ANTHONY COUNCIL MINUTES April 13 , 1982 Mayor Sundland opened the- meeting. with the - Pledge of Allegiance at 7 : 30 P.M. Present for roll call: Marks , Ranallo, Sundland, Letourneau, and Enrooth. Also present: : Dave Childs ,. City . Manager; William Soth, City Attorney; Carol Johnson, _ Finance. Director; and Lee Entner, Fire Chief. The . following were changes made in the-.minutes for the March 23rd Council meeting: Page 1 , para. 10 : Substitute "25" for "24" in the last line.. Page 2 , para. 3 Amend the report of the Mayor's recollection to reflect that "the pathway planning committee did not think the abutting property owners would be willing to assume the responsibility for snow removal from- the walkways" . Motion by Councilman Letourneau.. and seconded by Councilman Marks to approve as amended the minutes for the Council meeting held -March 23 , 1982 . Motion carried unanimously . Motion by Councilman Letourneau. and seconded by Councilman. Ranallo to approve as submitted the minutes for the Council work session held April 5 , 1982 . Motion carried unanimously. Motion .by Councilman.' Ranallo and seconded: by Councilman Letourneau to grant a temporary beer permit to. Carl .Branger,. 3604 33rd Avenue N.E. , for the Village Originals picnic .to be. held in- Central Park from 2 :00 P'.M. to 8:00 P.M. , September 11 , 1982 . Voting on the motion: Aye : Ranallo, Letourneau, Sundland, and Enrooth. Nay : Marks . Motion carried. It was noted -that, as requested .by Councilman Letourneau, ' the. applicant's age had been verified before the beer permit approved March 23rd had been issued. Councilman Ranallo reported. receiving a .number of complaints from • residents. who live near the Srogaa -Standard Station, 320.1. Stinson Boulevard, about the number of trucks .and. other- vehicles which are parked for long periods 'outside. the fence which was intended to serve as screen r� -2- for such activities . Councilman .Enrooth reported one resident had called him to report a "For Sale" sign-on one of these vehicles , wonder- ing whether the site is being used for "a used car lot" . Mr. Sroga's reaction to these complaints has .been that the City dug up his property • for the sewer diversion pipes and he. can' t use the- screened in area until the frost is out of the ground -and the gravel can be replaced by the City crews . Mr. Soth commented he .believes -"it would be reasonable for the City to inquire. ab.out the failure.. to comply with parking agreements for this. site. but the. City 's ability to withhold the license for the station would depend upon the requirement for fencing" . , Motion by Councilman Ranallo and seconded by Councilman Marks to table the service station license for the Sroga Standard Station on Stinson until the next .Council .mee.ting .to which Mr. Sroga -and his neighbors will be 'invited to.. air their differences- regarding the station' s appearance. Motion carried unanimously. Motion by Councilman Marks and seconded,-.by Councilman. Ranallo to grant a vending license .to St. Anthony Self Serve Laundry and a. bench license to U.S . Bench .Corporation. Motion carried unanimously. Motion. by Councilman .Letourneau and . seconded .,by Councilman Marks to _ approve payment of all verified claims.: submi.tted March 31st and April 13th, included with the April 13th, 1982 ..Council agenda. Motion carried unanimously. The Mayor urged .that the City 's. concerns. related to the. surface water management legislation which recently passed be presented at the public hearing scheduled-by the Metropolitan .Council- April 29th and Mr. Childs will prepare a listing of the .City' s. and the .AMM's questions about the new state agency for Council consideration at their next meeting. Councilman Marks indicated he .perceives there is- a great concern on the part of many people that the Metropolitan Council is over- stepping its authority as an advisory body to the. State Legislature and, in ' some instances , appears to be a legislative entity on its own, a problem he anticipates. will be addressed by. the legislative committee which has been established to oversee the Metropolitan Council' s activities . The Mayor. noted the League of Minnesota Cities is requesting nomina toins to their Board of Directors and reported the Metropolitan Transit Commission has notified -him that, altho.ugh .they will be con- structing .bus shelters at the 29th and .39th Avenues N.E. intersections with Silver 'Lake Road. this year, because of budget restrictions , they will defer the shelter construction planned for 33rd and Stinson Boulevard .for at least a year. The . joint meeting of the Council-.and .Community Service Advisory Board • members this year will- be a- barbecue held in. the inner court of the Parkview building, weather permitting, according to Councilman Enrooth. Friday , May. 28th was. the date preferred by: the Council for the event with any .other date in that .same. week acceptable, except the 25th which -3- is the date of the. Council meeting prior- to which the Board of Review will be conducted. by the Council. • Several . calls from .residents .annoyed by what they perceive to be an increase in commercial air traffic over St. Anthony were. reported by Mayor Sundland .who said one. man said he was.. unable to get a satis- factory. explanation from the. Airport - Commission: .representative he contacted. The Mayor' s questions related .to whether or- not air traffic has beenrerouted over the City and whether the normal traffic patterns have been affected by. the loss of air controllers will be presented to .the appropriate air - officials in a -letter to be written by staff over. the Mayor' s signature. Councilman Marks, recommended the various department heads be invited to attend future Council meetings as a means of letting them know the Council is quite aware of the difficulties they are. experiencing with the drastic budget cuts which have been necessary. Councilman Ranallo suggesteda better perspective could probably be achieved if these discussions were held at work sessions , as with the Liquor Operations Manager and the Public Works Director, where .frank and open discussions were possible. Mayor Sundland. said he has been having lunch with these administrators to let them know the City can't afford to lose good, trained people , and cuts in personnel will be among the last to be made for budget reasons . So many