She 7 stated they were very touched by the banner across Silver Lake 8 Road welcoming them to the- Village and they felt the City was 9 very beautiful . 10 11 Councilmember Marks is the Council ' s representative to the 12 Sister Cities Committee . He advised that the Gullickson ' s are 13 also hosting a reception for the visitors tonight . 14 15 The Mayor noted that the sister city relationship with Salo 16 was initiated by former Mayor Sundland about five years ago . 17 He and his wife had visited Salo and the wife of the Salo City 18 Manager came to visit St . Anthony. Also, at that time two 19 young men from Salo came to the City and were escorted by 20 Mayor Ranallo and former Councilmember Makowski . 21 22 In 1991 , members of the St . Anthony Orchestra travelled to 23 Salo to visit . Councilmember Marks felt one of the highlights 24 of that trip was the final concert which had a very moving 25 rendition of "Finlandia . " In 1992 some members of the Salo 26 Sports Club came to visit St . Anthony . • 27 28 Thy Mayor and the Counci 1 presented gi f is of St . Norwest Bank Minnesota 7 8 Motion by Marks , second by Enrooth to approve payment in the 9 amount of $1 , 185 , 000 . 00 to Norwest Bank Minnesota . This 10 payment is for the debt service which was issued in July of 11 1988 to construct the temporary water filtration plant and is 12 now maturing. The money to pay this debt comes from the funds 13 received from the U. S . Army settlement for the groundwater 14 contaminated by the arsenal . 15 16 Motion carried unanimously 17 18 7 . REPORTS 19 20 A. Planning Commission - May 18 , 1993 21 22 Commissioner Franzese was present representing the Planning 23 Commission . 24 25 1 . Casanova , 3312 36th Avenue - Garage Setback Permit 26 •27 Commissioner Franzese advised she did not participate in the 28 dic3cussion on this request and, abstained on the vote as Mr . 29 Casanova is her neighbor . 30 31 Mr . Casanova ' s proposed garage would be 23 . 6 feet x 22 . 2 feet 32 and would maintain a four foot setback on the west with 33 combined sideyard setbacks of twelve feet , four inches . He is 34 requesting this permit because he needs more garage room for 35 two cars . He also has noticed that homes with single car 36 garages have taken considerably longer to sell than those with 37 double garages . 38 39 Motion by Wagner, second by Fleming to approve the garage 40 setback permit to Leonard J. Casanova , 3312 36th Avenue which 41 would allow for a four foot sideyard setback on the west side 42 and combined sideyard setbacks of twelve feet , four inches 43 where the City Ordinance calls for five feet and fifteen feet 44 respectively as recommended by the Planning Commission . 45 46 Motion carried unanimously 47 48 49 2 . D. Henry, 3531 Croft Drive - Garage Setback Permit 50 I REGULAR COUNCIL MEETING . 1P JUNE 8 , 1993 PAGE 5 4 5 6 Mr . Henry i's requesting a garage setback permit to construct 7 a second twenty-two feet x twenty-four feet double garage with 8 an eighteen -foot sideyard setback . in the backyard to match the 9 grandfathered sideyard setback of the existing house . 10 11 .-Commissioner Franzese advised the Planning Commission is 12 recommending denial of this request . Members of the Commission 13 had suggested that a garage could be built closer to the 14 house. Also, there were objections from some of Mr . Henry ' s 15 neighbors . 16 17 Staff had noted that this request did not exactly meet the 18 intent of the garage setback permit process in that there is 19 already a two car garage on the property. It was also noted 20 that the second garage would accommodate the concerns of the 21 Council regarding the storage of boats and recreational 22 vehicles but still did not meet the spirit of the permit . 23 24 The Mayor observed that one of the reasons the Council has put 25 a permit process in place was to address vehicles and 26 recreational equipment left outside. 0 At-.the Planning Commission meeting, Mr . Henry was asked why he 29 didn ' t make an addition to his existing garage. He responded 30 that the bids on an addition would cost about $33 , 000 whereas 31 a detached garage would cost about $14 , 000 . At . the Council 32 Meeting he explained that the extra expense for the addition 33 was due to the footings necessary for the attachment . For a 34 detached garage only a floating slab was needed . 