21 3. PURPOSE OF THE BOARD OF REVIEW

23 Mayor Ranallo explained that the purpose of the Board of
24 Review it to review property valuations as ot January 2, 1993
25 and to hear appeals from citizens who feel aggrieved or have
questions regarding property valuations .
The Mayor also explained that any property owner who is not
29 satisfi'ed with the values placed on his/her property as a
30 result of this meeting, can make an appointment to be heard at
31 the Hennepin County Board of Equalization meetings. These
32 meet-ings are held the last two weeks in June. The deadline for
33 making an appointment to be included on the agenda is June
34 6th.

36 The appraiser advised those in attendance which quadrant of
37 the City had on-site inspections this year. It was also noted
38 that if another on-site inspection is requested, a different
39 appraiser than the one who originally appraised the property
40 will view it the second time.

42 Dr. Charles Kirk, 3612 Penrod Lane, stated that while some
43 market values appear to have been dropping, his increased
44 $1 , 700 . He had added a porch to his home which was completed
45 in 1990 . He noted this porch is still referred to in his
46 statement for taxes payable in 1993. The appraiser will
47 contact Dr. Kirk regarding this matter.

49 Mayor Ranallo said he has received calls from three property
50 owners whose values have decreased and they were concerned.

6 The appraiser explained the formula for determining a property
7 value. He noted that- comparables are used and age,
. 8 construction, size and sale price are looked at in this
9 formula as well .

11 Mr . 'Johnson'r 2500- W'. Armour Terrace, stated his property value
which was three times the average. The
12 increased 6 . 47% in 1991
13 previous increase was 2 . 5% which Mr. Johnson found acceptable.
14
15 In 1988 , Mr. Johnson paid $86 , 900 for the property. It was
16 valued at $72 , 600 in 1990 , $77 , 300 in 1991 , $79, 000 in 1992
17 and $81 , 000 in 1993. He requested that another on-site
18 reviewal be done of hi's property as he had concern regarding
19 the value placed on it and what he paid for it .

21 The appraiser advised that the reviewal serves to verify the
22 data already on the appraising sheet as well as establish a
23 value for the current year.

25 Motion by Enrooth, second by Fleming to request that the
26 property at 2500 W. Armour Terrace be reviewed by a Hennepin
27 County appraiser.

25 Motion by Wagner, second by Fleming to approve the agenda for
26 the April 13, 1993 Council Meeting with the addition to the
Manager' s Report of an explanation regarding the drilling
trucks on Rankin Road. Also, to be added to reports were some
29 comments made by the legal counsel for Roger Bona, owner of a
30 service station. Added to new business was the subject of
31 setting the date for the Reconvened Board of Review.

24 Street Light Petition

26 A petition was received requesting a street light to be
27 located in the alley behind and between 2612 and 2616 Pahl
28 Avenue. All affected property owners signed the petition in
29 support of the light .

31 The circulator of the petition, Casey Scott , was in attendance
32 at the Council Meeting. Councilmember Enrooth inquired if
33 there are any other lights in this alleyway. Mr. Scott advised
34 there is one located behind 2520 Pahl Avenue.

36 The City Manager advised that Northern ' States Power will
37 schedule the installation of the light and will also attend to
38 requirements regarding the distance between street lights .

13 Councilmember Wagner observed that one of the approved
14 invoices included a bill from 1992 . He also felt the charges
15 were quite high for the work done at Lowry Grove.

17 The City Manager noted that not all of the billing for work
18 done in 1992 has been received.

23 Mrs. Charlotte Olson, 3412 Skycroft Drive, arrived after the
24 Board of Review had been adjourned. She is requesting an
25 extention on the time to aggrieve her 1993 valuation.

27 Motion by Ranallo, second by Enrooth to recognize the right of
28 the owner of 3412 Skycroft Drive to go on to the Hennepin
29 County Board of Equalization as it was her -intent to
30 participate in the April 13, 1993 Board of Review.

