20 2 . PURPOSE_ OF MEETING

22 Mayor Ranallo explained that each year homes in one quadrant
23 of the City of St . Anthony is viewed by a Hennepin County
24 ,Appraiser.

26 This year homes located in the quadrant west of Silver Lake
)7 Road and north of 33rd Avenue were given on site reviewals .
29 The formula for determining the value of a home includes the
30 condition of the home, any improvements made to it , its
31 location and sales of comparable homes .

33 Property owners can address their concerns and grievances
34 regarding the market value placed on their property.

36 The Mayor noted this forum is to discuss market values not
37 taxes .

39 3 . CONCERNED PROPERTY OWNER COMMENTS

41 a. Carl and Shirley Marihart - 3101 Armour Terrace
42
43 Mr. Marihart advised the Council he is presently
44 refinancing a portion of his mortgage. An appraisal of
45 his home was done recently and it is $2 , 000 less than the
46 market value placed on it by the Hennepin County
47 appraiser. He noted that the appraisal done by the
48 private appraiser had also considered comp.arables in the
49 area.

51 The value placed on the home by Hennepin County was
52 $132 , 000 . The private appraiser placed the value at
$130 , 000 .

6 Busitzky noted that he has found refinancing appraisals
7 to be conservative.

9 The Mayor advised that if someone from the County were to
10 view the home there was an possibility that the value may
11 increase.

13 Busitzky stated that the process which would be followed
14 is for the City Council to direct ,He:nnepin County staff
15 to view the home and make a recommendation back to the
16 Council . He noted that councils generally accept the
17 recommendation made by Hennepin County in this type of
18 matter . If the Council does not accept the appraiser ' s
19 recommendation , then the property owner can appeal to the
20 County Board of Equalization, which meets in the last two
21 weeks of June, after which the owner can appeal to the
22 State Tax Court .

24 Motion by Marks , second by Fleming to direct that the
25 home located at 3101 Armour Terrace be viewed by a
26 Hennepin County appraiser. .

32 b. Theodore Swierczek - 2608 36th Avenue Northeast

34 Mr. Swierczek stated that his value has risen from
35 $84 ,000 in 1989 to $93, 400 in 1992 . He has made no
36 improvements, but noted he did lose trees and landscaping
37 in the tornado.

39 Last year a realtor advised Mr . Swierczek he could sell
40 his home for $109 , 000 . Mr. Swierczek questioned the
41 disparity between the present valuation and that
42 suggested by the realtor. He also felt the increase in
43 the value by Hennepin County was questionable.

45 Busitzky suggested that the home may have been
46 undervalued for many years . Mr . Swierczek did not recall
47 having his home viewed in the last fifteen years . In
48 light of the ratios applied to St . Anthony this home may
49 not be correctly valued.

51 No Council action was taken regarding the property.

9 Ms . Scott advised her value was increased $24 , 000 last
10 year . She had an appraiser from Hennepin County view the
11 home in 1991 and the value was reduced to $143 , 100 . This
12 year the value has increased $5, 000 . A realtor placed the
13 value of her home at $142 , 000 .

15 Motion by Wagner , second by Marks to direct the Hennepin
16 County Appraiser to review the home at 2520 Pahl Avenue
17 Northeast and report back to the Council .

24 Mr . Myslicki stated that the value of his home has
25 increased $5, 000 . The present value is placed at $99 , 400 .
26 He feels this is too high as no improvements have been
)7 made.
29 Motion by Marks , second by Enrooth to have the home
30 located at 3401 Belden Drive Northeast viewed by the
31 Hennepin County Appraiser.

37 e. Bruce Holton - 290-9 Rankin Road

39 Mr. Holton appeared at the 1991 Board of Review
40 questioning the value placed on his home at .that time. He
41 noted he was tardy for the Board of Equalization and did
42 not pursue action in the Tax Court , although he felt the
43 valuation was $25, 000 too high.

45 The valuation for this year is the first one which
46 addressed full market value. The estimated market value
47 decreased $2 , 000 to $130 , 000 for 1992 .

49 He had documentation in the form of a construction
50 statement and comparables and the appraisal from the
51 mortgage company and its comparables .

When Mr. Holton contacted Hennepin County Appraisal
-4 office , it was suggested that another appraiser view the

6 property. Mr . Holton felt this would not be beneficial
7 and is not requesting another reviewal .

