1. 3111 Silver Lake Road
Larry Beach plans to start construction of a house is June.
2. 2nd Vacant Lot by Coolidge
The Stafford's, who purchased the property from the City in February, plan on
building a house over the summer.
3. Roger Bona Gas Station
He plans to demolish building on Kenzie and construct repair garage. He wanted to
know if City would assist with a berm.
4. American Monarch
Have deposited check for $5,000 with the City. A tentative developer's agreement to
be approved on June 27th for $125,000 in assistance in return for keeping value at
$1.2 million and 67 jobs.
5. Nedegaard Twin Homes
Have deposited check for $5,000 with the City. A tentative developer's agreement to
be approved June 27th for $150,000 in assistance for $1.5 million in value increase
and $30,000-$35,000 in taxes.
6. MAKO/Olson Property
Have deposited check for $5,000 with the City. A tentative developer's agreement to
be approved on June 27th for $240,000 in assistance for a $2.4 million increase in
value and $40,000-$45,000 in taxes.
7. Bowling Alley
A check for $5,000 has been deposited with the City. A tentative developer's
agreement.will be considered June 27th for assistance in return for an approximate
$600,000 increase in value plus $14,000 in taxes. City's offer is for $60,000 in
assistance. The developer is asking for $125,000. A decision by the H.R.A. needs to
be made on the amount.
8. TIF Hearing
The hearing is scheduled for June 27th so the City will have the ability to fund 4, 5,
6, and 7 above plus possible other projects.
9. Apache Plaza
Held meeting with Mary Rothchild from First Bank today (May 23rd) to review issues
regarding Apache.

Re: Request for Tax Increment Financing TIF
Technical /Vocational Facility

Dear Mr. Momson:
By this letter and supporting documentation, Joan Crawford-Dietsch and myself John F. Dietsch as
individuals, are requesting assistance from the City of St. Anthony in the form of tax increment financing.
Said tax increment financing would be used to enable us to acquire, up-grade and renovate the property
and building presently known as the St. Anthony Bowling Center, 2654 Kenzie Terrace, for use as a
technical /vocational facility.
This facility would be leased long term to the Minneapolis School o'f Massage and Bodywork, Inc. a
technical/vocational institute specializing in somatic education and Federally approved as a 501 c3
corporation
The proposed redevelopment project is as follows.
Location and legal description:
Address: 2654 Kenzie Terrace
St. Anthony, Mn.
Legal Description: That part of lot 2, lying northwesterly of a line, said line described as follows:
Commencing at the northeast comer of said lot 2; thence southwesterly and drawn
parallel to the northwesterly line of said lot 2 to a point of intersection with the
southwesterly line of lot 2, and there terminating, all in block 2, "St. Anthony
Village Commercial Center Addition No. I", together with that part of the
northeasterly half of Sunset Avenue*Vacated lying northwesterly of the extension
southwesterly of the southeasterly line of the above described tract and lying
southeasterly of the east line of Harding St.; Together with and easement for
parking purposes over that part of lot 2 laying southeasterly of a line commencing
at the-northeast comer of lot 2, and drawn southwesterly and parallel to the
northwesterly line of said lot 2 to a point of intersection with southwesterly line of
said lot 2 in block 2, St. Anthony Village Commercial Center Addition Number
One, Hennepin County, Minnesota.
Scope of Project:
The scope of this project involves the purchase of the property located at 2654 Kenzie Terrace
including the existing building and redeveloping said property for use as a technical /vocational
institute of somatic education. Said project to include the following:
Exterior:
1. Resurfacing of existing blacktop area of parking lot with stall markings.
2. Installation of blacktop surface on dirt area of parking lot with stall markings.
3. Removal of all sign posts.
4. Removal of all parking area lighting directed away from the building.
5. Installation of perimeter parking area lighting directed towards the building thus
eliminating illumination of adjoining property.
6. Removal of existing blacktop surface located between the building and the public
sidewalk on Kenzie Terrace eliminating all motor traffic between the front
entrance to the upper level and the public sidewalk.
7. Removal of existing stairs and canopy located at the main entrance to the upper
level of the building. -
8. Back fill-and installation of handicap access ramp extending from the main
entrance of the upper level to the parking area.
9. Installation of new canopy designed to blend with the surrounding environment.
10. Installation of rock garden, low ground cover shrubs and 18" hedging between the
building and the public sidewalk on Kenzie Terrace.
11. Installation of screening along the south side of the parking area to eliminate the
headlights of cars from illuminating adjoining apartments. May include a limited
number of trees along the property line for shade.'
12. Installation of private garden picnic area at northeast corner of the building to
include privacy fencing for the use of all staff members and students. This area
would not be visible from outside the area.
13. Installation of an enclosed trash area.
14. Removal of all loose paint from exterior of the building and repaint either a light
gray or beige to better blend in with the surrounding environment.
15. Installation of new more modern signs in accordance with local'codes.
16. Removal of unsightly mounds of dirt and trees in rear of the parking area and
replace with new trees where feasible.