calls have been made regarding dogs running loose in the City , Councilman Ranallo reported he drove around in a four mile radius of his home one Sunday. afternoon and counted at least 20 dogs unleashed in that .area. He wondered if it would be cost effective to have MAPSI patrol at least one weekend but Councilman Letourneau commented he has observed the animal patrol. trucks .are not easily recognized and said he believes the -City' s practice of notifying the owners of complaints against their animals. would be more productive . Mr. Childs reported residents will be reminded of the existing animal control . ordinances in the next Newsletter. The. State Clerk' s . Conference report by Carol Johnson; Ron Berg ' s Cable T.V. update; Police report for 'February; Fire Department Report for March;. and the liquor . op.erations. sales. summary for March were discussed . and accepted as informational. Councilman Le.tourneau reported the North Suburban Cable T.V. franchise was- awarded to Teleprompter' Westinghouse April 1st and. 'state approval is anticipated within five months.. He said Teleprompter -has promised service will be offered to all ten communities no later than eighteen months fromnow contingent- upon adoption of the necessary ordinances by each city. . The Mayor then told Jim' Schwartz of .the Bulletin he found his article .on ..the franchise award to be most informative. It was the general consensus thatallconditions for branch pick up listed in the April 7th staff notes should be listed in the next Newsletter with emphasis placed- on the fact that no return collections will be- made. Although Mr. Childs confirmed it costs the City $38 per stop to-make these .collections , the Mayor and Councilman Enrooth believe the tradition should be continued since most residents view this service as a worthwhile expense. -4- As he introduced the new firefighter, Don Drusch, to the- Council, Chief Entner- told them how Mr. Drusch ' s expertise as a. paramedic has already proved a benefit to the department and invited the Council and •- their families to join the other City employees- in CPR training sessions which have now been . set up. Anew Resusci=Annie is being donated for theseclasses by the St. Anthony Kiwanis Club, according to Mayor Sundland. There was Council agreement with. Mr. Child' s conclusions that the City is not prepared to participate in the demonstration of curbside collection of recyclable materials at this time , especially since resident participation in the City ' s own recycling program has been minimal and .paper products are effectively recycled through the various paper drives conducted in the City. Motion by Councilman Marks and seconded by Councilman Letourneau to plan for. provision of a fire hydrant mid-block on Silver Lake Road between Silver Lane and 39th Avenue N.E. , as recommended by the Public Works Director in his April 13, 1982 memorandum. Motion carried unanimously. The Manager reported that, when the City siren malfunctioned during the first test this season, it was determined a new motor would be needed- and estimated the cost of repairs will- probably run about $2 ,000 . He then reiterated his recommendation that the 1982 City budget be modified. to reflect the $23,000 cut he anticipates will be necessary, based on current revenue projections , to balance the budget and added that a public hearing is required .to approve the necessary Revenue Sharing funds transfer. Motion by Councilman Enrooth and seconded by Councilman_ Letourneau to schedule a public hearing on the proposed Revenue .Sharing budget amendment for 7-: 45 P.M. , May .11, 1982 . Motion carried unanimously. Referring to Mr. Hamer' s report that it costs the City $38 ,470 . 69 to maintain its skating rinks , as well as the Public Works Director' s suggestions for -cutting back on these expenses in the face of declining use of the rinks the past few years , Mr. Childs recommended a committee be formed to study the future ice skating needs and services for the City. The Mayor suggested Ron Hanson., who had indicated an interest in the future of hockey programs in the City , should be contacted regarding membership on the committee. Motion by Councilman Marks and seconded by Councilman Ranallo to authorize the establishment of a five person committee to be selected by the Manager to determine future allocation of resources for ice skating within the context of budget cuts for all City programs . Motion carried .unanimously_. Motion by Councilman Ranal.lo and seconded by Councilman Marks to schedule the acceptance of proposals on. the City ' s insurance program for 10 : 00 A.M. , ' Monday , May 10 , 1982 in the City Manager' s office. Motion carried unanimously. -5- Mr. Childs gave a slide presentation of .the. graphs illustrating the decline in water .usage for the. City: over the past- years which he believes justify .a water rate increase to slow- or, stop' the water fund balance .depletion..and which would .pro.vide regular repairs ; -maintenance , and minor- expansion without borrowing. He also illustrated that the City, even with .the . 7G per cubic. foot increase , would. remain below virtually all- neighboring. communities .in. average rates. charged. The Manager. added,. that .the cost...of- repairing the pump on Well #4 will be just below the $10.,0.00 estimated by. Mr. . Hamer who- has confirmed that delaying .the repairs would have. proved more expensive . Reports from Mrs . Johnson and Mr. . Hamer. were included in the discussion. Motion. by. Councilman. Ranallo--and seconded by Councilman Letourneau to approve , the first reading. of. Ordinance 1982-004 . Councilman Marks .recommended. referring the. proposed fence ordinance to the Planning 'Commission for.._ their, recommendations. Motion by Councilman Ranallo and. seconded: by Councilman Marks to table action on Ordinance- 19'82-003 until the Council. has received the Plan- • ning Commission' s reactions to- the proposed statute. ORDINANCE 1982-003 AN. ORDINANCE RELATING ..TO: FENCES; REQUIRING BUILDING PERMITS; REGULATING LOCATIONS; PRO- HIBITING. CERTAIN ' FENCES.; AMENDING THE 1973 CODE OF ORDINANCES BY. ADDING A SECTION Motion carried unanimously. Motion by Counci.lmam. Marks. and seconded by-Councilman Letourneau to schedule a public hearing. on .the assessment: rolls for -.the..,Anthony Lane .North improvements during. the Council meeting May 11, 1982 .
