This "New Zt7,000 otype" consists of a 70,000 square foot all masonry construc building, Approximatey square feet is retail and approximately 60,000 square feet of buildings in the outside roduct area. This outside product area is quite different from a traditional lumberyard, T ie, lumberyard is fully enclosed and a majority of the material is stored under roof. This new retail ncept is reflected by our new "Quantum Leap" Entrance drive ugh. The customers can rdilve into the.outdoor storage area and select and load the desired product and pay for it as th exit the area without having to go into the main retail building. This outside storage area ha he benefit of operation without the use of loudspeakers as all employees have hand held radi s. There is also no pole mounted lighting in the outside product area as all lighting is moui ited on the buildings and shine down. We have been very successful in positioning our "New Prototype" in areas that are densely populated and i i upscale retail areas, because of this new design that enables ours ore to blend in and co-exist in areas that a traditional "Lumberyard" could not be constructed. Wecertainly think that our n w design is a much better alternative to looking at the back of a 12rge discount retailer or large grocery store which in many instances have trash dumpsters and loading docks visible to the surrounding businesses or residents. Our "New Prototype" will be hilly enclosed so there will nc t be anything visible. ANTHONY ORDINANCE 1994-002 AN ORDINANCE RELATING TO PERMITTED CONDITIONAL USES IN A "C" GENERAL COMMERCIAL DISTRICT; AMENDING SECTION 1635.03 OF THE 1993 ST. ANTHONY CODE OF ORDINANCES The City Council of the City of St. Anthony hereby ordains: Section 1. Section 1635.03, Permitted Conditional Uses. is amended to add the following: (t) Hardware and building material supply store with outdoor lumber yard where (i) the lumber yard is screened in a manner approved by the City Council, and (ii) the hardware and building material supply store building contains at least 30,000 square feet of space. Section 2. Effective Date. This ordinance shall be in effect as of the date of its publication. According to the 1993 audit, the City has a fund balance in their capital equipment account of $209,650. I would propose we use $134,000 of the equipment reserve in 1995. This would then leave $75,650 in the equipment fund for emergencies, etc. I would also propose starting • in 1995 we start levying $75,000 per year to place in the equipment fund to continue an equipment replacement program. In 1995 I propose we would spend the $75,000 levy with the $134,000 from.the equipment reserve fund for total funds spent in 1995 of$209,000 The $75,000 we levy would be part of the property"tax levy each year that we would do on an annual basis. We will also eliminate the existing certificate of equipment levy, which in 1994 was $76,265. The benefits of this type of financing would be as follows: 1. Eliminate issuance and Moody's rating -- .savings of$7.000. 2. Eliminate interest cost over the life of the equipment certificate -- .savings of$80.000. 3. We can reduce or eliminate the $75,000 levy in any yeaar when the budget is in need of relief. With an equipment certificate, we cannot do that because we are obligated to pay the certificate holder. • The major disadvantage of this proposal would be the spending down of the equipment reserves by $134,000. However, if we levy the $75,000 each year, we will eventually build them back up. ANTHONY'S SISTER CITY OF 2 SALO, FINLAND. 3 Since Councilmember Marks is the official representative of the Sister City Program, 4 Mayor Ranallo requested he introduce Mr. Saarinen. 5 Councilmember Marks introduced Mr. and Mrs. Saarinen and their son Mike Saarinen 6 who will be an exchange student attending school in Woodbury. It was noted that their 7 daughter was unable to attend the meeting tonight. He reported that Arto Saarinen is the 8 President of the State Bank in Salo as well as the-President of the Salo, Finland City 9 Board which is comprised of 42 members and provides recommendations to their City 10 Council. 11 Mr. Saarinen stated that on behalf of Salo's City government, it is his pleasure to 12 represent Salo's residents and bring warm greetings to St. Anthony from Salo. He 13 explained that the Sister City relationship between Salo and St. Anthony started in 1985. 14 Mayor Ranallo read in full and presented to Mr. Saarinen a Proclamation declaring 15 August 9, 1994 as Salo, Finland Day. He also presented lapel pins to Mr. Saarinen and 16 his family. Mr. Saarinen presented Mayor Ranallo with a book regarding Salo which is • 17 printed in both English and Finnish as well as the Salo Crest.. Mayor Ranallo extended 18 his appreciation to Mr. Saarinen and introduced Barry Kinsey, Chairperson of the School 19 Board. Since the Salo crest is already on display at City Hall, the new Crest was given to 20 Mr. Kinsey so it can be displayed at the school. 21 Mr. Saarinen provided a detailed presentation regarding Salo, indicating it was 22 established in 1887 (belonging to Paris), became an independent community in 1887, and 23 a city in 1960. He reviewed population and employment figures and the type of 24 administrative system used by the Salo government. Mr. Saarinen explained that their 25 annual budget of$93 million is also used to fund the schools, hospitals, social services, 26 road and bridge construction. 