unrelated letters. Words are easier for the brain the process than letters because they are meaningful chunks of information. Even if we assume normal visual acuity to. be a constant factor, we still must make adjustment for changes in the sign and the angle of the sign in relation to traffic. Roughly speaking, one inch of letter size to twenty-fiVe feet of viewing distance has been considered about average. No one would argue that the ratios,given in. Table 8, which describe viewing requirements in a doctor's ofice, can be directly applied to the motorist attending to the driving task and extracting visual information from a diverse visual environment. Highway signs have two distinct advantages which on-premise business signs do not have. They are usually either directly facing traffic or immediately adjacent to the freeway. In addition, they are almost always easy-to-read white lettering on a green or blue background, Motorists, familiar with the standardized style of lettering and the colors, immediately recognize that they are receiving directional information, For the on-premise business sign the situation is usually quite different. Business signs are .communicating information which the motorist may not be specifically looking for, In addition, unless the business is part of a national chain, backed up by extensive advertising in other forms of media, the sign itself is not standardized and therefore not immediately recognizable as offering a certain type of information. When calculating the size of letters necessary for an on-premise sign, therefore, it would be wise to use lower measures of visual acuity. Reaction Distance Reaction distance is always a complex subject and becomes even more difficult when applied to commercial signage. Briefly, reaction distance is a measure of the pr710Unr of rilne it takes a Neswer to React ra 0 SiPION0 17. For some sign users, taking reaction time into consideration is of utmost importance, If a substantial number of people who view the sign are new to a trade area, either as vacationers or business travelers, the amount of time needed to I'eact will probably be greater than that of people familiar with the area, Their reaction distance cannot realistically be compared to the time needed by a local resident who is on the street, say, thirty times a month and who knows the business establishments. The local resident may read only the changeable part or display section of the sign because the other sections are familiar and have been read many times before. Any system of measurement has to allow for these differences. It follows that estimates of the necessary or adequate sizes of signs should also include these considerations. The local resident may use the on- premise sign only incidentally and may actually react to a landmark or a configuration of streets in terms of direction. The first lists simple reaction distance and usually includes the time needed for seeing, braking, and stopping. The second allows for anticipatory reaction distance. When anticipatory time is added (the time it takes for a person to prepare to stop), more time and distance are needed to react. Tables 9 and 10 illustrate the two types of traffic engineering tables (Miller, '1977). Designers of highway directional signs know .how To use this type of information. A standard procedure is to make the keyword larger. Commercial sign designers, on the other hand, have not always understood these requirements. The minimum and desirable minimum stopping distances are shown as they relate to the normal range of distances required for driving control. The driver recognizes elements in the visual field which serve as primary cues for the fine control task of his vehicle. Also to be considered is the "focusing distance," the point ahead upon which the driver gener- ally focuses his sight at various speeds. The driver constantly looks beyond the limits of the visual field used for fine control, concentrating toward or beyond his ability to focus. He does so to receive guidance and/or navigational information. Research and physiological studies indicate that this could be on the order of several thousand feet or even more and bears some relationship to anticipatory sight distance. As yet, anticipazory sight distance is not officially a part of the American Association of State Highway and Transportation Officials (AASHTO) design criteria, although the concept of longer sight distances under such circumstances is implied, and is being included in new criteria under preparation. Judgment based on preliminary investigations indi- cates distances on the order of three to four times the minimum stopping sight distances, and normally greater than intersection sight distances pre- vic)usly discussed, For the higher design speed highways these are in the range of 1500 to 2500 fleet. Table 10 gives anticipatory sight distances for different speeds of traffic. The following guidelines will be used in placing messages on the Bulletin Board: 1. Scope: a. The Community Billboard is an electronic marquee located at 3301 Silver Lake Road. 2. Purpose: a. The Planning Commission will be briefed on an amendment to the Silver Lake Village PUD to include the Taco Bell parcel as part of the PUD. Background Representatives of the developer and Wendy's will be at the meeting to present the concept and answer Planning Commissioner's questions. A PUD amendment request will be presented to the Planning Commission in July for consideration. The Robert Muir Company, developer of the Silver Lake Village, owns the Taco Bell site. Taco Bell is on a month to month lease. The.developer has been negotiating with Wendy's to build a new