6 Motion by Commissioner Bjorklund and seconded by Commissioner Jones to,
7 recommend Council approval of the request from Mike McGinn, 4021 Fordham ! ,
8 Drive, to subdivide without platting, Lot 9 , Block 4, Mounds View Acres
9 (described as 4017 Fordham Drive) into two single family residential EI
10 lots, approximately 62. 25 feet wide by 296 feet in length, totalling
11 18,400 square feet each, and to grant the necessary variance to the City
12 Zoning Ordinance which requires a minimum lot width of 75 feet, finding
13 that:

15 1. No opposition to the request was demonstrated at either the May 15th
16 or June 19th considerations or through communications with City staff.

18 2 . The applicant had secured the signatures of his neighbors on a docu-
19 ment which indicated approval of the proposed lot split and variance.

21 3. The unique physical attributes of this property and the adjoining
22 lots , as well as the fact that the property to rear remain un-
23 developed along with the fact that a precedent for similar lot
24 splits exist in Mounds View Acres and on the adjoining properties
25 where quality homes have been constructed by the applicant.

27 4. Platting the property would be expensive and cumbersome. •

31 At 7:53 P.M. , the Chairman read the notice of the hearing to consider i
32 a petition from Mike Pribula, 3570 Buchanan Street N.E. , to allow the
33 construction of a 36 foot wide single family home on the 50 foot wide
34 by 125 foot long vacant lot at 3231 Roosevelt Street N.E. ,which would
35 require a one foot sideyard variance to the City Ordinance requirement
36 for 15 foot sideyard setbacks . The notice had been published June 6th
37 and mailed to all property owners of record within 200 feet of the
38 subject property. No one present reported failure to receive the notice
39 or objected to its content.

41 Mr. Childs confirmed that the lot is a vacant lot of record which is con-
42 sidered by the City to be buildable under Section 12 , Subd. 1. 2 of the
43 Zoning Ordinance. The Manager reported receiving no objections to the
44 request, except a call from the neighbor to the south who felt much
45 better when she learned of the 10 ' setback on the south side and .that
46 the garage would also be on the north side. Mr. Pribula indicated he
47 was building the home for his own use.

49 The sideyard setbacks would be 10 feet on the south, leaving 15 feet
50 between houses, and 4 feet on the. north, leaving 19 feet between houses,
51. according to Mr. Pribula who .indicated there is a house across the
52 street very similar- to the one he wants.,to build. He also told the Com-•
53 missioners that the existing trees 'on his property would not interfere
54 with his =constructing the home as he -proposed. Mr. Childs indicated the
'55 proposed structure would- be.'in alignment with. the homes. on each side
56 which are approximately 25 and 22 feet from their front property lines.

5 Motionby Commissioner Bjorklund and seconded by Commissioner Jones to
6 recommend the Council grant a one foot sideyard setback variance -which
7 would allow P1ike Pribula to construct the single family dwelling he
8 proposes on the vacant lot at 3231 Roosevelt Street N:.E. , finding that:

10 1. The proponent had developed a proposal which would conform to the
11 wishes of his neighbor to the south. related to the placement of
12 his garage.

14 2. There was no other opposition from- adjoining property owners.

16 3. Several lots and homes of the same size have been developed on that
17 street-.

19 4. The unique characteristics of this lot with the extended shape and
20 no street address would appear to constitute a hardship for the
21 applicant to construct his home according to the Ordinance requirements .

23 Motion carried unanimously .

25 At 8 :07 P.M. , Chairman Zawislak opened the hearing to consider a petition
26 from Edwin and Alyce Brown for a variance to -the City Zoning Ordinance .
• 27 requirements which, would allow them to reconstruct their home at 2702
28 33rd Avenue N.E. ," which was severely damaged in the April tornado, with
29 an entryway which: would be two feet closer. to Belden Drive than its
30 existing distance of 14 . 2 feet. He read the notice which had been
31 Published June 6th and mailed to all adjoining property owners of -
32 record within 200 feet of the subject property. No one present reported
33 failure to receive that notice or objected to its content and the
34 Manager reported receiving no objections to the request.

36 Gary Brown, 1317 Hillside Circle, Chaska, MN, who had accompanied his
37 parents to the meeting, presented their request, saying they wanted to
38 replace- the old entryway with another which would be two feet longer
39 and which would not be so steep. The Manager confirmed that this would
40 require a two foot variance. from the setbacks established when the home
41 was built long before Belden Drive was constructed. In his June 15th
42 memorandum, Mr. Childs had recommended the variance be approved per
43 ceiving that the existing corner lot which is only 42 . 2 feet wide could
44 not accommodate a standard size house, anyway, and said there are
45 several other substandard lots and homes in the same block which .we. re
46 also grandfathered in with the. City Zoning Ordinance..
48 The applicants ' son assured Commissioner Jones that the existing driveway
49 ended at the front door and that there would be- no objections to having
50 it removed - if there was a concern that- it might be used to drive around
51 the house. The new garage fronts on Belden, he added.
• 53 Commissioner Jones indicated he perceives the reconstructed home would
54 be areal asset to the neighborhood, and he-.believes this to be just
55 another., instance of where the extra setback size required for corner
.56 lots is' not necessary.
I notion by Commissioner Franzese and seconded by. Commissioner Jones to

14 3. The applicants would suffer a hardship if they are forced to replace
15 the steep entryway on their existing home.

