Pledge of Allegiance. Roll Call. Consideration, Discussion, and Possible Action on All of the Following Items: I. Approval of October 22, 2002 City Council Meeting Agenda. Action requested. II. Proclamations and Recognitions. III. Community Forum. Individuals may address the City Council about any item not included on the regular agenda. Speakers are requested to come to the podium, state their name and address for the Clerk's record and limit their remarks to five minutes. Generally, the City Council will not take official action on items discussed at this time, but may typically refer the matter to staff for a future report or direct that the "matter be scheduled on an upcoming agenda. IV. Consent Agenda. These items are considered routine and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which event the item will be removed from the Consent Agenda and placed elsewhere on the agenda. ANTHONY 2 3 CITY COUNCIL REGULAR MEETING MINUTES 4 5 October 8, 2002 6 7 CALL TO ORDER 8 Mayor Hodson called the meeting to order at 7:00 p.m. 9 10 PLEDGE OF ALLEGIANCE. 11 Mayor Hodson invited the Council and audience to join him in the Pledge of Allegiance_. 12 13 ROLL CALL. 14 Present: Mayor Hodson; Councilmembers Horst, Sparks, Thuesen, and Faust. 15 Absent: None. 16 Also Present: City Manager Mike Mornson. 17 18 CONSIDERATION,DISCUSSION,AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 19 ITEMS. 20 21 I. APPROVAL OF OCTOBER 8, 2002 CITY COUNCIL MEETING AGENDA. 22 Motion by Councilmember Sparks to approve the City Council Meeting Agenda of October 8, 23 2002. 24 25 Motion carried unanimously. 26 27 II. PROCLAMATIONS AND RECOGNITIONS. 28 A. Presentation of Appreciation Plaque to Merle Fischer. 29 Jay Hartman, Director of Public Works, stated he is pleased to take this opportunity to recognize 30 Merle Fischer for over 25 years of service with both the Army and Air National Guard. Mr. 31 Hartman introduced Mr. Fischer and his family members. He explained that Mr. Fischer has 32 recently returned after a seven-month deployment due to the events of September 11, 2001. Mr. 33 Hartman reviewed Mr. Fischer's 25-year history of service to the United States of America 34 which included action during Desert Storm, Operation Enduring Freedom, and Operation 35 Freedom Eagle. He advised that Mr. Fischer's United States Air Force occupation is C-130 36 Flight Medic and he will retire in February of 2003. Mr. Hartman stated Mr. Fischer, for the 37 past 10 years, has been employed as a utilities operator for the City of St. Anthony. In addition, 38 Mr. Fischer enjoys coaching his three active daughters, fishing, and hunting. Mr. Hartman 39 congratulated Mr. Fischer for 25 years of service in the Air National Guard. 40 41 Mayor Hodson read in full and presented Merle Fischer with a plaque of appreciation for his 42 service to the United States of America for the past 25 years in the Air National Guard. 43 44 Mr. Fischer thanked the Council for this recognition. 45 City Council Regular Meeting Minutes 2 October 8, 2002 Page 2 1 Councilmember Faust stated it is not just the recognition of Mr. Fischer's 25 years of suffering 2 sacrifice for his country but for his wife and family also. He stated he served for 23 years and 3 appreciates the dedication and support of Mr. Fischer's family members. He stated he knows 4 Merle's daughters and wife have missed their father and husband and are also patriots. 5 Councilmember Faust stated it is not often you get an opportunity to honor and salute a patriot 6 and extended his appreciation to them. 7 8 III. COMMUNITY FORUM. 9 Mayor Hodson invited residents to come forward at this time and address the Council on items 10 that are not on the regular agenda. 11 12 Hearing none, Mayor Hodson moved forward with the agenda. 13 14 IV. CONSENT AGENDA. 15 B. Consider September 24, 2002 Council meeting minutes. 16 17 Councilmember Sparks requested that Item A be removed from the Consent Agenda. She 18 requested a correction to the September 24, 2002 meeting minutes,Page 7, Line 29,to indicate: 19 "to Family Services Collaborative and includes the Cities of St. Anthony and part of New 20 Brighton." 21 22 Mayor Hodson noted the meeting minutes incorrectly contain two copies of Page 2 and asked 23 that one be deleted. 24 25 Motion by Councilmember Sparks to approve the September 24, 2002 Council meeting minutes 26 as corrected. 27 28 Motion carried unanimously. 29 30 C. Consider licenses and permits. 31 D. Consider payment of claims. 32 E. Resolution 02-066, re: Approve Election Judges for November 5, 2002 State General 33 Election. 34 35 Motion by Councilmember Sparks to approve Consent Agenda Items B, C, and D. 36 37 Motion carried unanimously. 38 39 V. PUBLIC HEARINGS. 40 None. 41 42 VI. REPORTS FROM COMMISSIONS AND STAFF. 43 None. 44 City Council Regular Meeting Minutes 3 October 8,2002 Page 3 1 VII. GENERAL POLICY BUSINESS OF THE COUNCIL. 2 A. Ordinance 2002-0005, re: Moratorium on Licenses for Secondhand Goods. 