restaurant on the Taco Bell site. The Taco Bell parcel is not part of the PUD. The parcel needs to be included as part of the PUD in order to allow the Wendy's to be built. Without PUD designation, a Wendy's could not meet the on-site parking requirements in the St. Anthony zoning code. The proposed store is similar to other Wendy's outlets in the Twin Cities area. However, its reddish brick veneer will be similar in color to the Wal-Mart fagade. The store will be somewhat larger than the existing Taco Bell. The inclusion of the site in the PUD will present a tremendous opportunity to update a primary property along Silver Lake Road. Dominium needs to have City Council approval by the end of June to meet a closing deadline with Pratt Ordway Properties, the master developer. Background The Dominium project has been part of the overall Apache Plaza redevelopment plan since last summer when the concept for the Silver Lake Village (then the Village at St. Anthony) planned unit development was submitted to the Planning Commission and City Council for approval. (Planned unit developments require a change to PUD zoning in a two step process —Preliminary Development Plan and Final Development Plan.) On September 23, 2003, the City Council approved the concept plan for the entire Silver Lake Village and rezoned it to PUD. They also approved the Final Plat for the Dominium property. Therefore, the only action that needs to be taken on the Dominium project is approval of the Final Development Plan. No public hearing is required. It is required that the Planning Commission review the final plans and make a recommendation to the City Council to approve, approve with suggested modifications, or reject the plans. The criterion that the Planning Commission should use to make the recommendation is the consistency of the final plans with the concept that was approved last September. The concept (Preliminary Development Plan) that was approved last year is reflected in the Design Framework Manual dated August 19, 2003 and the Preliminary Site Plan dated 8/8/03. It shows the serpentine Dominium building located on the southwest portion of the site. The diagram shows the building as "Market Rate Rental Units." There were 220 units that were proposed last summer. If approved, the developer expects to begin construction in the fall and be ready for first occupancy in the summer of 2005. Findings of Consistency of Current Proposal with Preliminary Development Plan Building Location and Lot Coverage—The building is an S-shaped building with and east-west orientation. The building has only moved a few feet to the west of the location shown in the approved preliminary plan. Its lot coverage is very close to that shown in the preliminary plan. Building Appearance—The height of the building (52 feet—four stories) has remained the same. It's exterior appearance is also basically the same. The design details now include brick and cement board and dryvit (stucco like) surface panels. The designers are trying to simulate a row-house look rather than a traditional apartment building. The exterior materials are intended to be complimentary to the commercial developments in the PUD. The roof will be a sloping, peaked type roof. It will be clad with fiberglass/asphalt shingles. Architectural metals will be used as roof accents. Building Density—The number of apartment units has increased from 220 to 261 (18%). Types of Units—Seventy-nine units will be reserved for senior citizens. The senior citizen units will be located together in the west wing of the building. The first floor will have a few entries to two story units. The fourth floor will have loft style units. Affordability—Twenty percent of the units in the building (52 units) will be affordable to individuals or households that have incomes below 50% of the Area Median Income (AM]). The affordable units will be distributed throughout the building. Parking Spaces—The number of parking spaces is projected to be 444. The zoning ordinance would normally require 520 spaces. The number of underground spaces is 210—240 would normally be required underground. There are seven handicapped accessible spaces outside and six similar spaces in the underground garage. Site Plan and Landscaping—The site plan shows the location of buildings, setbacks, landscaping, driveways, and parking locations. Driveway aisles, parking stalls, and setbacks meet zoning code standards. However, the driveway and parking area along the west side of the development is only 2.5 feet away from the west property line. Planner's Analysis and Comments A PUD allows flexibility because of the large nature of the use. Some flexibility from normal city requirements is needed in order to approve this development. Parking -The number of parking stalls appears to be the biggest issue. The developer proposes 444 spaces. Normally, 520 spaces would be required. Seventy nine units will be reserved for seniors. Many other units in the building will also be occupied by seniors, but no exact determination can be made because there are no additional limits beyond the 79 units. Normal usage would suggest that seniors will not have more than one car. Therefore, a case can be made for a departure from the typical parking requirement of two spaces per unit. The building allows for two spaces for all the units other than the senior units. One space is provided for each senior unit. This appears to meet the intent of the zoning ordinance and should be approved. Appearance—The drawings provided by the developer are unclear as to how much of the facades will be brick and how much dryvit. This needs to be clarified before the City Council approves