9 Busitzky felt reviewing the new documents with Mr. Holton
10 may be helpful .

12 Mr . Holton suggested that there : also be a reduction
13 because of the location of the home. Busitzky advised
14 that a three percent credit was given for location . This
15 percentage is the usual allowance.

17 Motion by Marks , second by Fleming to direct Busitzky to
18 meet with Mr. Holton to view his documentation and return
19 a recommendation to the City Council .

25 f . Sandra Nephew-Rose - 2709 St . Anthony Boulevard

27 Ms . Nephew-Rose has owned her home for one year. When she
28 purchased the home, she was advised by the realtor that
29 the water problems which had been experienced in her
30 neighborhood were being solved by the City. She has since
31 been made aware that this may not be the case.

33 The City Manager advised her that there is a May 5th
34 _meeting scheduled where the water problems and possible
35 solutions will be' discussed. He noted that the City
36 Council has not made any decisions regarding this
37 situation, but -has been given four solutions to consider.
38 He stated that the four solutions range from a very
39 expensive improvement to doing nothing.

41 The May 5th meeting will address options. to reduce the
42 risk of flooding. The City Manager suggested he meet with
43 Ms . Nephew-Rose to review all of the options .

45 Mayor Ranallo encouraged her to attend the May 5th
46 meeting. He noted that _designating a "flood plane" 'in her
47 neighborhood will be a consideration, but there have been
48 some serious concerns with taking this action as it would
49 lower property values .

51 The City Manager observed that the remarks made by Ms .*
52 Nephew-Rose ' s realtor were made. before the City had
53 received the study done by Barr Engineering regarding the
54 flooding.

7 Mayor Ranallo inquired if it is her intention to seek a
8 lower valuation. She responded that this was not her
9 intention , but rather to seek solutions to potential
10 water problems . She will be attending the May- 5th meeting
11 and also indicated she will meet with the City Manager.

13 Busitzky observed that her appearance at this Board of
14 Review retained Mrs . Nephew-Rose ' s right to appear at the
15 Board of Equalization .

18 Sandra Nephew-Rose, 2709 St . Anthony Boulevard, appeared
19 at the April 14 , 1992 St . Anthony Board of Review .

26 A letter was received from Ms . Olson indicating she felt
her property valuation was too high. She requested she be

9 Salo, Finland is the St . Anthony Sister City. Last year a
10 delegation of residents from St . Anthony, which included members of
11 the St . Anthony Orchestra , visited Salo. At that time it was
12 indicated there was much interest among Salo residents to visit St .
13 Anthony this summer .
14
15 In attendance, at this Council Meeting was Sauli; Niinisto, who is
16 presently serving as the Chairman of the Salo City Council . He was
17 welcomed by the City Council .
18
19 Councilmember Marks , who visited Salo last year, stated that
20 Chairman Niinisto is the former police chief of Salo, previously
21 served as a judge, is a member of the Finland Parliament and a
22 member of the National Security and Defense Committee for Finland.
23
24 Chairman Niinisto presented a plaque to the Mayor which bore
25 symbols representing some of the City and Country' s history. He was
26 presented with a pin, cap and sweatshirt all bearing the St .
27 Anthony logo.

39 have this charge waived by Maier Stewart & Associates .

11 Report of Councilmember Marks

13 Last Thursday, Ccuncilmember Marks participated in a
14 conference for Planning Commissions . This is a second
15 level presentation of "Beyond the Basics . " Councilmember
16 Marks noted he had also participated in the first level
17 presentation earlier in the month.

19 Councilmember Marks stated that his active participation
20 is continuing on the affairs of the Sister City
21 Committee .

23 Report of Councilmember Enrooth

25 Councilmember Enrooth has been attending the bi-monthly
26 meetings every other Wednesday of the Hennepin County
di , Waste Management Committee . These meetings are convened
at 7 : 30 a.m.

30 He noted that the issues being addressed by the Committee
31 will affect St . Anthony and Hennepin County for the next
32 five years . Councilmember Enrooth noted some of the
33 issues which are being discussed, in particular, tipping
34 _ fees and funds which may be returned to the cities .

36 Report of Councilmember Fleming

38 Councilmember Fleming advised the Council of some of the
39 new information regarding the Village Fest Celebration .

41 A silent auction will be held for the first time this
42 year. Also, Bob Foster has been hired to entertain. It is
43 felt he will provide outstanding entertainment .