39 1 . Report of Councilmember Wagner

41 On Apri I
1st , Councilmember Wagner attended the meeting of the
42 Apache Merchants Association. The
merchants noted their
43 pleasure with the sizable crowd who attended the recent Craft
44 Show. They also felt the mall managment- is doing .a very good
45 Job generating weekend activities . The merchants
stated their
46 concerns regarding the CUB store and if it
will be a reality.
47
48 The Kiwanis Club is hosting a program featuring Mary Jo Bender
49 at Wilshire School on April 14th. Ms. Bender is a -motivational
50 speaker.

6 Councilmember Wagner noted that the plan for the Kiwanis Club
7 and elementary school children to jointly work on a clean up
8 project did - not materialize. He said that the Kiwanis Club
9 members plan to continue the project by cleaning up debris
10 from all of the City' park areas .
12 2 . Report of Councilmember Flemina

14 Councilmember Fleming attended a meeting of the Board of
15 Directors of the Northwest Youth and Family Services . A
16 fundraiser was planned for April 18th with the sale of almost
17 new toys and books .

19 Councilmember Fleming expressed her disappointment at finding
20 out about the Metropolitan Transit bill from the newspapers.
21
22 This issue addresses the problems being experienced between
23 the MTC and the Minneapolis Park Board. The MTC is running
24 one of its bus routes on a very short span of a parkway in
25 Minneapolis . This route was established without Park Board
26 permission and the Park Board is opposed to this practice. The
legislation has already received a hearing and is processing
onto the Senate floor for discussion. Its chief sponsor is a
29 senator from south Minneapolis .

31 Councilmember Fleming felt this information should have been
32 tracked more closely by the representative and senator for St .
33 Anthony Village and that. the Council should have been kept
34 apprised.

36 Mayor Ranallo requested that residents of Autumn Woods be
37 advised of this legislation.

39 3 . Report of Councilmember Enrooth
40
41 Counci.lmember Enrooth serves on the Association of
42 Metropolitan Municipalities ' Board of Directors . He advised
43 the board met last Thursday and has a very busy agenda.
44
45 The ARM publishes a grid which reflects the status of
46 legislative bills . This material is available to all member
47 cities .

8 Mayor Ranallo had nothing to report at this time.

10 B. Report of City Manaaer

12 1 . Drillinci on Rankin Road
13 The City Manager advised that Keys Drilling Company is
14 back working on Rankin Road. This is necessary as the
15 equipment they previously had at this site did not go
16 deep enough- They are endeavoring to go deep to check the
17 total contamination. There was also a cave in experienced
18 at the site. It is anticipated the equipment -will remain
19 on Rankin Road for another thirty days or more . When the
20 project is completed the debris and dirt will be cleaned
21 up by the company.

23 2 . - Neiahborhood Meetina - Silver Lake
24 Representatives of St . Anthony, Columbia Heights , New
25 Brighton and the Rice Creek Watershed District will meet
26 to discuss Silver Lake.
27
28 The Columbia Heights Public Works Director advised he
29 will pursue the installation of a holding pond which will
30 be done by city crews .
31
32 The New Brighton Public Works Director stated there is
33 some activity regarding the resolution of sedimentation
34 storage problems and the Wexford Heights development will
35 be assessed.
36
37 It was noted that New Brighton has approved a 30 mph
38 speed limit on Silver Lake Road. MnDOT wants a 45 mph
39 speed limit .

41 A letter has been sent to Dennis Cavanaugh of the C. G.
42 Rein Company, who owns Apache Plaza, regarding the
43 drainage problems being experienced on the 53 acres of
44 this shopping mal I and on some of the surrounding areas.
45
46 It was originally the intention of this company to
47 address problems only on five acres . Some parking spaces
48 can be used for holding ponds if necessary.

50 Mayor Ranallo inquired as to the costs of these ponds.

6 The City Manager responded that the costs have not been
7 determined as the designs are not done.

. 9 The City. Manager stated' he will be meeting in the near
10 �future with- representatives of Super Valu and of Apache
11 *Plaza .- It is felt that the CUB store will open in June,
12 1994 .