3 4 Mr. Mornson reviewed the ordinance with the Council and advised that because several requests 5 for secondhand goods stores are received each week, staff recommended the Council consider 6 this moratorium ordinance for adoption tonight. He explained that the current ordinance is 7 outdated and staff will submit it to the Planning Commission. The Planning Commission will 8 have up to one year to put the new ordinance into place. Mr. Mornson recommended the 9 Council waive first and second reading and consider this for the third reading and adoption 10 tonight. 11 12 Motion by Councilmember Horst to waive first and second reading, approve third reading, and 13 adopt Ordinance 2002-005, re: Moratorium on Licenses for Secondhand Goods. 14 15 Councilmember Sparks asked why staff is recommending this ordinance be adopted rather than 16 following the process for first and second reading. Mr. Momson advised that staff is currently 17 receiving several requests per week and under the current ordinance, the City does not have the 18 ability to inspect or control this type of use. During the moratorium period, this type of use 19 would not be allowed until the revised ordinance is adopted. 20 21 Motion carried unanimously. 22 23 VIII. REPORTS FROM CITY MANAGER AND COUNCILMEMBERS. 24 Mr. Momson reported that at the request of the Metropolitan Airports Commission(MAC), the 25 St. Anthony Police Department, and other metropolitan police departments, are working to 26 provide security at the metropolitan airports. This occurred when MAC released the National 27 Guard from airport security. Mr. Momson explained that the League of Minnesota Cities has 28 made an arrangement to allow this to occur,however,the City is paying the time and then billing 29 MAC. The City is making a commission on part of it. Mr. Momson explained that this will be 30 reflected in the City's budget by showing extra overtime expenses and an increase in revenue. 31 32 Mr. Mornson noted that last year, the State permitted the sale of certain types of fireworks. Now 33 the City is receiving inquiries about street sales of fireworks so in the future staff will be 34 recommending an ordinance to regulate the sale of fireworks and setting a time limit for that 35 type of sale. 36 37 Mr. Morrison reviewed the schedule of upcoming meetings. 38 39 Mr. Mornson advised that on October 16, 2002, the City will make a presentation in front of the 40 Metropolitan Council's Livable Communities Committee. Councilmember Faust will be 41 attending that meting on behalf of the City. Mr. Mornson stated they will have 15 minutes to 42 update them on the Apache Project and ask for some of the $6 million that is available for 43 livable communities. He noted the City may know by the end of October whether St. Anthony 44 will receive funding. 45 City Council Regular Meeting Minutes 4 October 8, 2002 Page 4 1 Mr. Mornson noted the liquor referendum will be on November 5th and staff will e-mail the 2 Council with those results. Mayor Hodson asked for a telephone call as well as an e-mail 3 update. 4 5 Mr. Mornson stated the Public Facilities Task Force update was held last week and went very 6 well. 7 8 Mr. Mornson stated the Fire Department Open House will be held on October 9, 2002 and the 9 pancake breakfast will be held on Sunday, October 13, 2002. 10 11 Councilmember Horst reported he attended the September 25, 2002 open house for Chandler 12 Place and explained that they recognized the 15th year anniversary for Chandler Place and the 13 35th year anniversary for the St. Anthony Health Center. He thanked them for the invitation to 14 this very nice event, and wished them good luck in the future 15 16 Councilmember Sparks had no report 17 18 Councilmember Thuesen had no report. 19 20 Councilmember Faust encouraged all to attend the Fire Department Pancake Breakfast on 21 October 13, 2002 from 8:00 p.m. to 12:30 p.m. at City Hall. 22 23 Councilmember Faust reminded the community of the October 14, 2002 Candidate Forum 24 starting at 7:00 p.m. which will be hosted by the Chamber of Commerce. All State Senators and 25 Representatives for St. Anthony have been invited. Councilmember Faust stated this is an 26 opportunity to ask questions of those candidates. 27 28 Mayor Hodson stated there was an excellent meeting last Saturday with the Public Works and 29 Fire Department Task Force. He stated they viewed several examples of buildings that would fit 30 in St. Anthony. Mayor Hodson stated this is a very energetic task force and the City could not 31 have selected a better group of people to evaluate this and come up with some options. 32 33 Mayor Hodson stated he has been nominated to sit on the Transportation Advisory Board 34 through the League of Minnesota Cities. He stated he thinks he can contribute to that group and 35 would like to follow up on that nomination. However, he has an obligation to serve on the North 36 Suburban Cable Commission. Mayor Hodson stated he would like to find someone in the 37 community to serve on this Commission and asked for the Council's input if they know someone 38 who has that interest. 