45 The next Village Fest meeting is scheduled in the
46 Community Center on 'May, ll , 1992 at 7 : 15 p.m.

48 Councilmember Fleming noted that meeting notices and
49 meeting minutes are no longer being mailed.

51 Mayor Ranallo has observed considerable enthusiasm about
52 Village Fest and that plans are really moving. He
suggested that another set of bleachers be borrowed and

6 placed near the main shelter in the park . Last year they
7 were a real convenience and it was felt to have another
8 set would be appreciated . He suggested contacting New
9 Brighton to borrow more bleachers .

11 The Mayor advised that Village Fest is planning a tennis
12 tournament also. He noted that the tennis courts are
13 scheduled for resurfacing before Village Fest .
14
15 Councilmember Fleming attended a seminar sponsored by the
16 Government Training Service in St . Cloud. Budgeting was
17 the main topic. She will report on this at the next
18 Council work session . At the seminar it was noted that
19 residents are not afraid of change, but rather are
20 concerned about the unknown .

24 On behalf of the Garden Club, Councilmember Wagner
25 thanked the Council for the Certificate of Appreciation
26 received.

28 Mayor Ranallo requested he be apprised of any such
29 matters of recognition or special awards as he would like
30 to be kept informed .

32 Councilmember Wagner noted that most people feel that CUB
33 will definitely be moving into the area of Apache Plaza
34 -Shopping Center. He feels the reality of the matter is
35 -that everyone is waiting for Dennis Cavanaugh to address
36 this matter.

38 He and the City Manager met with representatives of Super
39 Value today. He observed that Super Value appears to be
40 very enthusiastic to go ahead without having the City pay
41 all of the "freight . " Super Value has indicated a comfort
42 level with working with the City' s bond counsel ,
43 Springsted Financial Advisors and the City' s legal firm,
44 Dorsey & Whitney.

46 Councilmember Wagner as well as other interested parties
47 will be meeting with Dennis Cavanaugh on April 15th.

49 He noted that CUB has indicated an interest in public
50 financing such as a Tax Increment Financing District . It
51 is their hope that a Wal-Mart will locate on one side of
52 their building.

54 Councilmember Marks noted that public financing may be

6 needed for development and demolition purposes . Some of
7 the items to be financed could be drainage, water runoff ,
8 utilities and relocation costs .

10 The City Manager advised there will be no need for funds
11 to do improvements . He felt everyone was supportive of
12 having CUB locate in St . Anthony. He regretted that a
13 recent newspaper article left the impression that the
14 City is causing the delay. It was noted that neither City
15 staff nor Super Value representatives had breached the
16 communiction regarding the locating of the store in the
17 City.

19 He noted that there are four criteria which must be met
20 to be eligible for TIF funds . CUB is very excited at the
21 idea of having one of its stores located in the City and
22 is considering expanding the original size of the store
23 in the proposal .

25 Meetina to Discuss Bus Route
26
On Wednesday, April 15th, Mayor Ranal-lo will be meeting
with an MTC Commissioner and a Minneapolis Park
29 Boardmember to discuss a bus route being placed down
30 Stinson Boulevard . This route will accommodate the public
31 transportation needs of residents at Kenzie Terrace and
32 Autumn Woods .

34 .The City Manager noted he has requested the City Attorney
35 to contact the MTC' s legal counsel regarding this matter
36 and report his findings back to the City Council .

39 Volunteer Recognition Week Proclamation

41 Motion by Marks , second by Wagner to approve the
42 Volunteer Recognition Week Proclamation which designates
43 the week of April 26 - May 2 , 1992 as Volunteer
44 Recognition Week in St . Anthony.

50 The St . Anthony Lion ' s Club is sponsoring Earth Day and.
51 will be selling stickers to promote interest in the
52 environment .

6 sale of stickers will be used by the Lion ' s Club for
7 beautification projects within the City. Currently, the
8 Lion ' s Club has a project to clean up an area on 37th
9 Avenue near Stinson Boulevard.

19 The second phase of development has just opened in
20 Wexford Heights in New Brighton .

22 Considerable water runoff is being experienced from this
23 development in Silver Lake . The City Manager met with
24 Jerry Faust , Dr . Carr , and a representative of the
25 developer to discuss the water which is ponding on the
26 Salvation Army Camp grounds . He has also written to the
0 Rice Creek Watershed District regarding this matter .
29 There is natural drainage flow from the development into
30 the Camp grounds and the developer has made no provisions
31 for holding ponds . This activity is going to affect the
32 water quality in Silver Lake.

