ORDINANCE 1991-003
AN ORDINANCE REGULATING THE SURFACE USE OF THE WATER
OF SILVER LAKE LOCATED WITHIN THE BOUNDARIES OF
THE CITY OF ST. ANTHONY; AMENDING THE 1973 CODE
OF ORDINANCES TO ADD A NEW SECTION 1500:00
The City Council of the City of St. Anthony, Minnesota, ordains:
Section 1. The 1973 Code of Ordinances is amended to add a new Section 1500:00 to read
as follows:
Section 1: PURPOSE, INTENT AND APPLICATION: As authorized by M.S. §
378.32 (459.20), Subdivision 1 as now in effect and as hereafter amended, this Ordinance is
enacted for the purpose and with the intent to control and regulate the use of the waters
of Silver Lake in Ramsey County, Minnesota, said bodies of water being located within the
boundaries of St. Anthony, to promote its fullest use and enjoyment by the public in general
and the citizens of St. Anthony in particular; to insure safety for persons and property in
connection with the use of said waters; to harmonize and integrate the varying uses of said
waters; and to promote the general health, safety and welfare of the citizens of St. Anthony,
Minnesota.
Section 2: ADOPTION AND INCORPORATION BY REFERENCE OF
MINNESOTA WATERS AND WATERCRAFT SAFETY LAWS, AND BOAT AND
WATER SAFETY RULES PROMULGATED BY THE MINNESOTA DEPARTMENT
OF NATURAL RESOURCES: The Minnesota Waters and Watercraft Safety Laws, M.S.
§ 361.01-361.29, as they now exist and are hereafter amended by the State of Minnesota
Department of Natural Resources,Minn. Rules parts 6110.0100-.2300 as the same now exist
and are hereafter amended, are hereby adopted, incorporated herein by reference, and
made a part hereof as if set forth in their entirety. At least three copies of said Waters and
Watercraft Safety Laws and Boat and Water Safety Rules and Regulations, so adopted, shall
be marked as official copies and filed in the office of the City Auditor along with this
Ordinance.
Section 3: VIOLATIONS OF THE MINNESOTA WATERS AND WATERCRAFT
SAFETY LAWS, AND BOAT AND WATER SAFETY RULES PROMULGATED BY
THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES: Any person violating
the Minnesota Waters and Watercraft Safety Laws, and the Boat and Water Safety Rules
and Regulations promulgated by the Minnesota Department of Natural Resources, adopted
and incorporated herein by reference, shall be guilty of a misdemeanor.

Section 4: RESTRICTIONS DURING CERTAIN HOURS: Between the hours of
11:00 A.M. and 3:00 P.M. and between the hours of 7:00 P.M. and 3:00 A.M. on each and
every day of the week, no motorboat shall be operated at a speed in excess of five (5) miles
per hour. At all other times during each and every day of the week, motorboats shall be
subject to no speed limit and may be operated at unrestricted speeds.
Section 5: DIRECTION OF TRAVEL DURING UNRESTRICTED SPEED
TIMES: During the hours in which unrestricted operating speeds are permitted, all
motorboats shall travel and be operated in a counterclockwise direction around Silver Lake.
Section 6: NONSANCTIONED RACING PROHIBITED: Racing, that is the
participation of two (2) or more operators of motorboats operating their motorboats in a
competition of speed, shall be prohibited on the waters of Silver Lake unless the same takes
place as part of a scheduled or public race, regatta, tournament or other competition or
exhibition duly sanctioned by the county sheriff pursuant to Section 361.20 of the Minnesota
Statutes, as amended. `
Section 7:. ENFORCEMENT: The enforcement of this Ordinance shall be the
primary responsibility of the Ramsey County Sheriffs Department, and the City of St.
Anthony's peace officers. Other licensed peace officers including Conservation Officers of
the Department of Natural Resources of the State of Minnesota are also authorized.
Section 8: All authorized Resource Management, Emergency and Enforcement
Personnel, while acting in the performance of their assigned duties are exempt from the
foregoing restrictions.
Section 9: EFFECTIVE DATE: This Ordinance shall be in effect from and after the
date of its passage and publication.

20 Members of the Council and the City. Manager received books of comparable
21 values. This book contains a breakdown of homes in the City by types of
22 housing; that being, sale price compared to assessed value. In all cases
23 but one, the homes sold in 1990 sold for more than the assessed value.
24 The sale price was taken off the Certificate of Real Estate values.

Mayor Ranallo felt these were good comparables. The Mayor read a memo

• 27 from the Hennepin County Appraiser which advised property owners that
98 they still had the option to attend the Hennepin County Board of
29 Equalization if they did not agree with the appraiser' s recommendation.

1 Mayor Ranallo read a letter received from Jake Cadwallader, Property
2 Manager of Real Property Management Company, regarding properties
located at 2938 and 3004 Old Highway 8 which are fourplexes. He is
4 requesting consideration for value reduction.
5 Mr. Becken advised that this property owner can be considered as having
appeared at the Board of Review and can come before the Board of
P Equalization. The City Manager noted that this property owner is
9 requesting an analysis done on the basis of income.

11 Motion by Marks, second by Enrooth to add the properties located at
12 2938 and 3004 Old Highway 8 as having: appeared at the Board of Review
13 and secure the owner 's right to appear at the Board of Equalization.

17 David Jacobson, 3336 Highcrest Road , had sent a letter to the Board of
18 Review held on April 9, 1991 . The City Manager stated that Mr. Jacobson
19 was requesting acknowledgement of his letter having been received and
20 was not requesting a property reviewal .

