36 A letter was received from Dick and Natalie Sitarz, 3205
37 Armour Terrace, requesting a permit to keep three dogs .

39 City Ordinance permits a total of two dogs in a household and
40 to keep more than two would require a kennel license .

42 Mr . & Mrs . Sitarz were present at the Council Meeting. It was
43 explained that the third dog is owned by the Sitarz ' son and
44 is being housed at their home on a temporary basis . It is
45 their hope that this dog will be going back to live with their
46 son within six months . They also explained that their yard is
47 fenced and that the animal ' s barking is controlled so their
48 neighbors will not be disturbed.

7 Discussion continued regarding what action could be taken by
8 the Council to accommodate their request and not violate the
9 ordinance. It was noted that if there are any complaints
10 received regarding these three dogs the family would be
11 notified .

13 The City Manager suggested that a temporary kennel license
14 could be issued or a variance could be granted for six months .
15
16 Motion by Marks , second by Enrooth to grant a temporary kennel
17 license- to Dick and Natalie Sitarz, 3205 Armour Terrace, for
18 six months and that the license fee be waived .

24 6 . PRESENTATION OF CLAIMS

29 Motion by Wagner , second by Marks to approve payment in the
30 amount of $1 , 797 . 50 to Julee Quarve-Peterson , Inc . for the
31 handicapp accessibility audit for St . Anthony .

33 The City Manager advised that all of the fees due this firm
34 will be paid for from Community Development- Block Grant funds .
35 He also stated there will be a public hearing held in the near
36 future regarding handicap accessibility.

15 Councilmember Wagner brought greetings from the Special
16 Olympians from St . Vincent . He noted they all were at the
17 airport to say good-bye when he and his wife left for
18 home . He will bring the photos he took to share with
19' members of the Council .

21 Councilmember Wagner attended the Ramsey County League of
22 Local Government Meeting. Tax Increment was discussed and
23 he noted there is still confusion between cities and
24 counties . Nothing regarding this matter was resolved.

27 2 . Report of Councilmember Fleming •

29 Councilmember Fleming attended the recent meeting of the
30 Northwest Youth and Family Services . The need for more
31 space and perhaps a new location was discussed . Locating
32 adjacent to a specific building in New Brighton is , being
33 considered.

35 Councilmember Fleming quoted from the Northwest
36 Counseling Center ( a division of Northwest Youth and
37 Family Services ) 1992 yearend annual report . She noted
38 that out of a total of 295 new cases for 1992 , only 14
39 were from the St . Anthony School District .

44 Councilmember Marks had nothing to report at this time .

47 4 . Report of Councilmember Enrooth

49 Councilmember Enrooth attended the February 22nd Village
50 Fest meeting and he noted that there were many new people

6 in attendance . At its March meeting, the committee will
7 address a theme, decide on a logo or a variation of a
8 logo and discuss other ideas for identifying the
9 celebration . An ice cream social will be held on Sunday .

11 Mayor Ranallo inquired if having a tennis tournament is
12 being considered. He recalled that previously there had
13 been discussion regarding holding a tennis tournament
14 which would be the Clyde Paul Memorial Tournament .
15
16 The Mayor stated that Mr . Paul had been an instrutor at
17 the St . Anthony tennis courts and had perhaps chaired the
18 first Village Fest . Although , he had not been a resident
19 of St . Anthony he had spent significant time
20 participating in community events . He was killed in St .
21 Paul . His widow and father have indicated their
22 willingness to participate in a tennis tournament held in
23 his honor .

25 The City Manager will attend the March 2nd Chamber of
6 Commerce Meeting representing the Mayor .
Also, the Council will be receiving- a letter advising of
29 two scholarships which will be given to St . Anthony
30 students from the Chamber of Commerce.
31
32 The City Manager was requested to advise the Cable
33 Commission that no one will be attending the February
34 25th meeting from St . Anthony.
35
36 Mayor Ranallo advised that March 13th is the date of the
37 Chamber of Commerce City Dance . Tickets are $10 . 00 and
38 will be available at City Hall . Ernie' s Catering will
39 serve the dinner .

41 Discussion followed regarding the availability of wine
42 and beer at this Chamber function as well as the City ' s
43 potential liability.
44
45 The Mayor will be out of town from February 24 through
46 March 6th -

7 1 . Insurance Survey

9 The City Manager reminded members of the Council of the
10 need to turn in their insurance survey.

12 2 . Goalsetting Session

14 March 19th and March 20th are the dates selected for the
15 Council ' s Goalsetting Session . It will be held at the
16 Northland Inn . Karen Ray will be the Facilitator .

18 3 . Appreciation Dinner

20 The City Manager noted he had contacted the speaker
21 recommended by Councilmember Fleming. The honorarium fee
22 was very expensive .
23
24 The Mayor recalled that Mary Jo Palerento had been the
25 guest speaker at the last Chamber of Commerce Dinner .
26 Some members of the Council felt this was too recent and •
27 some did not feel she was effective. Councilmember Marks
28 had suggested Bob Terry . The City Manager will continue
29 to look for a speaker for the Appreciation Dinner .

32 4 . Sign Ordinance - Amortization
33
34 The City Manager advised that the Planning Commission had
35 requested this item be reviewed and then discussed it as
36 a concept .
37
38 The City Attorney had written in his opinion of
39 amortization it would be difficult to justify as the
40 enforcement would begin in ten years ; that is 2003 .
41
42 Councilmember Marks observed that signs which do not get
43 taken down usually need maintenance. The City Manager
44 noted that the City Code does address maintenance .
45
46 The Mayor stated he does not want to bind future councils
47 with legislation . Councilmember Enrooth felt this item
48 was on the agenda only because members of the Planning
49 Commission have voted to support it .

7 Councilmember Wagner recalled that the City Attorney had
8 discouraged approval of amortization when it was
9 previously discussed by the City Council .