27 Councilmember Marks reported that some,cities have developed an employee exchange 28 program with Sister Cities which can be beneficial in terms of finding new ideas and 29 methods. He commented on the challenges involved with international trade and the 30 benefits gained in becoming active with the Sister City Program. 31 Mayor Ranallo recognized and extended the City's appreciation to Don Singley, member 32 of.the St. Anthony Civic Orchestra,who is hosting the Saarinen family. He commented 33 on activities they have been involved in which included a tour of St. Anthony, trip to Ely, 34 Minnesota and the Mall of America. . . Schedule Meeting with Library Task Force, Mayor Ranallo commented 26 on the need to schedule a meeting with the Library Board. Due to budget 27 considerations, Fleming suggested a date before November. City Council Regular Meeting Minutes August 9, 1994 Page 4 1 Consensus was reached to schedule a joint meeting with the Library Board 2 on October 18, 1994, in Room 9 starting at 5:30 p.m. An alternate date of 3 October 24, 1994, was also agreed on. Ranallo stated he will contact the 4 Chair of the Library Board and report which date was selected at the 5 August 23, 1994, meeting. Fleming stated she will then notify the Task 6 Force. Council directed staff to post the required public notice. 7 2. St. Anthony VillageFest. Mayor Ranallo commented that the recently 8 held VillageFest Celebration was a huge success and announced he will be 9 holding a party for the volunteers on Friday,August 12, 1994. He 10 requested that staff post a public meeting notice since a majority of the 11 Council is expected to attend. 12 B. Council, 13 Councilmember Wagner reported on an Apache Merchants Association meeting 14 he attended at which Dennis Cavanaugh, C.G. Rein Company, indicated he was 15 optimistic regarding the CUB and Knox projects but unable to commit regarding 16 timetables until remaining paperwork is submitted. 17 Councilmember Wagner concurred with Mayor Ranallo that the VillageFest went 18 very well. He reported on the success of the Silent Auction and that 19 approximately 650 people attended the Kiwanis Pancake Breakfast. 20 Councilmember Flem ing announced the next St. Anthony Library Task Force 21 meeting is scheduled on Monday, August 22, 1994, at 6:30 p.m: 22 Councilmember Marks reported the St. Anthony Civic Orchestra will be hosting a 23 picnic at Dr. Gary Good's residence in honor of the visitors from Salo, Finland. 24 Councilmember Enrooth added his comments regarding the successful Silent 25 Auction. 26 C. Schedule Truth in Taxation Meetings City Manager Mornson offered 31 several meeting dates for the Truth in Taxation meeting. He noted that • 32 establishing a second meeting date is required. City Council Regular Meeting Minutes August 9, 1994 Page 5 1 Council consensus was reached to schedule the Truth in Taxation meeting 2 for Wednesday,November 30, 1994, with the second hearing on 3 December 14, 1994. It was also agreed to keep the November 22, 1994, 4 regular Council meeting-in case it is needed, but to reschedule the 5 December 13, 1994, meeting to December 14, 1994 (second hearing date). 6 3. Call to Order of September 13. 1994 Council Meeting. City Manager 7 Mornson pointed out that the regular meeting on September 13, 1994 is 8 also the primary election and will need to be called to order after polls 9 close (8:01 p.m.). 10 4. Reschedule September 6. 1994 Workshop City Manager Mornson 11 reported that the City Hall/Community Center report will not be 12 completed by September 6, 1994. Because of this, he suggested the 13 workshop be cancelled and rescheduled to later in September. During a 14 brief discussion, it became apparent that rescheduling will be difficult due 15 to Councilmember's schedules. Consensus was reached to cancel the 16 September 6, 1994, workshop and reschedule it to September 20, 1994, at 17 7 p.m. to discuss the Community Center update. Mayor Ranallo suggested that Council schedule a Town Meeting to receive resident's input on a date it following this workshop. 20 VIII. PUBLIC HEARING. 21 There were no public hearings. 22 IX. NEW BUSINESS. 23 A. Proposed Election Judges for State Primary Election(September 13, 1994). 24 Motion by Marks, second by Wagner to approve the election judges for State 25 Primary Election(September 13, 1994) as submitted by staff. 26 Motion carried unanimously. 27 B. Resolution 94-043, Re: Order Feasibility Report for 1995 Street and Watermain 28 Improvements. 29 Dave Ferguson, 3101 Bell Lane, explained that he owns the corner lot and is 30 concerned that this project may be too expensive. He questioned what his rights 31 are as a property owner. Mayor Ranallo suggested that Mr. Ferguson contact the City Manager to schedule a meeting to discuss the formula. The convenience store with fuel area is an allowed use in a "C" Commercial district. 2. The existing building will be removed and the fuel spills in the soil will be corrected according to MPCA standards. 3. Ground cleaning and tank removal will be done. Attached Documents 1. Certified survey with elevations. Drainage will be controlled by all new curbing to the storm sewer drainage. 