1. Removal of all interior walls, ceilings, bathroom fixtures, bowling lanes, counters,
carpeting,,light fixtures, heating and air conditioners, and etc.

Request for Tax Increment Financing:
1. Type of District: We are requesting that the City include the property located at 2654
Kenzie Terrace within its Tax Increment Financing Redevelopment District. The property
in question has been vacant for approximately three years and its condition has been
allowed to deteriorate to the point that the value of the property has decreased. The
condition of this property has become the topic of discussion for many residents and
business' in the area. The cost of up-grade and improvement of the exterior of the building
and land has now increased to the point that any further"deterioration would become cost
prohibitive based on added value to the property.
2. Amount requested: We are submitting a request that the City of St. Anthony provide
$125,000.00 of assistance to this project in the form of tax increment financing. It is
estimated that the exterior-improvements to the building and property will have more than
a monetary effect on the area, and in fact will enhance the entire environmental condition
of this location.
3. Method of Tax Increment Financing: We are requesting that the City of St. Anthony use
the method of one up front payment.
4. Tax Increment.Financing Anal A tax increment analysis has been ordered but is
unavailable at the time of this request. The analysis will be furnished as soon as it becomes ,
available.
Escrow Deposit:
Accompanying this request for tax increment financing is a check in the amount of$5,000.00 to
'.J be use as escrow deposit. It is our understanding that the escrow is to be used to cover the City.of
St. Anthony's costs for legal and fiscal help as needed and any monies not used will be refunded.
Developers Agreement:
A signed copy of the Developers agreement may be found in section 4.
Conclusion:
After evaluation the only conclusion that can be reached is that the property located at 2654
Kenzie Terrace is in need of redevelopment and to once again become a supporting member of
the City of St. Anthony. It is in our opinion that this property left idol would become a liability
on the City. By reaching an agreement on tax increment financing we will not only be able to
improve the environmental condition of the area but will be bringing a fast growing educational
facility to the area increasing the job opportunities and adding support to the other business in the
area.
Joan and I are anxious to begin this venture and look forward to a long and prosperous
relationship between us and the City of St. Anthony.

Dear Mike: -
I am writing to respond to your letter dated May 9, 1995 with an enclosure from Jerry Gilligan
on how the Tax Increment Financing("TIP) should be structured on the above-referenced
project.
1. Timing of Payment of Assistance. The underlying reason for the TIF assistance request
is the result of the exorbitantly high land cost of this property relative to what the City and the
neighborhood what to see developed on this site. ARNOLD Development is requesting
"upfront" TIF assistance to provide a "write-down" of the land cost for this type of development.
Owner-occupied townhouse development of this nature and market can only be feasible on
undeveloped land of approximately$5,000 - $7,500 per unit. That means that a development of
the nature acceptable to the City and the neighborhood can support a land cost of approximately
$100,000. Therefore, I am requesting the City participate and "write-down" the cost of the
property to an acceptable level to accommodate this type of development. It is not feasible for
me to provide a letter of credit for the amount of assistance on the land cost due to the fact that I
cannot support a higher land cost with an appraisal. Additionally, I am not asking for help to
complete improvements and therefore should not be bound be a financial requirement released
upon any improvement completion.

2. Indemnity of HRA and City. I have no problem with the indemnity and hold harmless
provisions proposed by Mr. Gilligan. I will require the same type of indemnity from the seller.
Please let me know your thoughts on the TIF assistance. If I am required to provide a letter of
credit the project becomes economically enviable for me.

The City has H.R.A. Project Funds that could pay for some of these projects. A resolution will be
prepared for consideration at the April 25th meeting. The Planning Commission will review this at
their May 16th Planning Commission meeting.. Both Counties and the School District will be notified
of the hearing on or about May 27th. The City Council and H.R.A. will hold the hearing and adopt
the amendment on June 27th. This will provide the City with a plan in place to provide assistance to
redeveloping various properties.

22 Fleming reported the library book sale is being held on Saturday, May 13, 1995.
23 Marks reported the Sister City Committee met and has determined an alternative place for
24 the Mayor/Manager of Salo to stay when he visits in August. There was Council
25 consensus for the Councilmembers to meet with Mr. Lindquist, Salo Finland,prior to the
26 work session on August 1, 1995.
27 Enrooth thanked the newspapers for their coverage on the St. Anthony city clean-up.