11 Two signs which have received considerable discussion are
12 those of Dairy Queen and Happy ' s Potato Chips .
13
14 The City Manager feels the new sign ordinance will
15 address signs not in compliance with the Comprehensive
16 Sign Plan .

18 The Mayor inquired what the problem is with the Happy ' s
19 sign . The City Manager responded it has been in place
20 since 1968 and has always been well-maintained.
21 Councilmember Marks noted it did not comply but was
22 grandfathered in .

24 Mayor Ranallo felt there could be considerable problems
25 resulting from requesting this business to take their
6 sign down after being in place for twenty-five years . He
also noted that this sign may comply as there are no
actual sales made out of the building. The signs are
29 directional and informational .

31 The City Manager advised that these types of signs ,
32 directional and informational , are not defined in the
33 sign ordinance nor are these types of signs controlled.
34
35 Most signs are controlled as to shape, size, and height ,
36 but signs which contain menu lists , hours , gas pump
37 directions , etc . are not defined in the sign ordinance.

39 The Mayor felt some thought should be given as to what
40 would most benefit the business community. He observed
41 that some of the commercial and business areas in the
42 City could use some help. He does not support
43 amortization .

45 The City Manager advised that the Planning Commission
46 will not hold a public hearing if there is no interest
47 from the City Council regarding amortization .

6 The Mayor felt maintenance should be enforced .
7 Councilmember Enrooth suggested that the issue has been
8 addressed sufficiently and no further action should be
9 taken .

12 5 . Parking Ordinance

14 The City Manager advised that the Planning Commission had
15 indicated that some of the most blatant parking problems
16 previously in evidence appear to have disappeared. It was
17 felt the accessory structure/double garage section of the
18 code would help alleviate some of the problems people
19 have been experiencing. With this addition to the code,
20 property owners would be allowed to construct a two-car
21 garage without having to justify a hardship.
22
23 The City Manager noted that only five people attended the
24 public hearing called by the Planning Commission to
25 discuss this matter .

27 Councilmember Wagner felt action should be held off for
28 awhile. The Mayor felt the situation had improved .
29 Councilmember Fleming suggested this issue be evaluated
30 after the spring and summer seasons .

32 The City Manager noted that an on-going evaluation would
33 remove this issue from the Planning Commission ' s
34 consideration .

43 A. Approval of 1991/1992 Recycled Content Annual Report

45 Motion by Marks , second by Enrooth to approve the 1991 and
46 1992 Annual Report for the use of materials with recycled
47 content in publicly funded construction and remodeling
48 projects . This report was prepared by Dave Urbia , Management
49 Assistant .

9 A. Liquor Store Prices

11 The City Manager advised that the prices of liquor store
12 merchandise had been adjusted and there may be an increase in
13 business . He cautioned that anticipated profits may not be
14 realized.

16 B. Watershed District Public Hearing

18 On February 24th at the Shoreview City Hall the Rice Creek
19 Watershed District will hold a public hearing.
20
21 The City Manager advised that the Silver Lake Property
22 Homeowners Association will present a petition at the public
23 hearing requesting a water quality study of the lake.
24
25 It was noted by the City Manager that the CUB project will not
26 change any water runoff at Apache Plaza as no non-pervious
surface will be added. Barr Engineering has been hired to
address this matter .

5 The public hearing was opened at 7:06 P.M..

7 Management Assistant Urbia provided a staff report. The proposed ordinance
8 language was provided by the City Attorney, which was previously used in the City
9 of Deephaven. The proposed language will assist residents in building double
10 garages, and allows the Planning Commission and City Council to grant the building
11 of these garages without violating a State law regarding granting variances only if
12 hardship is met.

14 Commissioner Madden requested staff research the issue of storage sheds and draft
15 some language that could be included in an ordinance (but not the current proposal).

17 Chair Faust opened the public hearing to discussion. Mr. Pete Loomis, 2933
18 Crestview, questioned the difference between a permit and an ordinance. Chair
19 Faust explained how the permit would allow flexibility without having to prove
20 hardship to grant a variance. •

24 Commissioner Gondorchin questioned the use of 528 square feet and 24 feet width.
25 Chair Faust and Commissioner Franzese stated that these numbers meet today's
26 standards, and may have to be changed in the future. Commissioner Gondorchin felt
27 the State Building Code should be referenced to see what a standard double garage
28 is.

31 of the proposed Accessory Structure Setback Permit ordinance.

34 motion. The Commission felt that would not be necessary.

3 A. Redevelopment Plan -- 3901/3909 Silver Lake Road

5 Management Assistant Urbia discussed the TIF proposal and draft redevelopment
6 plan. Urbia stated that the project would not be a lengthy TIF, with a quick payoff.
7 In addition, the benefits to St. Anthony in providing an excellent transitional buffer
8 zone from residential to commercial and the enhancement of the tax base are
9 important to consider.

11 Commissioner Gondorchin questioned the hours of operation. Mr. Vogel, who
12 represents the dentist consortium, answered approximately 7 A.M. to 7 P.M.,Monday
13 through Friday and something less on Saturday. Commissioner Franzese asked staff
14 what the zoning of the property was. Urbia stated it was commericial. Franzese
15 asked staff if the existing home could be used for commercial for a new business.
16 Urbia stated it could but it would need to be brought up to code if any remodeling
17 took place. Commissioner Thompson asked Mr. Vogel what the berming and foliage
18 plans would be. Mr. Vogel stated that considerable berming and trees would be
qP1 19 added to seperate the low-density commercial and residential areas.
Motion by Faust, second by Madden to indicate to the City Council that the proposed
22 TIF and redevelopment plan at 3901/3909 Silver Lake Road is viable and will
23 enhance the value to St. Anthony.

25 B. Concept Review -- 3901/3909 Silver Lake Road

27 Management Assistant Urbia explained the proposal for four additional parking
28 spaces. This proposal would require,a variance of ten feet from the requirement of
29 a parking lot in a commercial area to be at least twenty feet from a residential area.
30 Urbia said the advantage could be additional parking and less visibility of the
31 refuse/recycling area. A disadvantage is the ability to prove hardship and commercial
32 area encroachment.

