50 done by Fratallone and he felt this was unfortunate.

8 A. Fire Department 1992 Annual Report

10 Chief Johnson noted that statistically there appear to be no
11 trends evolving as they were consistent for the year .
12
13 He referred the Council to that section of the report which
14 addressed the distribution of response runs . This is a new
15 addition to the annual report .
16
17 The Chief felt the distribution may be a factor when
18 considering the relocation of the Fire Department . The runs
19 focus significantly on the senior citizen facilities which are
20 located on either end of the City.
21
22 The response runs outside of the City and the mutual aid calls
23 were reviewed.
24
25 Chief Johnson advised that a new hiring policy was created in
26 1992 . One black person and two women were hired to fill four
27 of the openings in the part time division of the department . •
28
29 Councilmember Marks inquired if the Chief felt the department
30 personnel has received sufficient training to be fully
31 qualified to respond to certain situations .
32
33 The Chief responded there are a number of areas in which more
34 training is desired . He has been sending one person to
35 training who then returns and does the training in-house . This
36 practice is cost effective . He feels the turn over in the
37 department has been a negative as it takes two hundred and
38 fifty hours to reach a minimum of training.

40 The Chief explained the hazardous materials procedures . He
41 noted that his personnel is not trained in all of the haz mat '
42 procedures but can respond to certain situations .
43
44 Councilmember Wagner inquired what the department has
45 available in equipment for very small children . The Chief
46 responded that pediatric emergency equipment and procedures
47 have lagged behind that available for adults . He noted that
48 typically adults receive much more sophisticated and effective
49 assistance than do small children .

6 Councilmember Wagner advised that Kiwanis International is
7 supplying oxygen equipment and size appropriate emergency
8 materials for use on very small children and infants . He
9 recommended that Chief Johnson request more information from
10 Kiwanis International .

12 Mayor Ranallo felt the report was very good . He also
13 recognized the quality assistance given by members of the Fire
14 Department during Village Fest .

17 B. Report of the City Council
18

20 Councilmember Marks attended a reception at the
21 Kenzington . He was pleased to see how many of the units
22 have been sold . There are about twelve units left to
23 sell . There are only one-bedroom units remaining and many
24 people desire two. bedrooms . Some consideration is being
25 given to remodel some of the units into two bedroom
6 units .
Councilmember Marks felt the Village Fest parade was very
29 enjoyable. The children ' s participation was particularly
30 special .

32 He received a call from a resident regarding a problem
33 being experienced upstream of St . Anthony at Locke Lake
34 in Fridley. The lake has been filled in and now some
35 property owners around the lake are requesting it become
36 a lake again .
37
38 The $588 , 000 assessment attached to this project would be
39 shared by all member cities of the Rice Creek Watershed
40 District . The lake ' s dam also needs repair .
41
42 Councilmember Marks felt this assessment would be unfair
43 since the lake restoration would benefit only owners of
44 private property around the lake.
45
46 -Councilmember Enrooth suggested it may be shortsighted
47 for St . Anthony to appeal this assessment in that the
48 City currently has a petition before the Rice Creek
49 Watershed District .

6 The City Manager advised the -assessment would probably be
7 between $4 , 000 and $5, 000 .

9 Vice President Gore visited the some small businesses in
10 the office complex where Councilmember Marks is employed.
11 He had an opportunity to welcome the Vice President .
12
13 Councilmember Marks will be vacationing the first two
14 weeks in August and wi 11 be absent from the f irst counci 1
15 meeting of the month.

17 General Discussion on Village Fest - 1993
18
19 Councilmember Enrooth stated that from the Village Fest
20 Board.-of .Directors ' perspective, the annual event came
21 off very well this year. The wrap-up meeting is scheduled
22 for September .
23
24 Councilmember Wagner gave a report on the gross receipts
25 received to date for Village Fest . His wife, Audrey, is
26 the Village Fest Committee Treasurer .
27 •28 Gross receipts were given with comparisons to those for
29 1992 . Councilmember Wagner advised that the Silent
30 Auction grossed nearly three times the money that was
31 realized in 1992 .