the plans. Likewise, the colors have not been defined yet. The developers only state that the buildings colors are intended to be compatible with the commercial developments. This should be clarified by the time the Council approves the plan or delegated to staff in the same way the final approval of the materials was left to staff for the Wal-Mart building. Density—The number of units increased 18% from that shown in the preliminary approval. However, the Planning Commission showed no alarm at this increase when it reviewed the project on May 18. The PUD zoning does not have a maximum density limitation. Therefore, it only needs to be demonstrated that there are sufficient buffers, open space, and parking. The parking issue has already been addressed. There are no other low.density residential properties in proximity to the apartment building. It is buffered from major streets by the Wal-Mart building, the railroad tracks and businesses along 37`h Avenue N.E., and by commercial uses to the west. The new park will provide open space relief for this project and the Hunt project to the north. Public transportation is available on 391h Avenue. Therefore, the increase in units to 261 is not an issue and should be approved. Setback from West Property Line There is concern that the parking stalls along the west side of the site are only 2.5 feet from the property line. The developer proposes to landscape this area. If the area is landscaped with shrubs, people on the passengers side of the cars parked in the stalls will not be able to get out of their cars or will trample the landscaping. The landscaping should probably be omitted along this property line until such time as there is new development to the west and the property lines can be adjusted to accommodate the landscaping. Summary It is recommends that the Planning Commission recommend approval of the Final Development Plan subject to the following conditions: 1. The color and location of exterior materials on the building be clarified prior to approval by the City Council or the Development Review Committee. 2. The landscaping along the west property line adjacent to parking stalls be omitted until some future date when property is developed to the west and the lot lines can be readjusted. FINAL DEVELOPMENT PLAN for SILVER LAKE VILLAGE APARTMENTS St. Anthony Village, Minnesota May 24, 2004 PROJECT NARRATIVE Developer The Developer for this project is Dominium Development and Acquisition, LLC, a firm specializing in the development of multi-family rental housing projects. Introduction The rental housing project site is part of an overall redevelopment area on the old Apache Plaza site now named Silver Lake Village. The parcel size for this housing site is approximately seven acres and is bound by a new Wal-Mart development on the east, Baker's Square and Don's Car Wash on the west, an extended 38th Avenue on the north and the existing railroad property on the south. The City of St. Anthony Village's future vision suggested that a mixed-use development would be most appropriate for this redevelopment area. Those uses would be office, retail, restaurant, and housing. This application for Final Development Plan approval is.for the market rate and affordable rental portion of the overall housing component to this new mixed-use redevelopment. Proposed Rental Housing Unit Make Up Previously, the St. Anthony Village City Council approved the PUD for the entire redevelopment project now called Silver Lake Village. The site has been cleared of existing structures and some of the new commercial construction has commenced. This proposal is for the development of an up-scale multi-family general occupancy and senior rental complex, both market rate and affordable, which will include 261 apartment units. There will be a mixture of studio, one, two and three bedroom units of the traditional "flat style"apartments plus a few two-level town home units at grade and four loft style apartments at the 4'�h level. Building Shape and Placement The building proposed has a horizontal "S" shape layout arranged with the long dimension running in the east-west direction. The concept of this design is to architecturally and aesthetically engage the new"Central Park", which is a common element for the entire redevelopment, with this project's common plaza spaces(one of the"coves" of the S shape facing north)creating an even larger open park-like space. The other"cove"of the S (south facing) is used as an area for surface parking which, is essentially at the rear of railroad side of the building. There is a "drive-through" element at the south end of Apache Lane that will allow vehicular traffic to pass"through" the building at the 1st and 2"d levels to easily access the surface parking on the south side of the building. The entire building is a four-story structure with another level of underground heated parking. There is a one and a half level common area party room/leasing office which is located in the courtyard facing Central Park and is attached to the main housing building. Exterior Materials The exterior elevation of the four-story housing integrates the design appearance of the classic"row- house" theme, which is intended to embrace the overall "urban"feel of Silver Lake Village. Instead of traditional horizontal layering of different materials,the developer has elected to provide strong vertical elements on all surfaces, changing materials from brick(possibly two colors)on the projecting bay elements to colored, smooth"stucco-like" surface panels and other siding on the vertical recessed deck elements, again simulating the row-house look. All exterior materials are chosen