34 Mr. Vogel explained the reason his client desired a concept review. They wished to
35 "test the waters to see if the proposal would be feasible. Mr. Vogel discussed the
36 advantages of the four additional parking spaces and the hiding of the
37 refuse/recycling area.

39 Commissioners Thompson and Franzese believe that a variance could be granted, as
40 the additional parking and reconfiguration of the refuse/recycling area would be
41 beneficial. Commissioners Faust, Madden, and Gondorchin believe that they could
not grant a variance, as they do not see hardship and the proposal would encroach

5 Members of the Planning Commission received copies of the 1993 Planning

8 Management Assistant Urbia announced two Planning Commission training
9 opportunities for Commissioners to consider. Interested Commissioner members
10 should contact Urbia for registration information.

12 Members of the Planning Commission received copies of the 1992 Code of
13 Ordinances. Management Assistant Urbia explained the update process, where staff
14 will provide those pages with changes, and each Commissioner is responsible to
15 change their Ordinance book.

19 a. Commissioner Madden's Comments
20 Commissioner Madden questioned the Northgate Office Park sign. Management
21 Assistant Urbia explained staff enforcement efforts, including the sign in question.
22 At the time, no response was given to the staff letter, but follow up will occur.

24 b. Commissioner Gondorchin's Comments
25 Commissioner Gondorchin reported on the February Environmental
26 Quality/Recycling Committee Meeting. He stated the meeting was very informative
27 regarding water, sanitary sewer, and stormwater issues. Commissioner Gondorchin
28 stated he will be unable to attend the May 13th meeting due to a conflict, and hoped
29 another Planning Commissioner would be able to fill in.

31 Commissioner Gondorchin stated his displeasure in the manner the City Council
32 handled the RV parking issue in relation to the Planning Commission. He felt for
33 the Commission to work on the issue and then the City Council to indicate it may not
34 want to consider an ordinance. Urbia stated that the Council provided this
35 information, at the request of the City Manager, so that the Planning Commission
36 would know the Council's feelings on the matter so that the Commission may
37 determine the direction to take on the issue. Urbia further stated that the Council
38 did not wish to offend the Commission in any way.

40 C. Commissioner Franzese's Comments
41 Commissioner Franzese reported City Council actions at the February. 9, 1993
42 Council Meeting. The City Council did not approve by a 2 to 1 vote the •

1 recommendation to amend ordinance language requiring identification signs to face
2 the frontage they are allowed for. The City Council deferred discussion of sign
3 amortization to the March 2, 1993 Council Work Session. Upon the request of the
4 City Manager, the City Council discussed its feelings towards the proposed parking
5 _ ordinance. The Council did not feel an ordinance would be appopriate, as the
6 problem has addressed itself, probably from further awareness by exposure in the
7 media.

9 Commissioner Franzese asked staff the meaning of the Mayor's desire to see the
10 Planning Commission amend its by-laws so that abstension votes may not be taken.
11 Commissioner Madden stated that he voted this way so as not to offend the business
12 community and not approve illegal signs. Urbia stated that Robert's Rules of Order
13 allow for abtension votes, so the Planning Commission technically cannot amend its
14 by-laws to prohibit abstension voting. However, Urbia stated it is a good idea to vote
15 yes or no to assist the Council in a recommendation.

17 Commissioner Franzese asked staff if there is funding for membership in the
18 Minnesota Planning Association (MPA). Urbia will check with the City Manager.

Other
1 Five to six residents were present to discuss the public hearing for the, proposed
22 accessory structure setback permit. The residents missed the public hearing, as the
23 St. Anthony Bulletin had an error in the Notice of Hearing stating the starting time
24 as 7:35.P.M.. instead of 7:05 P.M.. The Planning Commission spent time explaining
25 the proposal, what was discussed at the public hearing, and answered questions from
26 the residents. Mr. Jack Novak, who previously received a variance to build a garage,
27 spoke strongly in favor of the proposal. In addition, he complemented the City for
28 taking this sort of action to help St. Anthony residents.

BACKGROUND
The Planning Commission recommended the proposed accessory structure setback permit
to only allow flexibility for attached or detached garages. The amended language has been
provided.
Although the definition of an accessory structure/building includes more than garages, the
proposed ordinance defines which accessory structures are being addressed for the permit.
Therefore, I recommend leaving the name of this ordinance as proposed.
• The definition for accessory building is below. I found no definitions for storage buildings
or sheds. The section numbers of the proposed ordinance will be assinged upon City
Attorney review. The City Attorney provided the City with the original ordinance language,
which was also used in Deephaven.
1605.01; Subd. 1. Definitions: Accessory Building. A subordinate building on the same lot
as the prim__ary building on a lot, the use of which is incidental to the use of the primary
building.
RECOMMENDATION
Recommend to the City Council the adoption of the accessory structure setback permit.

the proposed accessory structure setback permit on Tuesday, February 16, 1993 at 7:05 P.M.,
or as soon thereafter as possible. Public Hearings are held in the Council Chambers of the

An attached or detached garage may be located within the side setbacks
and/or rear setbacks set forth in Sections 1615.04, 1616.04, and/or 1620.04 if

In granting or denying the setback permit, the Council will consider criteria
other than solely setback requirements.

Section 1xxx.01. Accessory Structure Setback Permit.
Subd. 1. Permitted Structures. The following accessory structures may be located
within the side setbacks and/or rear setbacks set forth in Section 1xxx.02 if a setback
permit has been issued for the structure under this Section:
(a) Garage which will cover an area of no more than 528 square feet and
no dimension of which is greater than 24 feet.