33 Attendance at the Kiwanis Pancake Breakfast was up about
34 200 compared with 1992 . He felt some of this increase may
35 have been due to the advertising done during the parade .
36 The Mayor suggested there should be some space _allocated
37 for children to play. Their activity on the stage was
38 disruptive.

40 Councilmember Enrooth observed that only about ten
41 percent of St . Anthony ' s residents support and attend
42 Village Fest activities .
43
44 Councilmember Marks suggested that Village Fest
45 announcements could be made by using the fire truck
46 driving through neighborhoods .
47
48 Councilmember Fleming received only one negative comment
49 regarding the parade. Many folks would have liked to see
50 more bands .

6 The performance of the St . Anthony Orchestra on Sunday
7 was very well received. Councilmember Wagner felt having
8 them perform in the tent was a good idea ..

10 The Mayor has received many positive comments regarding
11 Village Fest activities . He also received very favorable
12 comments from a parade clown participant who felt the
13 children attending were extremely well -behaved. This
14 behavior was also observed at the ping pong drop.
15
16 The Mayor will be drafting a thank-you letter to be
17 submitted to the newspapers which serve the City.
18
19 Mayor Ranallo inquired if any parades had been held in
J the history of the City . Councilmember Marks responded
21 that the City previously celebrated "Wrangler Days"
22 usually in September . There was a parade associated with
23 this celebration .
24
25 Councilmember Fleming noted this year was the first year
6 for a Village Fest parade .
Councilmember Enrooth received some negative comments
29 from crafters who had booths at the Village Fest . He
30 noted those who stayed until Sunday did quite well . There
31 was some thought that the location of the crafters booths
32 should be improved next year .

34 The Mayor thanked members of the City Council , City
35 staff , Village Fest Committee members , and Police and
36 Fire reserves for their efforts in making this year ' s
37 Village Fest successful .

39 The Mayor .will again have a thank-you party at his home
40 for all of those who participated in putting Village Fest
41 on . The date_ will be selected very soon .

43 Regarding the open house at the Kenzington , Mayor Ranallo.
44 noted that Vice President Gore and George Latimer and
45 Henry Cisneros of .HUD had not responded to their personal
46 invitations to attend . The State' s two senators and
47 District Four and Five congressmen had also been invited
48 and did not attend. The Mayor felt this was unusual in
49 that this is the first RTC project of its kind in the
50 country .

6 B. City Manager ' s Report

8 1 . Sale of Lots at 27th Avenue Northeast and Coolidge
9 Street

11 The lots in question are two newly created residential
12 lots in the vicinity of 27th Avenue and Coolidge Street .
13 These lots resulted from the demolition of Rosie' s Cafe
14 and the Good Luck Cafe .
15
16 The City Manager requested direction from the City
17 Attorney regarding sale of these two lots . The City
18 Attorney advised there is no legal requirement that these
19 lots be sold by bid. He stated the Council can solicit
20 offers from prospective purchasers if it does not choose
21 to go the sealed bid auction approach.
22
23 Both the City Attorney and the City Manager support
24 putting these lots on the open market rather than
25 pursuing the bid process .

27 The City Manager advised he has received about six calls
28 regarding the sale of these two lots . He felt each lot
29 could comfortably accommodate a one story rambler and the
30 parcel purchase price could be between $30 , 000 and
31 $35, 000 . He has also received very favorable comments
32 from developers and neighbors in the area of the lots . He
33 recommended the sale be considered after the roadway
34 construction is farther underway and the berm is in
35 place .

37 The Mayor felt the lot value should be $40 , 000 but that
38 an objective opinion is needed.

40 Councilmember Enrooth felt the lots would not sell for
41 $40 , 000 in view of the heavy traffic in the area . He
42 requested the parcels be staked.

44 The City Manager noted he has received a request from a
45 person who owns property adjacent to some of the
46 redevelopment to purchase thirty feet of land . The City
47 Manager observed lots would result which may need
48 variances for construction.