to be complimentary to the surrounding new retail and condominium housing components. The primary roof will be sloping with architectural fiberglass/asphalt roof shingles. Pre-finished, colored, architectural metal roofing in standing seam fashion will be used to ornament the key focus points of the project including the club house, the top of the drive-through element and the north east end of the building which overlooks the central park. Window frames will be all white. Parking There are 234 off-street surface parking spaces including 7 handicapped accessible spaces shown within the proposed property lines of this new site. There are also another 210 heated parking spaces including 6 handicapped in the lower level of the structure for a total count of 444 spaces for the site. This is a ratio of 1.7 spaces for each rental unit. The developer, Dominium Development and Acquisition, LLC, has determined through experience with many other housing projects that they own and manage, that this parking ratio is more than adequate. Drainage and Utilities Overall site plans are provided showing the preliminary design of the grading;drainage and utilities proposed for the housing development. These plans are all consistent with the previously approved Planned Unit Development submittal for the entire redevelopment area. Landscaping A preliminary landscaping plan is included with this submittal and is consistent with the previously approved Planned Unit Development for the entire redevelopment area. It is designed to take advantage of all the open green space on this specific site taking special care to integrate the plaza and associated landscaped areas with that of the new central park and condominium landscaping design. Background It is required that the Planning Commission review the final plans for the Hunt/Pratt condominium development and make a recommendation to the City Council to approve, approve with suggested modifications, or reject the plans. The criterion that the Planning Commission should use to make the recommendation is the consistency of the final plans with the concept that was approved last September. The concept (Preliminary Development Plan) that was approved last year is reflected in the Design Framework Manual dated August 19, 2003 and the Preliminary Site Plan dated 8/8/03. It shows the four condominium buildings being located north of the Dominium rental building. If approved, the developer expects to begin construction in the fall. Finding of Consistency of Current Proposal with Preliminary Development Plan Building Location and Lot Coverage—The final plans show four modified U- shaped buildings facing each other. A central open space spine separates the buildings. The lot coverage and locations are the same as in the preliminary plan. Building Appearance—The height of the building is four stories. Height varies from a typical 50 foot height to a maximum of 60 feet in some end locations. The height has remained the same as in the preliminary plan. The buildings' exterior appearance is also basically the same. The design details show brick facing on the lower three floors with stucco/stucco board on the upper floor. The exterior materials are intended to be complimentary to the commercial developments in the PUD and to the Dominium building. The roof will be flat with parapet walls. Building Density—The number of apartment units has decreased from 256 to 251. Types of Units—Three-hundred eighty people are expected to reside in the 251 units. There will be a mix of one bedroom, one bedroom with den, two bedroom, and two bedroom with den units. All of the units will be for sale. Affordability—All of the units are expected to be market rate units. None of them are expected to be affordable to households with median incomes less than 50% of AMI. Parking Spaces—There will be 89 parking spaces (1.4 spaces per unit) in each garage. That amounts to 356 spaces for the four buildings. In addition, there are 64 outside spaces on private property. The total amount of spaces is 420 (1.7 spaces per unit). There are 22 spaces along 39th Avenue that cannot be credited to the development because they are in the public right-of-way and can be used by anyone. Planner's Analysis and Comments A PUD allows flexibility because of the large nature of the use. Some flexibility from normal city requirements is needed in order to approve this development. Parking-The number of parking stalls is less than would normally be allowed by code. Normally 502 spaces would be required. Four hundred and twenty are being provided. There are 22 spaces along 39"' Avenue. However, these are on public right-of-way and cannot be used to satisfy parking requirements for the project. The developer has done several buildings similar to these. His experience is that many units are purchased by single individuals who live alone or senior couples where there is just one driver. Therefore, the 1.7 spaces per unit is expected to be adequate. Appearance—The exact colors have not been defined yet. However, the color rendering indicates a rusty brick color compatible with other buildings in the PUD. The colors should be clarified by the time the Council approves the plan or delegated to staff in the same way the final approval of the materials was left to staff for the Wal-Mart building. Final Plat—The final plat is in conformance with the PUD and meets all the platting requirements of the City of St. Anthony. Summary It is recommends that the Planning Commission recommend approval of the Final Development Plan subject to the condition that that the color of exterior materials on the building be clarified prior to approval by the City Council.