Subd. 2. Procedures. Application for a setback permit must be made in writing on
forms provided by the Clerk and must be filed with the Clerk, together with a filing
fee in the amount required under Section 1xxx.03. The application must include a
survey ef other drawing showing the proposed location of the structure and the
structures on the property adjoining the setback in question. The application must
also address the other matters to be considered by the Planning Commission and
Council, as set forth in Subdivision 3 of this Section. The permit application will be
considered by the Planning Commission and Council, and notice of the hearing will
be given, all in the same manner as provided in Section 1xxx.04 for special use •
permits. After the hearing, the Council will grant or deny the permit, stating its
reasons for doing so.
Subd. 3. Matters Considered. In granting or denying the setback permit, the Council
will consider the proximity of the accessory structure to any structures on the
adjoining property, the extent of vegetation or other screening on the subject
property and the adjoining property, the effect of the structure on the light and
visibility available to the adjoining property, matters of fire safety, the existing
accessory structures on the adjoining property, the ability to locate accessory
structures elsewhere on the subject property, and any other matters which may be
relevant to the degree on encroachment into the setback which is being requested by
the applicant.
Subd 4. Effect of Permit. If a setback permit is granted, it will run with the title to
the property for which it was granted so long as the accessory structure for which it
was granted continues to exist. If that structure is destroyed or removed, the permit
will automatically expire.

I would like to change the Police Reserve Bylaws as follows:
Under Article II Memberships applicants must meet the following requirements:
Add line - However, applicants at least 18 years old and currently enrolled in an approved
law enforcement program will be considered for membership.
• Due to the difficulty in finding and keeping personnel in the reserve program, I believe this
will help. If you or the council should have concerns with this change please let me know.
Also, I believe this change has to be approved and voted on by the council to enable to me
make this change.
I also plan to increase the reserve strength to twelve (12) members which is the authorized
strength. This will be done due to the kinds of commitments we have made in the
community over the past three to four years. We have been hard pressed to muster up
enough personnel for various functions and maintain a week-end reserve patrol unit.
I therefore request that the council act on this matter at the earliest possible date.

Article I - Purposes and Oboectives:
1 . To assist any police officer, firefighter, civil defense personnel or other duly
authorized City employee, official or agent in the performance of emergency
services.
2. To assist with crowd control activities, and park patrol duties, under the
supervision of a regular, sworn police officer.
3. To conduct and participate in the crime prevention activities of the St: Anthony
Police Department. These activities will include, but are not limited to:
a. Education in public safety and crime prevention techniques;
b. Encouraging enrollment and participation in Operation Identification and
Neighborhood Crime Watch; •
C. Conduction of premise security checks of residential and non-residential
buildings within the community; and
d. Public presentations and information dissemination on topics as approved
by the Chief of Police.
4. To perform other lawful functions as directed by the Chief of Police and his
assigned supervisor.
5. The principal purpose of the Reserve Police is to assist the regular Police in their
duties. They are not to be used in place of regular Police Officers, but may
assist regular Police Officers assigned to details such as, but not limited to,
sporting events, parades, funerals, special events that require traffic direction
and control, and other local details. Under no circumstances shall Reserve
Officers be assigned to any detail that requires the services of a state licensed
regular Police Officer, without the explicit permission of the Chief of Police.

2. Good driving record - no alcohol-related offenses, and must possess a valid
driver's license.
3. Good physical condition as attested to be a doctor's certification of heath, to
be paid for by the applicant.
4. A resident of the Minneapolis/St. Paul metropolitan area and U.S. citizens only.
5. The City shall avoid appointment of persons related to elected or appointed City
officials.
6. Must be a high school graduate or equivalent.
7. Must not have any felony or gross misdemeanor offense convictions, and must
• be willing to submit to a background investigation.
8. Must possess, or obtain within six months, a valid Red Cross First Aid
Certificate or equivalent, as determined by Chief of Police
9. Pass such examinations as determined by City Manager to determine fitness for
the Reserve, to be paid for by the City of St. Anthony.
10. Within one year after acceptance, complete either the Hennepin or Ramsey
County Civil Defense Auxiliary Reserve Training Program or a similar program
designated by the City Manager. Until such a program is completed, members
shall be considered trainees. Failure to complete the program within one year
shall be grounds for dismissal.
11 . Members shall be on probation until an approved reserve training program has
been completed. As trainee Reserve Officers, they are to be accompanied by
either a Reserve Officer, a regular Police Officer, or be in training sessions at
all times.

Article III - Organization:
1 . The Chief of Police shall be the commanding officer of the St. Anthony Police
Reserve. As officers, members of the Reserve act for and through the Chief of
Police.
2. The Chief of Police may appoint a Coordinator of the Reserves, who shall be
responsible for the day-to-day operation of the Reserve and shall serve for an
indefinite period upon the discretion of the Chief of Police, City of St. Anthony.
3. An election shall be held by the Reserves to elect one Sergeant, however,
before appointment is confirmed and made final, approval must be passed on
the Chief of Police and the Reserve Coordinator. The Sergeant shall serve for
an indefinite period upon the discretion of the Chief of Police and the Reserve
Coordinator.
4. Additional supervising officers may be elected or appointed upon approval of
the Chief of Police.
5. Reserve Officers shall be under the work direction of the St. Anthony Police •
Department Police Officers at all times.
6. The Reserves shall hold organizational and/or business meetings as are
necessary. Policies and regulations governing administrative and ministerial
duties of the Reserve may be promulgated by a majority vote of the Reserve,
but are subject to the approval of the Chief of Police.
7. The Reserve Unit is not to exceed twelve people.
8. The City will not pay any direct monetary compensation for duty as a Police
Reserve Officer.

every reserve officer:

e. One flashlight with holder and one paid of handcuffs with case,
f. Chemical spray in container with case.
2. Reserve Officers must provide and pay the cost of the following pieces of
equipment:
a. Light blue shirt (blouse) with Reserve bars on each collar and patches on
sleeve,
b. Black (or dark navy) uniform trousers (slacks),
C. Black leather shoes or uniform boots,
d. Black leather belt with key holder, baton and holder (leather must be
basket weave style),
e. Dark colored gloves,
f. Necktie (male/female style).
The City will provide replacement shirts or blouses and trousers or slacks, when
necessary, provided the Reserve Officer has completed at least one year of
service with the St. Anthony Police Reserve:
3. Reserve Officers are responsible for the care and condition of their equipment,
and are required to wear suitable uniform when on duty.
4. Upon resignation or termination, all issued equipment is to be turned in to the
Chief of Police.
5. The wearing of firearms will be not authorized by the Chief of Police, and the
use of firearms is only at the discretion of the Chief of Police, his designated
representative, or the regular Police Officer in charge.