50 The City Manager will pursue a quick appraiser ' s opinion .

12 A. Resolution No. 93-041 , Re: Variance from State Road Width
13 Requirements on 37th Avenue Northeast Street Construction

15 Councilmember. Wagner inquired if the City has to take the
16 conditions noted in the variance from the State.

18 The City Manager noted these conditions are always included in
19 these types of agreements but they actually do not hold the
20 State harmless .
21
22 Motion by Marks , second by Enrooth to adopt Resolution No . 93-
23 041 being a resolution relating to a variance from the State
24 of Minnesota for road rehabilitation on 37th Avenue Northeast
25 between Silver Lake Road and Stinson Boulevard .
Motion carried unanimously
29 B. Resolution No . 93-042 , Re : Early Retirement Incentives

31 At this point in time, the Mayor felt this resolution would
32 only affect one City employee . He stated his opposition to the
33 project as he felt it would indirectly cost the City money.

35 The City Manager noted that a majority of other cities are
36 adopting the incentive but stated that if the fund becomes
37 underfunded the participating cities could be requested for
38 additional funding.

40 Councilmember Fleming was interested in how neighboring
41 communities are handling this issue .

43 Motion by Fleming, second by Enrooth to table this resolution
44 for further information from two other communities regarding
45 their position and that staff return their findings at the
46 next Council Meeting.

6 C. Resolution No 93-043 , Re: Approval of Engineering
7 Services for 1994 Street Construction Improvements

9 The City Manager advised this resolution will authorize a
10 continuance of the street construction improvements which are
11 presently being done this year . He reviewed the 1994 program
12 and the progress on the 1993 work . He referred to the Project
13 Schedule prepared by the engineering firm doing the project .
14
15 Motion by Marks, second by Wagner to adopt Resolution No . 93-
16 43 being a resolution approving Maier Stewart & Associates ,
17 Inc. as engineers for the 1994 street construction
18 improvements .

22 D. Establishina Public Hearina for Vacatina Portions of
23 Coolidge Street

25 Motion by Marks , second by Enrooth to establish August 10 ,
26 1993 at 7 : 00 p.m. as a public hearing date for discussing
27 vacating portions of Coolidge Street Northeast lying within
28 Lots 1 and 2 , Block 1 of First Addition to the Village of
29 St .Anthony .

34 E. Future Planning Strategies

36 Mayor Ranallo requested this item be added to the Council
37 agenda . His feelings are that the Council should do some
38 planning for the future of the Village rather than wait until
39 issues need immediate attention .

41 The Mayor cites examples of the "Walgreen ' s Store" and the
42 "Clark Station" issues which were not anticipated. The Council
43 was put into a situation which it must react rather than
44 respond. He felt if policies and planning were in place these
45 types of situations could be better addressed. Long range
46 planning is being done in other communities and the Mayor
47 feels this is beneficial .

49 The City Manager noted that the City' s comprehensive plan
50 should be reviewed and updated

6 Councilmembr Enrooth recalled there had been some focus and
7 vision but this had not been considered lately. He agreed some
8 strategic planning is necessary . He cited the example of
9 examining the City' s housing stock would be a good place to
10 start .

12 Some discussion continued regarding the potential for the
13 "Clark Station" parcel -on 33rd Avenue and Stinson Boulevard.
14
15 The Mayor expressed a concern that some undesirable business
16 could go in there . The City Manager noted this parcel is zoned
17 for townhomes . He is still working with someone to develop
18 this site . It could be a very good site for a home hospice
19 facility.

21 Councilmember Marks suggested the comprehensive plan be redone
22 in that there have been many changes in the City' s
23 demographics . He recommended the Planning Commission review
24 the comp plan and perhaps a consultant could be hired to
25 update it .

Councilmember Marks felt there should be a series of meetings
of all persons in the City interested in participating in its
29 future direction . Among those who could be included are focus
30 groups and church representatives .

32 He also suggested that the information received from City
33 surveys be referred to for direction. The information he
34 received from the National League of Cities Conference
35 regarding "visioning" would be very timely. He will get this
36 data to the Councilmembers .

38 The Mayor felt the Council , the Planning Commission and the
39 Chamber of Commerce should all be involved with future
40 planning.