34 -Dennis Palmer of Barr Engineering contacted the developer
35 of Wexford Heights where he was referred to the New
36 Brighton City Manager, who ultimately referred him back
37 to the developer .

39 The City Manager advised that there is a joint powers
40 agreement to study the water quality of Silver Lake. The
41 participants in the joint powers agreement are Ramsey,
42 Hennepin and Anoka counties and the cities of St .
43 Anthony, New Brighton and Columbia Heights . He noted that
44 St . Anthony will take the lead on this matter and ensure
45 that the water quality study is done appropriately.

47 It is still the intention of Ramsey County to widen the
48 intersection adjacent to. Wexford Heights and the
49 Salvation Army Camp in its Silver Lake Road project .

51 Utility Eneray Audits
Minnegasco and NSP are required by law to provide
services to it consumers .

6 An offer has been received in City Hall from a utility
7 company to perform free energy audits and conduct a
8 seminar which will address energy issues . This offer is
9 focused on the elderly- and low income population. The
10 City Manager noted that the energy audits will be done by
11 a private, certified company so there will be no
12 possibility for an utility company profit or gain .

14 A resident mailing list has been requested as well as a
15 letter of support for these activites which would be
16 signed by the Mayor . The Mayor suggested the letter be
17 signed by the City Manager.

21 The City Manager advised that insurance renewals , the
22 1991 audit , and the RFP for auditors for the 1993 audit
23 will be on the agenda of the May 26th Council Meeting.

25 Recyclina Center

27 "Use it properly or lose it" is the suggested slogan for
28 the Recycling Center . Urbia noted that the problems with
29 junk and non-recyclable debris being left at the i
30 Recycling Center continue. He felt this type of problem
31 is more evident in the Spring.

33 Councilmember Enrooth suggested that a fence be installed
34 which would make for improved operation.

36 Urbia advised there are funds from a Hennepin County
37 grant program which could be used to move the Recycling
38 Center. He felt there would not probably be enough funds
39 to pay for the whole move but a portion of it . It was
40 noted that the grant is charged $250 each month for
41 operation of the Recycling Center and a portion of his
42 salary is taken from the grant .

44 There are on-going problems. with recycled newspaper being
45 contaminated with magazines and catalogues . Urbia is
46 working on having a category which will address this
47 "mix . "

49 The Mayor felt if the problems cannot be controlled the
50 Recycling Center will be closed.

The following report is regarding a request from Adel Alwan for a conditional use permit
to allow for more than three amusement devices at Sheik's Garden Restaurant, Inc.; 3800
Apache Plaza.
The conditional use permit is necessary as Mr. Alwan proposes to have 23 amusement
devices. According to the Zoning Ordinance, Appendix I, Section 9, Subdivision 3(14),
an establishment is permitted to have more than three amusement devices (as defined
• in Section 510:05) only by conditional use permit. Mr. Alwan was before the Planning
Commission in February to request a conditional use permit to allow up to 30 amusement
devices. The Planning Commission approved the request unanimously under certain
conditions. The City Council, at its March 10th meeting, did not approve the request by
a 3 to 2 vote.
Mr. Alwan's proposed plan (see attached drawing) would allow him to generate additional
revenue in the older, rear portion of the restaurant. The front portion of the restaurant
has been renovated. Mr. Alwan proposes rules that he believes will create a family
atmosphere. In addition, Mr. Alwan will have 8 amusement devices solely for children.
The remaining 15 amusement devices will be video devices for both children and
adults.The three conditions are satisfied for this conditional use permit, if the owner
carries out the intent stated in answering the conditions. The Planning Commission
should consider adding the following conditions in conjunction with recommending
approval of the conditional use permit:
(1) The arcade shall prohibit tobacco, alcohol, and drugs on the premises.
(2) The arcade shall prohibit individuals under the influence of tobacco, alcohol,
and/or drugs.
(3) Proper supervision should be available at all times to ensure appropriate
conduct and behavior.
• (4) The access from kitchen to dining area shall be segregated to ensure
safety.
(5) The number of amusement devices allowed ;will be dependant upon the •
available number of amusement device licenses and available space within
the area designated on the proposed plan.
(6) The hours for the arcade will be no later than 10:00 P.M.
(7) The process of an annual review consisting of City staff, the Police Chief,
and the restaurant owner to review complaints generated by the restaurant,
both inside and outside the establishment.
(8) The arcade shall consist of 23 amusement devices, of which 8 will be solely
for children and 15 will be video:devices for both children and adults.