6. The City may provide one vehicle to be clearly marked "St. Anthony Police
Reserve" for use in patrolling parks, public relations/crime prevention activities,
crowd control, and other activities as designated by the Chief of Police.

b. The Reserve vehicle will not attempt traffic stops;
d. In event of emergency calls, the Reserve.vehicle will respond routinely,
obeying all traffic laws, except when directed by the Officer on duty or
a Police supervisor;
d. The Reserve vehicle may perform house and business checks and patrol
parks;
e. Any vehicle maintenance problems must be reported at the end of the
shift, and the vehicle gassed and oil checked;
f. The Reserve vehicle will report to the Police Officer on duty once each
hour;
9. The Reserve vehicle shall not respond to any felony-in-progress call;
h. The vehicle is to be checked in and out through a Captain or Police
Officer of the St. Anthony Police Department. Arrangements are to be
made at least four hours before scheduled duty and the use of the
vehicle;
i. No Reserve Officer is to retain keys to the Reserve vehicle without the
permission of the Chief of Police, or to use it for non-authorized
purposes;
i. The minimum patrol period for one Officer is two hours; the maximum
is eight hours in a given day; and
k. The vehicle is not to leave the City unless authorized by a regular Police
Officer or Captain in charge.

Article V - Conduct:
Violations of the following nature shall subject Reserve Officers to disciplinary action
under Article VII - Discipline:
1 . Drinking an intoxicating beverage or using non-prescribed mind-altering drug
while on duty or up to four hours beforehand.
2. Immoral conduct while on duty.
3. Actions detrimental to the reputation of the Reserve Unit, Police Department,
or the City.
4. Violation of a criminal law.
5. Insubordination to the rank or request of a commanding Reserve or. regular
Police Officer, or to a City Official, when a supervisory officer is not present or
when-not under the work direction of a supervisory officer.
6. Disrespectful or profane language or public criticisms of the department.
7. Misuse or abuse of position.
8. Sleeping or other evidence of inefficient performance while on duty, such as
loafing, recreational reading, conducting private business or gambling..
9. Release of information to the public, except as authorized by a police
supervisor, or a confidential nature, including informants, witnesses, and
investigation report.
10. The soliciting or accepting of any gratuity.
11 . Recommending any attorney or bail bond broker or acting as a bailor, except
relatives.
12. Identifying themselves as Police Officers or Peace Officer. in any way.
Article VI - Discipline:
A person who is guilty of a conduct violation as contained in Article V - Conduct, or
non-performance as contained in Article IX - Performance, shall be subject to
disciplinary action under this article.

1 . The Chief of Police may.suspend, demote, or terminate any Reserve Officer
guilty of a conduct rules violation, after weighing the severity of the violation,
the Officer's past performance and the attitude of the Officer. Any action so
taken shall be expressed in writing.
2. The Reserve Officer may appeal the action of the Chief of Police to the City
Manager within ten days of the Chief's written action. The City Manager shall
express his/her action in writing.
3. Within ten days after receiving the City Manager's written response, an Officer
may appeal the action to the City Council.
4. The City Council shall issue a ruling on the violation and disciplinary action
taken which shall be binding and final.
Article VII - Use of Firearms:
The carrying and use of firearms is expressly prohibited, except as follows:
1 . Under conditions of great emergency, the Chief of Police, his designated ,
representative or the regular Officer in charge may dispense weapons to
Reserve Officers who meet the requirements of Article VIII, No. 2.
2. - Reserve Officers shall become knowledgeable and proficient in the use of
firearms and shall be certified in their use before they are allowed to use them.
They are never to be carried, except when expressly authorized, however.
Article VIII - Performance:
Officer shall be expected to function at least to a satisfactory level, and are
responsible for performance in the following area:
1 . Assistance to regular Police Officers of the St. Anthony Police Department.
2. Assistance to the St. Anthony Fire Department, especially in the performance
of its Civil Defense responsibilities.
3. Crime Prevention programs, including house and business checks, as directed
by the Chief of Police.
4. Crowd and traffic control duties.

5. Park patrol, especially to aid in preventing vandalism to public property, and to
develop a spirit of rapport with park users.
6. Testifying, as needed, in criminal prosecutions.
7. Assisting other cities, as needed.
8. To remain a member in good standing of the Police Reserve, Officer must spend
at least 150 hours per year in Reserve related duties, including training and
membership meetings. Officers are not to spend less than 8 hours in any one
month in Reserve-related duties. Violation of this rule shall be grounds for
disciplinary action under Article VII - Discipline.
Article IX - Ride-Along:
Reserve Officers may ride with regular Police Officers, subject to the following:
1 . A Ride-Along is strictly up to the discretion of the Chief of Police and the
regular Officer involved.
2. ReseWists desiFiAg to be a Rid .
2. Reservists are to be under the direct control and direction of the regular Officer
in the car.
3 . Reserve Officers are not to drive a regular St. Anthony Police Department
squad car unless authorized by the Officer in charge.
4. Ride-Alongs are restricted to not less than two hours, nor more than eight
hours in any one day.
Article X - Rules, Regulations, Amendments, and Dissolution:
1 . The Chief of Police may promulgate ruled and regulations on the operation of
the Reserve Unit within the context of these Bylaws. The.Reserve Unit may
appeal such rules and regulations to the City Manager and City Council if they
deem them to be unreasonable, unfair, or unenforceable by a majority vote of
all Reserve members.
2. The Bylaws may be amended upon a majority vote of the City Council.
3. The Reserve Unit may be disbanded by a majority vote of the City Council.