2. Site plan showing the setbacks and the variances the owner is requesting. There are two variances for the structure, one on the south side yard setback of 7 feet and the other on the back yard setback of 13 feet. There are two variances requested for the canopy, one on the west end of 12 feet and one on the north end of 20 feet. Most stations rebuilt are having a problem with the 35 foot setback. They need to be able to put the canopy in to accommodate the customers. Two out of the four existing driveways will be closed. • - At the south end of the structure there is a trash enclosure to be of the same material as the principal structure. • Six parking stalls are required by ordinance and this plan meets the requirement. Signage The sign is a standard sign for the Stop 'N' Go businesses. The third test boring (TBV"3) should be advanced in the grassy area west-southwest of the pump islands, to define the magnitude of contamination within the soils of this area. 2). Field screen test boring samples with a flameionization detector and laboratory analyze one soil sample per boring for BETX, AL ME, and THGAS -parameters to document levels of petroleum contamination to soils. 3). Because there is evidence that groundwater is impacted, we will convert test boring (TB) #2 to a flush thread PVC screened monitoring well to define the extent and impact of contamination to the uppermost unconfined aquifer. Based on existing site information, it appears that this well should be completed near grade. • 4). Stabilize monitoring well and sample for levels of petroleum hydrocarbons and other volatiles as outlined by the MPCA. Collect water elevation (from this well plus other 5 on site) data on least two dates to plot groundwater samples per MPCA guidelines for Remedial Investigation: first round MDH 465D DRO, VOC's, MME, and dissolved lead. ' 5.) Complete well recovery rate (slug test) tests on at least two of the monitoring wells, and complete a sieve analysis on at least one soil sample representative of the aquifer soil to provide information for the consideration and possible design of a corrective action system. 6.) Conduct a health risk assessment which gathers information on known and potential impacts to public health and the environment, including an area well search and a utility conduit vapor survey. 7.) Prepare a limited report according to MPCA Remedial Investigation (RI) Report guidelines, including the section on proposed corrective actions. If conclusions indicate that "no action" or "continued monitoring" position is justified as corrective action, the RI report will be completed within this scope of service. Site #: LEAK00001118 Dear Mr. Olson; As per our discussion concerning your property located at the above mentioned location, I have completed the following scope of services: Reviewed the'MPCA working file for this site Reviewed past and current environmental site activities occurring on site - Reviewed past request by the MPCA for specific site activities to be completed Compiled information within these reports to verify current Petrofund reimbursement possibilities Recommend future activities that will complete site work and qualify property owner for partial reimbursement from'the state reimbursement fund On March 24th, 1994, E products Inc. reviewed the site file at the offices of the Minnesota Pollution Control Agency (MPCA). At this time, all pertinent coorespondance relating to the past activities at the Mico Oil site was copied and is attached (see Enclosure 1). Items of interest included the current MPCA attitude of the MPCA towards past site activities and references towards future activities that were required and not yet completed. As stated in the MPCA letter dated January 17, 1992, the MPCA requested additional work to be completed by Mico Oil Company. The MPCA staff had reviewed Nova's September 24, 1991 Corrective Action Design (CAD) and agrees with most of the conclusions recommended within the report. However, the MPCA staff would like some additional work completed and had listed their request very clearly. Yingling stated to me in a telephone conversation that she would appreciate the continuance of the project in a well planned and coordinated effort that would resolve issues presented by the MPCA. Please take note of the recommendation portion of Nis. Yingling's September 3, 1992, review,.stating,"CAD not approved, request additional Remedial Investigation". This statement is consistent,throughout the MPCA file. Complete the required work and the MPCA will partially approve the CAD issued Nova. My recommendation is to complete the following. Complete the most recent request stated by the MPCA. The tasked requested are not significant and will help this project to reach the final goal of reimbursement. Request that Nova or the following consultant to assemble all monitoring data for the past three years into one single report for implementation into an updated CAD. Because of the lapse of time the best recommendation Would be to organize the site and site activities. This would show the MPCA of your interest to work with them as a responsible property owner. Each of the above recommendations are only stating the obvious, the MPCA would like to see some progress and you will have to spend some money to adlieve these results. The best advice is to shop around for the best prices for the eventual work that will occur. The MPCA will most likely approve a CAD upon the-completion of the above scope of services. This approval will allow you to seek reimbursement for any funds