22 Mr. Becken advised that appointments to appear at the Board of Equalization
23 should be made by June 10th as the Board will be meeting for two weeks
24 starting June l7th. Each property owner who will be appearing will- be
5 allotted ten minutes to present his/her information regarding the value

• 25 of the property. He noted that all property owners who have appeared
27 at the City's Board of Review have been advised of the Findings of
98 the Hennepin County appraiser of the value of their property. This
�9 advisory letter also explains how their value can be appealed at the
30 Board of Equalization. The Ci.ty Manager was requested to notify those
31 property owners who had attended the April 9th Board of Review and
32 were not present at this Reconvened Board of Review as to the process.
33 Doug Jones explained that a property owner can apply for an abatement
34 which must be done by May 15th. Mr. Becken advised that an abatement
35 can correct an erroneous value from a previous year.

5 A. Council Reports

7 Report of Councilmember Wagner
P Councilmember Wagner gave a status report on the City' s participation
9 in the Special Olympics. He will be in contact with the City which is
10 being hosted by St . Anthony. He will invite the athletes to visit the
11' City if possible and make arrangements for souvenirs to be given to
12 the athletes .

i4 Apache Plaza is presently installing a garden center.. Councilmember
15 Wagner noted that the Health Fair held at the Plaza recently was very
16 successful as was the Pine Box Derby. He felt these activites were
17 very positive and were encouraging for the Plaza.

19 Mayor Ranallo advised he has received calls from residents across from
20 Apache Plaza expressing concern with a "hut" and he inquired what this
21 structure was supposed to be . The City Manager felt the City staff had
22 been misled when the structure was requested that it should have an
23 accessory use designation. He will contact the owners regarding the
24 need for a conditional use permit.

• 26 Report of Councilmember Fleming
27 Councilmember Fleming attended the reception for retiring Officer Bill
28 Ferguson. She presented the award for the twenty-six year employee.

31 Councilmember Marks had nothing to report at this time.

33 Report of Councilmember Enrooth
34 Councilmember Enrooth received photos of the Recycling Center from _Sue
35 VanderHeyden. He noted that there are tires left at the Center each
36 week and there is broken glass. He felt the appearance .of the Center
37 is getting worse.

39 Councilmember Enrooth expressed concern with the amount of funding
40 the Center is requiring each year and felt serious consideration should
41 be given to continuing its use. He recommended that the bin be locked.

43 Mayor Ranallo has noticed that large pieces of furniture are being left
44 at the Recycling Center and it costs the City to have these items re-
4S moved. He suggested that it be open only during certain hours.

47 The City Manager advised that the gate is open during the week as
48 vehicles from the Public Works Department use this area for access.
49 This facilitates dumping all week long by residents as well as non-
50 residents. He will contact the Public Works Director regarding changing

1 the location of the Center. He also felt that hiring someone to work •
2 at the Center should be considered. Mayor Ranallo suggested this may
be an opportunity to use volunteers.

5 Doug Jones, a resident of the City, felt rubbish removal should include
a recycling charge. He stated his experience with a rubbish hauler. The
7 Mayor felt the City did not want to get into a billing responsibility
R for rubbish hauling. Mr. Jones felt that recycling should be mandatory.
9 He suggested that one hauler could be responsible for picking up all
10 of the recyclables.

12 The City Manager stated that mandated recycling is coming very soon.
13 He felt that organized hauling in each city will be next .

15 Mayor Ranallo noted that "pooling" of rubbish is taking place in the
16 City already. He felt the Recycling Committee could make some sug-
17 gestions on this issue.

19 Report of Mayor Ranallo
20 Mayor Ranallo attended the 25th Anniversary Celebration of the Lions
21 Club. He presented a plaque to the organization from the City. He
22 was amazed at all of the activities this organization participated in
23 as well as the fundraising which was done that benefitted the City and
24 its residents. He noted there is a need for more members as the Lions
25 Club presently has eighteen members. The meetings are on the second and
26 fourth Tuesdays of each .month.

28 The Mayor received a letter from the Tri-City American Legion requesting
29 the Council to authorize participation in the Legion' s Fourth of July
30 Celebration in New Brighton. He requested members of the Council to give
31 this request some thought.

33 The Mayor' s preference is to have some celebration in St . Anthony. He
34 requested this be an agenda item at the next Council work session.

36 B. Report of the City Manager

38 a. Status of Filtration Plant
39 The City Manager thanked the Councilmembers who attended the GAC
4 0 ceremony.

42 Congressman Sabo' s office staff have contacted the City Manager re-
43 garding their willingness to help with EPA. EPA had contacted the
44 Congressman' s office and advised that the City has a "fully protected
bS system." The staff is aware that the City is not accepting the system
46 and will gather more information on the City' s behalf. The faci.lity - - --
47 still belongs to the MPCA. Senator Durenberger's office had expressed
48 a willingness to be of any help necessary to the City. Senator Marty's
49 staff has also been advised of the situation.

• 1 The City Manager stated to all interested parties that the City' s
2 residents expect and trust a fully protected system. He noted
that if one of the pumps were not in use the pumping capacity of
4 the system would be reduced by two-thirds. Sprinkling bans are
5 anticipated for this summer. Presently, there is no backup.

7 A thank you letter has been sent to Congressman Sabo for his well wishes which
P his staff who had attended the dedication conveyed to the City.

10 b. Stop Sign at 29th Avenue and Crestview
11 A letter was sent to residents in the- area of this stop sign inquiring
12 if they held any opinion regarding the disposition of the sign. No
13 responses were received but it was felt that it may be prudent to
i4 leave the sign in its present location.