14 Some members of the Counc i I expressed thei r concerns wi th
15 the delays involved with the CUB project .
16
17 The Mayor requested that the City Manager include the
18 issue of the CUB store project on the agenda of the April
19 27th City Council meeting. He wants this on record so if
20 the project is not developed the City Council will bear
21 no blame. He also requested that a representative of
22 Super Valu be in attendance at this meeting to address
23 the concerns expressed.

25 The City Manager felt some of the delay is due to the
406 need to draft many documents , relocate tenants already in
-7 Apache Plaza and complete the numerous plans required by
28 this project .
29
30 Some members of the Council also noted there have been
31 some comments in the community which reflect doubt that
32 this project will materialize. It is a highly visible
33 project .

35 C. Unocal Service Station
36
37 Steven Berndt , legal counsel for the owners of St . Anthony
38 Unocal , was present at the Council Meeting to discuss his
39 clients ' concern regarding the development plan for the south
40 end of the City. His clients own two parcels . On one of these
41 parcels the service station is located. It has been understood
that access to the service station off of 27th Avenue is being
43 closed. Presently, there are three access areas on 27th
44 Avenue.

46 Roger Bona, the owner of the service station, has hired a
47 planner. He indicated his willingness to discuss his plans for
48 his property with staff . He did advise he feels he needs
49 access to 27th Avenue to effectively operate his business .

6 Mr. Bona and' his legal counsel stated their biggest concern is
7 that a final plan for this area has already been approved and
8 they had no input .

10 The City Manager assured Mr. Bona that there have been no
11
final decisions made regarding his property and he is waiting
12
to see the plans which Mr. Bona ha's for his parcels .
13
14 Presently, staff is in the process of finalizing the road plan
15 and going out for bids . This information will be back to the
16 Council in May. At the April
Planning Commission meeting,
17 information regarding subdivision of the two residential lots
18 and the outlots will be considered.
19
20 The City Manager recommended that Mr. Bona present his plans
21 to the Planning Commission . He also advised that any changes
22 to the site plan would require a conditional use permit . Mr.
23 Bona again stated his primary issue at this time is access to
24 27th Avenue.

26 The City Manager reviewed the process and anticipated time
27 table for the southend development project . It will be
28 included on the agenda of the Planning Commission at its May
29 meeting. This will accommodate the legal notice requirements .
30 A development agreement will be drafted to give land to Mr.
31 Bona in exchange for an agreed upon item. The project ' s
32 concept review can be added to the agenda for the Planning
33 Commission April meeting so it can be informally considered.

35 The Mayor suggested that members of the South End Task Force
36 should also be advised of this informal discussion.

38 The City Manager advised the Council that he and the City
39 Attorney had met with Mr. Bona and his legal counsel to
40 discuss how he could gain an additional *6, 000 square feet but
41 would be expected to eliminate any access from his property to
42 27th Avenue.

44 Mr. Bona stated he feels additional dialogue should be had
45 regarding this matter. While it is being identified as a
46 neighborhood" project , Mr. Bona noted the area does include
47 businesses and these have to be considered in the whole scheme
48 of things .

6 Councilmember Fleming noted that the Task Force never formally
7 voted on a plan which they preferred.

9 The City Manager reviewed the timeline for this project . The
10 specifications are currently out for bids . In May or June,
.11 k6ad construction will begin but the access settlement with
12 the service station will have to be resolved before this phase
13 begins . The Good Luck Cafe will be demolished in May.

24 93-026 being a resolution authorizing the sale of onions by
25 the Shriners on May 22 , 1993 .

32 these onions only at the Stonehouse. The profits realized from
33 this fundraiser will benefit the Shriner' s Hospital .

38 Resolution No. 93-024 being a resolution approving a Knights
39 of Columbus tootsie roll campaign.

45 ordinance relating to garage setback permits ; amending
46 subdivisions 2 and 4 of Section 1650 . 02 of the St . Anthony
47 1993 Code of Ordinances ; amending said section by adding a new
48 subdivision; and amending Section 615. 07 to add a garage
49 setback permit fee.