Dear Tom:
. After receiving your letter of April 1 , 1992 regarding the City
Council decision about use restrictions on Silver Lake and
subsequent discussion with you and Association Officers, I
believe there has been a basic misinterpretation* of the proposal
by the Lake Association . I will attempt to remedy this Problem
by giving some historical Perspective to this issue .
The Silver Lake Residents Association, at their annual meeting in
1989, decided to survey residents in order to seek direction
regarding usage and management of the Lake . This was decided upon
not as a demonstration " lake ownership" but rather as a group
that are materially impacted by active use of the lake. An
exhaustive Poll was developed (the .results of which are in..your
files) . What was found in the Poll , was that there was a large
body of residents around the Lake who believed that motor usage
• should be restricted in order to allow for a greater variety of
lake activities (swimming, fishing, canoeing, wildlife watching,
etc . ) . This group is quite large and their Preferences were
explicitly articulated . The Poll al-so demonstrated there was
another body of residents that Preferred to use their motor boats
on the Lake . At the annual meeting in 1990, the Silver Lake
Residents Association decided to Proceed with an ordinance that
accommodated both groups in that it allowed unrestricted motor
usage for the bulk of the time, but set aside certain hours for
alternative use also.
After 1990 annual meeting, a body of residents from around the
Lake, who Preferred to use motors on the lake gathered and asked
that another vote be taken . They brought this matter up at the r
1991 annual meeting and the Poll was agreed upon . You have the
results of the Poll . You should know that of the sJx People not
voting, three were the result of the ballots not being sent in by
the Person who collected them. We know the addresses of the
residents who did vote, but were not counted and they have stated
that they favored the Ordinance . One Person who voted against
the ordinance did so because they wanted different hours
restricted (4:00-7 :00 PM) .
The Proposal that was taken to the City Council therefore was not
a "close vote" . Indeed, the vote was 59% in favor of r•estrictiri�7
motor usage 'if all the ballots were counted (this can be
• verified) .
Also, the Preferences of the .residents were not really about some
restrictions or none, but the majority (59%) Preferring no motor
• use or the restrictions and the minority (41%) wanting less
restrictions or none .
I believe this accurately reflects the history of our Proposal to
You, which satisfies neither group completely, but reflects a
compromise . Clearly, you should be aware that there are
dissatisfied residents on both sides of this Proposal . However,
we believe you should act on this as not only an accommodation
worked out : over three years, but also as the reflection of the
wishes of a substantial majority of residents .
In order to successfully implement this ordinance for the
upcoming year, it is important that the City Council move with
all deliberative speed . The governing officers of the Silver
Lake Residents Association would be glad to meet with the City
Council if there are any other further questions .