16 c. Assistant to the City Manager's Position Vacancy
17 The City Manager stated that Sue VanderHeyden will be missed. In light
18 of the State' s financial problems the City Manager is recommending that
19 the position be filled by an intern at an hourly rate without benefits.
20 He feels the position is important and that approximately eighty percent
21 of the tasks will focus on recycling.
22
23 Mayor Ranallo recognized the need to be conservative with finances and
24 noted that the -City has already reduced the work force by eliminating
25 one police officer position and one public works position.

27 8. PUBLIC HEARINGS

29 A. Allocation of Community Development Block Grant Funds
30 The Public Hearing was opened at : 10 p.m. . It was scheduled for
31 7:45 but no one was in attendance for this issue so it was not
32 affected by the hearing opening later.
34 The public hearing is on the housing and community development needs
35 of the City. The Statement of Objectives consists of seven program
36 areas. The City Manager reviewed the program areas and the funds
37 which will be used for these programs.

A. Resolution No. 91 -024; Re: Police Union Agreement for 1992
Motion by Marks, second by Fleming to adopt Resolution No. 91-024 ;
being a resolution ratifying the 1992 agreement between the City
L of St. Anthony and American Federation of State , County, and
P Municipal Employees (AFSCME) -Council 14, Local 57, representing
9 St. Anthony Police Department employees .

13 B. Resolution No. 91 -025; Re: Ramsey County Recycling Expansion Grant

15 Motion by Marks, second by Enrooth to adopt Resolution No. 91-025
17 being a resolution approving the Ramsey County Recycling Expansion
18 Grant Program.

21 C. Sidewalk Petition
22 Mayor Ranallo had received a petition from residents on Silver Lane
�3 for the installation of a sidewalk on the south side of that street.
24 The City Manager advised that the owners of the Equinox Apartments
25 have stated they will not support the installation of the sidewalk.
26 The assessment for these apartments would be approximately $14,000.

78 The City Manager advised that to assess a benefitted property owner
�9 the City has to prove that the property will be benefitted in property
30 value in the same amount as the assessment . He suggested that an
31 appraiser could be hired to prove the benefit of this sidewalk. The
32 appraiser services will add to the cost of the project which is esti-
33 mated to be approximately $27,000. If benefit is not proven the City
would be responsible for a portion of the costs on the southside
35 of the project.

37 Doug Jones stated that the Sports Boosters have indicated a willingness

ITEM REZONING PETITION
Forrest and Marty Harstad of Harstad Companies, 1900 Silver Lake Road, New Brighton, are
petitioning the City to rezone the property at 3816 Foss Road, from Light Industrial to R-4 Multiple
Family Residence District.
Harstad's had previously petitioned the Planning Commission and City Council for a rezoning from
LI to R-3 Townhomes. This request was approved on October 23, 1990. However, there was a
problem concerning capacity of the proposed number of units for the lot.
City staff has been working with the Harstad's to try to resolve this issue. To meet the capacity
requirements of the zoning ordinance, the Harstad's would have had to reduce the proposed
development to such an extent that it would not have been feasible. Therefore, the Harstad's have
changed the proposed development to 2 eight-plex condominiums which fit under the zoning district
of R-4.
The previous rezoning was to be allowed on the condition that the development occurred,
therefore, the present request is from LI to R-4.

36 Assistant to the City Manager VanderHeyden reported the area is zoned for
37 light industrial. The lot has R-3 zoned property and Light Industrial. The

39 of townhome put in that area. Proposal is to put two buildings with eight
40 toa-nhomes each. If rezoning is approved,. Harstad will have to come back
41 with the full detail plan. Right now just to consider rezoning. Staff feels it is
42 a reasonable request.

17 and indicated the traffic is already heavy on the 30 foot wide residential

21 south side of their property as a junk yard; and he recommended the City •
22 look into the matter.

24 He suggested that there could be access from Chandler Drive as well as Foss
25 Road to help the traffic problem because Chandler is much wider. Madden
26 questioned whether rezoning guaranteed that townhomes would be on the
27 property.

7 Bruce 0 Brien, president of Toa�nhomes of St. Anthony, said that he a1-as
8 concerned that the area not be for industrial use. He said the toa'nhome
9 proposal is mostly favorable. Questions to the developer are with regard to
10 fire lanes, single car garages, parking and the amount of land available.

12 Madden clarified that the hearing was to approve rezoning only. O'Brien
13 would like to see the property rezoned regardless of the developer.

16 consideration of a west exit.

35 industrial.

37 Murphy inquired about the history of the property. City staff was unsure.

40 property at 3816 Foss Road from industrial to R'): and recommend that the
41 approval not be granted and made final until such time as a final plat plan is
• 42 approved by the City Council for the rezoning. We find that this would be
43 the best and highest use for the property at this time.

There is stiff some abuse of the Recycling Center. There continues to be trash dropped at the site,
yard waste, and miscellaneous junk. We are also having a problem with theft (black dirt).
As staff, we have discussed relocating the drop off site closer to Chandler Drive. We would
construct a gate on Chandler Drive and fence the recyclables so people could not enter the Public
Works yard. This would limit our exposure to liability that we are now faced with.
I recommend that we also utilize volunteers to man the Center. It may mean a reduction in hours
at the Center until we get enough volunteers interested.