42 The City Manager advised that the cities of Roseville and
43 Moundsview have held town meetings to look at issues and plan
44 for the future. He will contact these two municipalities
45 regarding the format they followed and their results .

47 Councilmember Fleming felt the Council ' s August 3rd work
48 session would be an appropriate time to kick-off this study.

44 read the Notice of Public Hearing which appeared in the July
45 21 , 1993 edition of the St . Anthony Bulletin .

47 Commissioner Franzese inquired if the stated time for a public
48 hearing could be different than 7 : 05 p.m. She felt this could
49 leave residents who are attending a public hearing regarding
50 their property inconvenienced by having to wait .

6 Management Assistant Urbia responded this had been discussed
7 with the City Manager . The City Manager ' s position was to
8 commence the first public hearing of the meeting at 7 : 05 p.m.
9 as is presently the practice.

11 Urbia advised this conditional use permit request was the
12 primary reason for this special Planning Commission Meeting.
13
14 Approval is being sought before school starts . If this matter
15 were not considered before the regularly-scheduled Planning
16 Commission Meeting, it would be too late to locate the
17 portable classroom on school property with Council approval .
18
19 The Council indicated it chose to have this matter brought
20 before the Planning Commission for its review process and not
21 to have this process circumvented .
22
23 Urbia explained that this portable classroom will be used to
24 alleviate space needs for special work projects and will not
25 be used for actual classes . It will be located on the Wilshire
26 Elementary School property in an area which is not readily
27 visible from other areas of the neighborhood.
28 •29 The trailer is 12 ' x 56 ' with a 4 ' hitch on the north end . It
30 will have two doors and the proposed location is twenty feet
31 from the building. State law requires it be located at least
32 ten feet from the building .

34 David Abrahamson , principal of Wilshire Elementary School , was
35 present to respond to any questions members of the Planning
36 Commission may have.

38 Commissioner Werenicz observed that currently a Task Force is
39 meeting to consider permanent solutions for overcrowding- in
40 the schools . He questioned why there is a plan to place this
41 trailer in this location for two years . He recalled another
42 temporary trailer issue was for a period of one year .

44 Urbia responded that there appears there will be a space need
45 for two years for this type of portable classroom.
46
47 Mr . Abrahamson noted there is much better lease cost for two
48 years than one. He also advised there will be no plumbing in
49 the trailer but there will be electricty and electric heat .

6 Commissioner Franzese inquired if there will be any security
7 measures taken regarding this trailer . She observed that it
8 will be located in a relatively unseen place and could be
9 vulnerable to vandalism.

11 Mr . Abrahamson responded that the location was chosen so the
12 unit would be less visible to the neighborhood. He also noted
13 that the lack of vandalism in the area is remarkable and he
14 credited the parents and the children . There are no concerns
15 regarding potential vandalism.

17 Commissioner Werenicz was concerned with the safety of the
18 electrical installation . Mr . Abrahamson stated that the
i9 General Electric Company is doing the installation and he has
20 been assured that it will meet code and any outside apparatus
21 will be safe and concealed .
22
23 The unit is only one and one half years old and is coming from
24 the St . Peter School District . It will have all new skirting.
25
26 Commissioner Franzese inquired if there is a covered walkway
being included in the project . She felt this would be an asset
in poor weather .

30 Mr . Abrahamson noted it will be located a maximum of twenty-
31 five feet from the school building doors . There will be coat
32 racks in the unit to accommodate outer clothing for the
33 children if the weather is cold or wet .

35 Chair Faust advised he had been contacted by Commissioner
36 Madden regarding two of his concerns . The first is that he did
37 not receive a public hearing notice for this matter . He
38 questioned if any were sent .
39
40 Management Assistant Urbia responded that notices of the
41 public hearing were sent to residents within three hundred and
42 fifty feet of the affected property. He noted that Mr . Madden
43 should have received a notice.
44
45 Commissioner Franzese recalled that Commissioner Madden ' s
46 address had changed, although his location had not , and
47 perhaps this could account for why he did not receive the
48 notice. Urbia will follow up on this . .