29 1. Fire Department's 1994 Annual Report,
30 Fire Chief Richard Johnson presented the Fire Department's 1994 Annual Report. He
31 indicated the City will need to acquire a new fire engine within the next three to five
32 years. Johnson explained a new fire truck will cost approximately $200,000.00 and will •
33 last 20 to 25 years. He stated the three fire engines the Fire Department currently have
34 are a 1985, 1975, and 1972 models. He referred to the amount of mutual aid fire calls for
35 1994. During the year of 1994, the Fire Department responded to four major house fires,
36 an apartment building fire, a row of townhomes on fire, and two major gasoline fires in
37 neighboring communities. Johnson reported the Roseville Fire Department had donated

•1 600 feet of 4" supply hose to St. Anthony and the mutual aid calls are a benefit as they
2 provide for a larger budget and sharing of training aids. Johnson reported that arson is
3 becoming almost an epidemic in the State and a lot of it is being committed by children.
4 He indicated the Juvenile Fire Setters Program in St. Anthony, which was implemented in
5 1980, has been very effective to curb the amount of arson by children in the community.
6 Ranallo stated he liked the amount of schooling and seminars the members of the Fire
7 Department attend. The Council commended the Fire Department for their good work
8 and efforts and indicated they had received favorable comments on their response time.
9 2. Ciiy's 1994 Financial Statement,
10 City Manager Morrison referred to the audit packet. He advised the Councilmembers to
11 review the information and indicated Stuart Boniwell will be present at a future Council
12 meeting to discuss the report.
13 3. Consideration of a Resolution(95-033) and Letter of Support for Reallocation of
14 CDBG Funds for Northwest Youth and Family Services,
15 Morrison reported of Management Assistant Kim Moore-Sykes attendance at a meeting
16 last week with Ramsey County and Northwest Youth and Family Services (NWYFS).
17 He reported that Ramsey County CDBG funding did not allocate as many funds to
49 8 NWYFS as they were expecting,to be used for the proposed building. In order for some
of the contingency funds to be redirected, the cities need to draft letters or resolutions
20 stating they support this action and would act to reallocate funding to NWYFS. He
21 indicated these are.due by today, May 9, 1995. He stated half the cities did not attend the
22 meeting. He reported approximately 50% of the cities were in support of this reallocation
23 of funds.
24 Motion by Marks, second by Fleming to adopt Resolution 95-033, relating to Northwest
25 Youth and Family Services to reallocate Ramsey County Community Development
26 Block Grant Funds.

28 4. Consider Contract with the State of Minnesota. Department of Administration
29 Buildinia Codes and Standards Division,
30 Morrison explained that by law,the State of Minnesota has to be the building inspector
31 for the school unless the City has a qualified building inspector. He indicated St.
32 Anthony does have a qualified building inspector and this contract will allow him to do
33 the inspections.
34 Motion by Marks, second by Enrooth to approve the Contractual Agreement between the
City of St. Anthony and the State of Minnesota, Department of Administration Building
Codes and Standards Division.

ITEM: LEAGUE OF MN CITIES INSURANCE RENEWAL
Mr. Mark Flaten of American Risk Services will be present at the May 23, 1995, Council
Meeting to discuss and finalize insurance coverage for June 1, 1995 - May 31, 1996.
The attached information includes price quotations for property, auto, general liability, workers'
compensation and liquor liability. The cost for maintaining our present coverage of $10,000
deductible and $50,000 aggregate totals $240,53 7.
This amount represents an decrease in premiums of ($13,153) which is primarily due to a
decrease in St. Anthony's workers comp modification (111 - 1.23) and Off-Sale liability
dropped from $.57'per $100 of receipts to $.52.
Again this year, the lowest premium for On-Sale and Off-Sale liability coverage occurs by
splitting the coverage between two company's (Transcontinental & Britamco Underwriters).
As in previous years, no other insurance companies choose to compete with the League of
Minnesota Insurance Trust. A former liquor liability carrier (Park Glen) did bid on the Off-Sale
liability coverage. Park Glen's quote was equal to Transcontinental's, however, based on a
comparison of the two organizations, there is no incentive to change.
Workers' compensation costs continue to be a concern for Minnesota businesses. To offset the
increases in 1994, St. Anthony adopted the following workers compensation options:
A. Managed Care Plan where employees who are injured on the
job are assigned to a specific clinic for rehabilitation of
their injury. This results in a 5% reduction in workers' comp
premiums.
B. $500 deductible per claim for medical costs only. This
results in a 4% reduction in premiums.
• Last year the savings in premium for the $500 deductible totaled $5,702 compared to actual
medical costs of $1,846.43 for a net gain of $3,855.57.
• Last years coverage is primarily duplicated with the exception of the addition of the Pe:
Option. This protection covers costs for contamination caused by underground storaet
It is recommended this be added because of the age of the City's underground gas tank=s,
must be removed by 1998).
Recommendation:
Staff recommends approval of the following insurance coverage for the upcoming year:
1) Council accept the League of Minnesota Cities insurance proposal
for property, auto, and general liability .which includes a $10,000
Deductible Per Occurrence/$50,000 Aggregate totaling $77,255.
2) Council approve workers' compensation coverage totaling $96,342 which
includes an employee Manage Care Plan and a $500 per claim medical
deductible.
3) Council approve Transcontinental as the City's Off-Sale liquor
liability carrier at a cost of $14,601.
• 4) Council approve Britamco Underwriters as the City's On-Sale liquor
liability carrier at a cost of $51,016.
5) Council approve adding coverage for the City's underground gas tanks at
a cost of $1,323.