17 4. There was no demonstration: of opposition to the request from the
18 neighbors .

23 to remove the consideration of the request for signage for the St.
24 Anthony Court Homeowners Association from the table .

28 In his June 15th memorandum, the Manager had recommended that in .place
29 of the two signs the City had permitted to identify the townhomes over
30 the winter months , a single two-sided sign would be allowed on the
31 existing berm north of the main entrance, which Mr. Childs perceived
32 would better meet the intent of the Sign Ordinance and adequately-
33 identify the property. Because of the close P.U.D. tie-in with the
34 signage on the barber shop next door, the Manager had referred to that
35 signage as another issue which could affect the decision on the town-
36 home signage . He read aloud the letters he sent to Craig Morris May 21st
37 and June 7th, urging him to be in attendance at the hearing which would
38 be held at 8 : 30 P.M. that evening. There had been no response to
39 either. request that Mr. Morris bring in plans for a permanent sign to
40 replace the temporary sign in front of his shop which had been damaged
41 by the tornado .and the Manager suggested the discussion of the St.
42 Anthony Court signage be deferred until after 8: 30 P.M.

44 Motion by Commissioner Jones and seconded .by Commissioner Bjorklund to .
45 move the agenda to item 7A.

49 At 8:22 P.M. ,, the hearing was opened. to consider . the request from Reverend
50 Joseph.. A'.. Valtinson, Jr. , Pastor of Elmwood Lutheran Church, .for place-
51 ment- of , a 12 -foot .X! 65 .foot .mobile home on the north.-end- of the church
52 property at . 3615 Chelmsford Road .N.E. , which could be utilized. as.
'53''temporary. :Sunday •Schoo1 classrooms during the time, not ,to exceed three
54 ,years, during' which. time the- congregation-,would be conducting 'a. drive ,
55 to raise $95,000 with which to construct .:a sanctuary/classroom addition
56 on that side. of the existing church structure. - The , notice -of the hearing

3 Zawislak. -No one preserit :reported failure to receive the notice or
4 objected to its content. Copies of the petition request- for the
5 temporary structure and the explanation of the church's proposal had
6 been included in -the Commission packet along with a copy of the May 24th
7 letter from Erling M. Weiberg, spokesman for the group of neighbors who
8 had participated in the previous planning for an addition on the south
9 side of the church, indicating that the neighbors were in favor of the
10 church being permitted. to utilize the trailer for -classrooms until the l
11 northern addition could be built.

14 period of three years on the condition the trailer is skirted and tied .
15 down.- He also indicated the church representatives had .agreed to place t
16 the mobile home ten feet from their building to meet the fire code.
17 Mr. Childs indicated there had been no calls about the request. E

19 Commissioner Bjorklund indicated he perceived this request did not
20 differ much from schools who erect similar structures to accommodate
21 classes while they wait' to see whether their student population would
22 go down. Commissioner Jones indicated he was not in favor of granting
23 permission for the interim- addition for as long as 'three years , per- E
24 ceiving the church should know whether they would be able to build the
25 structure within two years, and, at that time, they could request an
�26 extension of their permit until the addition is up'. Commissioner Wagner
27 was concerned that the structure would be sturdily constructed and
28 suggested it might not be needed until October.

30 Reverend Valtinson indicated the church would be renting space in the
31 Wilshire-school building for 100 pupils this summer but said it was '
32 difficult to get the little ones to the school in the winter. He '
33 indicated there would be no plumbing in the structure and said some EE°
34 of the church Council members had not been too impressed with. the trailer t
35 the church had first considered which had been used by Control Data
36 for business purposes.

38 Donald Esau and Larry Antczak, 3505 and 3501 - 36th Avenue N.E. , the
39 neighbors who live closest to the church,, were present and-.Mr. Esau
40 indicated he was speaking on behalf of Mr. Weiberg who had been unable
41 to attend. He reiterated that all the neighbors on 36th Avenue and
42 Mr. Hastay on Chelmsford had been contacted and all supported -the new
43 plans of the church and their request fora structure to use as temporary
44 classrooms until the new addition is completed. He said, since the
45 meetings on the south addition,. communications had been kept' open- between
46 the church and the neighbors -and, although, there was still-. some concern
47 about , the slope of the. land between the church and the neighbors ' pro
'48 perties, the church had been keeping that area mowed this summer. He
49 attributed the change in feelings between the parties to .the efforts of
.50 the City(' 'Council, staff, and Planning - Commission-. Mr. Esau also
.51-confirme.d that none -of the neighbors were against permitting the churc' h-
�52. to use the mobile. home for. three years .