6 Commissioner Madden ' s second concern dealt with the proximity
7 of the trailer to the soccer fields near the school . He was
8 interested in whether the trailer would interfere with soccer
9 activities as this is a very busy field . Urbia assured him
10 there would be no conflict .

12 The Public Hearing was closed at 7 : 15 p.m.

14 Commissioner Franzese commented that this project is exciting
15 in that it reflects the school district is growing.

17 Motion by Franzese, sescond by Thompson to recommend approval
18 of the conditional use permit as requested by Independent
19 School District #282 noting there was no opposition expressed
20 to its approval , all three conditions for approval were met
21 and with the following conditions : 1 ) the portable unit may
22 remain in place for a period of 24 months from the date the
23 unit is placed on site ; 2 ) the electrical wiring for the
24 portable unit must be encased in a safe manner ; and, 3) the
25 bottom skirting area and hitch must be concealed with
26 appropriate material and there will be no plumbing.

42 Chair Faust read the Notice of Public Hearing which was
43 published in the July 21 , 1993 edition of the St . Anthony
44 Bulletin .

46 The house construction on this property was begun in 1992 when
47 the City had no ordinance requirements regarding lot coverage.
48 During the 1993 recodification process , this issue was
49 addressed and a thirty percent lot coverage policy was
50 adopted .

6 Initially, the builder and owner planned to raze the existing
7 garage along with the fire damaged home . At a later date, it
8 was decided to leave the garage for use as a playhouse and for
9 storage . This resulted in the newly-constructed home and .other
10 impervious surfaces having a lot coverage of approxima-tely
11 31 . 6% .

13 The variance would be for an additional 9 . 7% lot coverage over
14 the existing 31 . 6% lot coverage resulting in total lot
15 coverage of 41 . 3% . These figures are estimates only because
16 the exact sidewalk measurements are not known . The hardship is
17 that the ordinance requirements changed during the
18 construction of this home and the consideration for the future
19 of the garage .

21 Commissioner Franzese noted that in a letter received from a
22 neighbor the request was made that the garage be re-roofed as
23 well as the exterior be upgraded .. She inquired if re-roofing
24 is part of the project .
25
26 The Building Inspector will review this . The contractor
advised that the present roof on the garage matches that on
the house.

30 Commissioner Werenicz suggested that lot coverage had been
31 addressed in the ordinances before recodification . Urbia
32 mentioned that there was nothing specific regarding lot
33 coverage but rather floor area ratio to the structure.

35 Commissioner Werenicz noticed that a deck is planned to be
36 built in the very near future. He was concerned with how this
37 would impact on the ground underneath it and how it would
38 contribute to water flow direction .

40 Urbia advised that this deck will be off of the ground and
41 will have rocks underneath it . There will be no impact as this
42 does not constitute an impervious surface .

44 Mr . Bob O'Connell , 3101 Silver Lake Road , lives next door to
45 this home . He is of the opinion that the garage looks just
46 fine and has no problem with its appearance.

48 Janice Cohn, the contractor, stated that a new roof will be
49 needed on the garage eventually but there are no plans
50 presently to re-roof . Siding .will be put on soon .

8 Commissioner Franzese observed that all of the hardships
9 related to this request appear to be based on the
10 recodification process whereby some of ordinance requirements
11 were changed.

13 She also expressed some concern regarding the proximity of the
14 deck to the garage . She was advised that it will be five feet
15 between the house and the garage which is acceptable.

17 Motion by Franzese, second by Werenicz to recommend approval
18 of the variance petition by the City Council in that no one
19 appeared to speak against the request , the three conditions
20 for granting a variance are fulfilled, and that the following
21 conditions be met : 1 ) the garage exterior must be upgraded to
22 match the newly-built house ; and, 2 ) the garage must be
23 upgraded structurally if the Building Inspector finds any
24 deficiencies .

29 Chair Faust advised this item will be on the Council Meeting
30 agenda on August 10th . He recommended the interested parties
31 attend that meeting.

34 C. Petition for Variance - Michael and Kay Baker , 3044 Croft

40 Chair Faust read the Notice of Public Hearing which appeared
41 in the July 21 , 1993 edition of the St . Anthony Bulletin .

