9 The meeting was called to order at 7 : 00 p.m. and the Pledge
10 of Allegiance was led by Mayor Ranallo.

5 ■ IN'T'RODUCTION TO THE CITY'S THREE NEW POLICE OFFICERS.

7 Mayor Ranallo welcomed the three new police officers to St .
8 Anthony and asked Police Chief Engstrom to introduce the new
9 officers. Two of the new officers will help with Lauderdale
10 and the third new officer is replacing one who left .
11
12 Ron Leonard started working full time for St . Anthony on
13 November 22, 1993 and has a AA Degree. He is married and
14 has a two year-old daughter and resides in Maple Grove .
15
16 Tim Flynn started working for St . Anthony on November 29,
17 1993 and has a BS Degree from St . Thomas University and
18 completed his skills in Edina. He is single and resides in
19 St . Paul .
20
21 Mike Royce started working for St . Anthony on November 29,
22 1993 and has a BA Degree from Mankato State . 'He is single
23 and resides in Eagan. •

25 The Chief indicated that they were doing remarkably well in
26 the field training program and would be out on the streets
27 in approximately eight weeks .

29 Elie Dubay, 3012 32nd Avenue N.E. , questioned how many
30 patrol cars there were.--in the Village . Police Chief
31 Engstrom responded that there were two marked patrol cars
32 and one unmarked car. The Mayor added that the Chief drove
33 an unmarked car. There is one unmarked back-up car which-
34 the City uses as a court utility car and they will be adding
35 one more car to the fleet sometime in March. The Mayor said
36 there is also another marked car which the police reserves
37 use which is not fully -equipped.

6 Village High School Bowling Team and congratulated the team
7 for winning the State Championship in December, 1993 . Lynn
8 Anderson, Coach of the bowling team, said during the
9 championship tournament the team averaged a 186 score and
10 that St . Anthony should be very proud. She introduced the
11 members of the bowling teams as follows : Jason Ludkin,
12 Shawn Skilling, Neil Anderson, Dan Graft . Sharon Stansgard
13 was also present representing her son Chris who couldn' t
14 make it and Jason' s Ludkin' s mother.

16 Mayor Ranallo presented the- team with a plaque and all of
17 the members came forward to accept it and have their picture
18 taken.

5 Commissioner Rosemary Franzese appeared on behalf of the
6 Planning Commission to support Mr. Barton' s petition to
7 relocate an existing garage on his property. The
8 Commissioner informed the Council that this request was
9 previously before the Commission and the applicant withdrew
10 his prior request for a breezeway. At this time he is
11 requesting to move an existing free standing accessory
12 structure. In addition to the move the applicant will also
13 be changing the existing gravel surface to a hard concrete
14 surface .

17 The Planning Commission put several conditions on Mr.
18 Barton' s request : (1) be in accordance with Ordinance
19 1650 . 11 regarding the mover, permits, zoning codes, and
20 condition of the building; (2) the exterior match and be
21 upgraded to satisfactorily meet the requirements by the City
22 Engineer and a professional survey be completed; and (3)
that the edge of the hard surface driveway be a minimum of
44 five feet from the property line.

26 Mr. Don Dick, Mr. Barton' s neighbor to the north, was
27 present and Commissioner Franzese indicated he previously
28 objected to the request because his garage would be so close
29 to the edge of the property line.

31 Councilmember Marks indicated there was a letter from Mr.
32 Barton nIs neighbor to the south, Ken. Friberg and Lona Miller,
33 3511 Harding Street, endorsing Mr. Barton' s request .

35 Mayor Ranallo indicated he received communication today from
36 Bill Solz, an attorney, addressing the requirement that the
37 edge of - the hard surface driveway be a minimum of five feet
38 from the property line . Councilmember Fleming said she
39 didn' t see any objection to the request in that letter.