ITEM : PAVEMENT MANAGEMENT SYSTEM STUDY
The Interim Report, presented, to the City Council by the Road Task Force, recommended the City
establish a formal Pavement Management System for all City streets. Staff has met with three
engineering firms and recommends the firm of Braun Intertec Pavement, Inc. to prepare the study.
Braun is a leader in pavement management and has performed similar studies for Golden Valley,
Roseville, Eagan, Bloomington and Minneapolis.
The pavement management system proposed will serve the City by supplying factual information
and justification on needed road repairs and replacement. It will also be used as a budgeting tool
to assist in the preparation of a five year capital improvements program. This will better enable
the City to plan long range expenditures and identify future bonding needs.
As part of the pavement management system report, Braun will also prepare an assessment policy
for the City. The cost of the pavement management system and the assessment policy is $16,850.
To keep the cost lower and to free the City from being dependent on one engineering firm, Braun
will train City staff to conduct the condition survey and City staff will input the information into the
software.
Recommendation: Fund the study come from the City's road restoration fund balance.

INTRODUCTION
• Maintenance of a functioning street system is a major task for Saint Anthony Village. To maintain
the street system in the most efficient manner, the Engineer must have at his disposal a
complete inventory of the streets. This inventory should include detailed information regarding
the composition and construction of the pavement, its use (including traffic volume), its present
and past condition, plus a detailed record regarding all other affected structures such as curb
and gutter, sanitary and storm severs, water and other utilities.
This information forms the basis of a functioning pavement management system. This vast array
of data is most valuable if it is stored in computer files allowing rapid and easy access. Not only
does this pool of information make the Engineer's task of establishing a street maintenance
program easier and more efficient, it can provide others such as the City council or the public
with factual information regarding the status of the system of streets and related structures. In
addition, it provides a sound foundation from which to project future needs. This enables the
City to plan and prepare a budget for maintenance as it is required rather than responding to the
highest current needs, often at higher costs.
Without such a database and management system, the task of efficiently managing a pavement
network is more difficult. Even the task of managing a small network is difficult since decisions
may be dominated by individual opinions and awareness.
Braun Intertec Pavement Inc. is a firm that was established to provide agencies with the expertise
and tools necessary to establish a functional Pavement Management System. This project is
very similar to others we at Braun Intertec Pavement Inc., have completed for other
• municipalities. Our role in assisting these communities has ranged from very comprehensive to
relatively minor. We have what we feel is the perfect combination of pavement management
services: 1)experienced and qualified staff, and 2)user friendly computer software. Our
assistance to the City of Saint Anthony will be to:
determine the specific needs of the City
provide and install the necessary computer programs and establish the database
train city personnel; they will be trained to do all of the tasks involved in developing and
maintaining a pavement management database
provide necessary original forms and manuals to record street surface condition and
other relevant data
provide specialized surveys and evaluation for pavement surface distress as well as train
city personnel to perform these surveys on-their own
• assist city staff in preparing a long range maintenance schedule with emphasis on timely
rehabilitation -
provide required services as needed from time to time for special tasks and to update the
system to keep it current with technology

Develop an appropriate assessNent policy for the City based on the results of the long
range maintenance needs. •
Present the results of all of the above to the City Council and general public.

STAFF QUALIFICATIONS
•
BACKGROUND OF BRAUN INTERTEC STAFF
For this project, the Project Manager will be Mr. David W. Janisch, P.E. Mr. Janisch will be the
primary contact to the city throughout the project. Mr. Janisch has been r project manager on
similar projects throughout his career. The computer software which will be implemented on the
city's computers was written by Mr. Janisch. His role in this project would be to organize the
field crew, supervise the data collection, meet with and train city staff, modify the software, and
analyze and present the findings of the study. Mr. Janisch has considerable experience in this
area and was the Assistant City Engineer for the City of Roseville, MN during the time Roseville
implemented its Pavement Management Program.
Other Braun Intertec Pavement staff who will be assisting on this project will be Mr. Benjamin
Worel, and Mr. Guy Kohlnhofer. The role that each will play in the project depends on whether
the City decides to have Braun Intertec collect the surface condition data or simply train City staff
to do so. It is anticipated that Mr. Worel will be the field representative in charge of collecting
the City's pavement condition data. Both Mr. Worel and Mr. Kohlnhofer have been project
managers during the surface condition data collection of this type for other cities involving
hundreds of miles of pavement. Most recently Mr. Kohlnhofer was in charge of the data
collection for the City of Oakdale, MN and Mr. Worel for the City of Minneapolis Parks
Department. Resumes of each of these persons is found on the following page.

SUMMARY EXPERIENCE
Mr. Janisch was an employee in the Research and Development Office of the Minnesota
Department of Transportation from 1978 to 1981 while attending the University of Minnesota.
He operated a Model 2000 Road Rater and developed the computer software used by
Mn/DOT to analyze the deflection data.
Upon gradation from the University of Minnesota, Mr. Janisch worked as a project engineer
for Midwest Pavement Management from 1982 to 1986. His responsibilities included
deflection testing with a Model 2000 Road Rater and analyzing deflection data. Mr. Janisch
developed a computerized pavement management program which was implemented in the
cities of Roseville, Moorhead and Golden Valley, Minnesota.
In 1986 Mr. Janisch began working for the City of Roseville as its Assistant City Engineer. He
was in charge of six full time and four part time employees and was responsible for city
street, sewer and water construction. He was selected as Roseville's 1987 Public Works
Outstanding Supervisor. With his efforts, Roseville became one of the first cities in Minnesota
to incorporate the results of a pavement management program into the city policies for street
maintenance and reconstruction. Mr. Janisch joined Braun Pavement Technologies, Inc. in
April of 1988. He brings to the company practical municipal experience relating to pavement
management and the use of deflection testing in designing new city streets.
KEY WORK EXPERIENCE
Mr. Janisch developed a computerized pavement management program written in Turbo
PascalT"" which can keep track of over 200 data items for every section of pavement. This
program can then produce reports which can prioritize a street system based on any of the
criteria selected. This program has been implemented or used in several cities in Minnesota.
The City of Roseville was able to completely modify their street maintenance and
reconstruction policy using this program. Mr. Janisch did all the computer programming and-
made many presentations to city and county engineers as well as city council and city
=-residents.:=Mr. Janisch also trained Roseville street department personnel in how to perform
detailed surface condition ratings-and record the data. -
Mr. Janisch has assisted several communities in implementing a pavement management
program.