BACKGROUND
Nedegaard Construction Company, Inc. has submitted a petition for rezoning of a parcel
of land known heretofore as Mounds View Acres, Second Addition from an R-1, Single
Family District to R-2, Two Family District. Mr. Bruce Nedegaard, owner of Nedegaard
Construction, Inc. has acquired the back portion of 4001 Fordham Drive, and the vacant
lots behind 3929 Fordham Drive, 3921 Fordham Drive and a portion of the vacant lot
• behind 3917 Fordham Drive in order construct a proposed twin homes project that will be
southwest of the Evergreen Townhomes. Mr. Nedegaard is requesting that this
aforementioned parcel be rezoned to R-2 so as to accommodate the construction of this
' twin home project.
The R-2 zoning district requires that each proposed lot for a twin home building be at
minimum 12,000 square feet. Mr. Nedegaard has a total of 165,257 square feet for the
project and this parcel will more than adequately provide the square footage he needs to
build six twin home buildings.
DEVELOPMENTAL ANALYSIS
By allowing the rezoning of this parcel of land, Mr. Nedegaard's project will benefit the
City in a number of ways. Rezoning this area will allow development of these vacant lots;
the proposed project will increase the tax base of the City; and will provide alternate living
options for those people who no longer want to live in a single family residence or for
those who are first time home buyers.
RECOMMENDATION
Staff recommends the approval of the rezoning of this R-1 zoned parcel to an R-2 zoned
parcel. Rezoning of this parcel to allow for the construction of the twin home project is
an appropriate use for this land.

Dear Kim:
I am writing for the purpose of supporting our request to rezone
the subject property from R-1 to R-2.
As you know, our proposal for this site is to construct six
twinhome buildings for a total of , twelve individual living
units. We believe this is appropriate for the -following
reasons:
1. The property to the north is a townhome development
with an overall density of approximately seven units
per acre,
2. The property to the east is a railroad line,
3. This property is triangular shaped and due to the
shape it would be difficult to efficiently design
single family residential lots,
4. Due to the cost of correcting the soils on the site
even with tax increment financing assistance, a higher
density is necessary in order to make this site
economically viable, and
S. Again, due to the site location it would be very
difficult to design a public roadway system to serve
in an R-1 district. By making this R-21 the roadway
system can be owned by the association which creates
greater flexibility in.the design of this road system.

BACKGROUND
Nedegaard Construction Company, Inc. has submitted a petition for subdivision of
property known heretofore as Mounds View Acres, Second Addition into three (3) parcels

Drive and will have that street addresses. The third parcel will be used to construct the
proposed twin homes project.

BACKGROUND
Arnold Development has submitted a petition for rezoning of 2938 Old Highway 8, 3004
Old Highway 8 and 2926/2930 Old Highway 8 to an R-4 zoning district. These properties
were originally known as the Mako Inc./Olson properties and the residential structures
were converted to rental units or built as rental units before the area was zoned.
Mr. Arnold Gregory, Arnold Development, approached the City with a development plan
for the area, whereby he would purchase the properties, demolish the existing structures,
combine the three parcels and construct 18 owner-occupied townhomes on the site. It is
anticipated that these townhomes will sell for approximately $135,000 to $150,000.
Mr. Gregory's original site plan was developed for an R-4 zoning because it was
determined to be more appropriate considering the triangular configuration and the sloping
topography of the properties. He developed a townhouse plan that had four 4-unit
buildings and one 2-unit building to be sited on the narrower portion of the property.
Rezoning at R-3 would not allow for a building with less than three units.
Since submitting his rezoning application, there was concern voiced by the neighbors
regarding rezoning the property to an R-4. Many of these neighbors felt that if this
property is zoned R-4, and the project feel through, that an R-4 designation would allow
for the building of apartment buildings. Mr. Gregory and City staff have suggested that
because this is a prime piece of real estate property, it would be too expensive to develop
into an apartment complex. Should an apartment be proposed for this site, the proposed
complex would have to have up to 68 apartment units and at minimum six floors to make
the project economically viable. This project would not be approved by the City because
it exceeds the height limit of three stories.
Despite this argument and out of consideration of the neighbors, Mr. Gregory is requesting
that the Planning Commission consider approving an R-3 designation rather than the
original request to rezone the property-to an R-4. The City Attorney has indicated to
City staff that a petitioner can revise a zoning request to a lower zoning level during the
public hearing but can not go up to a higher zoning level. Changing a request to a higher
zoning level would require another public hearing. •
Approving the rezoning of this parcel of land for this project is appropriate for the
following reasons:
* Rezoning will allow for the redevelopment of these aging rental properties;
Given the triangular configuration and the sloping topography, it will be too
expensive to build single family homes on this property. In addition, an R-1
zoning is inappropriate because the property is directly across from industrial
and commercial properties. This was an issue for the Mako, Inc. and Olson
when they considered redeveloping this parcel last year.
* The proposed townhouse project conforms to the concept of future land use
for this area as seen on the land use map in the City's Comprehensive Plan.
The map suggests that office buildings or townhouses are appropriate uses for
this property.
Townhouses will provide alternate living options for those people who do
not want to live in a single family residence or who are looking for smaller
homes. '
* This project will certainly protect or increase the property values of the
surrounding homes. '
With minor adjustments to the site plan and plat map, Mr. Gregory's project meets all the
height, area, density, front- and side-yard setbacks and parking requirements. He will
require a variance for backyard setbacks, which will be addressed in a later public hearing.
He is also petitioning the City for TIF assistance to defray demolition costs that estimated
to be $30,000.
RECOMMENDATION
After reviewing the developer's revisions to this project, the Staff recommends the approval
of the rezoning of this R-2 property to R-3, allowing for the construction of owner-
occupied townhomes. Rezoning of this area to allow for the construction of this project
appears to be an appropriate and best use for this land.