54 Commissioner Bjorklund indicated he believed two' winters' should be
55 enough and that staff: should be authorized to -veto any structure which

l' 'does not meet the standards of that residential neibhborhood. : Com •
. 2: missioner Bowerman said he :agreed . that some restrictions had to . be. put
. 3 on -the request, but, did not believe the Church should be forced to
4 undertake a $95,000 project sooner than is fiscally responsible. . .Com-
5 :missioner Franzese said- she: reco.gni.zed that the church, should .be able . i
6. to keep the trailer long enough to make it worth their cost and would---I
7 also be in favor of not imposing stringent conditions .on the- approval .' I
8 'The Chairman indicated he was puzzled that, now that the neighbors were
9 in accord with the church's plans, the Planning Commission was the
10 party in opposition. He sided with the neighbors , believing the City -
11 should let them work things out with the church. F

13 Commissioner Jones said he could foresee many problems arising from the
14 use of the trailer which the neighbors might not see at this point. He
15 wanted the City Fire Marshall to check out the facilities before so �
16 many children are permitted to use them and wanted assurance the exterior 1
17 of the structure would be well maintained while it was in use , which
18 Commissioner Bowerman questioned the City could force, citing several
19 instances of poor maintenance the City has not been able to control.

21 Reverend Valtinson indicated the congregation' s concern for the welfare j
22 of the children would prompt them to have a fire inspection made. He I
23 said...the church would need to have the. new classrooms in place early I
24 in August so preparations could be made before the fall sessions began.

26 Pdotion by Commissioner Bjorklund and seconded by Commissioner Jones to
27 recommend the Council grant a variance to the Elmwood Lutheran Church • i
28 which would allow them to install a mobile home to be used for class- r
29 rooms , to the north of their existing church at 3615 Chelmsford Road
30 N.E. , August , 1984, for a period not to exceed two years , with provision
31 for the extension of that permit subject to the review and determination
32 of the City staff. In recommending that the variance be granted, the
33 Planning Commission finds that:

35 1. A proposed church addition to the existing church building, which
36 meets the .approval of the neibhbors , is in the planning stages , and
37 that project is .the reason the temporary structure is needed.

39 2 . The temporary structure would be in an area where it could not be
40 easily seen.
41
42. 3. There was no .opposition to the proposal but. was instead supported
43 in writing by the neighborhood spokesman and in person by the two
44 closest neighbors .

46 _4. A -precedent for allow such structures had been established- in the
47 . City prior. to this request.

49 Motion carried. unanimously.

51 .Commissioner .Bjorklund :questioned .whether. the propane --tank, in front -of_
52 the..American -Monarch building -on -37,th-Avenue N.E. could pose a hazard. •
53 for:'the residents across .the street -in the. event another destructive-
54-.wind. passes. through-..the --City. Mr.. .Childs . indicated .-he would •check� with
55 the Fir.a-. Department about. the possibility, although he is certain they
56 know the tank is . there..

• 1 At 8: 35 P.M. , the hearing on the St.' Anthony Court signage was resumed i
2 with Mr. Morris having failed to make an appearance. . Chester Krumm,
3 President of the Homeowners Association, had resubmitted the application
4 for the two signs they were allowed over the winter with his Play 24th
5 letter to which he had attached a rendering of the Pine Cone Nursery
6 in Coon Rapids, illustrating the landscaping and plantings which would
7 be bermed up in such a manner that the legs of the existing signs would i
8 be concealed.

10 Mr. Krumm and another Homeowners Association member, Edward T. Mattson, c
11 reiterated that they perceived the signs were important to distinguish `
12 their driveway from the Silver Lake Road and to prevent vehicles coming I
13 from Apache from driving right into their property or making U turns
14 off Silver Lake Road on the driveway. Their property needs to be
15 identified as private property from both directions on Silver Lake Road,
16 Mr. Mattson said. Mr. Krumm also told the Commission the townhome �
17 owners were also considering barricading the northern entrance to their
18 property because of the number of cars and semis who drive on their
19 roadway and break down the curbs .

21 Commissioner Jones noted there is a street named Silver Lake Court not
22 too far away and he wondered if maybe the use of "court" on the sign
23 (_"St. Anthony Court") might have contributed to the confusion. Com-
24 missioner Franzese suggested the Manager might contact Ramsey County
25 to see if signage could not be put up in front of the townhomes
26 prohibiting U turns. `

28 Commissioner Bjorklund indicated he recognized the homeowners' need to
29 identify their property but told them he considered the signs that were '
30 up now to be cheap and not of the same quality or appearance as is
31 required by the City 's Sign Ordinance. He cited several instances of
32 commercial signs which more closely matched the type of construction
33 St. Anthony prides itself as demanding.

35 Commissioner Bjorklund indicated he had heard that the owner of the
36 barber shop at 3909 Silver Lake Road was going to sell his business and
37 he wanted the City to take immediate action regarding the signage for
38 that business which was damaged in the recent storm because he believes
39 Mr. Hedlund still owns that parcel. The Commissioner believes one good
40 quality sign for the townhomes should be the only identification sign
41 permitted for both properties in accordance with the P.U.D.
42
43 Commissioner Wagner questioned the value of signs which were probably
44 covered with snow most of the last winter. Mr. Mattson indicated he
45 believed the berming be about 22 to 25 inches above present ground level.
46 Mr. Krumm said the snow storage had been somewhat of a problem with the
47 exceptional snows we had this winter, but the homeowners had kept them
48 pretty well plowed out, he added.