THIS AGREEMENT, made this day of 19_,
by and between the CITY OF ST. ANTHONY, a municipal corporation under the laws
of the State of Minnesota, (hereinafter called "Landlord") and AGA KHAN CULTURAL
CENTER, aka H. H. PRINCE AGA KHAN SHIA IMANI ISMAILI COUNCIL FOR
MIDWESTERN U.S.A. (hereinafter called "Tenant"),
WITNESSETH:
That the Landlord, in consideration of the rents and covenants hereinafter mentioned,
does hereby Demise, Lease and Let unto the Tenant, and the Tenant does hereby hire
and take from the Landlord the following described premises located in the County of
Hennepin and the State of Minnesota, viz:
That portion of the building (hereinafter called the "Building") located at 3301 Silver
Lake Road, crosshatched on Exhibit 1 attached hereto and made a part of (hereinafter
called the "Leased Premises").
TO HAVE AND TO HOLD THE SAID PREMISES, without any liability or obligation on
the part of said Landlord of making any alterations, improvements or repairs of any
kind on or about the said premises save as provided herein, for the term of twelve
• (12) months commencing August 1 , 1993, unless terminated at an earlier date as
hereinafter provided.
ARTICLE 1 . RENT.
Tenant will pay to Landlord at 3301 Silver Lake Road,, St. Anthony, Minnesota
55418, or at such other address as may be designated by Landlord, without
prior demand and without any deduction or set-off, annual rent in the amount
of $12,000, payable in monthly installments of 51 ,000 each.
ARTICLE 2. TERM.
The term of this lease shall be twelve (12) months commencing on August 1 ,
1993 and terminating on July 31 , 1994 unless terminated at an earlier date as
hereinafter provided.
ARTICLE 3. UTILITIES AND SERVICES.
Landlord agrees to furnish heat, water, sewer service, and electricity in
reasonable amounts, trash pick up,.and snow plowing, but Landlord shall not
be liable for any loss or damage caused by or resulting from any variation,
interruption or failure of such services due to any cause beyond its reasonable
• control; and no temporary interruption of failure of such services, incident to
the making of repairs, alterations or improvements or due to accidents or

strikes, or conditions or events not under Landlord's control shall be deemed
as an eviction of the Tenant or relieve the Tenant from any of the Tenant's
obligations hereunder.
ARTICLE 4. NON-LIABILITY OF LANDLORD.
Landlord shall not be liable to Tenant or those claiming through or under
Tenant, or Tenant's agents, guests, invitees, clients or otherwise for any
damage for failure to furnish services or utilities, the necessity for repairs or
improvements to such services, fire, explosion, strikes, or any causes beyond
Landlord's reasonable control; nor shall Landlord be liable for personal injuries,
death, or any damage from any cause in or about the leased premises or the
building within same are located, including the parking area, and without
limiting the generality of the foregoing, any personal injuries,-death or damage
resulting from the use or escape of gas, water, steam, electricity, air
conditioning or other agency, or due to fire, explosion or action of the
elements. Landlord shall have no responsibility or liability for loss or damage
to fixtures, facilities or equipment installed or left on the premises. Tenant
agrees to place and maintain throughout the term hereof at its sole expense,
such fire and other casualty insurance covering Tenant's property as Tenant •
deems appropriate in Tenant's reasonable discretion. Tenant further agrees to
place and maintain throughout the term hereof, comprehensive general liability
insurance covering the leased premises and providing insurance coverage with
minimum amounts of liability for bodily injury to one person in the amount of
Five Hundred Thousand Dollars ($500,000.00) and for bodily injury to any
group of persons in the amount of Five Hundred Thousand Dollars
($500,000.00) and for property damage- in the amount of One Hundred
Thousand Dollars ($100,000.00). Landlord and Tenant each expressly waive
any right of recovery against each other for any losses caused by or resulting
from any acts -of negligence or carelessness of the other, to the extent that
such losses might arise from fire or any other peril covered by any policy of
insurance.
ARTICLE 5. CARE OF PREMISES.
Tenant agrees:
1) to keep the leased premises in as good condition and repair as they
were in at the time Tenant took possession of same; reasonable wear
and tear and damage from the fire and other casualty, for which
insurance is normally procured, excepted;
2) to keep the leased premises in a clean and sanitary condition; •

3) not to commit any nuisance or waste on the leased premises, throw
foreign substances in plumbing facilities, or waste any of the utilities
furnished by Landlord;
4) if Tenant shall fail to keep and preserve these premises in the state of
condition required by the provisions of this Article, the Landlord may, at
its option, put or cause the same to be put into the condition and state
of repair agreed upon, and in such case, the Tenant, on demand, shall
pay the cost thereof;
6) Tenant agrees to abide by such Rules and Regulations as may be
reasonably promulgated by Landlord.
Tenant shall erect no signs on the leased premises without the prior written
permission of the Landlord. Landlord shall be responsible for the maintenance
and repair of structural members, walls, footings and the roof of the building
of which the leased premises are a part, subject, however, to the provisions of
Article 1 1 . Tenant shall be responsible for all other maintenance, repair and
replacement necessary for use of the leased premises; the Landlord shall be
• responsible for maintenance of the parking area; including snow plowing, and
for an adequate level of security lighting.
ARTICLE 6. USE.
Tenant shall use the leased premises for meetings and religious or other
gatherings for the Aga Kahn Cultural Center and for no other purpose. Tenant
agrees not to commit or permit any act to be performed on the premises or any
omission to occur which will be in violation of any statute, regulation or
ordinance of any governmental body or which will increase the insurance rates
on the building which will be in violation of any insurance policy carried on the
premises by the Landlord. The Tenant shall not disturb other occupants of the
building by making any undue or unseemly noise or otherwise, and shall not do
or permit to be done in or about the leased premises anything which will be
dangerous to life, limb or property.
ARTICLE 7. INSPECTION AND REPAIRS.
The Landlord or its employees or agents shall have the right to enter the
premises at all reasonable times, for the purpose of inspection, cleaning,
repairing, altering or improving the same or said building, but nothing contained
in this lease shall be construed so as-to impose any obligation on the Landlord
• to make any repairs, alterations or improvements.