BACKGROUND
Arnold Development originally submitted a petition for fronryard and backyard variances
for the The Arbors townhome development. This property was originally 2938 Old
Highway 8, 3004 Old Highway 8 and 2926/2930 Old Highway 8 and were known as the
Mako Inc./Olson properties. Mr. Arnold Gregory, owner of Arnold Development,
approached the City with a development plan for the area, whereby he would purchase the
properties, demolish the existing structures; combine the three parcels and construct 18
owner-occupied townhomes on the site.
He is P urchasing these three parcels and is proposing to build two 3-unit buildings and
three 4-unit buildings. Because of the City's zoning ordinance, Mr. Gregory is required to
rezone this parcel to R-3 in order to proceed with his redevelopment plans. The property
is 74,250 square feet and will allow for the construction of five townhome buildings.
On the original plat submitted initially, the variance request was for a frontyard variance as
well. Due to the reconfiguration as the result of a change in the rezoning request, Mr.
Gregory and his architect, Mr. Mazzara were able to eliminate the need for the frontyard
variance for this project. The project meets all of the frontyard and sideyard setbacks, .
parking requirments, density and area/width requirements.
Mr Gregory is requesting that he be granted a 10 foot variance to the backyard setback of
the townhome development. Under the R-3 zoning ordinance he needs a 30 foot backyard
setback. Due to the shape and the topographical conditions of the parcel, he is unable to
attain the backyard setback requirement. This 10 foot variance is required for Lots 1
through 8. The request for backyard variances range from an 10 foot variance for Lots 1,
2, 5 and 6 to a 2 foot variance for Lots 7 and 8.
RECOMMENDATION
Staff recommends the approval of the backyard variance request.
Approving the backyard variance for this project is appropriate for the following reasons:
* In order to construct this project, Air. Gregory needs the backyard setback
variances because of the unusual configuration and the sloping topography.
He is trying to configure the site plan.to best utilize the entire site and at the
same time make the proposed townhome development as desirable for the
neighborhood and as self-contained as possible.
* The proposed townhouse project conforms to the concept of future land use
for this area as seen on the land use map in the City's Comprehensive Plan.
The map suggests that office buildings or townhouses are appropriate uses for
this property.
* The variances are also required to make the best economic use of the
property and a certain number of units are needed to make the parcel
feasible for development.

best utilize the entire site and at the same time make the proposed development self-containing.
Initially, we attempted to avoid the setback requests and use the existing alley to the north for a
secondary ingress and egress location. It was extremely cumbersome and the alley width made it
virtually impossible for passing vehicles. The proposed variance makes the proposed
development self-containing and much more desirable for the'surrounding neighborhood.
3. The proposed variance is caused by the fad that to make economic use ofthe parcel a
certain number of units need to be attainable to make the parcel feasible for development.

RELATING TO LOT COVERAGE
BACKGROUND
Staff was asked to research the possibility of increasing lot coverage for R-1, R-1A, and R-2
zoning districts. In contacting Fridley, Arden Hills, Little Canada, Mounds View and New
Brighton, Staff has found that St. Anthony's requirement of 30% lot coverage, which
includes driveways and sidewalks, is restrictive in comparison. Lot coverages ranged from
25% for buildings only in Fridley to 40%, including driveways, in New Brighton. Most of
the cities contacted had 35% lot coverage for their comparable residentially zoned districts.
RECOMMENDATION
Staff recommends that lot coverage be increased from 30% to 35%. Lot coverage will
continue to include driveways and sidewalks. This increase will allow more of the lot to
be built while at 35%, the residential lots will retain most of its impervious surfaces for
run-off.