Mr. Janisch developed a computerized overlay design program which is based on deflection
information gathered with Braun's Model 2000 Road Rater. This program is based on
Mn/DOT developed relationships as well as the AASHTO 'Interim Guide for the Design of
Pavement Structures". This program has been used to analyze data from nearly all of the 87
counties in the State of Minnesota.
As part of the Strategic Highway Research Program (SHRP), Which is a national pavement
research project, Mr. Janisch is the Data Manager. His duties include overseeing the data
entry, and report generation into the Regional Information Management System (RIMS). RIMS
is the database used by SHRP for data storage and retrieval.

Mr. Worel is involved in all facets of Braun Pavement Technologies, Inc. Primarily he is working
on the Strategic Highway Research Program (SHRP) project.This involves the data management
of the North Central Region states/provinces and operating a nondestructive testing device with
the Model 8000 Falling Weight Deflectometer.
Mr. Worel is responsible for data entry/retrieval from the regional data base. The regional data
base (known as RIMS) uses the structural query language (SQL) to obtain reports and analyze

This study involved conducting workshops around the State of Minnesota on the topic of
pavement rehabilitation choices. The workshops concentrated on the thought process involved
when choosing a pavement rehabilitation. The participants were taught how to recognize
pavements' distress, the probably causes of the distress and common rehabilitation procedures
for its repair. As a companion tot he workshops, an extensive manual was prepared and is now
being reviewed by the advisory committee. This manual, which includes over 100 photographs
of pavement distress, is intended for use by cities and counties within Minnesota. These
manuals will be the ones provided to the city as part of this project.

PROJECT 11: Development of Pavement Life Prediction Models

This study involved the development of prediction models for four pavement types. The project
involved the statistical analysis of fourteen years of condition data. Individual models were
developed for three levels of traffic and three levels of soils strength for each of the four
pavement types. The prediction models were based on the predicted growth of the distresses
and future condition indices were calculated from the projected distresses. The models have
been incorporated into the Mn/DOT pavement management system. This type of work will be
done to develop pavement deterioration curves for the city as part of this proposal.

SCOPE OF SERVICES
• The following tasks will be performed as part of our Scope of Services for the City of Saint
Anthony.
Task 1• Develop Pavement Management Parameters with City Staff
The first step in establishing a pavement management system for the City of Saint Anthony
would be to meet with City staff and develop the parameters to be used in the program. This
would involve identifying pieces of information desired to be stored in the computer software, as
well as field information to be collected during the surface condition surveys. Our experience
in other municipalities indicates that this results in approximately 250 pieces of information being
stored for every block of street. In particular, information such as curb and gutter type and
condition, the presence of sidewalks or bike paths along the roadways, the condition of
manholes, gate valves, and catch basins are data which can easily be collected during the
surface condition survey. This information is also invaluable to the City when determining which
pavements are of higher priority than others.
Because our program was written by our own staff modifications to the data can be easily made.
This results in the City obtaining a software package which truly is its own upon completion of
the project. The main purpose of Task 1 will be to identify how the Saint Anthony pavement
management program will be unique unto itself.
Task 2: Review Progress with City Staff
The progress of the project will be reviewed with staff approximately every week. During the field
data collection, staff will be notified daily as to the whereabouts of the crew, as well as the status
• and anticipated date of.completion. Monthly reports will be submitted to the City detailing the
current status of the project and the anticipated date of completion.
Task 3: Initialize Database
The database will be initialized using the parameters determined in Task 1. Initializing the
database involves determining each street segment, obtaining its length and width, and entering
the data. The initial data entry will be done by Braun Intertec staff. Subsequent data entry (such
as Pavement Condition) may be done by the City, if desired.
We recommend that the data be collected and organized by block of street. While other
methods could be used, we have found that the block-by-block approach is understood by
everyone most easily.
The current version of PMP is capable of storing over 250 pieces of information for each
individual block of street. The program is certainly not limited to 250 items, but by the amount
of data storage available to the City. PMP was written in a modular format which allows for the
addition of desired files. Unnecessary files can also be eliminated with minimal effort. For the
City of Saint Anthony it is anticipated that approximately 7 data files will be used to store the
information.