ARTICLE 8. ALTERATIONS.
Tenant will not make any alteration, additions or improvements in or to the
leased premises or add, disturb or in any way change any plumbing or wiring
therein without the prior written consent of the Landlord as to the character of
the alterations, additions, or improvements to be made, the manner of doing
the work, and the persons to do the work. In the event that such prior written
consent is granted, Tenant agrees to make such alterations, additions or
improvements at its own sole expense, and warrants to Landlord that all such
alterations, additions, or improvements shall be in strict compliance with all
relevant laws, ordinances, governmental regulations and insurance
requirements.
The Tenant shall be responsible for the purchase and installation of any
additional air conditioning units, other than those already provided, the cost of
changing the combination on the vault, the cost of purchasing and installing
any new locks, any improvements to the landscaping of the building and the
installation of carpeting and drapes, if desired.
ARTICLE 9. COMMON AREAS. •
Tenant is hereby granted the nonexclusive right to use the driveways, parking,
sidewalks, hallways and restrooms serving the Building in connection with
Tenant's use of the leased premises and subject to the provisions of this Lease
and any rules and regulations established by Landlord; provided, however, that
Landlord may reserve for Landlord's exclusive use not more than 20 existing
parking stalls and any new parking stalls added by Landlord, which stalls
Landlord may mark by a sign or signs indicating Landlord's reservation.
ARTICLE 10. USE OF CAFETERIA AND GYMNASIUM.
If Tenant desires to use the Cafeteria and Gymnasium in the Building, Tenant
will schedule such use through St. Anthony/New Brighton Independent School
District No. 282.
ARTICLE 11 . ASSIGNMENT OR SUBLETTING.
Tenant agrees to use and occupy the leased premises throughout the entire
term hereof for the purpose or purposes herein specified, and for no other
purposes, in the manner and to substantially the extent now intended, and not
to assign this Lease or sublet said premises, or any part thereof, whether by
voluntary act, operation of law, or otherwise, without obtaining the prior •
written consent of Landlord in each instance; Tenant shall seek such written
consent by a written request therefor, setting forth such information as

Landlord may desire. In the event that a bona fide sub-tenant or assignee is
proposed to Landlord by Tenant, and Landlord is unwilling to consent to such
proposed sub-tenancy or assignment, Landlord shall have the right, at
Landlord's sole discretion, to terminate this lease upon thirty (30) days written
notice to Tenant in lieu of consenting to such proposed sub-tenancy or
assignment. Consent by Landlord to one assignment of this Lease or to one
subletting of the leased premises shall not be a waiver of Landlord's rights
under this Article as to any subsequent assignment or subletting. Landlord's
rights to assign this Lease are and shall remain unqualified.
ARTICLE 12. DAMAGE BY FIRE OR OTHER CASUALTY.
If fire or other casualty shall render the leased premises untenantable, this
Lease shall terminate forthwith, and any prepayments of rent shall be refunded
by the Landlord pro-rate; provided, however, that if the premises can be
repaired within ninety (90) days from the date of such event,then at Landlord's
option by notice in writing to Tenant mailed within thirty (30) days after such
damage or destruction, this Lease shall remain in full force and effect, but the
rent for the period during which the premises are untenantable shall be
• discounted pro-rata.
ARTICLE 13. EMINENT DOMAIN.
If such a portion of the leased premises are taken by any public authority under
the power of eminent domain as to render the remaining portion unsuitable for
the purposes intended hereunder, then the term of this Lease shall cease as of
the day possession shall be taken by such public authority, and Landlord shall
make a pro-rata refund of any rent that may have been paid in advance. All
damages awarded for such taking under the power of eminent domain shall
belong to and be the property of Landlord, irrespective of the basis upon which
they are awarded.
ARTICLE 14. SURRENDER.
On the last day of the term of this Lease or on the sooner termination thereof,
Tenant shall peaceably surrender the leased premises in good condition and
repair consistent with Tenant's duty to make repairs as provided in Article 5
hereof. On or before the last-day of the term of the lease or the sooner
termination thereof, Tenant shall at its expense remove all of its equipment
from the leased premises, and any property not removed shall be deemed
abandoned. Tenant shall reimburse Landlord for any expenses incurred by
• Landlord with_ respect to removal or storage of abandoned property. All
alterations, additions and fixtures, other than Tenant's equipment, which have
been made or installed by either Landlord or Tenant upon the leased premises