THE CITY OF ST. ANTHONY; AMENDING THE 1973 CODE

The City Council of the City of St Anthony, Minnesota, ordains:
Section 1. The 1973 Code of Ordinances is amended to add a new Sectior 1500:00 to read
as follows:
Section 1: PURPOSE, INTENT AND APPLICATION: As authorized by
378.32 (459.20), Subdivision 1 as now in effect and as hereafter amended, this Ordinance is
enacted for the purpose and Aith the intent to control and regulate the use of the waters
of Silver Lake in Ramsey County, ?Minnesota, said bodies of water being located within the
boundaries of St. Anthony, to promote its fullest use and enjoyment by the public in general
and the citizens of St. Anthony in particular; to insure safety for persons and property in
connection with the use of said waters; to harmonize and integrate the varying uses of said
waters; and to promote the general health, safety and welfare of the citizens of St. Anthony,
Minnesota.
Section 2: ADOPTION AND INCORPORATION BY . REFERENCE OF
MINTESOTA WATERS AND WATERCRAFT SAFETY LAWS, AND BOAT AI ND
WATER SAFETY RULES PROMULGATED BY THE MINNESOTA DEPARTMENT
OF NATURAL RESOURCES: The Minnesota Waters and Watercraft Safety Laws, M.S.
§ 361.01-361.29, as they now e)dst and are hereafter amended by the State of Minnesota
Department of Natural Resources, Minn. Rules parts 6110.0100-.2300 as the same now a)dst
and are hereafter amended, are hereby adopted, incorporated herein by reference, and
made a part hereof as if set forth in their entirerv. At least three copies of said Waters and
Watercraft Safety Laws and Boat and Water Safety Rules and Regulations, so adopted, shall
be marked as official copies and filed, in the office of the City Auditor along with this
Ordinance.
Section 3: VIOLATIONS OF THE MINNESOTA WATERS AND WATERCRAFT
SAFETY LAWS, AND BOAT AND WATER SAFETY RULES PROMULGATED BY
THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES: Any person violating
the Minnesota Waters and Watercraft Safety Laws, and the Boat and Water Safery Rules
and Regulations promulgated by the Minnesota Department of Natural Resources, adopted
and incorporated herein by reference, shall be guilty of a misdemeanor.
Section 4: RESTRICTIONS DURING CERTAIN HOURS: Between the hours of
11:00 A.'.%4. and 3:00 P.M. and between the hours of 9:00 P.M. and 8:00 A.M. on each and
every day of the week, no motorboat shall be_operated at a speed in excess of five (5) miles(Cc os r
per hour. At all other times during each and every day of the week, motorboats shall be ,!�ROir�c-,
subject to no speed limit and may be operated at unrestricted speeds. vo u'/4i.F
Section 5: DIRECTION OF TRAVEL DURING !.UNRESTRICTED SPEED
TIMES: During the hours in which unrestricted operating speeds are permitted, all
motorboats shall travel and be operated in a counterclockm ise direction around Silver Lake.
Section 6: NONSAII'CTIONED RACING PROHIBITED: Racing, that is the
participation of two (2) or more operators of motorboats operating their motorboats in a
competition of speed, shall be prohibited on the waters of Silver Lake unless the same takes
place as part of a scheduled or public race, regatta, tournament or other competition or
exhibition duly sanctioned by the county sheriff pursuant to Section 361.20 of the Minnesota
Statutes, as amended.
Section 7: ENFORCEMENT: The enforcement of,this Ordinance shall be the
primary responsibility of the Ramsey County Sheriffs Department, and the City of St.
Anthony's peace officers. Other licensed peace officers including Conservation Officers of
the Department of Natural Resources of the State of Minnesota are also authorized.
Section 8: All authorized Resource Management, Emergency and Enforcement
Personnel, while acting in the performance of their assigned duties are exempt from the
foregoing restrictions.
Section 9: EFFECTIVE DATE: This Ordinance shall be in effect from and after the
date of its passage and publication.

Dear Mr. Burt:
This letter will present our proposal for performing an analysis of the
drainage system tributary to the ponds in the northeast corner of the Salvation
Army camp, in the northern portion of the City. The goal of the study is to
recommend the most cost effective drainage system for the area, considering
conveyance needs, right-of-way and property concerns, and future runoff
treatment systems. I anticipate the following tasks will be necessary to
• perform the work:
• Data Review. During this task Barr will meet with representatives of
the communities and agencies that may have an interest in the
configuration and cost sharing recommendations of the report. This
would include St. Anthony, Columbia Heights, New Brighton, Anoka
County and Ramsey County. We would also meet with representatives of
Short Elliot Hendrickson (SEH) to go over the recommendations which
that firm presented in their August 25, 1983 report to the City.
Available information will also be obtained from the -Rice . Creek
Watershed District. This task is expected to account for
approximately 30 percent of the work effort.
• Treatment Options Assessment. During this task, the use of the
existing ponds as treatment basins to protect the water quality of
Silver Lake will be considered. Optional configurations to adapt the
ponds for this purpose will be considered since the ideal pond
configuration may have an impact on the options for configuration of
the conveyance system. This task will account for about 5 percent of
the required work effort.
• System Study. Barr will perform a limited preliminary design of
optional configurations for the conveyance system to drain the
watershed, the tributary to County Road E west of Silver Lake Road.
Two configurations will be considered, one in County Road E and one
within the Salvation Army camp area. Sufficient analysis will be
• performed to permit the preparation of a preliminary cost estimate to
allow comparison of the two systems. Approximately 35 percent of the
work effort is required for this task.