Task 4: Develop Analysis Format
Because we want the program to truly be the City of Saint Anthony's, as opposed to being a
generic software program, we will develop unique analysis formats which relate specifically to
Saint Anthony. This will involve developing pavement deterioration curves based on actual Saint
Anthony.data. These curves are then used to predict anticipated pavement decay. Curves will
also be developed which will note the impact of the various types of maintenance on City streets.
Typically curves will be developed for crack sealing, patching, seal coating, and overlays alone .
and in combination with each other. These curves are then used to predict the impact of
performing certain types of maintenance on city streets.
Task 5: Produce program code.
The program will be user friendly with a number of help screens available. The program was
written by Braun Intertec Pavement Inc. staff using Borland International's TURBO PASCAL. We
feel that by using a high level language rather than a database software package that we are
capable of achieving maximum flexibility. Our program is not bound by the restrictions of other
software. TURBO PASCAL is also very fast and the compiled source code occupies a minimum •
of disk storage space.
The report generation portion of PMP will allow the City to generate customized reports based
on several combinations of parameters. This includes sending the output to a computer file for
importing into a graphics program or CADD system. All of the appropriate safeguards are built
into the program to minimize entry errors as much as possible. Each entry is scanned for proper
format and content as well as appropriate range checking. Data is automatically backed up
upon exiting of the program. As the data is being entered, it is automatically stored on disk
once the information is completed. Several items, such as the section length, width and surface
type, are stored in more than one file. This information is automatically updated in any file which
needs to refer to it by entering it into a single file.
The program is capable of both storing and analyzing maintenance information. With this
information and the condition information, maintenance strategies can be analyzed to determine
the most cost effective procedure. Based on life cycle costs, budgets can be prepared with a
number of different time spans which will consider rehabilitation of the appropriate sections of
roadway.
As condition information is collected over the years certain trends will develop which will be
unique to the City. The program will use the past condition information to help in predicting
future condition. This allows for information which is unique to the City of Saint Anthony to be
taken into account when developing maintenance strategies.
The program will be expandable to allow for typical maintenance used by the City of Saint
Anthony along with anticipated costs and expected life. This information can be updated in the
future with current techniques and costs. The program will be modified so that all of the items
identified in Task 1 will be included. Examples of the software data screens, reports, and graphs
produced with the results are included in the Appendix.
Task 6: Perform Surface Condition Surveys and/or Train City Staff
Braun Intertec Pavement Inc. will work closely with Saint Anthony staff during training and
collection of the surface condition information. We have done surface condition ratings on
hundreds of miles of pavements both in Minnesota and throughout the country. We are also
experienced in training city personnel on the collection of pavement surface distress information.
Certain criteria will be developed after discussing with city staff regarding how to deal with
intersections. The rating system we used is similar to the one endorsed by the American Public
Works Association known as PAVER. The rating system measures actual quantities of cracking
and distress rather than applying some type of numerical rating. Each type of distress is
identified and measured along with its severity. A numerical rating is then calculated by the
computer.for use in prioritizing the streets.
In the City's Request for Proposal it was indicated that the surface condition surveys may be
done entirely by the Consultant or entirely by Consultant trained city staff. We have given
estimates for both types of data collection and entry in the cost estimate portion of the proposal.
Task 7: Installation and Office Training
The software developed through the above tasks will be installed on the City's computer system.
This will involve installing the software, providing users manuals, and training office staff on the
use of the pavement management software. As mentioned previously, the program will be user
friendly which allows it to be used by someone with every little experience in pavements,
database software, or engineering details. Typically the data are entered by clerical staff in the
street or engineering departments.
Task 8: Develop Long-Range Maintenance Recommendations
Long-range maintenance recommendations will be given based on the results of the surface
condition surveys and the subsequently developed pavement decay curves. This report will
detail which blocks of street are recommended for receiving certain types of rehabilitation based
on their cost, benefit, and expected life. All of the reports generated will be done using the
pavement management software and can be duplicated by City staff in the future.
Task 9: Develop a City Assessment Policy
" The results of the long range maintenance recommendations will be used to develop a citywide
assessment policy. It is anticipated that contacts will be made with many municipalities to
research any assessment policies they may have in place. Once all the data have been received,
a preliminary assessment policy will be presented to the City Manager for discussion. Once this
policy is refined and felt to meet the City's needs, a formal policy will be drafted for review by the
- -council. The policy will also be reviewed by the City Attorney to determine its legality.

Task 10: Present Recommendations to City Council and Public
The results of the long-range maintenance recommendations listed in Task 8 and 9 will be
presented to the city council and public to provide for better understanding within the
community. We have found that if the public and council understand the principles behind the
program, that implementing the results of a study based on this program is much more easily
done.

As you requested, we have estimated the engineering time required
to provide the City of St. Anthony with a Comprehensive Pavement
Management Study.
We have already furnished you with a schematic which depicts the
steps required to complete the study and the services which will
be provided. We feel these services will fit the needs of the
City of St. Anthony for a pavement management system. In
summary, the study would be compiled in the following steps:
1. All of the streets catalogued and inventoried in
January, 1980 will be listed on the computer.
2. The Director of Public Works will furnish SEH with an
updated maintenance history for all the pavements and
the annual maintenance cost.
3. The inventory established on the computer will provide
a listing of the streets in either alphabetical or
numerical order complete with history data compiled
from existing records.
4. A field rating survey would be . conducted by our
personnel accompanied by City personnel if desired to
visually rate all the pavements which are classified as

the composite field rating for each street segment and
prioritization. A structural analysis will be
conducted as well as traffic analysis and required
pavement section for a projected timetable .
6 . Recommendations will be provided for both maintenance
and capital improvements .
7 . A capital improvement program for a designated period
of time will be provided. This program will be
separated into two segments; maintenance and capital
improvements .
8 . A City map designating the recommendations will be
prepared.
9 . A fully bound report will be submitted to the City
Council at the conclusion of the study.
The study will consist of all the City streets included in the
January, 1980 study. This street network consists of bituminous
surfaced streets only. Concrete streets will not be rated and
catalogued as a part of this study.
Ile have included a computer printout of the basic steps in the
study and an estimate of the hours for each discipline of
personnel involved in the study. We have also included the cost
of the study. We estimate that the cost would be approximately
$14, 195 . We are submitting this information to you for your
review and study as requested.
As we discussed earlier with you, we feel that a Pavement
Management Study will enhance the infrastructure maintenance for
the City of St. Anthony and provide a budgeting tool . A pave-
ment management system will also save money for the City in their
street maintenance program by readily providing the information
required to make more intelligent and timely decisions about
pavements and their maintenance requirements.
We have included a list of our pavement management clients for
your information. These clients have implemented the pavement
management process to different degrees . Ile will furnish
references and a more detailed description of each project upon

We would propose to complete the pavement evaluation phase by May 15, 1991 .
Once authorized, we would begin the research work over the remaining winter
months. We would recommend that the actual pavement evaluation not be
completed until the street surfaces are clear of snow and ice; hence, the
May completion date.
The assessment manual phase can be substantially completed over the winter
months. Once the methods of financing capital improvement projects have
been established, the manual can be completed. The final completion date
would then track along with the pavement evaluation phase on 5/15/91.
Based upon the work tasks outlined above, we would propose to complete the
pavement evaluation phase for a not-to-exceed cost of $13,500. The
assessment manual phase would be completed for a not-to-exceed cost of
$3,300.