50 Commissioner Franzese indicated she saw no need for two signs and agreed
51 the quality of the signage should be improved over what is there now.

53 Commissioner Wagner said he would rather see one well designed sign
54 replace the two signs that are in front of the townhomes now.

1 Commissioner Bowerman- had- no objections to two signs. as long..,as they. .areo
2 -easy- to read from both directions... .He hated to see .the City put -undue. . i.
3 restrictions : on the signage which the Association..might not be able- to..- ,
4 afford.

6 Commissioner Jones said he would make a motion to expedite matters but
7 still believed two signs were needed to define the townhome location.
8 However, he would be willing to put off a final decision until staff
9 has had an opportunity to work with the Association representatives on .:
10 signage which would meet the criteria set in the Sign Ordinance.

12 The Chair indicated he would also like to see staff meet with the
13 applicants to get a better sign and he liked the idea of having. the
14 County .sign the road in front of the townhomes to alleviate some. of the
15 problems the owners have said they have.

17 Commissioner Bjorklund indicated he wanted .to protect the interests of
18 the neighbors in that area who had toiled away so many years to get a
19 suitable project for that property.

21 Commissioner Hansen said he would prefer one sign which could be well .
22 designed so it could be seen from both directions on Silver Lake Road.
23 He suggested that if only one sign were developed, the money. invested
24 in two signs could be applied to even better landscaping than proposed.. .
25 He wondered if a "V" shaped sign might be more effective and opposed
26 voting on a motion without assurance that the quality of the signage
27 would be improved.

29 Motion by Commissioner Jones and seconded by Commissioner Franzese to
30 recommend the Council grant the St. Anthony Court Homeowners Association
31 a variance to the Sign Ordinance which would allow them two signs to I
32 identify their property, which would be 10 square feet each, and to , - i
33 recommend the City staff work with the Association representatives on
34 the final plans for the signs which should be ground hugging; well
35 landscaped, as proposed; and of substantial materials to conform to
36 the quality of the construction of the townhomes .

46 Motion by Commissioner Jones and seconded. by Commissioner Bjorklund to
47 table action on the variance request for 30- days to give -staff- sufficient
48 time to work with the . townhouse representatives to develop adequate,
49 but quality signage to identify their property and . (to recommend) the
50.-homeowners be granted an. additional 60 days to use -the : existing signs .

• I The discussion of the Morris sign resumed with- Commissioner- Bowerman.
2 saying ,it was definite- in his mind that the Craig Morris sign- was
3 intended to be only temporary in nature and that it was permitted in
4 -lieu of permanent signage for the rest of:.the P.U.D. project, when, or
5 .if, such a project was developed- for the. rest of the Hedlund property
6 along Silver Lake Road. The :Commiss.ioner stated further that the Morris
7 sign didn' t come anywhere close to : the criteria set for a commercial .
8 business.

10 Motion by Commissioner Franzese and seconded by Commissioner Bjorklund
11 to recommend the Manager be authorized to follow the course of action
12 stated in -his June 7th letter to �Mr. Morris if the. barber shop pro-
13 prietor fails to takedown the sign which is in violation of the
14 ordinance (within 30 days) staff be directed to remove it*, after con-
15 sulting with the City Attorney.

17 Motion carried unanimously.

19-There were four proposals listed in the agenda for which the Commissioners
20 ere asked to give concept reviewal and recommendations to the proponents.
21 Commissioner Bjorklund indicated he believed four at one meeting were
22 too many, especially in view of the number of hearings which had been
23 scheduled for the same evening. Mr. Childs said he would keep that
24 in mind in the future.

28 dining. area on the south side of their home out. two feet at the same time
29 they construct a three season porch on the back of the house on the .
30 same side, which would require no variance from the City . Mr. DeKanick
31 indicated they wanted a larger dining room to accommodate large family
32 dinners and he could not see why his neighbor to the south objected to
33 the expansion because the dining room only -faces the neighbors ' garage.
34 This neighbor was the only one who did not 'sign the letter of approval.
35 he took around the neighborhood, Mr. DeKanick said. Mr. Childs had
36 verified in his June 15th memorandum on the request that the neighbor
37 in question had strongly objected to their proposal to come within 3
38 feet of the property line.

48 access between the houses difficult. He perceived, there no real hard-
49 ship but -only an inconvenience- for the 'applicant if the request is denied.

20 of a similar operation in another locale.

SUMMARY DISCUSSION OF SUBJECT: The Planning Commission completed a concept
review on this request at the last meeting. The DeKanicks propose a 2 foot X 124
foot addition to the south side of their home at 3109 Wilson Street N.E. The zoning
ordinance requires a 5 foot setback, where the applicant desires a 3 foot side yard
setback. The neighbor to the south strongly objects to the variance and has indicated
that they will take legal action if the variance is approved.
The DeKanicks have also requested that their addition be defined as a "bay" which is
allowed to come within 3 feet of the side property line. (See Section 12 , Subd. 3.2
(page 27-28) of the Zoning Ordinance) . The Ordinance and Building Codes do not define
bays , but the dictionary calls it a "wing" of a structure, which is probably not
what is intended by the Ordinance. A Planning Commission interpretation would be
helpful .
ALTERNATIVES: Approval or denial should have substantial reasons to support them. A
review of last month' s minutes might indicate one or more positions for the Commission
to take.