6 The City Manager advised that this ordinance will not require
7 another survey be gotten if there is already one on file.

12 Rosemary Franzese, a member of the St . Anthony Planning
13 Commission, inquired what impact is expected on the St .
14 Anthony liquor operations with the opening of a Columbia
15 Heights liquor store on 37th Avenue near Stinson Boulevard.

17 The City Manager responded that there will be price wars with
18 the competition and that some prices in the St . Anthony
19 operation have already been reduced. He noted that this will
20 adversely impact on profits . He also felt .that with the advent
21 of a large grocery store at Apache Plaza there will a definite
22 advantage for the City' s liquor stores .

A Pat Lynch and Nancy Schroeder from St. Charles approached me concerning the annual
marathon run held each fall as a fund raiser for St. Charles Borromeo School.
They have made a request to hold the marathon in St. Anthony on October 2, 1993,
Saturday, 9 a.m. to noon, using city streets covering a distance of at least six miles. I
informed them that their request would have to go before the City Council for sanction and
final approval.
The marathon would start at St. Charles on 27th Avenue at Stinson and wind through the
city on the west side to 36th Avenue. They would cross over to the east side at 36th and
Penrod and wind its way back to St. Charles School playground. I have a tentative route
that is exactly six miles in length. The school anticipates approximately 300 plus participants
kindergarten through 8th grade. It will require a minimum of 20 adult volunteers from St.
Charles and our Reserve Officers to control traffic along the route. In addition, St. Charles
will be requesting the use of Central Park restroom facilities. The police department can
handle this event provided all the aforementioned requirements are met.

Notice is hereby given that there will be a public hearing by the City Council of the City of
Saint Anthony at 7:05 P.M., or as soon thereafter as possible, on Tuesday, April 27, 1993,
in the Council Chambers of the City Hall, 3301 Silver Lake Road (enter northeast.corner)
for the following purpose:
St. Anthony, Minnesota is presently conducting an ADV'504" Accessibility
Study for its buildings, programs, and services. To make the findings of this
study as meaningful and pertinent as possible, the City requests the
participation of anyone who would wish to contribute to the study in any way.
Participation may take the form of advice, suggestions, questions, or an
interest in involvement, and would be all the more relevant if contributed to
by persons with disabilities. For the purposes of this study, "disability" is
defined as any physical or mental impairment which substantially limits one
or more major life activities, i.e., seeing,walking, speaking, hearing,breathing,
self care, learning, and performing manual tasks. The term includes people
who have a past record of impairments such as recovered heart attack victims,
recovered cancer patients, former patients of mental hospitals, etc.

RESOLUTION 93-027
A RESOLUTION APPROVING THE CITY OF ST. ANTHONY'S
COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT (ADA)
WHEREAS, the City of St. Anthony, contracted with Julee Quarve-Peterson, Inc. (JQP) to
conduct an ADA accessibility audit; and
WHEREAS, JQP has recommended a priority ranking system based from the result of the
ADA accessibility audit for the City of St. Anthony to utilize in its efforts
towards compliance of ADA; and
W'HEREAS, JQP has recommended a grievance procedure, as required by ADA; and
WHEREAS, City staff has recommended a transition plan based upon the accessiblity audit and
priority rankings to ensure compliance with ADA.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
approves the accessibility audit; the priority ranking system; the grievance procedure; and accept
public input to utilize in the transition plan.

Accessibility Evaluation City of St. Anthony Village
INTRODUMON
Julee Quarve-Peterson, Inc. has completed an accessibility audit of all City of
St. Anthony Yillage facilities and sites. In producing the attached report, the following
activities have been completed:
1. Met with staff to discuss the scope of the project, identified specific sites to be
evaluated, and obtained further information regarding each site.
2. Conducted on site surveys.
3. Produced a narrative report identifying specific recommendations for each site to
provide a more usable envirorunent.
4. Facilitated community meetings to obtain public comment regarding the proposed
accessibility upgrades.
5. Shared information regarding outdoor recreation design guidelines.
6. Assisted in the prioritization and -development of the transition plan for
implementation of increased access for the City of St. Anthony Village.
7. Assisted in the completion of grievance procedure and public notices.
8. Provided attachments which include, copies of applicable laws, codes,guidelines, and
resources.
9. Provided product information.
10. Conducted training sessions for the City of St. Anthony Village.