shall remain as Landlord's property and shall be surrendered with the leased
premises as a part thereof. If the leased premises be not surrendered at the
end of the term or sooner termination thereof, Tenant shall indemnify Landlord
against loss or liability resulting from delay by Tenant in so surrendering the
premises, including, without litigation, claims made by'any succeeding tenant
founded on such delay, and attorneys fees. Tenant shall promptly surrender all
keys for the leased premises to Landlord at the place then fixed for payment of
rent and shall inform Landlord of combinations on any locks and safes on the
leased premises.
ARTICLE 15. NON-PAYMENT OF RENT: DEFAULTS.
If any one or more of the following occurs, (1) a rent payment from Tenant to
Landlord shall be and remain unpaid in whole or in part for more than fifteen
(15) days after notice from the Landlord; (2) Tenant shall violate or default any
of the other covenants, agreement, stipulations, or conditions herein, and such
violation or default shall continue for a period of ten (10) days after written
notice from Landlord of such violation or default; or (3) if Tenant shall be
adjudged bankrupt or file a petition in bankruptcy or otherwise indicates
insolvency or becomes insolvent; then it shall be optional for Landlord to •
declare this Lease forfeited and the said term ended, and to re-enter said
premises, with or without process of law, using such force as may be
necessary to remove all persons or chattels therefrom, and Landlord shall not
be liable for damage by reason of such re-entry or forfeiture; but
notwithstanding re-entry by Landlord or forfeiture or termination of this Lease,
the liability of Tenant for the rent provided for herein shall not be relinquished
or extinguished for the balance of the term of this Lease. Tenant will pay, in
addition to the rentals and other sums agreed to be paid hereunder, such
additional sums as the court may adjudicate reasonable as attorney's fees in
any suit or action instituted by Landlord to enforce the provisions of this Lease,
or the collection of the rentals due Landlord hereunder.
ARTICLE 16. HOLDING OVER.
In the event Tenant remains in possession of the premises herein leased after
the expiration of this Lease and without the execution of a new lease, it shall
be deemed to be occupying said premises as a tenant from month to month,
subject to all the conditions, provisions, and obligations of this lease insofar as
the same can be applicable to a month-to-month tenancy.
ARTICLE 17. COVENANTS TO HOLD HARMLESS.
Except in the case of negligence of Landlord, its agents or employees, Tenant •
agrees to hold Landlord harmless for any liability for damages to any person or

property in or about the leased premises. All property kept, stored, or
maintained in the leased premises shall be so kept, stored, or maintained at the
sole risk of Tenant. Tenant agrees to pay all sums of money in respect of any
labor, services, materials, supplies or equipment furnished or alleged to have
been furnished to Tenant in or about the leased premises which may be secured
by any mechanic's, materialmen's or other lien against the leased premises or
the Landlord's interest therein and will cause each such lien to be discharged
at the time performance of any obligation secured thereby matures, provided
that Tenant may, upon depositing and maintaining with Landlord a sum
reasonably satisfactory to Landlord to protect Landlord's interest in the leased
premises from such lien, contest such lien, but if such lien is reduced to final
judgement or process thereon is not stayed, or if stayed and said stay expires,
then and each such event Tenant shall forthwith pay and discharge said
judgement. Landlord shall have the right to post and maintain on the leased
premises, notices of non-responsibility under the laws of Minnesota.
ARTICLE 18. SUBORDINATION.
Tenant agrees that this Lease shall be subordinate to any mortgages or trust
• deeds now on or hereafter placed upon said premises and to any and all
advances to be made thereunder, and to the interest thereon, and all renewals,
replacements, and extensions thereof.
ARTICLE 19. GENERAL.
This Lease does not create the relationship of principal and agent or of
partnership or of joint venture or of any association between Landlord and
Tenant, the sole relationship between Landlord and Tenant being that of
landlord and tenant. No waiver of any default of Tenant hereunder shall be
implied from any omission by Landlord to take any action on account of such
default if such default persists or is repeated, and no express waiver shall affect
any default other than the default specified in the express waiver and that only
for the time and to the extent therein stated. Each term and each provision of
this Lease performable by Tenant shall be construed to be both a covenant and
a condition. All preliminary negotiations are merged into and incorporated in
this Lease: This Lease can only be modified or amended by an Agreement in
writing, signed by the parties hereto. All provisions hereof shall be binding
upon the heirs, successors and assigns of each party hereto. Any notice
required to be served in writing hereunder shall be mailed to the parties at the
addresses set out after their respective signatures. Any and all indebtedness
owing by the Tenant to the Landlord pursuant to the terms of this Lease which
remains unpaid for a period of thirty (30) days after it first becomes due and
payable shall bear interest from and after the lapse of such thirty (30) day

period at the rate of eight percent (8%) per annum. This Lease shall not be
effective until executed by all parties hereto.
ARTICLE 20. TERMINATION.
Landlord shall have the right to terminate this lease at any time upon 30 days
prior written notice to Tenant.

18 . 2 Employees filling a higher job class based on the
provisions of this ARTICLE shall be subject to the
conditions of ARTICLE XVI (PROBATIONARY PERIOD) .
18 . 3 The EMPLOYER has the right of final decision in the
selection of employees to fill posted jobs based on
qualifications , abilities and experience.
18. 4 Job vacancies within the designated bargaining unit will
be posted for five ( 5 ) working days so that members of the

ARTICLE XIX INSURANCE
19 . 1 The EMPLOYER will contribute up to a maximum of two
hundred eighty-five dollars ($285.00 ) per month per
employee for calendar year 1993 for group health and
life insurance including dependent coverage . By mutual
agreement employees may use fifteen dollars ( $15 . 00 ) of
the health insurance dollars for dental insurance.
19 . 2 Employees not choosing dependent coverage cannot be
covered at EMPLOYER expense for any additional insurance
than the individual group health and group life insurance. •
Additional life insurance can be purchased by, employees at
the employee ' s expense to the extent allowed under the
EMPLOYER' S group policy.
19. 3 Individual employees may provide for an increased EMPLOYER
contribution for insurances over that amount stipulated by
19. 1, by lowering their salary from the rates stipulated
in APPENDIX A to provide for an increased EMPLOYER
contribution which will fully pay for the employee ' s
health, life, and dental insurance, including dependent
coverage.
ARTICLE XX SICK LEAVE
20 . 1 Sick leave with pay shall be accrued by all permanent and
probationary employees at the rate of one ( 1 ) day for
each calendar month of full time employment or major

C-2 . Employees assigned by the EMPLOYER to Utility Operator
will be paid the wage rate of the job classification to
which the employee is assigned .
C-3. All present employees with the Classification of
Maintenance Worker II will be grandfathered in as
Maintenance Worker Step E. Existing employees classified
as Maintenance Worker I will be put into the step system
based on their length of service and their ability to
perform the required duties of the assigned step and the
lower steps.