39 40 Mr. Mornson stated Staff will advertise this opening with a one-year term. It was noted that this 41 is an important appointment since they will be representing the City of St. Anthony. Mr. 42 Mornson stated it would be at the appointment of the Council. 43 44 Mayor Hodson stated he can serve as the alternate. 45 City Council Regular Meeting Minutes 5 October 8, 2002 Page 5 1 Mayor Hodson reminded all that it is homecoming week at the St. Anthony High School with-a 2 lot of activities. Hall, Assistant City Manager - SUBJECT: Public Hearing for Business Data Record Services Expansion Requested Action: A public hearing will be held on October 15 for Business Data Record Services demolition and expansion plans at 3015 37th Avenue Northeast. The final submitted site plan shows demolition of four existing buildings and construction of a new 40,000 square feet building. Notification has been sent to the property owners within 350 feet of the proposed development. Mr. Murlowski of Belair Excavating is representing Business Data Record Services for two variance requests: 1) A building height variance of 9 feet for a proposed 44 feet building height; and 2) A side yard variance request of 35 feet (along Macalester Drive) for a proposed 5 feet side yard adjacent to a street. Background: Mr. Murlowski met with the Planning Commission on August 20 for a concept review of preliminary site plans. The applicants are now submitting their final plans and are asking for two variances. First, a variance for building height of 44 feet is proposed. According to city ordinance, maximum building height in a Light Industrial zoning district is 35 feet, which makes this a variance request of 9 feet. Fire Chief Joel Hewitt has reviewed the proposed plans and stated the height will be okay because of the mutual aid.agreement. A good example of what this height will look like is at another nearby Business Data Record Services site at 200 Old Highway 8 in New Brighton. That building stands 42 feet in height. The second variance request is for the side yard setback. The side yard is considered Macalester Drive. The applicants are requesting a side yard setback of 5 feet. City ordinance states a side yard adjacent to a street must be at least 40 feet, which makes this a variance request of 35 feet. Although the proposed side yard setback won't make the building stick out any more than the existing building, it would be on the curb line. Public Works Director Jay Hartman has reviewed the existing an proposed setbacks and said for snow removal there will still be plenty of room in the right of way to stock pile snow. Still, he noted, this is a substantial variance request. Per the applicants, the existing side yard setback at Macalester Drive is 5 feet at the south building and 30 feet at the north building. The existing front yard setback at 37th (County Road D) is 20 feet, the existing side yard at the Xcel substation varies from 2 feet to 0 feet. Finally, the existing rear yard setback at the railroad varies from 3 feet to 1 foot, 6 inches. The property and easement lines are 50 feet from the railroad centerline. 14 The city engineer reviewed and approved the drainage plans. The runoff from the site will go to a new water retention pond shown on the site plan. Parking is adequate at the site, per city ordinance, because this is a warehousing facility which requires the facility must have at least one space per employee on the largest shift plus one parking space per company vehicle. Outlined below, please find a list of projects and the current status of each: I. Wellhead Protection Plan As you may recall, Ramsey County SWCD has volunteered to complete the groundwater modeling information for the City of St. Anthony and to assist in the preparation of the Wellhead Protection Plan. We recently met with Matt Swanson of the Ramsey County Soil and Water Conservation District(SWCD) to discuss their progress on the Plan. At this meeting, we reviewed some of the assumptions used in developing the groundwater model and the results of the modeling. Results of the groundwater modeling are attached for your information. We anticipate a meeting with the Minnesota Department of Health towards the end of October to discuss these results and to define the Wellhead Protection limits within St. Anthony Village. We also anticipate that in February, a draft Wellhead Protection Plan would be available for presentation to the City Council. II. Water and Sewer Study We have completed the St. Anthony Village Water Needs and Sanitary Sewer Studies. A full copy of these reports has been provided to each of you for your review. Attached is a brief summary of the information used to evaluate the Village's Water and Sewer needs, and a Table, which summarizes the recommendations and priorities for implementation of sanitary sewer and water improvements within St. Anthony Village. IV. 2001 Street Reconstruction The street and utility construction is 