■ Cost Sharing Formula. Barr will suggest a formula for the allocation
for the costs for the recommended system and explain the basis for
the suggested allocations. The formula will consider design factors
such as contribution to flow and watershed area, as well as factors
such as special benefits which might be associated with each
configuration. This task amounts to about 15 percent of the work
effort.
Report/Administration. A report will be prepared which summarizes
the analysis and the recommendations for consideration by -affected
cities and agencies. This task accounts for approximately 15 percent
of the work effort.
Barr proposed to perform the work on a time and expenses basis with a cost
not to exceed $3,700. Time would be billed in accordance with our current fee
schedule, a copy of which is attached. Expenses would be billed at cost. The
cost of the study would ultimately be shared between the affected parties in the
same proportion as construction. In the meantime, you may wish to consider cost
sharing for the study by St. Anthony, New Brighton, Ramsey County, and possibly
the developer of Wexford Heights.
We are prepared to begin this work immediately and finish within 30 days ,
of being directed to proceed. If this proposal meets with your approval, please •

EXECUTIVE SUMMARY
INTRODUCTION
In 1987 , the Ramsey County Public Works Department began the
project development process for reconstructing Silver Lake Road
from Silver Lane to I-694 . A Project Path Report for this
project has been reviewed and approved by the Federal Highway
Administration ( FHWA) , the Minnesota Department of Transportation.
(MnDOT) , and the Ramsey County Board of Commissioners .
The Public Involvement Record has been completed and will be
submitted to the FHWA and MnDOT for review and approval if the
cities approve the reconstruction proposal recommended by Ramsey
County. Following approval of the Public Involvement Record , the
Ramsey County Public Works Department will prepare a Study Report
for review and approval by the FHWA, MnDOT, and the Ramsey County
Board of Commissioners . ', If approvals. are received, the Ramsey
County Public works Department would initiate final design for
this .project with construction anticipated to begin in 1994 .
EXISTING DEFICIENCIES
The existing deficiencies of Silver Lake Road between Silver Lane
and I-694 are :
• 'Safety: Ramsey County reviewed accident data for the
intersections of Windsor Lane , Inca Lane , County Road E,
Third Street , Fifth Street, and Seventh Street. A total
of 67 accidents were reported at these intersections from
1986-1989 . New Brighton residents were involved in 52 of
the 67 accidents reported. The reconstruction proposal
would correct the majority of these accidents .
• Traffic Capacity: The current roadway design does not
accommodate existing traffic volumes ( see attachment) and
will not accommodate projected traffic volumes .
• Sight Distance/Vertical Curves : The current roadway design
does not meet state aid standards for these elements .
• Drainage : Poor or inadequate .
• Load Capacity: Currently limited to five tons . Ramsey
County requires its roadways to be reconstructed to a nine
• ton capacity.
o Pavement Condition: The roadway base is deteriorated.
The pavement is cracked and rutted.
IMPROVEMENT ALTERNATIVES
Ramsey County has identified three alternatives .for the
improvement of Silver Lake Road :
• Do Nothing: This alternative would not address any of the
deficiencies identified . The roadway would continue to
deteriorate . Ramsey County does not consider this a
viable alternative .
• Recycle/Overlay: . The maintenance division of the Ramsey
County Public Works Department would perform this
operation . It would improve the pavement condition and
load capacity. It would not address any of the other
deficiencies identified . The cost to the cities and the
County would be less than the reconstruction proposal .
The -roadway would not be eligible for reconstruction for a
minimum of 15 years .
• Reconstruction Proposal : The reconstruction proposal
recommended by Ramsey County would correct all of the
deficiencies identified. The project is ' anticipated to
cost $2 . 9 million . Federal , State and County funds would
finance approximately 90% of the total project cost . •
RECOMMENDATION AND ACTIONS
Ramsey County recommends the reconstruction alternative for the
improvement of Silver Lake Road and requests concurrence from the
cities of New Brighton and St . Anthony to proceed with develop-
ment of construction plans in accordance with that recommenda-
tion. The County further requests that the cities take action on
this request by May 1 , 1992 .

AN ORDINANCE RELATING TO WATER RATES; AMENDING
SUBDS. 2 AND 3 OF SECTION 550:00
OF THE 1973 CODE OF ORDINANCES OF THE
CITY OF ST. ANTHONY
THE CITY OF ST. ANTHONY DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Subds. 2 and 3 of Section 550:00 of the 1973 Code of Ordinances are amended
to read as follows:
Subd. 2. Water Rates. Water bills shall be computed quarterly at the following rates for
water used as indicated by the meter supplying each water service: Commercial, Residential
and Building Construction users 3.83 per hundred cubic feet or any fraction thereof.
Subd. 3. Minimum Charges. A minimum charge of$8.30 per quarter is hereby established
for all premises served, to cover water pumpage, bookkeeping expenses, and meter rental.
All water sold shall be on the basis of meter readings except in the case of minimum
charges; provided, however, if deemed necessary, a flat rate of not less than the minimum
charge may be established by the Council.
Section 2. This Ordinance shall take effect upon its publication.