41 Scott Barton, 3515 Harding Street, responded to
42 Councilmember Marks ' question regarding the setback

5 requirement on the drawing. Mr. Barton said he believes his
6 house was the original farm house for the Gardena Acres
7 subdivision and is not completely square. He also said he
8 has found all four iron monuments on the property and he
9 wasn' t sure if the Planning Commission was aware of that
10 when the added condition of obtaining a surveyor was
11 applied. Mr. Barton said he wasn' t objecting to the
12 surveyor but didn' t want to spend the money on one if he
13 didn' t have to and was wondering if the City inspector- could
14 perform the survey. Larry Hamer, Public Works Director,
15 said the City couldn' t act as a surveyor.

11 Councilmember Enrooth felt that since it was one of the
18 oldest lots in the Village and that it is a potential bone
19 of contention as to where the property line is between Mr.
20
21 Barton and his neighbor to the north, that the property line
22 should be clarified.
23
24 Motion by Marks and seconded by Enrooth to approve Mr.
25 Barton' s request with the same conditions applied by the
26 Planning Commission.

32 Councilmeniber Enrooth reported that the field trip to the
33 burner is Thursday, January 14, 1993 in the morning.. He
34 felt it would -be very interesting. He also reported the
35 previous two couples will be co-chairing VillageFest which
36 is tentatively scheduled .for August 6, 1994 . VillageFest
37 will be a one-day event starting early in the morning with a
38 5K run and a band at night .

42 1. . Response to Recycling Center RFP for 1994 .

5 At the request of the Council, Management Assistant Sarah
6 Bellefuil obtained additional bids for recycling services .
7 She received two additional bids. Mayor Ranallo asked if
8 BFI would continue on a month-by-month basis in case the
9 City decided to close the recycling center. Management
10 Assistant Bellefuil said BFI' was willing to continue with
11 • 1993 prices until March of 1994 and that she hadn' t talked
12 with them about going month-to-month beyond March. She said
13 St . Anthony was one of the few places left that still had a
14 recycling center open. Mayor Ranallo explained that
15 residents were already paying for the recycling in their
16 rubbish bill . However, the City receives reimbursement from
17 Hennepin County for the recycling center and which is one of
18 the reasons it is kept open.

20 Councilmember Enrooth suggested the City continue the
21 recycling center through the middle of May to allow for
�22 Spring clean up.
Z4 VII. PUBLIC •HEARINGS.
25
26 The City Manager reported that one neighborhood meeting was
27 held before the .actual costs were determined. The project
28 was explained and the inconveniences that went along with
29 the reconstructions and overlays. Additional correspondence
30 was sent to each affected property owner after the City
31 received bids showing exactly what the amount would be if
32 the assessments are approved and which also informed them of
33 the public hearing on .the project .
34
35 The Mayor said that about four or five years ago a task
36 force was formed to make recommendations to the City Council
37 on what they felt should be done to streets and sidewalks .
38 They also looked at sewer and water, and other public
39 utilities as well . The City now has a more sophisticated
40 pavement management study which computerizes information
41 about road conditions .. From the computer evaluation they
42 are able to determine project areas. The Committee

5 recommended that the project be done and spread over a
6 period of time based on the pavement management report .
7 They also made a recommendation on the assessment policy
8 which the Council approved and was subsequently amended at a
9 lower rate.

11 The public hearing was opened at 7 :35 p.m. The notice of
12 the hearing appeared in the December 15, 1993 edition of the
13 Bulletin. Motion by Marks and seconded by Enrooth to open
14 the public hearing.

18 Mark Anderson and Bob Roberts, representing the engineering
19 firm Rieke Carroll Muller and Associates, were present at
20 the meeting. Mr. Anderson gave a presentation of the 1994
21 street improvements . He explained the project would consist
22 of street reconstruction and replacement of water main and
23 storm sewer lines on 32nd Avenue N.E. from Rankin Road to
24 Silver Lake Road and on Hilldale Avenue N.E. from Rankin
25 Road to Silver Lake Road. The project also consists of a
26 bituminous overlay over the existing pavement on Croft Drive
27 from 32nd Avenue N.E. to 33rd Avenue N.E. ; Skycroft Drive
28 from 32nd Avenue N.E. to 33rd Avenue N.E. ; 31st Avenue N.E.
29 . . from Rankin Road to Silver Lake Road; Rankin Road from 32nd
30 Avenue N.E. to 33rd Avenue N.E. ; and 32nd Avenue N.E. from
31 Croft Drive to Rankin Road.