We respectfully submit a request for a lot variance. The variance we
ask is 2 ft. Our lot is 75 ft. , the proposed house is 62 ft. The south-
ern neighbor is approximately 19 ft. from our lot. The northern neighbor
is approximately 14 feet from our lot line.
Placing our home equidistant from the North and South boundaries would
leave 25.5 ft. between houses to the south. The northern boundaries would
leave 20.5 ft.
We believe the quality of design would be an asset to St. Anthony Village.
We also believe the house blends nicely into the present neighborhood.
Incidently, the proposed house design won three Reggie Awards for excellence
in the 1982 St. Paul and Mpls. Parade of Homes. Our construction tectmiques
would copy the winning design. •

Dooner proposes an 18 foot setback where 30 feet is required and cites an odd-shaped
lot as the hardship or special circumstance and cites other properties in the neigh-
borhood with shorter setbacks as precedent for his request._
ALTERNATIVES : Recommend approval or denial to the Counci 1 .
RECOMLIENDATION: Because of the lot configuration, a justification for a hardship
may exist. Fi er, while average alignment does not allow the setback he proposes ,
the average neighborhood setbacks are substantially less than 30 feet and other
variances have been granted, setting a precedent for the request.

SUM1'4ARY DISCUSSION OF SUBJECT: Ruth Smith 's home was destroyed by the tornado.
She proposes to build a new home with an attached garage to replace her previous
smaller home which had a detached garage. The home would face 34th rather than
Edward Street, which then presents a setback problem.
ALTERl�;ATIVES :
1 . Grant a variance due to the small size of the lot, or
2. Interpret the front of the corner lot to be the short side (regardless of where
the front door is) in which case a variance is not necessary.
3. Recommend denial .
RECOMMENDATION: As I suggested at a previous meeting , I recommend that for corner
lots , the Commission establish a policy that the short side is the front regardless
of the location of the front door.

SUM14ARY DISCUSSION OF SUBJECT: As a part of their tornado reconstruction activity.
Faith Methodist Church proposes a small addition to the church. Since churches are
conditional uses in a single family (R-1) zone, your conditional use approval is
required for the expansion. The only concern which staff had about expansion of the
church dealt with the need for additional parking, since I am aware of occasional
complaints from neighboring homeowners. The church is aware of a need for additional
parking and proposes an additional 20 spaces.
AL'T'ERNATIVES : Approve, modify or recommend denial .
RECOM IENDATION: No objections have been received and I recommend approval because
of the efforts of the church to address their parking situation.

SUMb1ARY DISCUSSION OF SUBJECT: The St. Anthony Health Center proposes an 84
unit senior housing project to be connected with the rest home and located on the
vacant property immediately west of the existing facility. Such a use requires
conditional approval in an R-4 zoning classification. In addition , they propose a
height of 4 stories 0 allowed) and a total number of units in the two structures
(existing plus proposed) of 14.9, where 119 are allowed. The attached memo shows that
the neighbors were invited to an informational meeting by the Health Center. I under-
stand attendance was sparse. We have received no objections .
AL'T'ERNATIVES : Recommend approval , modification, or denial .
RE-COMMENDATION: Recommend approval , since 149 units of elderly housing and rest
home may be much less intensive than 149 units of market rate apartments with lots of
vehicles , larger family units , more traffic and generally larger units . This appears
to be an excellent proposal .

Notice is hereby given that there will be a public hearing by the
Planning Commission of the City of St. Anthony on Tuesday, July: 17,
1984 , at 8 : 45 P.M. , in the Council Chambers of the City Hall , 3301
Silver Lake Road (enter northeast corner) for the purpose :
Consideration of a request from St'. Anthony Health Center, 3700
Foss Road N.E. , for a conditional use permit to allow con-
struction of a senior rental housing building in conjunction
with the existing rest home facility and located on the existing
vacant parcel directly west thereof and described as Lot 8
(exc. the N 75 feet of the E 1/2) and all of Lots 9 , 10 , 11 ,
12, and 13, Block 11, Mounds View Acres Second Addition , Ramsey
County.
The applicant further requests two variances for said project
as follows :
1 . Applicant proposes a height of 4 stories or approximately •
42 feet, where the Zoning Ordinance permits the lesser of
3 stories of 35 feet.
2 . The applicant proposes 84 units for a total of 149 units
on the site . The Ordinance allows 119 units on the site .
Anyone wishing to be heard with reference to the above matter shall .