35 36 Councilmember Enrooth inquired if this request would have met 37 the criteria for approval under the old ordinance . The City 38 Manager said a hardship would have to be proven . He felt in 39 the truest sense of "hardship" it would never meet the 40 definition . 41 42 The City Manager felt enforcement of banning parking of 43 recreational vehicles outside or on a driveway would be very 44 difficult . He suggested that some conditions which addressed 45 this could be put into the permit . Mr . Henry stated that one 46 of his reasons for requesting this permit is so he will have 47 inside coverage for some of his recreational vehicles and 48 equipment and does not want to park them on his driveway . He 49 felt this would be more acceptable to his neighbors . 50 • 1 REGULAR COU14CIL MEETING • 2 JUNE 8 , 1993 3 PAGE 6 . 4 5 6 One of Mr . Henry ' s neighbors stated that a garage setback so 7 far into the yard would be ugly and ruin the neighborhood . 8 9 _. The City Manager advised that by ordinance thirty percent or 10 less- of-- a - parcel can be covered . Mr . Henry ' s request- would 11 comply with this ordinance requirement . He also noted this 12 could set a precedent as all corner lot owners could apply for 13 this permit if Mr . Henry ' s is approved . He questioned if the 14 Council wants to have garages built in backyards or detached . 15 He inquired if the Council desires staff to re-look the 16 ordinance and revisit the permit process . The question of 17 outbuildings is the issue as well . 18 19 Councilmember Fleming felt the issue setting a precedent is 20 one of primary concern . It was also noted that some options 21 for Mr . Henry had been discussed at this meeting which were 22 not discussed at the Planning Commission meeting. 23 24 Motion by Marks , second by Ranallo to lay this matter over , 25 return it to the Planning Commission and take up again when 26 the Planning Commission and staff have a recommendation . • 27 28 29 Motion carried unanimously 30 31 32 3 . Sarna, 3259 Stinson Boulevard - Setback Variance 33 34 Mr . Sarna is requesting a variance for the placement of a 35 canopy over the gas pumps at his service station and grocery 36 store at 3259 Stinson Boulevard. The proposed canopy has been 37 reduced in width from thirty-two feet to twenty-eight feet . 38 Even with this reduction , a ten foot setback variance from 39 33rd Avenue and an eighteen foot setback variance from Stinson 40 Boulevard would be required as the City requires thirty-five 41 foot setbacks from the streets on both sides because the City 42 treats these as front yards . 4 3- 44 Mr . Sarna reduced the size of the canopy and the concrete slab 45 but is proposing no changes in the angle of the canopy. He 46 stated there is no signage being considered for the canopy. 47 48 The Planning Commission recommended the Council approve a 49 twelve foot variance on the 33rd Avenue side and a twelve foot 50 variance on the Stinson Boulevard side . REGULAR COUNCIL MEETING JUNE 8 , 1993 3 PAGE 7 4 5 6 Councilmember Marks inquired on what hardship was the Planning 7 Commission ' s recommendation for approval based. 8 9 Some,. hardship-considerations were that all competitors have 10 canopies'and -that --th-e pumps are at an angle which would make 11 it - quite expensive to move them. Mr . Sarna felt the hardship 12 would be one of economics . Commissioner Franzese suggested 13 that the canopy is a unique structure and could be considered 14 a hardship by its uniqueness . 15 16 Councilmember Marks advised that economic hardship is never a 17 valid nor legal reason for approval of a variance. 18 19 The Mayor stated it is not the intent of the Council to oppose 20 the canopy as it is recognized as a convenience for Mr . 21 Sarna ' s patrons . 22 23 Mr . Sarna said he has viewed all options to move the pumps . 24 The City Manager felt the whole issue is one of design . He 25 observed that ingress and egress options , parking requirements , vehicular movement and the general layout of the property should be considered before any decision is made on 28 th2s request . 29 30 Motion, by Marks, second by Wagner to lay this matter over 31 until it is reviewed by staff with Mr. Sarna and brought back 32 to the Council . 33 34 Mr . Sarna noted that the hardship claimed by the Amoco Station 35 is not apparent . The Management Assistant explained the 36 hardship at the Amoco Station. 37 38 The City Manager advised that if an error is made in granting 39 a variance another variance using this error as an example 40 cannot be done . 