spent in the past. A question of reimbursement that will still need to be asked is if the current property owner receives reimbursement from monies spent by the previous owner. Before an application is considered for rezoning any R/O District, a statement indicating the expected impact of the proposed development on the environment and public facilities including streets, schools and utilities, and an economic feasibility study of the development, are required. (c) Maintenance buildings for the storage of equipment used to maintain grounds, buildings, trees and equipment, to be located in such a way as to minimize the potential damage to the environment by the seepage or spillage of oil, gasoline, solvents or lubricants. This is especially true for the larger State and Federal elections. An Absentee Ballot Board is composed of election judges with an equal number of each party (a minimum of 2). These judges would work on the absentee process only and can be stationed at a precinct or at City Hall while accepting and rejecting ballots and listing the accepted ballot voters. Their duties would begin after the.last mail delivery on election days. Recording and counting the ballots would be done at the precincts after 8:00 P.M. on election days, however, time is saved in the judges not having to accept, reject and list the ballot envelopes election night. RECOMMENDATION Recommend Council adoption of the attached ordinance amendment to allow for an establishment of an Absentee Ballot Board. • • CITY OF ST. The secretary of state shall adopt rules establishing methods and procedures for issuing ballot cards and related absentee forms to be used as provided in section 203B.08, subdivision 1 a,and for the reconciliation of voters and ballot cards before tabulation under ' section 203B.12. History: 1983 c 253 s 7 203B.13 ABSENTEE BALLOT BOARDS. Subdivision 1. Establishment. The governing body of any municipality may by ordinance, or the school board of any school district may by resolution, authorize an absentee ballot board. The board shall consist of a sufficient number of election judges appointed as provided in sections 204B.19 to 204B.22. Subd. 2. Duties.The absentee ballot board may do any of the following: (a)Receive from each precinct in the municipality or school district all ballot envelopes marked "Accepted" by the election judges; provided that the governing body of a municipality or the school board of a school district may authorize the board to examine all return.absentee ballot envelopes and receive or reject absentee ballots in the manner provided in section 203B.12; (b)Open and count the absentee ballots,tabulating the vote in a manner that indicates . each vote of the absentee voter and the total absentee a vote cast for each candidate or question in each precinct;or (c)Report the vote totals tabulated for each precinct. Subd. 3. Compensation of members. The municipal clerk shall pay a reasonable compensation to each member of the absentee ballot board for services rendered during each election. Subd. 3a. Absentee voter list. If the election judges of an absentee ballot board are authorized to receive,examine,validate,and count absentee ballots,the county auditor or municipal clerk shall prepare a list of all persons who have applied for absentee ballots at the election and deliver it to the election judges of the absentee ballot board along with the applications for absentee ballots. The polling place rosters must include an indicator for all persons on the absentee voter list. The county auditor may provide a supplemental list for use by the election judges after the polling place rosters have been prepared. If a person on the absentee voter list appears in the polling place, the election judges shall notify the election judges of the absentee ballot board. When notified by the precinct election judges that the voter has voted in person, the election judges of the absentee ballot board shall make a notation on the absentee voter list that the voter has voted and no absentee ballot may be counted for that voter. t 203B-8 MINNESOTA ELECTION LAWS- 1991 Subd.4. Applicable laws.Except as otherwise provided by this section.all of the laws applicable to absentee ballots and absentee voters and all other provisions of the Minnesota election law shall apple to an absentee ballot board. Military service;temporary residence outside United States.Sections 203B.16 to 203B.27 provide alternative voting procedures for eligible voters who are absent from the precinct where they maintain residence because they are: (a) Either in the military or the spouses or dependents of individuals serving in the -- military;or 1 (b)Temporarily outside the territorial limits of the United States. Subd.2. Permanent residence outside United States. Sections 203B.16 to 203B.27 provide the exclusive voting procedure for United States citizens who are living permanent- ly outside the territorial limits of the United States who meet all the qualifications of an eligible voter except residence in Minnesota,but who are authorized by federal law to vote in Minnesota because they maintained residence in Minnesota for at least 20 days imme- diately prior to their departure from the United States. Individuals described in this subdivision shall be permitted to vote only for the offices of president, vice-president, senator in Congress,and representative in Congress.