ITEM: Ordinance to Regulate Adult Use and Sexually Oriented
Businesses
BACKGROUND
In October, 1994, the City Council discussed the possibility of amending the City's Code
of Ordinances to include an adult use ordinance in the event that someone may be
interested in locating such a business in St. Anthony. The courts have ruled that an
owner of this type of business is protected under the First Amendment and that to
severely restrict or prevent this business in a community, is clearly in violation of the U.S.
Constitution. Where local governments have been sued because they prohibited or
severely restricted an adult use business, the Courts have decided in favor of the owner of
an adult use or sexually oriented business allowing them to collect lost profits and/or
judgement awards. (Such was the case for the City of Ramsey in a recent decision by the
Courts.) They have also said that a local government can regulate adult use and sexually
oriented businesses through zoning, but not to the point where it would be impossible to
do business. They can be allowed in certain zoning districts, regulated hours of operation
and not within the proximity of a school, library, day care center, residential areas, liquor
stores, etc.
Since the Courts have indicated to local governments that they can only regulate, not
restrict, adult use/sexually oriented businesses. The City Council, the City Manager, Staff
and the City Attorney have been working to draft an amendment to the Zoning
Ordinance that will regulate these businesses, which can be done through the following
mechanisms:
1. Zoning Regulations. Zoning restrictions will only be upheld if the intent is
to control secondary adverse effects on the surrounding community.
Secondary adverse effects that have stood up to legal challenges have been:
a. loss in private and commercial property values;
b. increased criminal activity; and
C. threats to public safety and health.
2. The Courts have ruled that local governments can adopt ordinances that are:
a. content neutral in time, place and manner;
b. serving substantial governmental interest (in other words,
the local government must have a legitimate concern/reason
for spotlighting this issue — control secondary adverse effects);
C. and not unreasonable in limiting alternative aN*eru
communication.
The City Attorney sent information about the study that Edina did to draft and an
ordinance that Was both within the perimeters established by the Courts and at 0. 1!
time, would protect their communic�• from the secondary adverse effects of adult 4.
sexually oriented businesses. They formed a study group and the following is the r:

The City of Ramsey was forced to deal with this issue as the result of a legal challenge to
their issuance of a moratorium on sexually oriented business. The courts determined that
the City's placing a moratorium violated the constitutional rights of the owner of a
sexually oriented because the moratorium limited his freedom of speech. The City of
Ramsey was required to pay back lost income to the business owner.
They retained a consultant at that point to help draft an di buseiness anould protect
community from the secondary adverse effects of an adul
business in question to operate in a regulated manner. The following suggests were
reported to the City Council:
1. Establish a commercial zoning district for adult use/sexually oriented
businesses.
2. Adult use/sexually oriented businesses should be separated from:
a. residential zoned districts
b. schools
c. daycare centers
d. libraries
e. parks/recreational areas
f. on-sale liquor businesses
9- churches
h. other adult use/sexually oriented businesses
The recommended distance was at least 750 feet. The City Council ultimately
adopted a distance of 1000 feet.
3. The ordinance adopted restricts adult use/sexually oriented business to one
"product" per location. For example, one store can only stock
books/magazines. Another can only have as-inventory videos/movies.
The attached is a copy of the proposed draft of the ordinance that would amend Chapter
16 of St. Anthony's 1993 Code of Ordinances. It establishes that only the commercial
zoning district will be available for the location of adult use and sexually oriented
_ businesses and these kinds of businesses can not be closer than 400 feet to residential zoned
areas, schools, daycare centers, libraries, parks/recreational areas, churches, on•sa;c, r
businesses, or other adult use or sexually oriented businesses.
RECOMMENDATION
Staff recommends that the Planning Commission reeordinan a to amen-.-
.due consideration, recommend approval of the proposed adult use
Chapter 16, Section 1605.01, Subd. 4 and subsection 1635.03(a) of the St. Anthony 1993
Code of Ordinance.

The City received a proposal (see attached) from Braun Intertec for the upgrade of the City's
infrastructure software. Following is a summary of the proposal.
Task 1, Setup ICON Software $510
Braun will setup an ICON software module which will provide empty data bases for all data.
Braun will also convert only the street database with the corresponding from and to information
• in the block database.
Task 2, Installation of ICON Software on City Computer $255
Braun will install the software on a City computer after they have tested it.
Task 3, System Training 2 days total at $75/hour $1,200
Braun will instruct City staff on survey methodology, data entry, modification and retrieval on
site. After all data is entered, a day of instruction for data analysis on the City's infrastructure
will be provided.
Task 4, Mapping
I do not feel the City has an immediate need for computerized mapping at this time. The
mapping program can be added at a later date, if desired.

RE: Cost Estimate for upgrading the City's Pavement Management Program, (PMP) to the new
version of the software-Infrastructure CONsultant, (ICON).
Dear Mr. Hammer:
Pursuant to our telephone conversations, Braun Intertec is pleased to submit the following cost
estimate for updating your pavement management program and provide training to the City of St.
Anthony's staff. Our proposed scope of services includes the following:
PROPOSED SCOPE OF SERVICES
Task 1, Setup ICON software
Braun Intertec will setup a ICON software module for the City. This can be provided in varying
options. The City's existing data is currently stored in the 11 PMP files. This data consists of many
different type of data. The first option is to provide empty databases for all data. City staff will then
need to create the City's network before any other type of data can be entered. The second option is
for Braun to convert only the street database with die corresponding from and to information in the
block database. This would save the staff data entry time allowing St. Anthony staff to start
immediate data entry with the City's collected data. A third option would be to convert more of the
old collected data for comparison to newly collected data'providing historical trends.
Task 2, Insiallation of ICON Software on City Computer
After the City of St. Andiony's ICON software is tested by Braun Intertec staff, we will install the
software on the City's computer for city data entry.
The new software operates in the Windows operating environment. Both ICON's database and
executable will be loaded on one PC or a LAN network designated by-City staff.