SECTION 504 GRIEVANCE PROCEDURE
REQUIRED UNDER-DEPARTMENT OF HEALTH, EDUCATION, AND
WELFARE
(84.7 WED.,, MAY 41 1977)
The City of St.Anthony Village has adopted an internal grievance procedure providing for prompt and equitable
resolution of complaints. all-eging-any action prohibited by the Department of Health, Education, and Welfare
f the Rehabilitation Act of 1973. Section 504 states,in pan

that 'no otherwise qualified han&agped individuals...shall, solely by reason of his handicap, be excluded from
the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity
receiving federal financial assistance..."
Complaints should be addressed to: City Manager, who has been designated to coordinate Section 504
compliance efforts.
1. A complaint should be filed in writing or verbally, contain the name and address of the person filing it,
and briefly describe the alleged violation of the regulations.
2. A complaint should be riled within 45 days after the complainant becomes aware of the allegedviolation.
(Processing of allegaLions of discrimination occurring before this grievance procedure was in place will
be considered on a case-by-case basis.)
3. An investigation, as may be appropriate, shall follow a filing of a complaint. The investigation will be
conducted by the Public Works Director. These rules contemplate informal but thorough investigations,
affording all interested persons and their representatives, if any, an opportunity to submit evidence
relevant to a complaint. Under 84.7 Wed., May 4, 19T7, the Public Works Director need not process
complaints from applicants for employment.
4. A written determination as to the validity of the complaint and description of resolution, if any,.shall
be issued by the City Manager and a copy forwarded to the complainant.
5. The Public Works Director shall maintain the files and records of the City of St. Anthony Village
relating to the complaints filed.
6. The complainant can request a reconsideration of the case in instances where he or she is dissatisfied
with the resolution. The request for consideration should be made within 45 to 60 days.
7. The right of a person to a prompt and equitable resolution of the complaint filed hereunder shall not
be impaired by the person's pursuit of other remedies such as the filing of a Section 504 complaint with
the Department of Justice. Utilization of this grievance procedure is not a prerequisite to the pursuit
of other remedies.
8. These rules shall be construed to protect the substantive rights of interested persons, to meet
appropriate due process standards and to assure that the City of St. Anthony Village complies with
Section 50.4 and the Department of Health, Education and Welfare.

EXECUTIVE S
The City of St.Anthony Village in its continuing efforts to provide an appropriate living and
work environment for residents and employees has just completed a thorough evaluation of
its buildings and sites for compliance with applicable laws, codes, and design guidelines
pertaining to access.
As a form,of local government, the City of St. Anthony Village is required to comply with
specific state and federal laws which mandate that all barriers to discrimination be removed
to provide persons with disabilities equal opportunity. The following laws pertain to the
City of St. Anthony Village:
Section 504 of the 1973 Rehabilitation Act
Section 504 of the 1973 Rehabilitation Act states that any entity receiving Federal
financial assistance -- either directly or indirectly -- must prohibit any discrimination
in the form of communication,structural accessibility,programs,policies,etc.,against
persons with disabilities.
As a result, an evaluation of all city buildings, facilities, programs, and practices were
supposed to completed as well as the implementation of a barrier removal program.
Enforcement- for Section 504 of the 1973 Rehabilitation Act is through various
Departments of the Federal Government. If an entity is found not making efforts
to comply with Section 504-O'f the 1973 Rehabilitation Act, there is a risk of losing
federal funding.
Americans With Disabilities Act Iltle 11
Title II of the Americans With Disabilities Act is intended to apply to all programs,
activities, and services provided or operated by state and local governments.
Currently, 504 only applies to programs or activities receiving federal financial
assistance. Like Section 504 of the 1973 Rehabilitation Act, the Americans With
Disabilities Act requires that architectural barriers be removed if they are necessary
for program accessibility.
Per of the Americans With Disabilities Act, local government should review all
buildings and facilities to determine what architectural barriers Odsts, the cost to
remove those barriers,and then determine what the appropriate implementation plan
should be to comply.