43 This variance is for sixteen feet from the thirty foot setback
44 requirement . This is a two story house with a single tuck
45 under garage. The owners intend to expand their garage into a
46 two car garage. They plan to add living space over the added
47 garage space. This would not be permitted under the garage
48 setback permit process so they are pursuing the -variance
49 process .

6 This type of living space is not addressed under the City ' s
7 ordinances . The property owners feel the hardship is in that
8 this type of request could not be considered under a garage
9 permit process .

11 Other advantages to this addition is that the appearance of
12 the home would be improved with an added living level on the
13 garage to coincide with the height of the house. There is also
14 consideration being given to adding on to the back of the home
15 in the future.
16
17 Commissioner Franzese requested staff to place directional
18 symbols on drawings to accommodate the ease of reading them.
19 She felt this would more accurately identify lot lines and
20 proximity of other houses and structures .

22 Urbia advised this is a corner lot . Corner lots require a
23 thirty foot setback unlike other lots which require only a
24 fifteen foot setback .

26 Commissioner Werenicz expressed his concern with the sight
46 lines at the corner of the block . He feels there are some
shrubs located on this property which interfere with traffic
29 sight lines . He suggested these be pruned back or removed .

31 Mr . Baker stated that these bushes had been pruned recently
32 and he is planning on installing a fence in this area.
33
34 The Public Hearing was closed at 7 : 58 p .m.

36 Commissioner Franzese inq.uired whay a garage permit is not
37 being requested . Urbia explained staff would prefer to keep a
38 narrow definition of a garage permit .

40 Chair Faust also noted that if staff had interpreted this to
41 be a garage permit request it would not have met the three
42 conditions as required . He preferred staff ' s interpretation .
43 He also felt the required setback for a corner lot could be
44 considered as a hardship.

46 Commissioner Franzese stated she would have preferred the
47 garage permit process thereby not needing to satisfy
48 conditions nor hardships . She felt anything is open for
49 interpretation .

6 Motion by Faust , second by Franzese to recommend approval of
7 a variance of sixteen feet of the 30 foot sideyard setback
8 requirement to allow the addition of seven feet at 3044 Croft
9 Drive with the following conditions : 1 ) the existing stucco
10 would be done entirely throughout the home for uniformity; -
11 and , 2 ) the existing gravel driveway would be upgraded to
12 asphalt or cement ; no one appeared to speak against the
13 request ; the three conditions required by Minnesota Statutes
14 were met ; this is an end lot and there is a thirty foot
15 setback instead of a fifteen foot setback required ; and the
16 style of the house with a tuck-under garage constitutes
17 extraordinary circumstances .

19 Commissioner Thompson is of the opinion that this work will be
20 a big improvement .
21
22 Commissioner Werenicz again stated his concern regarding the
23 sight lines at the corner of the lot . He felt the property
24 owners should perhaps consider removing the shrubs and bushes .

26 Urbia advised that the property owner can be requested to
27 remove these shrubs if they are in the right-of-way or
28 interfere with traffic sight lines . He did feel the bushes may •
29 look closer to the corner than they actually are because of
30 the construction in the area .

32 Chair Faust advised there should be a letter sent to the
33 property owners if it is found these shrubs do pose a problem
34 for visibility .

39 August 10th Council meeting and the property owners were

7 coverage has been discussed by staff . Members of the Planning
.8 Commission are being asked for their opinion .

10 Chair Faust finds the current thirty percent acceptable and
11 feels there is no need to proceed with discussion at this
12 time. Urbia suggested that a future discussion be kept in
13 mind .

15 Commissioner Franzese inquired what could be included in the
16 ordinance to. accommodate exceptions which were over thirty
17 percent . Urbia responded this would become very subjective .

i9 Chair Faust , noting there were only four Commission members
20 present , expressed his reluctance to make any changes .
21 Commissioner Werenicz was in agreement with this position .