41 42 Motion carried unanimously 43 44 4 . Rezoning Properties Located on Silver Lake Road South of 45 39th Avenue 46 47 This rezoning is being requested to correct a zoning error and 48 bring it into conformance with the St . Anthony Comprehensive 49 Plan . The properties will be rezoned from R-2/R-4 to 50 Commercial . • I REGULAR COUNCIL MEETING • 2 JUNE 8 , 1993 3 PAGE 8 4 5 6 Commissioner Franzese noted there were some concerns regardi.ng 7 what this rezoning would allow on the property . Residents were 8 assured that a fast food -operation was not an allowable use in 9 this commercial zoning . Owners of the two properties , Mr . Lee 10 and Twin - City- Federal have stated their support for the 11 rezoning. 12 13 In response to an inquiry from the City' s Management 14 Assistant , Ramsey County wrote a letter which addressed access 15 from these parcels to Silver Lake Road . The letter noted that 16 any access points allowed along the east side of Silver Lake 17 Road south of 39th Avenue would be right in , right out only 18 driveways . The median would not be allowed to be opened for 19 left turns . The construction of a right in, right out access 20 at either thirty feet or 170 feet from the Twin City Federal 21 curb should not cause any potential traffic problems . 22 23 24 Motion by Wagner , second by Marks to approve the rezoning to 25 C (General Commercial District ) according to the Planning 26 Commission ' s findings wh-ich are as follows : 27 28 Lot 7 , Block 7 of Mounds View Acres Second Addition which 29 is presently zoned R-4 (Multiple Family Residence 30 District ) ; Lot 8 , Block 7 of Mounds View Acres Second 31 Addition is presently zoned R-2 (Two Family Residence 32 District ) ; and, Lot 9 , Block 7 of Mounds View Acres 33 Second District which is presently zoned R-2 (Two Family 34 Residence District ) . 35 36 Motion carried unanimously 37 38 B. Council Reports 39 40 1 . Report of Councilmember Wagner 41 42 Councilmember Wagner attended a meeting of the Community 43 Service Council . He advised that legislative action taken 44 during the recent Legislative Session will have a severe 45 negative impact on the funding for the Community Service 46 Council budget . This organization will lose funding for 47 perhaps ten years . The Annual Compliance Meeting is scheduled 48 for June 15th in the Middle School Board Room. 49 50 • REGULAR COUNCIL MEETING JUNE 8 , 1993 3 PAGE 9 4 5 Councilmember Wagner attended the recent meeting of the Apache 6 Merchants Association . He stated that all merchants in the 7 shopping center are anxious for information regarding the 8 final plans for a CUB Store . There was also interest in the 9 . future of a canopy being included in the development . 11 - The City Manager advised that the numbers have been finalized 12 with all involved entities regarding financing of the project . 13 Staff is presently waiting for the site plans . He feels the 14 progress of the project is going well . 15 16 2 . Report of Councilmember Fleming 17 18 Councilmember Fleming attended the first meeting of the 19 Proie'c-t Reflect Respect , a project spearheaded by the 20 Northwest Youth Services Bureau . There were sixty plus people 21 in attendance . She feels the program is fantastic and the 22 speakers were excellent . The purpose of the project is to make 23 things better and that people must become more involved. "I ' 11 24 try" is not enough ; becoming involved will changes occur . 25 Councilmember Fleming suggested that either of the two speakers would be an excellent choice for the St . Anthony 8 Re�;ognition Dinner. She recommended staff consider this . 29 30 3 . Report of Councilmember Marks 31 32 Councilmember Marks had nothing to report at this time. 33 34 4 . Report of Councilmember Enrooth 35 36 Councilmember Enrooth had no City business to report on at 37 this time but shared the "health" of the fish in Ontario. He 38 noted most of them had eluded his fishing pole. He also 39 advised that the water level is down seven feet . 40 41 5 . Report of Mayor* Ranallo 42 43 Mayor Ranallo attended the recent meeting of the St . Anthony 44 Shopping Center Merchants Association. He advised that a full 45 time person had been hired to exclusively concentrate on 46 renting of vacant spaces on the shopping center . 