A RESOLUTION APPROVING A COOPERATIVE AGREEMENT FOR A
DRAINAGE SYSTEM CAPACITY STUDY AND AUTHORIZING THE
MAYOR AND CITY MANAGER TO EXECUTE SAID AGREEMENT
ON BEHALF OF THE CITY
WHEREAS, the findings of a Preliminary study indicate that a, system capacity study is-
warranted of the existing drainage capabilities of Drainage District No. 6.
BE IT RESOLVED, that the City Council of the City of St. Anthony hereby approves the
cooperative agreement between Hennepin County and the City of St. Anthony for a
Drainage System Capacity Study (attached hereto); and
BE IT FURTHER RESOLVED, that the City Council of the City of St. Anthony hereby
authorizes the Mayor and City Manager to execute said agreement on behalf of the City.

IN A DRAINAGE SYSTEM CAPACITY STUDY
AGREEMENT, Made and entered into this day of 19 by
and between the County of Hennepin, a body politic and corporate under the laws of the
State of Minnesota, hereinafter referred to as the "County" and the City of St.
Anthony, a body politic and corporate under the laws of the State of Minnesota,
hereinafter referred to as the "City" .
WITNESSETH:
WHEREAS, The City, through its agent Barr Engineering Company, has performed a
preliminary study of the existing drainage capabilities of a watershed known as
Drainage District No. 6 in which County State Aid Highway No. 88 is located; and
• WHEREAS, The findings of said preliminary study indicate that a system capacity
study is warranted to identify cost effective options for solving existing drainage
problems within said Drainage District No. 6; and
WHEREAS, The estimated cost of said System Capacity Study is between $15,000 and
-$20,000; and
WHEREAS, The City has requested the County participate in the funding of said
Study for cost effective options, and
WH REAS, Hennepin County Resolution No. 91-4-403, approved April 23 1991
authorized the preparation of a cooperative agreement between the City of St. Anthony
and Hennepin County for said System Capacity Study in which the County's participation
is to be .$5,000_or. less;.-.and
WHEREAS, It is contemplated that said work be carried out by the parties hereto
under the provisions of M.S. SEC. 162.17, Subd. 1 and SEC. 471.59.

The County will participate in the costs of the hereinbefore mentioned System
Capacity Study to identify cost effective options for solving existing drainage
problems within said Drainage District No. 6.
II
The City or its agents shall be responsible to ensure that all work and services
required for the completion of said System Capacity Study are in accordance with any
and all applicable laws, regulations and guidelines related to location, design,
safety, flood control and environment.
III
The City or its agents shall be responsible for the collection of any and all data
required to complete said Study.
IV
All plans, designs, reports and specifications prepared in accordance herewith •
shall be prepared by or under the direct supervision of a professional engineer or
land surveyor, as applicable, registered in the State of Minnesota, and said plans,
designs, reports and specifications shall be certified by him as required by law.
V
At the request of the County, the City or its agents shall furnish the County with any
working copies of any plans, designs or reports at any time during the study process.
VI
The County retains the right to at any time review and comment on the plans,
designs or reports of the City or its agents in regards to their effect on the
drainage of the roadway and right of way corridor of County State Aid Highway No. 88.
VII
The City shall be responsible for the accuracy of the work of its agents and
shall ensure that all necessary revisions or corrections resulting from errors and
omissions on the part of the City or its agents are promptly made without additional •
compensation by the County. Acceptance of the work by the County shall in no way

• relieve the City or its agents of the responsibility for subsequent corrections of any
such errors or omissions and also the clarification of any ambiguities.
VIII
Upon completion of said System Capacity Study, the City shall furnish the County
with three (3) copies of the completed report.
IX
The County shall reimburse the City for a portion of the costs of the herein
agreed Study. Said County reimbursement shall be Five Thousand Dollars and No Cents
($5,000.00) .
The City shall invoice the County for reimbursement. Said invoice shall include
a copy of any invoices submitted to the City by its agents for work performed in
accordance with this agreement and totaling at least $5,000.00.
Invoices will be checked by Hennepin county and payments will be made in full ,
without retainage within forty-five (45) days of receipt.
X
All records kept by the City and the County with respect to this project shall be
subject to examination by the representatives of each party hereto.
XI
It is understood that the $5,000.00 reimbursement to the City provided for herein
is for the County's total share of said System Capacity Study for solving existing
drainage problems within said Drainage District No. 6 in the vicinity of County State
Aid Highway No. 88.
Nothing herein shall be construed as a commitment by the County to participate in
the construction costs of any improvements implemented as a result of said Study.
XII
• It is further agreed that each party to this agreement or their agents shall not
be responsible or liable to the other or to any other person whomsoever for any

claims, damages, actions, or causes of actions of any kind or character arising out of•
or by reason of the performance of any work or part hereof by the other as provided
herein; and each party further agrees to defend at its sole cost and expense any
action or proceeding commenced for the purpose of asserting any claim of whatsoever
character arising in connection with or by virtue of performance of its own work as
provided herein.
XIII
It is further agreed that any and all employees of the City and all other persons
engaged by the City in the performance of any work or services required or provided
herein to be performed by the City or its agents shall not be considered employees of
the County, and that any and all claims that may or might arise under the Worker's
Compensation Act or the Unemployment Compensation Act of the State of Minnesota on
behalf of said employees while so engaged and any and all claims made by any third
parties as a consequence of any act or omission on the part of. said employees while so
engaged on any of the work or services provided to be rendered herein shall in no way
be the obligation or responsibility of the County.
Also, any and all employees of the County and all other persons engaged by the

The provisions of M. 5. ,181.59 and of any applicable local ordinance relating to
civil rights and discrimination and the affirmative action policy statement of
Hennepin County shall be considered a part of this agreement -as--though fully set -forth
herein.