Task 3, System Training (Optional)
Training generally consists of two phases. The first phase of training provides instruction on survey
methodology, data entry, modification and retrieval. This training consists of two days of instruction.
At least one day is recommended. The second phase of training would consist of two days of
instruction in data analysis, budget planning, report preparation and system upkeep. The first phase
of training would be conducted at the City of St. Anthony on the City's hardware in conjunction with
installation. The amount of training can be altered to a minimum of two days. The second phase of
training can not proceed until all required data is entered into the software since the budget module
relies on certain information to be entered for each section.
Task 4, Mapping (Optional)
Automated mapping can be incorporated directly into the ICON system. The mapping provides many
advantages for the pavement management and presentation of the City data. The city can provide a
suitable automated map in DXF format for inclusion into the system as one option. Braun Intertec
could prepare a map for the City as another option.
The project team will load the mapping files of all the infrastructure networks in to a single reference
map of the City. This map is then linked with the inventory and condition survey data collected in
earlier phases to allow interactive data retrieval and reporting capabilities in the pavement management
system.
ICON has an internal map graphics engine that can display the information contained in the system.
The ICON data are also compatible with CAD or GIS programs, provided the CAD or GIS contain a
coordinate or segment identifications for each street block or segment. Some CAD software have this
capability such as Intergraph's MGE and AutoDesk's AutoCAD version 12. The ICON street
segment must be.identified by the same coordinates or segment identification codes. The data files
within ICON contain fields to provide such a link.
The link allows maps to be generated that will highlight, color code, or identify in some manner
streets that have a specific attribute. Maps could then be generated that identify the streets that fall
into each maintenance categories identified by the City for many other applications. Many
applications can be identified that deal with specific pavement related attributes. These text files are
loaded into GIS using their file transfer capabilities. Once a cross reference file is built which allows
the mapping database to know which block of street goes with the data in the database, mapping is
done.
Maintenance Agreement (Optional)
Standard upgrades or changes to the ICON program to accommodate new files, reports etc. will be
supplied annually at no additional charge provided that the City purchases a Maintenance Agreement.
The cost of the Maintenance Agreement is $750 per year for each user. We will keep the City abreast
of any new enhancements that are scheduled for the maintenance year.

F. EWATED SCHMULE
We have outlined the project so that all services are completed within one month to three months
depending on the tasks selected.
Services provided to the City such as meetings, reviews and training attendance are included in the
schedule.

The City Council of the City of St. Anthony hereby ordains:
. Section 1. 'Section 1-605.01, Subdivision 4 of the City Code is amended to
read in full as follows:
Subd. 4. Adult Uses. The following uses will be deemed adult uses and will
have the following definitions:
(a) Adult Body Paintin S� tudio. An establishment or business which.
provides the service of applying paint or other substance, whether
transparent or nontransparent, to or on the body of a patron when such
• body is wholly or partially nude in terms of specified anatomical areas.
(b) Adult Bookstore. An establishment or business which barters, rents or
sells items consisting of printed matter, pictures, slides, records, audio
tape, videotape, or motion picture film and either alone or when
combined with adult motion picture rental or sales and adult novelty
sales within the same business premises has either 10 percent or more
of its stock in trade or 10 percent or more of its floor area containing
items which are distinguished or characterized by an emphasis on the
depiction or description of specified sexual activities or specified
anatomical areas.
(c) Adult Cabaret. An establishment or business which provides dancing
or other live entertainment, if such dancing or other live
entertainment is distinguished or characterized by an emphasis on the
presentation, display, depiction or description of specified sexual
activities or specified anatomical areas.
(d) Adult Companionship Establishment. An establishment or business
which provides the service of engaging in or listening to conversation,
talk or discussion between an employee of the establishment and a
customer, if such service is distinguished or characterized by an
emphasis on specified sexual activities or specified anatomical areas.
(e) Adult Conver�at�o^ rZap Parlor. An establishment or business which
provides the ser�•ice of engaging in or listening