47 48 There have been some long term parking of cars observed in the 49 shopping center ' s parking lot . The Police Department will be 50 monitoring this situation . 1 REGULAR COUNCIL MEETING • 2 JUNE 8 , 1993 3 PAGF. 10 4 5 6 C . City Manager ' s Report 7 8 1 . 1992 City Audit 9 10 - St-wart Bonniwell performed the 1992 audit for the City of St . —11 ---Anthony : Members- of - the- Council received copies of the audit 12 and Mr . Bonniwell ' s report . 13 14 The Mayor felt the audit gets more complicated to understand 15 each year and requested Mr . Bonniwell to explain the current 16 assets and liabilities of the City . 17 18 Mr . Bonniwell referred to two pages in the audit which 19 reflected the investments and debt statement for the year 20 ending in 1992 . The City has $10 . 5 million in cash and 21 investments and has a debt of $5 . 3 million . 22 23 Mayor Ranallo inquired if the City were in a position to use 24 some of its cash - to pay for improvements . Mr . Bonniwell 25 responded the City could fund the projects internally and then 26 assess the benefited property owners . 27 28 Thr3 Mayor questioned what could be done if funds were used to 29 finance projects internally and then it was found that the 30 City needed funding quickly. Mr. Bonniwell advised that bonds 31 could still be sold . 32 33 The City Manager noted a problem would result if projects were 34 funded internally in that the fund dedicated for future needs 35 would be depleted and there would be no opportunity to 36 replenish it by the time it was needed. 37 38 In Mr . Bonniwell ' s audit report he noted that the utility 39 billing system was inefficient . Councilmember Enrooth recalled 40 that this system is only five years old and wondered how it 41 could have become inefficient in such a short time. 42 43 Mr . Bonniwell stated that the City has many different types of 44 charges . The capacity of the system is limited and it has been 45 "maxed" out . The Finance Director advised that the needs of 46 the various charges has exceeded the efficiency of the system. 47 48 Councilmember Marks noted that Mr . Bonniwell had suggested 49 there may be a problem with the segregation of duties . 50 I REGULAR. COUNCIL MEETING JUNE 8 , 1993. PAGE 11 4 5 6 Mr-: Bonniwell suggested it may not be a problem but has the 7 potential to be troublesome because of the limited number of 8 City staff . 9 10 Councilmember Wagner. observed what appeared to be a loss of 11 $12.,_690 in the DARE Fund . He was advised the revenue in the 12 fund is located in another place in the audit . The Finance 13 Director advised there is 'a $12 , 000 balance in the Fund as the 14 School District had made a contribution to it . 15 16 Motion by Wagner , second by Fleming to accept the Auditor ' s 17 report . 18 19 Motion carried unanimously 20 21 22 2 . Northgate Office Park Sionaae 23 24 Previously , the Council had denied a variance for this 25 signage . At its June 1st work session , the Council had 26 received additional information from the City Attorney 0 0 regarding how this request could be accommodated. 29 Motion by Fleming, second by Marks to bring back the issue of 30 the Northgate Office Park signage for reconsideration. 31 32 Motion carried unanimously 33 34 35 Motion by Fleming, second by Enrooth to approve the Northgate 36 Office Park request for a sign variance. 37 38 Motion carried unanimously 39 40 41 Motion by Enrooth, second by Marks to approve the first 42 reading of Ordinance No. 1993-007 being an ordinance relating 43 to signs ; amending Section 1400 . 08 to add the replacement of 44 business identification signs . 45 46 Motion carried unanimously 47 48 49 3 . Oak Grove Sanitary Landfill Trust 50 • I REGULAR COUNCIL MEETING 2 JUNE 8 ; 1993 3 PAGE 12 4 5 6 Over a period of many years hazardous waste and unacceptable 7 material was dumped into the Oak Grove Sanitary Landfill . At 8 the time this material was dumped it was not considered 9 unacceptable . The funds for cleaning up this material were not 10 available through the Superfund so contributors to the 11 landfill material are being held liable for the associated 12 costs . 13 14 Numerous large corporations have been sited as contributors 15 and are being held responsible for many thousands of dollars . 16 These corporations have combined their efforts to establish 17 what other entities have contributed to this landfill in 18 anticipation that they will also contribute to the clean-up. 19 20 One of the haulers who removed refuse from the St . Anthony 21 City Hall and Community Center Building has been identified as 22 a contributor to this landfill during the time objectionable 23 material was received . 