Enforcement of the Americans With Disabilities Act is through lawsuits filed as a
result of a complaint by a person with a disability or an organization representing
persons with disabilities. As of July 26, 1992, local government is at risk of being
exposed to a lawsuit if implementation plans have not been developed.
Minnesota State Building Code Chapter 1340
:-The--Nlinnesota state building code regarding accessibility was implemented in
November 1975.- Any building remodeled, constructed, or having a change of
occupancy after that date.is to comply with the Minnesota Building Code Chapter
1340 design guidelines. The NEnnesota Building Code Chapter 1340 is enforced by
local or state building officials.
It is encouraged that the City of St. Anthony Village use the information provided in this
report to develop a transition plan which outlines a schedule or the action to be taken for
each recommendation listed. As each upgrade has been completed as a result of repair,
remodeling, replacement, or as a proactive approach to removing architectural barriers, the
specific items should be dated or "checked off' to identify that the action has been
completed.
Based upon the observations of JQP, Inc., it is recornmended that the City of St. Anthony
Village take a proactive position in implementing those recommendations identified under
the "Plan of Action"to be consistent with the intent of the Americans With Disabilities Act.
Until such time all proactive recommendations are to be implemented, the City of St.
Anthony Village should be aware of their obligations to provide program accessibility.
Section 504 of the 1973 Rehabilitation Act and the Americans With Disabilities Act Title
H do indicate that it is not always necessary to make structural upgrades to provide
accessibility. The concept of program accessibility is acceptable to meet both of these laws.
Therefore, it is important that the City of St.Anthony Vulage review the programs provided
at each location in relation to the following report to identify where potential barriers may
exist at a site creating potential accessibility problems for persons with disabilities. It is
acceptable to relocate programs to an alternate site which may provide a greater level of
accessibility.
Those items listed as short term recommendations in the Plan of Action are recommended
to be implemented within the next two years. These reconu-nendations typically can be done
by facilities staff and require limited financial responsibility.
Long term recommendations are accessibility projects which will require a greater level of
planning, the potential involvement of an architect and/or outside construction firm, and
may require separate budgeting.

A reactive approach should be taken to accommodate a qualified employee's request for
accessibility upgrades to provide an appropriate work environment. It is encouraged that
the City of St. Anthony Village establish a procedure to communicate with employees to
determine appropriate needs.
The City of St. Anthony Village should establish a policy that all new construction and
remodel.ing meet the new construction guidelines produced as a result of the Americans
With Disabilities Act.
Finally, this report should be reviewed at such time any site. or facility undergoes repair,
remodeUng, or replacement. For example, if faucet hardware located in a restroom needs
to be replaced, it should be replaced with hardware which requires single effort operation,
i.e. single lever, dual blade, or electric eye. Over a period of time, through general
upgrades, eventually each site will provide accessibility features which will meet the needs
of all persons.
The sites surveyed have been categorized into three priority rankings for accessibility
upgrades. The rankings are based upon the number of activities located at this site, impact
of community use, and unique features. Upon review of this report, the community or staff
may place a higher ranking on a particular site for specific reasons. At such time, the City
of St. Anthony Village should review the request and see if it is appropriate to make it a
higher ranking. The site ranldngs are as follows:
APACHE WELLS SPORTS BAR AND GRILL -- PRIORITY RANKING 3
Proactive
Add the $200 phrase where missing on the reserved accessible parking stall signs.
Eliminate the gap at the entry threshold.
Finish upgrading the toilet rooms to provide full accessibility by displaying the white
on blue Wheelchair Access Symbol and provide adequate space adjacent to the latch
side of the door on the pull side.
Lower the public pay telephone to an appropriate height.