33- Mr. Anderson said during—the water main installation- only
34 one half of the pavement at a time will be removed to allow
35 access to homes during the process . A higher curb will'also
36 replace the current one which acts as a barrier to keep
37 traffic within the roadway and assists in plowing. The 1994
proposed improvements will begin May 15 and end in early
39 August .

41 Larry Hamer, Public Works Director, said NSP will be
42 replacing all of the gas mains and he is working with NSP to

6 possibly remove the poles located in the front yards .

8 Harvey Roloff, 3012 Hilldale Avenue, wanted the Engineer to
9 show him how the curbs would run into the driveways . The
10 Engineer explained that the driveways would have a tapered
11 apron out to the roadway. The curb height will be six
12 inches.

14 Mayor Ranallo urged the residents to contact the City if
15 they were experiencing problems during the reconstruction.
16
17 Gloria Nashko, 3400 33rd Avenue N.E. , felt her assessment
18 was too high because she is not allowed to sell her lot .
19 She was wondering if she was assessed for a water valve in
20 the back of her lot because she doesn' t have one. The City
21 Manager said a stop box would be put on her lot in case the
�22 lot was ever divided.
X14 The City Manager explained that to appeal the process, the
25 resident must appeal in writing to the City Clerk thirty
26 days from the adoption of the assessment . After that time
27 the resident has ten days to file the appeal in District
28 Court .

30 Elie Dubay, 3012 32nd Avenue N.E. , appeared to express his
31 displeasure regarding his trees being cut off by NSP.

33 Don Anderson, 3208 Croft Drive, wanted to know what the
34 reasoning was for grinding the concrete down. The City
35 Manager explained that on Mr. Anderson' s street there is a
36 bump which was filled in over the concrete with asphalt,
37 which created a drainage problem. The proposal was to grind
38 off approximately one and a half inches to improve the
39 drainage. Mayor Ranallo suggested a meeting with all
40 parties .

42 Greg Prom, 3201 Hilldale Avenue, inquired if 32nd and

5 Hilldale were going to be worked on at the same time . Mr.
6 Anderson said it would be up to the contractor. Mr. Prom
7 also wanted to know when the assessments were due. The City
8 Manager said they could be paid in full by November 30, 1994
9 with no interest or it would be assessed over a fifteen year
10 period of time appearing each year on the property taxes
11 with an interest rate of two percent over prime rate.

A RESOLUTION AUTHORIZING EXECUTION OF A PROXY IN
FAVOR OF CERTAIN AMENDMENTS TO THE DECLARATION OF
TRUST OF THE MINNESOTA MUNICIPAL MONEY MARKET FUND
BE IT RESOLVED by the City Council of the City of St. Anthony, Minnesota as follows:
Section 1. Background. .
1.01 The City of St. Anthony is a participant in the Minnesota Municipal Money Market
Fund (4M Fund), by reason of its approval of a joint powers agreement in the form of a
Declaration of Trust.
1.02 The City has been asked to consider certain amendments to the Declaration of Trust of
the 4M fund.
1.03 The City has reviewed and considered the proposed amendments to the Declaration of
Trust as described in the attached proxy statement and amended Declaration of Trust.
• Section 2. Authorization.
2.01 The City of St. Anthony approves the proposed amendments described in the proxy
statement and amended Declaration of Trust.
2.02 At a meeting of the 4M Fund participants to be held on February 2, 1994,
is authorized to attend and vote on behalf of the City in favor of the
proposed amendments, or in the alternative, is authorized to execute the attached proxy in
favor of the amendments and forward it to the proxy agent to be voted accordingly.