24 25 St . Anthony and other cities serviced by this hauler are being 26 assessed for the clean-up. St . Anthony ' s share is $15 , 000 , 27 which is fifty percent less than what will be owing if it is 28 not paid by June 30th . 29 30 Mr . Burt and other city managers met with Senator Durenberger 31 regarding this matter . They inquired if there were Superfund 32 dollars available and requested the Senator ' s help. The funds 33 were depleted and the Senator was not effective in a resolve 34 to remove the municipalities ' liability. 35 36 Motion by Wagner , second by Fleming to authorize the City 37 Manager and the City Attorney to settle the claim with the Oak 38 Grove Sanitary Landfill Trust in the amount of $15, 000 . 39 40 Motion carried unanimously 41 42 8 . PUBLIC HEARINGS 43 44 There were no public hearings . 45 46 9. NEW BUSINESS 47 48 A. Change Order #1 - Booster Pumps and Pumphouse 49 Installation 50 REGULAR COUNCIL. MEETING JUNE 8 , 1993 3 PAGE 13 4 5 6 The City Manager advised that the overflow from the pumphouse 7 runs over the fields to the drainage ditch . This flow 8 direction must be 'changed . The costs will be paid by the 9 federal government . 10 11 Motion by Marks, second by Wagner to approve Change Order #1 12 being the water system improvement project in the amount of 13 $2 , 699 . 50 . 14 15 Motion carried unanimously 16 17 18 B. Resolution No . 93-038 ; Re : Call for Hearina for the Sale 19 of Bonds for 1993 Road Improvements 20 21 Springsted Financial Advisors prepared its recommendations for 22 the sale of the General Obligation Improvement Bonds . The 23 proceeds from this bond sale will be used to finance the 24 construction of various street and utility improvements . Soth believed that lot size is a hardship because the movement of the pumps to allow a canopy within the building envelope would take away the parking use of his property. Soth said the cost;to move the pumps is a hardship. This is an economic hardship, which can be considered if not considered as the sole hardship. Sarna, Stop-N-Save, 3529 2 Stinson Boulevard -.The Public-Hearing-was opened- at--9 : 06- p.i._.m-:....with Chair - 5 Faust reading the Notice of Hearing which had been 6 published in the May 5 , 1993 edition of the St. Anthony 7 Bulletin. 8 9 The Chair noted that the Commissioners hadn't received any 10 of the documentation for the proposal in their agenda 11 packets . He indicated that they had the option of tabling 12 without consideration or tabling later in the meeting if 13 they perceived the need for more information. The fact 14 that the proposal had received a concept review at the 15 Commission' s April meeting, prompted the Commissioners to 16 suspend the rules governing deadlines for submitting 17 documentation for a proposal . 18 19 Mr. Urbia indicated the applicant had reduced the width of the canopy over the gas pumps from 32 feet to 28 feet. However, even the reduced size would require a 10 foot 22 setback variance from 33rd Avenue N. E. and 18 feet from 23 Stinson Boulevard. Thirty five foot setbacks from the 24 street are required for both sides which the City 25 Ordinance treats as front yards . 26 27 The Management Assistant had been requested to research 28 the number of setback variances granted to the Amoco 29 Station on 37th and Silver Lake Road. His research 30 indicated only a 13 foot variance had been granted there 31 since 1985 . 32 33 Mr. Sarna confirmed that the previous request for a canopy 34 32 feet X 32 feet had been pared down to only a 32 foot X 35 28 foot canopy and concrete slab, with no changes in the 36 angle for the canopy. He assured the Commissioners that 37 he planned no signage on the canopy. 38 39 The Public Hearing was closed at 9 : 15 p.m. 40 41 Chair Faust indicated he still found the canopy obtrusive 42 on that corner where the station can be seen from all 43 directions. He also noted this 12 could set a precedent as all corner lot owners could apply for 13 this permit if Mr . Henry ' s is approved . He questioned if the 14 Council wants to have garages built in backyards or detached . 15 He inquired if the Council desires staff to re-look the 16 ordinance and revisit the permit process . The question of 17 outbuildings is the issue as well . 