HOUSING*-AND REDEVELOPMENT AUTHORITY MINUTES
• May 22, . 1984
The meeting was called to order by Chairman Sundland at 9 :46 P.M.
Present for roll call: Sundland; Vice Chair Enrooth; Secretary/
Treasurer Marks; and Commissioners Ranallo and
Makowske.
Also present: David Childs , Executive Director; William Soth,
Attorney; Muffy Gabler of Walker Senior Housing Corpora-
tion; and Steve Yurick of Arkell Development Corporation.
Motion by Secretary/Treasurer Marks and seconded by Commissioner
Ranallo to approve as submitted the minutes of the H.R.A. meeting held
May 8, 1984.
Motion carried unanimously.
Motion by Commissioner Ranallo and seconded by Secretary/Treasurer
Marks to authorize the reimbursement of $4,000 to Arkell Development
Corporation to cover the costs of demolition of the G & G Autobody
building for Phase 1 of the Kenzie Terrace Redevelopment Project minus
-the rock for the driveway -as per their agreement with the H.R.A.
Motion carried unanimously.
• The Fourth and Fifth Amendments to the Redevelopers Contract were pre-
sented by staff for H.R.A. consideration. Mr. Childs read the changes
in Page 11 of the Third Amendment and Mr. Soth read the amendment
modifications to the Fourth Amendment which would extend the con-
struction deadline on Phase 1 from June 11 to July 1, 1984 as requested
by the developer. Mr. Yurick reported the 47th unit in the Kenzington
had been sold that evening and indicated the ground breaking ceremonies
for the project would be held- at 11:00. A.M. , Saturday, June 23rd.
Commissioner Ranallo complimented the developer on the fine dinner
reception, which had been given for all those who are purchasing a
condominium and said the ground breaking ceremonies would add to the
credibility of the project.
Motion by Secretary/Treasurer Marks and seconded by Vice Chair Enrooth
to approve the Fourth Amendment to the Redevelopers -Contract as pre-
sented by staff.
Motion carried. unanimously.
Motion by Commissioner Ranallo and seconded by Secretary/Treasurer
Marks to approve the Fifth Amendment to the Redevelopers Contract
which would extend the construction deadline on Phase 1 from June 11th
to July 1, 1984 as- per staff recommendation.

Motion by Secretary/Treasurer Marks and seconded by Vice Chair Enrooth
to adjourn the Housing and Redevelopment Authority meeting at 9:55 P.M.

The meeting, _which `had been ' rescheduled from June 11th', -was opened 'at
7: 3'0 P.M. with the Pledge of Al legiance ' led'. by Mayor -Sundland.

During the discussion of the May 22nd Council meeting minutes; •Councilman .
Makowske indicated she would never have voted for the motion on Page 7
which authorized the City's support for the acquisition of a Doppler"
Radar system for testing by the National Weather service, but, rather,
had perceived that motion had only authorized the City Attorney to look
further into the matter. Councilman Enrooth had told her he had
seconded the motion, -fully understanding.: tha't Mr. Soth had already
indicated that he saw no problem with the City lending its non-profit
tax identification for `donations for the-.purchase of the' equipment to
be made in the City's name and that the motion approved such an action
while authorizing the details to be resolved to the satisifaction of
• the attorney. Mayor Sundland and 'Councilman Ranallo indicated they.
had based their vote of approval on the same assumption. Mr. Childs
added that he had found out that the upgraded Doppler system recently
announced by Channel 5 was still not the- equipment with a single
computer assisted display system, which the Kavouris- Company had
proposed be tested by the Weather Service.-
Councilman Ranallo modified, with- the approval of the others`, the word-
ing of Paragraph 8, Page 3, to indicate the Council and the Mayor 'had
only authorized the Fire and Police Departments to look into the
feasibility of writing anew ordinance to 'req'uire -partitions between'
every two stalls in apartment garages. The Councilman said he was
concerned the restrictions might apply to the -Kenzi•ngton •garages , but
Mr. Hamer told him he understood the State Uniform Building' :Code would
be making an exception for that structure due ' o, the construction
materials used.

A number of questions were raised related to the temporary 3.2 beer
permit requested for the LeDoux's Corner N.E. softball tournament to
be held in Central Park, August 11th and 12th, for which $200 a day in
rental fees were to be charged.
Motion by Councilman Ranallo and seconded by Mayor Sundland to table
action on the application for a temporary 3.2 beer permit from Thomas
Brama for the softball tournament to be held August 11th and 12th, until
staff has investigated further the applicant's home address and whether
the applicant proposed the sale of beer.
Motion carried unanimously.
Motion by Councilman Ranallo and seconded by Councilman Enrooth to
approve payment of all verified claims listed for May 31, 1984 in the
May 22, 1984 Council agenda, as well as $1, 393.65 to Dorsey & Whitney
for legal services during April, 1984.
Motion carried unanimously.
Councilman Ranallo indicated he was very encouraged to see the City's
Marketing Committee would be looking into ways of aiding young families
to purchase homes in St. Anthony. He was also pleased to find that
the Committee intends to cooperate in the grand reopening of the Silver
• Lake Mall (.Apache Plaza) and it was noted that the garden clubs would
be working with the mall management to improve the aesthetics of the
area around the center.
Councilman Enrooth reported attending a recent meeting of the Silver
Lake Home Owners Association at the Salvation Army campgrounds and said
he perceives the lake to be a real asset to the City, one which may have
previously been overlooked. The Councilman indicated there had been a
great deal of discussion about the misuse of the lake and a Columbia
Heights Police Officer who was in attendance had told the residents
their complaints about racing boats , etc. , should be directed to either
the Ramsey or Anoka County Sheriff's Offices. The Mayor said he had
investigated and found Ramsey County is responsible for policing the
lake and had suggested to them that it might be beneficial to have
the water patrol to make an occasional appearance on the lake.
Councilman Makowske said she had received a call related to the City's
Channel 11 T.V. advertising for the new liquor warehouse which the
caller had termed as "very tasteless" . Ray Nelson had received many
complimentary comments about the same television spot, according to the
Manager.
The January financial report and the May fire department report and
liquor operation summary were accepted as informational following a
brief discussion of the latter in which Mr. Childs advised that the
• auditor had indicated the next report might give a more accurate profit
picture for the new warehouse operation. He also said the insurance
carried on the Apache operation had not been settled yet and could also
affect the final figures .