100% complete. There area number of warranty issues,which we anticipate to be addressed this fall. These warranty issues include: ■ The workmanship on several driveways within the project have been considered unacceptable. We have met with the Contractor and their subcontractors concerning the repair of these driveways. If the driveway repairs are riot completed this fall, they will be completed next spring. ■ The maintenance access to the Harding Street Holding Pond off of 30`h Avenue will be regraded and sodded this fall to eliminate the ponding that is present. ■ The landscaping Contractor for the Harding Street Holding Pond has continued, and will continue through next year, replacing materials within the Harding Street Holding Pond such as dead trees, shrubs, and plant materials.. r ■ The seeding Contractor for the Harding Street Holding Pond will continue to maintain the vegetation in the pond for the next year and a half. This year's maintenance included mowing and replacement and reseeding of areas where erosion had occurred, and where vegetation has not been established. ■ The landscape Contractor is anticipated to repair the fence along the east side of the Harding Street Holding Pond within the next couple of weeks. V. 2002 Street Reconstruction Utility work is 100% complete. The street reconstruction up to the base course of asphalt has been completed. The second lift, or wear course, of asphalt will be laid next summer. Work that remains to be completed on the 2002 Street Reconstruction project includes restoration of driveways and yards. The Contractor has brought in new topsoil, and we are still anticipating sod around the end of October, first part of. November, weather permitting. By way of background in 1999, we reconstructed the intersection of Pahl Avenue and Wilson Street as part of the flood mitigation improvements in St. Anthony. Part of these improvements included lowering the intersection of Wilson Street and Pahl Avenue by approximately 1.5 feet. This home is located in the southwest quadrant of the intersection of Wilson and Pahl Avenue. As a result of this construction, the driveway elevation was altered by approximately one foot by lowering Wilson Street to accommodate additional storm water storage in the intersection and to allow for the water to flow into the new holding ponds located in the southeast corner of the intersection. The slope of the driveway, prior to construction, was approximately 11.25% in the steepest portion with a 7.5/o grade extending from the garage streetward 10 feet; please see _-- attached diagram and photos. The new driveway consists of a constant 13.33% grade from the garage to the street. During construction, the following changes were made to the z. property at 2616 Pahl Avenue based on conversations with the resident to minimize the impact to their property from construction activities. These changes were as follows: 1. At the residents' request, a retaining wall, which had been planned to be placed at x:. >.' the right-of-way boundary along Wilson and Pahl Avenue, was moved up to the house. The yard was reshaped and resodded to provide for flatter slopes ~ 4 approaching the house from the street. 2. We have reviewed the driveway situation and found the driveway not to be extraordinarily steep. There are a number of driveways within St. Anthony Village that are considerably steeper than the one currently located at 2616 Pahl Avenue: Based on our review, we do.not believe that the property warrants a change in conditions and that it can be adequately managed in the wintertime through routine snow and ice removal. However, the residents are requesting that the City of St. Anthony give consideration to removing the existing driveway and constructing a new driveway that would approach the garage from the south off of the existing alley, and to reposition the garage door opening from the east side of the house to the south.side, thus facing the alley. Additionally, the residents have issued concerns over rocks that have been popping from the concrete surface over the last couple of years. We have reviewed the driveway and found that there are a number of locations where the rocks have popped out of the concrete surface. We do not feel that the rock popping is excessive, thus warranting a total replacement of the driveway. He then said that Staff has been working 36 with Culvers because Culvers wants to get the parking lot in before winter to 37 ensure a March opening. 38 39 Mr. Mornson indicated that he and Jay are working on filling out an application 40 for state or national awards for flooding work. 41 42 Mr. Momson indicated the liquor statement was good for August and commented 43 that the best months of the year are coming up. 44 Mr. Mornson indicated Staff would like to hold a coffee meeting with 6 representatives and senate members before the January legislative blitz. 2 Mr. Mornson reported that Autumn Woods would be presenting a plan before the 2 Planning Commission in the near future. 3 4 V.