8 6 . CONSIDERATION OF AMENDMENTS TO THE KENZIE TERRACE
9 REDEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN

11 Chairperson Ranallo stated that three years ago the City
12 worked with Lang-Nelson to : develop their Kenzie Terrace
13 project .

15 At that time all projections for the project were based on
16 setting the taxes at $1 , 200 per unit . Because of legislative
17 changes to the formula for determining property taxes for
18 apartment buildings , the taxes have increased to $1 , 500 per
19 unit .

21 The Tax Increment Financing package for this development was
22 originally proposed to be paid off in ten years . Presently, it
23 is set for seven years .

25 The developer, Lang-Nelson , is requesting the City Council to
26 approve amendments to the Redevelopment Plan to provide for an
27 interest reduction program by the H.R.A. with respect to their
28 housing units located in Kenzie Terrace . The amendments to the
29 Financing Plan would authorize the use of tax increments
30 derived from the Kenzie Terrace Tax Increment Financing
31 District of the H.R.A. established by the Financing Plan to
32 provide for the payment by the H.R.A. or the City of the costs
33 of the Interest Reduction Program.

35 The Chairperson noted that there are pros and cons - to
36 approving this request . If it is not approved the development
37 could result in having less than quality management .

39 Members of the H.R.A. felt that the present management is
40 running a very fine operation and one of which they can be
41 very proud .

43 Chairperson Ranallo felt that if the St . Anthony H.R.A. had
44 forced Apache Plaza Shopping Center to participate in an
45 operation similar to this that the present problems being
46 experienced at the Shopping Center would have been avoided.

4.8 The Executive Director noted that the original life of the Tax
49 Increment District was for twenty years , but the plan is to
50 have it all paid in ten years .

8 extending the TIF District to include the south end of the
9 City where redevelopment is anticipated. He will follow up on
10 this matter with the City' s bond counsel .

16 reservations regarding this matter but; thinks it is necessary
17 to approve for the public good.

35 south end area hinges on the future of the trailer court . He
36 recalled that previously merchants in the St . Anthony Shopping
37 Center were critical of extending the Tax Increment District ,
38 but now appear to be supportive .

40 Mr. Brewer, representative of La-Nel , thanked the H.R.A. for
41 passing the resolution . He mentioned this was rather a long
42 drawn out process but his partners were not critical of the
43 procedure.

45 7 . ADVANCED DESIGN

47 A letter was received from Janice Khan, President of Advanced
48 Design , 2500 Highway #88 , which addressed a collaboration
49 between the City and her firm for developing a program which
50 would improve the housing stock in the City.

52 The Executive Director felt a program for removing or
demolishing blighted homes and buildings holds some very
positive possibilities for St . Anthony . The City would

10 impressive building. The Executive Director requested that
11 each of :the Commissioners share their thoughts on this
12 proposal with him individually.

15 8 . OLD CLARK STATION

17 Mr . Fisher is the owner of the property where the old Clark
18 Station is located on 33rd Avenue and Stinson Boulevard.

20 It had been understood that the property was contamination
21 free . Braun Engineering did a study of soil samples--;f:r.om the
22 property and found it is still contaminated.

24 The Executive Director advised that Mr. Fisher is responsible
25 for cleaning up the property. He noted there is Superfund
26 money still available for the costs of such an undertaking.
27 i 28 He is requesting direction from the H.R.A. He suggested that
29 the property could be purchased from Mr . Fisher and developed.
30 He also suggested the H .R.A. consider purchasing the house
31 directly north of this property to be included in any
32 development of the site.

34 The Chairperson questioned if it would not be wise to also
35 include the ten foot strip of land which is not owned by Mr .
36 Fisher. The Executive Director felt a "friendly" condemnation
37 could be done to gain ownership of this strip.

39 The multiple zoning also extends to the property directly _
40 north of the old Clark Station parcel . This house, is presently
41 rental property and is owned by Mr . Ammermann.

43 Executive Director Burt will work with legal counsel before
44 possession is taken from Mr. Fisher. He noted that an owner is
45 responsible for cleaning up contaminated soil . He does not
46 want the City to become liable for this clean up.

48 Three developers have contacted' the Executive Director
49 indicating an interest in developing this parcel .

51 The Executive Director was directed by members of the H.R.A.
52 to pursue development of this parcel .