The Manager said the request from the Minneapolis Park and Recreation
Board for Minneapolis water and sewer connections for the Gross Golf
Course Clubhouse would be deferred to the next Council meeting, June 26th
Mr. Hamer had submitted a lengthy report on the operations of the City
water system and he advised it would probably be necessary for the City
to implement an odd/even sprinkling ban for the City this summer,
especially since Superfunding would be available to the City only if
water conservation measures are taken.
Motion by Councilman Makowske and seconded by Councilman Enrooth to
authorize the City Manager and Public Works Director to take whatever
water conservation measure they believe necessary for the summer.

In his June 11th memorandum, Mr. Childs had listed the actions which
the Council should take to implement the Roseville water connection.
Mr. Hamer had tabulated the four bids for the watermain connection
construction on 29th Avenue N.E. which had been taken June 4th and
advised that the lowest had been for $127,090 from R. W. Moore. The
Public Works Director said the engineers had underestimated the cost
of the meter manhole and had estimated the project cost to be $105,000,
which, Mr. Childs said, could probably be offset somewhat, if the City
is able to rent or borrow a meter from St. Paul, which the R. W.
Moore company has agreed to modify their bid to exclude. Councilman
Ranallo commented that the final cost would be much lower than an
earlier proposal from the water softener companies to rent their •
equipment. Mr. Childs indicated state officials had urged the City to
apply for state superfunds with an adjustment to be made later for
any federal monies, if such funds are made available to the City.
Motion by Councilman Enrooth and seconded by Councilman Ranallo to
adopt the resolution which accepts the proposal from Short-Elliott-
Hendrickson, Inc. for the preparation of plans and specifications for
the construction of the watermain along 29th Avenue N.E. to provide
temporary water service to a portion of St. Anthony from the Roseville
system at a cost of $7,000, which would be reimbursed from the state
Superfund.
RESOLUTION 84-028
A RESOLUTION ACCEPTING A PROPOSAL FOR PLANS AND
SPECIFICATIONS FOR THE CONSTRUCTION
OF A WATERMAIN INTERCONNECTION
Motion carried unanimously.
Motion by Councilman Enrooth and seconded by Councilman Ranallo to
adopt the resolution which awards the contract for the watermain con-
struction on 29th Avenue N.E. to R. W. Moore for an amount not to
exceed $127,090 with the total project cost not to exceed $134 ,090,
plus attorney's fees, if the City is unable to rent or borrow an 8 inch
meter manhole from St. Paul, and subject to St. Paul and Roseville agree-•
ing to the connection of the Roseville water system to a portion of
St. Anthony, as proposed.

A RESOLUTION- AWARDING THE. CONTRACT_ FOR--"CONSTRUCTION
OF,- A 'WATERMAIN INTERCONNECTI'.ON
Motion carried unanimously .
The Manager reported: St. Paul would be willing to sell water to the City
at the. same rate they charge their high tier cumstomers, rather than
the lower rate charged to Roseville, but he said he anticipated a lower
rate than 75� could be negotiated with St. Paul- .if the Roseville Con-
nection were to become permanent. Mr. Childs said the City would
have to pay out about 45C' per hundred cubic feet more for St. Paul
water than is charged the City users under the new water rates .
Mr. Hamer reported encountering no problems with negotiating the seven
easements necessary for the watermain construction.
A rough draft of the agreement with St. Paul and Roseville for the
water connection had been included with. the Council agenda and Mr.
Childs told the Council there had been no problem with the concept at
the City, Roseville , or St. Paul staff level. . He said the final
document to be drafted by the attorneys for the three parties would be.
submitted for the St. Paul Water Board approval, June 20th.
Motion by Councilman Ranallo and seconded by Mayor Sundland to adopt
• the resolution which authorizes the City Manager. and Mayor, and to be
reviewed by the City Attorney, to enter into an agreement with Roseville
and St. Paul for Roseville to provide water to St. Anthony for a period
ending October 31 , 1985 , in accordance with the rough draft presented
to the City Council and Mayor, June 11, 1984 .
RESOLUTION 84-030
A RESOLUTION AUTHORIZING THE DIAYOR AND CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH THE CITIES OF
ROSEVILLE AND ST. PAUL FOR A WATERMAIN
INTERCONNECTION ON BEHALF OF THE CITY OF ST. APITHONY
Motion carried unanimously.
The Manager had several encouraging reports related to City properties .
He said the home at 3012 Silver Lake Road, which had been so poorly
maintained had been foreclosed by the VA and the Clark Oil Company
property on the corner of 33rd Avenue and Stinson Boulevard had.been
sold to a neighbor. He also indicated the adjoining- property owners
to the Walbon property on Old Highway 8 seemed to be generally agree-
able to having that property developed for a 32 unit townhome project
in spite of one strong .objection from one neighbor.
Mr. - Childs said H.U.D.. officials would be in the City to investigate
the request for 202 funding,- for the Kenzie Terrace senior housing
• project which the Manager reported had tied for first place Metropolitan
Council- rating with a Rogers, Minnesota project:
In his -.June 8th memorandum recommending. Council approval of the police
contract negotiated with AFSCME, Mr. Childs had recommended .funding a