specifically excluded from patronage and wherein material is presented
which is distinguished or characterized by an emphasis on matter
depicting, describing or relating to specified sexual activities or specified
anatomical areas.
(h) Adult Mini-Motion Picture Theater. A building or portion of a
building with a capacity for less than 50 persons used for presenting
material distinguished or characterized by an emphasis on specified
sexual activities or specified anatomical areas for observation by
• patrons therein.
(i) Adult Modeling Studio. An establishment or business which provides
to customers, figure models who engage in specified sexual activities or
display specified anatomical areas while being observed, painted,
painted upon, sketched, drawn, sculptured, phoEographed, or otherwise
depicted by such customers..
' (j) Adult Motion Picture Arcade. Any place to which the public is
permitted or invited wherein coin or slug-operated or electronically,
electrically or mechanically controlled or operated still or motion
picture machines, projectors or other image-producing devices are
maintained to show images to five or fewer persons per machine at
any one time, and where the images so displayed are distinguished or
characterized by an emphasis on depicting or describing specified sexual
activities or specified anatomical areas.
(k) Adult Motion Picture Rental or Sales. An establishment or business
which barters, rents or sells videotapes or motion picture film and
either alone or when combined with adult bookstore or adult novelty
sales within the same business premises has either 10 percent or more
of its stock in trade or 10 percent or more of its floor area containing
items which are distinguished or characterized by an emphasis on the

activities or specified anatomical areas.
: Section 2. Section 1605.01 of the City Code is hereby amended to add the
following new subdivisions:
Subd. 87. Sexually—Oriented Businesses. Adult bookstores, adult motion
picture theaters, adult motion picture rental, adult mini-motion picture
theaters, adult steam room/bathhouse/sauna facilities, adult companionship
establishments, adult rap/conversation parlors, adult health/sport clubs,
adult cabarets, adult novelty businesses, adult motion picture arcades, adult
• modeling studios, adult hotels/motels, and adult body painting studios as
defined in Section 1605.01, Subdivision 4. In addition, all other premises,
enterprises, establishments, businesses or places at or in which there is an
emphasis on the presentation, display, depiction or description of specified
sexual activity or specified anatomical areas which are capable of being seen by
members of the public. The term "sexually—oriented businesses" shall not be
construed to include, (i) schools or professional offices of licensed physicians,
chiropractors, psychologists, physical therapists, teachers or similar licensed
professionals performing functions authorized under the licenses held,
(iii) establishments or businesses operated by or employing licensed
cosmetologists or barbers performing functions authorized under licenses
held, or (iii) the sale of clothing.

Section 3. Chapter 16 of the City Code is hereby amended to add a new -
Section 1670 to read as follows:
SECTION 1670.- SEXUALLY-ORIENTED BUSINESSES
. 1670.01 Council Finding The City Council has reviewed various reports regarding
sexually-oriented businesses and has considered studies done in other cities,
ordinances of other cities, court cases regarding sexually-oriented businesses, and
other materials pertaining to adult uses and sexually-oriented businesses. In
particular, the Council has reviewed materials related to the adverse secondary
characteristics related to adult uses and sexually-oriented businesses. The Council
has reviewed evidence taken from the City of Minneapolis, where studies have
shown a strong correlation between sexually-explicit businesses and increased crime
rates, and from the City of St. Paul, where studies have suggested such a correlation
as well as a possible correlation between sexually-oriented businesses and depressed
property values. The City Council has also relied upon evidence taken from
reported court cases involving other municipalities which are smaller suburban
cities in Minnesota and in other states. The City Council believes that the
experiences of the cities of Minneapolis and St. Paul are relevant to the City of St.
proximity, and that the smaller cities involved in

and conclusions:
(a) The Council finds that sexua]1),-oriented businesses have adverse
secondary characteristics, particularly when they may be accessible to
minors or are located near residential properties or schools, churches,
temples, synagogues, day care centers, libraries, recreational areas and
parks, and such businesses can exert a dehumanizing influence on
persons attending or using such properties.
(b) Sexually-oriented businesses can contribute to an increase in criminal
activity in the area in which such businesses are located.
(c) Sexually-oriented businesses can significantly contribute to the
.� deterioration of residential neighborhoods and can impair the
: character and quality of the residential housing in the area in which
such businesses are located, thereby exacerbating the shortage of
affordable and habitable housing for City residents.
(d) The concentration of sexually-oriented businesses in one area can have
a substantially detrimental effect on the area in which such businesses
are concentrated and on the overall quality of urban life. A cycle of
decay can result from the influx and concentration of sexually-oriented
businesses. The presence of such businesses is perceived by others as
an indication that the area is deteriorating and the result can be very
detrimental. In many cases other businesses move out of the vicinity
and residents flee from the area. Declining real estate values, which
can result from the concentration of such businesses, erode the City's
tax base and contribute to overall urban blight.
(e) The regulation of the location and operation of sexually-oriented
businesses is warranted to prevent the adverse secondary effects of such
businesses on the City's crime rate, its retail trade, its property values,
and in general the quality of the City's neighborhoods, commercial and
industrial districts, and urban life.

2 Executive Director Mornson reported the house located at 3111 Silver Lake Road had
3 been torn down. He indicated there has been some concern expressed by the neighbors

5 Fleming indicated she had also spoke with the owner of the property to the south of the
6 lot. She reported the resident was-concemed with the change of how the property looked.
7 Fleming indicated she understood the resident's concerns and advised her to attend the
8 Planning Commission meeting so she would be better informed.