23 The Planning Commission membership roster was included with
24 agenda materials . Two corrections were made to it .

26 Management Assistant Urbia directed the commissioners '
27 attention to that section of City Code which addressed
abandoned motor vehicles . He advised that after the public
hearing was concluded , Mr . Bona , owner of. Unocal on Kenzie,
30 stated this time prohibition would not work for his business .
31 He noted that there are situations with vehicles on his
32 property where they remain for longer periods of time waiting
33 for parts or repairs . The City Council approved fourteen days
34 in place of the 48 hours for this particular situation.

36 Commissioner Franzese observed what appears to be a typo with
37 regard to required distance of a garage to house. The copy
38 stated thirty inches and she felt it should be thirty-six
39 inches . Urbia will check this out .

41 Chair Faust recommended that "revised" be added to the bottom
42 of any page in the City Code which has revisions . This will
43 help future Planning Commission members as well as be a good
44 reference . Commissioner Werenicz noted it could also be
45 helpful in avoiding legal problems .

47 Commissioner Franzese observed that pumps appear to have been
48 moved at the gas station on 33rd Avenue and Stinson Boulevard .
49 She also inquired as to the status of the CUB Store at Apache .

6 Urbia responded that the City is still waiting for some
7 documents, the signed development agreements and the landscape
8 plans . There are still some details being worked out regarding
9 the lease for the City ' s liquor store. He is hopeful all of
10 this will be finalized in the very near future.

12 Commissioner Thompson inquired as to the progress of the
13 dental building scheduled to be built on 39th Avenue and
14 Silver Lake Road.

16 Urbia advised that the development agreements have all been
17 signed and received in City Hall . It is expected this project
18 will move quickly now.

20 Chair Faust explained that tonight ' s meeting is in lieu of the
21 regularly scheduled meeting. He inquired if there are any
22 agenda items which would necessitate holding a meeting on the
23 third Tuesday of August . Urbia stated there are no items .

26 Planning Commission member . Urbia explained he is employed in
27 the environmental field . Chair Faust has contacted him to
28 welcome him to the Commission. He is absent from tonight ' s
29 meeting as he is on vacation.

Background
The School District is requesting a portable classroom to help alleviate space needs. The
placing of the portable unit is in an area that is not readily visible from other areas of the
community. The portable unit will be used for special work projects, and not for actual
classes. There will be an electrical connection but no plumbing. There will be two or three
doors, depending on the model ordered. The trailer is 12' X 56' with a 4' hitch on the north
end. According to the Fire Chief, the unit must be at least 10' away from the school building,
as required by state law. The proposal calls for a 20' setback of the portable unit from the
building.
• Note: I have included a small drawing to give an estimation of location. A drawing to scale
is at City Hall and will be available prior to and at the meeting.
Recommendation
Recommend approval of the Conditional Use request with the following conditions:
(1) The portable unit may remain in place for a period of 24 months from the date
the unit is placed on site.
(2) The electrical wiring for the portable unit must be concealed in a safe manner.
(3) The bottom area and hitch must be concealed with appropriate material.

Last week I discussed with you the School District's interest in placing a portable classroom
on the Wilshire Park Elementary site. It now appears we will move forward with this action
for the 1993-94 school year.
In a recent discussion with Larry Hamer he mentioned that such a decision must be shared
with the Planning Commission and City Council prior to the physical placement of a
portable. Obviously we wish to follow whatever regulations the City may have in order to
meet applicable codes.
We have no intention of adding plumbing to the unit,as it will be used in a casual way and
not as a formal classroom. The intent is to use it for small group and/or one-on-one pull-out
instruction. We will however,need appropriate electrical service.
I need to know the procedure we must follow in order to place the portable unit on site,
hopefully by August 1. Please let me know if there are specific applications that need to be
made,or if this letter would suffice.