5% increase for non-union personnel in keeping -with -settlements in other
communities': there' was an indepth discussion of this request, with •
Councilman Ranallo-••indicating he would like to ha•ve::the dollar -amount
involved-rather than tying. .the raise .to union wage increases. .. ..Topics ..
which were also - covered were the anticipated requirement for setting
the criteria for comparable work values and the provision in the 1984
budget for salary increases negotiated this year with the liquor as
well as. public works and fire department employees . Councilman.-Ranallo
indicated the former •would h,e addressed at the League of Minnesota
Cities conference in Duluth- that week and the Manager said the Metro
Area Managers Association. had agreed to bid on a proposal for a study
to establish a common denominator on which the criteria for comparable
work values might be set for all the cities involved.

submitted the minutes of the H.R.A. meeting held May 22, 1984.

Motion by Commissioner Ranallo and seconded by Secretary/Treasurer Marks to approve
payment of $1,745.96 to Dorsey & hhitney for legal services during April on the
Kenzie Terrace 202 senior housing project and $1 , 097 . 50 to GME Consultants , Inc.
for the soil report for the same project.
Motion carried unanimously.
The data on the Metropolitan Council's rating on the 202 project had been included
in the agenda packet and Mr. Childs reiterated that the City project had been tied
• for first place with the Archdiocesan project in Rogers, Minnesota.
In his June 22 memorandum, the Executive Director had addressed the three cash. flow
studies done by the Springsted company for the proposed Walbon redevelopment project
at 33rd Avenue N.E. and Highcrest Road following the meeting with neighbors in that
area. He said the studies had indicated the proposed 34 unit townhome project with
land sales proceeds of 54,000 per unit would be more feasible with a lower land
purchase cost and- higher level of land sale than the development of nine single
family dwellings-or the same number of townhomes with no land sale proceeds, which
both required substantial tax levies for 2S years to meet cash flow needs.
Mr. Childs presented the revised plans for the townhome development which had been
modified to meet the objections of the neighbor across the street, Virgil Hietal,
who with Vi Dorumsgard, an opponent of the proposal spoke.
Mr. Hietala said his first impression had been that he would be facing eight
garages which would all be exiting on 33rd Avenue. He said, "with the revisions,
the proposal would now be the lesser of two evils", which he could accept.
Mrs-. Dorumsgard -who -said,she does not live in the home at .33rd Avenue N.E: .where
her son lives, "because J' asked. him to", indicated she .was opposed to having 48
feet of her house- facing the back of a townhome project. She thought the developer
could make :enough profit building two single family ,homes...on .the.land..which was
just rezoned for ihaf,:purpose -and only 30 townhomes..on the rest of the Walbon.
property. Mrs. -Dorumsgard reiterated the problems she has had over .the.years with
the- triangular shaped-.parcel in front of her. picture window.-and said the. Walbon's
• attorney is now stalling, the. t-ransfer of the land to her.

Mrs. Dorumsgard was told the economics-for.. :that or for building single family homes.
next to her just -weren't there. Her suggestion that Mr. Childs hadn't been-fair..
or honest to her were sharply contested and the Mayor told Mrs. Dorumsgard the only-
reason the City had: gotten involved in the project at all had been because of the.
constant complaints over the last 14 years from her and her neighbors about the... .., .
"types of activities 'on the Walbon properties. The Walbons won't just go away,.; .
Mayor Sundland told' her and when she asked just what she would be looking at from.
her front window, he said she would probably see the exterior of the townhomes .
which would not be much different in appearance from the homes in that area, whose_
owners had all agreed they could live better with this project than to continue
with the noise and appearance of the Walbon property. If that had not been the
case, the City would not be considering the next steps in the process of redevelop-
ing that problem property.
Mrs. Dorumsgard left the meeting after the following action was taken:
Motion by Commissioner Ranallo and seconded by Secretary/Treasurer Marks to take
the steps necessary to make a final decision on the redevelopment of the Walbon
Property for a 32-unit townhome project by authorizing land, building and reloca-
tion appraisals of the subject property and to authorize staff to negotiate an
agreement with Dick Krier for consulting services on the project.

Motion by Commissioner Ranallo and seconded by Vice Chair Enrooth to adjourn the
Housing and Redevelopment Authority meeting at 9:15 p.m.