18 19 Councilmember Fleming felt the issue setting a precedent is 20 one of primary concern . It was also noted that some options 21 for Mr . Sarna, 3259 Stinson Boulevard - Setback Variance 33 34 Mr . Sarna is requesting a variance for the placement of a 35 canopy over the gas .pumps at his service station and grocery 36 store at 3259 Stinson Boulevard. The proposed canopy has been 37 reduced in width from thirty-two feet to twenty-eight feet . 38 Even with this reduction , a ten foot setback variance from 39 33rd Avenue and an eighteen foot setback variance from Stinson 40 Boulevard would be required as the City requires thirty-five 41 foot setbacks from the streets on both sides because the City 42 treats these as front yards. 43 44 Mr. Sarna reduced the size of the canopy and the concrete slab 45 but is proposing no changes in the angle of the canopy. He 46 stated there is no signage being considered for the canopy. 47 48 The Planning Commission recommended the Council approve a 49 twelve foot variance on the 33rd Avenue side and a twelve foot 50 variance on the Stinson Boulevard side . Mr . Sa.rna felt the hardship . 12 would be one of economics . Commissioner Franzese suggested 13 that the canopy is a unique structure and could be considered 14 a hardship by its uniqueness . 15 16 Councilmember Marks advised that economic hardship is never a 17 valid nor legal reason for approval of a variance . 18 19 The Mayor stated it is not the intent of the Council to oppose 20 the canopy as it is recognized as a convenience for Mr . 21 Sarna ' s patrons . 22 23 Mr . Sarna said he has viewed all options to move the pumps . 24 The City Manager fel.t the whole issue is one of design . He 25 observed that ingress and egress options , parking 26 requirements , vehicular movement and the general layout of the property should be considered before any decision is made on th= s request . 29 30 Motion by Marks , second by Wagner to lay this matter over 31 until it is reviewed by staff with Mr. Sarna and brought back 32 to the Council . 33 34 Mr . Sarna noted that the hardship claimed by the Amoco Station 35 is not apparent . The Management Assistant explained the 36 hardship at' the Amoco Station. 37 38 The City Manager advised that if an error is made in granting 39 a variance another variance using this error as an example 40 cannot be done. tMotion carried unanimously 43 44 4 . Rezoning Properties Located on Silver Lake Road South of 45 39th Avenue 46 47 This rezoning is being requested to correct a zoning error and 48 bring it into conformance with the St . Anthony Comprehensive 49 Plan . The properties will be rezoned from R-2/R-4 to 50 Commercial . Residents were 8 assured that a fast food operation was not an allowable use in 9 this commercial zoning . Owners of the two properties , Mr . Lee 10 and Twin City- Federal have stated their support for the 11 rezoning. , 12 13 Ire response to an inquiry from the City ' s Management 14 Assistant , Ramsey County wrote a letter which addressed access 15 from these parcels to Silver Lake Road . The letter noted that 16 any access points allowed along the east side of Silver Lake 17 Road south of 39th Avenue would be right in , right out only 18 driveways . The median would not be allowed to be opened for 19 left turns . The construction of a right in, right out. access 20 at either thirty feet or 170 feet from the Twin City Federal 21 curb should not cause any potential traffic problems . 22 23 24 Motion by Wagner , second by Marks to approve the rezoning to 25 C (General Commercial District ) according to the Planning 26 Commission ' s findings which are as follows : 27 28 Lot 7 , Block 7 of Mounds View Acres Second Addition which 29 is presently zoned R-4 (Multiple Family Residence 30 District ) ; Lot 8 , Block 7 of Mounds View Acres Second 31 Addition is presently zoned R-2 (Two Family Residence 32 District ) ; and, Lot 9 , Block 7 of Mounds View Acres 33 Second District which is presently zoned R-2 (Two Family 34 Residence District ) . 35 36 Motion carried unanimously 37 38 B. Council Reports 39 40 1 . Report of Councilmember Waciner 41 42 Councilmember Wagner attended a meeting of the Community 43 Service Council . He advised that legislative action taken 44 during the recent Legislative Session will have a severe 45 negative impact on the funding for the Community Service 46 Council budget . This organization will lose funding for 47 perhaps ten years .