Background
The home construction began in 1992, under the ordinance conditions prior to recodification
in 1993. At the time, there was no lot coverage provision in the ordinance. The newly built
home and other impervious surfaces have a lot coverage of approximately 31.6%. The builder,
in obtaining a building permit, planned on razing the existing garage structure in the backyard,
as well as the fire damaged home. The owner of the property-decided at a later date to keep
the existing garage for use as a playhouse and storage. The hardship is caused by City
Ordinance, as it changed during the building process. During any building process, there are _
times when decisions are changed.
• Recommendation
Recommend approval of the Petition for Variance for the lot coverage requirement of 30% to
allow the existing garage to remain. The hardship is caused by City Ordinance. The variance
would-be for an additional 9.7% lot coverage over the existing 31.6% (estimate) lot coverage.
The total lot coverage would be 41.3%. The following conditions must be met in granting the
variance:
• The garage exterior must be upgraded to match the newly built home.
• The garage must be upgraded structurally, if the Building Inspector finds any
deficiencies.
Notes
• The owner has a letter on file stating that she will follow the decision of the City
Council
• The existing lot coverage minus the detached garage structure is an estimate only
because the exact sidewalk measurements are not known. I used a figure of 2% of the
total lot area to determine the sidewalk area. The following is the components in
determining lot coverage:
Total Lot Area = 134.12' + 15' * 68' = 10,140.16s'

Background
The applicant, Michael and Kay.Baker, 3044 Croft Drive, request a variance of 16 feet from
the thirty foot sideyard setback requirement. As this is a two story home with a single tuck
under garage, the garage setback permit cannot be used if the owner builds living space over
the added garage space. The hardship would be caused by City Ordinance, as under the garage
setback permit this would be allowed. In addition, this would correct an extraordinary
circumstance, as the appearance of an added garage area without living space above would
degrade the appearance of the home. By granting the variance, an undue hardship would be
relieved in allowing a double garage, which meets the standards of today.
• Recommendation
Recommend approval of a variance of 16 feet of the 30 foot sideyard setback requirement to
allow to the addition of 7 feet. The allowance of the variance request would allow for a
double garage and additional living space, which will provide uniformity to the home. The
variance request should be approved with the following conditions:
(1) The existing stucco would be done entirely throughout the home for
uniformity.
(2) The existing gravel driveway would be upgraded to asphalt or cement.

As requested by the City Council, I have contacted neighboring communities regarding this
_ issue. The results are as follows:
(1) New Brighton -- resolution approved for option number one.
(2) Mounds View -- one employee eligible. If employee is interested, staff will
recommend to the City Council to approve option number one.
(3) Columbia Heights -- three out of eight eligible employees are interested.
Staff will recommend to the City Council to approve option number one.
(4) Roseville -- will consider option number one, but there is not an overall
interest by eligible employees.
• (5) Fridley -- resolution approved for option number one, two of three eligible
employees retired. The two employees planned to retire regardless of the
incentive.

RESOLUTION 93-042
A RESOLUTION TO OFFER EARLY RETIREMENT INCENTIVES
WHEREAS, Laws 1993, Ch. 192, authorizes cities to offer an early retirement incentive to
certain long-service employees, and
WHEREAS, The City of St. Anthony can benefit from a reduction of its work force by
conserving scarce financial resources, and
WHEREAS, the City of St. Anthony can make one of the two authorized options available
at no direct cost to the city or its taxpayers.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St.
Anthony:
1. City employees who are eligible under Laws 1993, Chapter 192, and are
covered under Minnesota Statutes Section 353.29 and 353.30, are hereby
authorized to accept and receive the multiplier percentage increase authorized
by Laws 1993, Chapter 192, Section 108, Subdivision 3(b).
2. It is not the intent of the resolution to authorize any hospital, medical, or
dental insurance continuation benefit option for any city employees or former
city employees.
3. Any vacancy created when an employee has taken an early retirement incentive
as authorized by this resolution, shall be filled only after passage of a
resolution or motion passed by the City Council.in which the vacant position is
described and the need to refill the position is stated.
NOTE: 353.29 and 353.30 apply to basic and coordinated PERA members, not to
members of PERA police and fire fund.
Eligibility of the incentive program is limited to employees who have at least
25 years of combined service credit in any state pension plan or at least age 65
with at least one year of combined credit, are immediately eligible upon
retirement for an annuity, are at least 55 years old, and retire on or after May
is 17, 1993, and before January 31, 1994.
