ANTHONY / SPECIAL COUNCIL MEETING MINUTES January 25 , 1983 The meeting was called to order by Mayor Sundland at 7 :00 P .M. Present for roll call: Enrooth, Letourneau, Sundland, Ranallo and Marks . Also present: Larry Hamer, Public Works Director as Acting Manager; Richard Krier, H.R.A. Planning Consultant; and William Soth , City Attorney , who was present for the H.R.A. discussions . Tom Lindskog, 3315 Skycroft . Drive was interviewed for -the position which is open on the Chemical Use/Abuse Information Committee. He told the Council he had been a resident of the City for the past thirteen years and up until the last year .; when--he--:and=his wife co - a °Ihd'dle School ":PISA, __had ' participated -.in many of the Nativity Lutheran Church activities .- -Because he has three children in the St. Anthony school system, Mr. Lindskog believes service on this committee would keep him informed regarding any drug problems in the schools and he is familiar with the workings of the committee through his association with two former members -who are moving away. However, Mr. Lindskog assured the Council he would keep an open mind on how • the Committee should be run. -� h candidates The Mayor indicated he was concerned that one of the cand s for a e the Planning Commission had been told he would be appointed to this Committee , if not to the Commission, even though he had been assured that such was not the case by the other Council members . Councilman Marks indicated he was very impressed with Mr. Lindskog 's areas of involvement in the community -and opted for making the selection that evening. Motion by Councilman Marks and seconded by Councilman Enrooth to appoint Tom Lindskog to represent the Council on the St. Anthony Chemical Use/Abuse Information Committee . Voting on the motion: Aye: Marks , Enrooth, Ranallo, and Letourneau. Nay: Sundland. Motion carried. Mr. Krier indicated the City Manager had requested he appear before the Council to advise them as members of the Housing and Redevelopment Authority as to the proper procedures for conducting February 8th the • interviews of the two firms who had submitted proposals for the Kenzie Terrace Redevelopment Project. The Planning Consultant indicated he would be reviewing the proposals from the two firms , the Knutson Co- mpany and Kraus Anderson, the next two weeks and would meet with the H. R.A. the Friday before the interviews to givean evaluation of the -2- proposals . His . eval,uation would be structured in such a manner, he . C • said, as to stimulate other .questions .for the City officials to ask of the developers . Mr. Krier. suggested the format. of the interviews he distributed should be followed as closely as possible so the inter- views would be perceived to be fair by the developers. The consultant said his experience with developers has been that they want interviews held as close together as possible and conducted in as formal manner as possible for fairness . For this reason, Mr.. Krier. indicated he believes it- to be essential. that only the H.R.A. .members. be permitted to participate in the questioning, with . the Attorney permitted. to clarify any legal questions. He also recommended the proceedings be taped and recorded to avoid any misunderstandings later. When asked at what point public input to the planning would be sought, the consultant indicated that on February. 22nd .the H.R.A. would appoint a tentative developer and accept a general plan for :the project, by resolution, after which there would be 90 days in which the plans could be .fine=tuned before an agreement with the developeris signed and it would be in this. interim that the H.R-.A. could seek the advice and input of the public and other participants in the- planning process . Mr. Soth entered the meeting during this discussion and,' when Mr. Krier suggested the meeting scheduled for 5.:00 . P.M. , February lith, where the H.R.A. would discuss the proposals , should be closed to the public, gave his thoughts on that proposal. He said up until a recent meeting of city attorneys , he had..believed such meetings -should be open, . but information he received at that time raised the question in C • his own mind whether the violation of . rights of privacy would not be involved as well as the open meeting laws .if the public were permitted to attend the meeting where confidential .economic information provided by the firms would be discussed. He said he would. research the matter further. The attorney added that -other persons have no legal right to speak during interviews which are by nature , public hearings , not debates . Mr. Soth also .advised that it be made .clear that the selection of a developer is only tentative in order that claims against the City later would be negated in- the event the negotiations which follow selection fail to produce a viable project. Motion by Councilman Ranallo and seconded by Councilman Marks to' adjourn the special work session at 7 : 45 P.M. Motion carried unanimously. Respectfully submitted, Helen Crowe,, Secretary