The Silver Lake Homeowners Association has requested' the City to adopt a speed limit for the
lake.
The attached ordinance has been reviewed by the City Attorney and his comments have been
included with the ordinance.
This ordinance will require three readings and will also require Columbia Heights to adopt the
same ordinance.
Once final adoption of the ordinance is done, the Department of Natural Resources Commissioner
will review the ordinance to determine if the speed limit is valid.

AN ORDINANCE REGULATING THE SURFACE USE OF THE WATER
OF SILVER LAKE LOCATED WITHIN THE BOUNDARIES OF
THE CITY OF ST. ANTHONY; AMENDING THE 1973 CODE
OF ORDINANCES TO ADD A NEW SECTION 1500:00
The City Council of the City of St. Anthony, Minnesota, ordains:
Section 1. The 1973 Code of Ordinances is amended to add a new Section 1500:00 to read
as follows:
Section 1: PURPOSE, INTENT AND APPLICATION: As authorized by M.S. §
378.32 (459.20), Subdivision 1 as now in effect and as hereafter amended, this Ordinance is
enacted for the purpose and with the intent to control and regulate the use of the waters
of Silver Lake in Ramsey County, Minnesota, said bodies of water being located within the
boundaries of St. Anthony, to.promote its fullest use and enjoyment by the public in general
and the citizens of St. Anthony in particular; to insure safety for persons and property in
connection with the use of said waters; to harmonize and integrate the varying uses of said
waters; and to promote the general health, safety and welfare of the citizens of St. Anthony,
Minnesota.
Section 2: ADOPTION AND INCORPORATION BY REFERENCE OF
MINNESOTA WATERS AND WATERCRAFT SAFETY LAWS, AND BOAT AND
WATER SAFETY RULES PROMULGATED BY THE MINNESOTA DEPARTMENT
OF NATURAL RESOURCES: The Minnesota Waters and Watercraft Safety Laws, M.S.
§ 361.01-361.29, as they now exist and are hereafter amended by the State of Minnesota
Department of Natural Resources, Minn. Rules parts 6110.0100-.2300 as the same now exist
and are hereafter amended, are hereby adopted, incorporated herein by reference, and
made a part hereof as if set forth in their entirety. At least three copies of said Waters and
Watercraft Safety Laws and Boat and Water Safety Rules and Regulations, so adopted, shall
be marked as official copies and filed in the office of the City Auditor along with this
Ordinance.
Section 3: VIOLATIONS OF THE MINNESOTA WATERS AND WATERCRAFT
SAFETY LAWS, AND BOAT AND WATER SAFETY RULES PROMULGATED BY
THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES: Any person violating
the Minnesota Waters and Watercraft Safety Laws, and the Boat and Water Safety Rules
and Regulations promulgated by the Minnesota Department of Natural Resources, adopted
and incorporated herein by reference, shall be guilty of a misdemeanor.

Section 4: RESTRICTIONS DURING CERTAIN HOURS: Between the hours of
8:00 A.M. and 11:00 A.M. and .between the hours of 3:00 P.M. and 7:00 P.M. on each and
every day of the week, no motorboat shall be operated at a speed in excess of five (5) miles
per hour. At all other times during each and every day of the week, motorboats shall be
subject to no speed limit and may be operated at unrestricted speeds.
Section 5: DIRECTION OF TRAVEL DURING UNRESTRICTED SPEED
TIMES: During the hours in which unrestricted operating speeds are permitted, all
motorboats shall travel and be operated in a counterclockwise direction around Silver Lake.
Section 6: NONSANCTIONED RACING PROHIBITED: Racing, that is the
participation of two (2) or more operators of motorboats operating their motorboats in a
competition of speed, shall be prohibited on the waters of Silver Lake unless the same takes
place as part of a scheduled or public race, regatta, tournament or other competition or
exhibition duly sanctioned by the county sheriff pursuant to Section 361.20 of the Minnesota
Statutes, as amended.
Section 7: ENFORCEMENT: The enforcement of this Ordinance shall be the
primary responsibility of the Ramsey County Sheriff's Department, and the City of St.
Anthony's peace officers. Other licensed peace officers including Conservation Officers of
the Department of Natural Resources of the State of Minnesota are also authorized.
Section 8: All authorized Resource Management, Emergency and Enforcement
Personnel, while acting in the performance of their assigned duties are exempt from the
foregoing restrictions.
Section 9: EFFECTIVE DATE: This Ordinance shall be in effect from and after the
date of its passage and publication.

6. In Section 4, in line 1, I would recommend changing the word "During" to
"between", and in line 2 before "3:00 P.M.", insert "between the hours of."
7. Section 9 can be deleted, since these are the penalties for a misdemeanor.
8. I assume that this is based upon some form submitted to you by the DNR
If not, I would recommend that you get from them a proposed form of ordinance
and see how it compares.