A meeting of the Participants of the Minnesota Municipal Money
Market Fund (4M Fund) will be held on Wednesday, February 2,
• 1994 at 2:00 p.m. , at the League of Minnesota Cities' offices,
3490 Lexington Avenue North, Shoreview, MN. The purpose of the
meeting is to consider amendments to the Declaration of Trust.
The Technical Advisory Board of the 4M Fund recently proposed to
the 4M Fund Board of Trustees certain changes in the 4M Fund
Trust Document. The changes require a vote of the participants.
The changes are discussed in detail in the attached proxy
material.
You are cordially invited to attend the meeting, but whether or
not you plan to be present, please fill in, date and sign the

The City Council of the City of St. Anthony hereby ordains:
Section 1. Section 610.02 is amended to read as follows:
610.02. Water Rates. Water bills will be computed quarterly based on metered
water used at the rate of $.86 per 100 cubic feet or any fraction thereof.
Section 2. This ordinance shall be in effect as of the date of its publication.

SUBJECT: DESIGNATION OF CITY'S LEGAL NEWSPAPER
Both newspapers that submitted bids for 1994's legal publications were sent letters requesting
them to re-bid. The Focus contacted me and indicated they feel their bid was very
comprehensive and chose to stay with their original bid. The Bulletin is doing the same.
• The issue now comes to the actual state law referring to the lower case alphabet of 90 points.
The Bulletin meets the statutory requirement, however the Focus is at 72 points. In an attempt
to clarify this issue, I contacted Mark Athenson, legal counsel for the newspaper association.
He has yet to return my call.
In addition, I discussed the issue with John Turner of the League of Minnesota Cities staff as
well as Bill Soth. Their findings are that there is no case law specifying point size. However,
both recommend that it would be appropriate to accept the bid which is in compliance with the
statute and how it is written.
RECOMMENDATION
Recommend the Council designate the St. Anthony Bulletin as the City's 1994 legal
newspaper.

News is 78 points long. State law requires the lower case alphabet length to be 90 points
long. The short length of the alphabet results in smaller legal type, and could possibly
invalidate legal notices published in the smaller size.

I have checked the law regarding the requirements for the forms of public
notice to be given under Minnesota Statutes, Section 331A.'05, and have also talked
with Mark Athenson, who is the attorney for the State Newspaper Association.
The statute clearly requires that all notices be "printed in a type face no
smaller than six point with a lower case alphabet of 90 point." The reference to the
six point type face is a reference to the height of the type. The reference to the ninety
point has to do with the spacing and width of the letters. That is, a full alphabet is
required to be 90 points wide on the page.
As I understand it, The Bulletin meets the six point and 90 point
requirements, but The Focus newspaper has only 72 point type face rather than 90
point. In reviewing the law, I find there are no cases or opinions,interpreting the
statute. On its face, the statute clearly requires 90 point type for any public notices.
After discussing this with Mark Athenson, we both concluded that there was no
flexibility under the statute which would permit smaller type face. You mentioned
that you thought Columbia Heights and Fridley were using The Focus for their
public notices. If so, this would appear to be contrary to the statute.
In discussing the newspaper printing process with Athenson, he saw no
reason why The Focus shouldn't be able to use 90 point type for your public notices
even though they might use smaller type face for the rest of the newspaper. This is
something you should pursue with them. It would seem that with the current

processes for printing, it wouldn't be that difficult to put St. Anthony notices in the
90 point type.
If they are not able to do this, it would not be advisable far St. Anthony to use

I enjoyed attending the council meeting on January 11th and appreciate the time the council took to discuss St.
Anthony's legal publications with me. I know Focus News could do an excellent job for your city and hope to
have the opportunity to serve you.
Since that meeting, I have faxed some information to Tom Burt to help better explain the sizing of the legal ads.
Minnesota Newspaper Association had sent us a form last year to show how they determine size of legals. I
faxed a copy to Tom and also filled out the form showing how our legal price compares to our competitor using
MNA's calculations. (I have enclosed a copy of each form with this letter.) As you can see, we are $1.30 per
column inch cheaper than our competitor.

we published it and the way it looks when our competitor publishes it. You can see that because we use a
different format, your legal would not take as much space per inch and, therefore, it is cheaper to run the legal

A copy of our original bid sent to Tom Burt in December is also enclosed. I gave you a very good price at that
time and I feel I need to stay at that rate. If after receiving our final bids you would like each of the newspapers
to do a sample legal for you to compare the price per column inch of the finished product, (as I did with the
Fridley sample enclosed) we would be happy to accommodate you.
