7 The Board of Review was convened by Mayor Ranallo at 6: 30 p.m.

20 2 . PURPOSE OF MEETING

22 Mayor Ranallo explained that each year homes in one quadrant
23 of the City of St . Anthony is viewed by a Hennepin County
24 Appraiser.

26 This year homes located in the quadrant west of Silver Lake
27 Road and north of 33rd Avenue were given on site reviewals .
0 The formula for determining the value of a home includes the
30 condition of the home, any improvements made to it , its
31 location and sales of comparable homes . .

33 Property owners can address their concerns and grievances
34 regarding the market value placed on their property.

36 The Mayor noted this forum is to discuss market values not
37 taxes .

39 3. CONCERNED PROPERTY OWNER. COMMENTS

41 a. Carl and Shirley Marihart - 3101 Armour Terrace
42
43 Mr. Marihart advised the Council he is presently
44 refinancing a portion of his mortgage. An appraisal of
45 his home was done recently and it is $2,000 less than the
46 market value placed on it by the Hennepin County
47 appraiser. He noted that the appraisal done by the
48 private appraiser had also considered comparables in the
49 area .

51 The value placed on the home by Hennepin County was'
52 $132 , 000 . The private appraiser placed the value at
$130 , 000 .

6 Busitzky noted that he has found refinancing appraisals
7 to be conservative.

9 The Mayor advised that if someone from the County were to
10 view the home there was an possibility that the value may
11 increase .

13 Busitzky stated that the process which would be followed
14 is for the City Council to direct Hennepin County staff
15 to view the home and make a recommendation back to the
16 Council . He noted that councils generally accept the
17 recommendation made by Hennepin County in this type of
18 matter. If the Council does not accept the appraiser' s
19 recommendation, then the property owner can appeal to the
20 County Board of Equalization, which meets in the last two
21 weeks of June, after which the owner can appeal to the
22 State Tax Court .

24 Motion by Marks , second by Fleming to direct that the
25 home located at 3101 Armour Terrace be viewed by a
26 Hennepin County appraiser .

32 b. Theodore Swierczek - 2608 36th Avenue Northeast

34 Mr. Swierczek stated that his value has risen from
35 $84 , 000 in 1989 to $93, 400 in 1992 .. He has made no
36 improvements, but noted he did lose trees and- landscaping
37 in the tornado.

39 Last year a realtor advised Mr . Swierczek he could sell
40 his home for $109, 000 . Mr. Swierczek questioned the
41 disparity between the present valuation and that
42 suggested by the realtor. He also felt the increase in
43 the value by Hennepin County was questionable.

45 Busitzky suggested that the home may have been
46 undervalued for many years . Mr. Swierczek did not recall
47 having his home viewed in the last fifteen years . In
48 light of the ratios applied to St . Anthony this home may
49 not be correctly valued.

51 No Council action was taken regarding the property.

7 C. Marjorie Scott - 2520 Pahl Avenue Northeast

9 Ms . Scott advised her value was increased $24 , 000 last
10 year . She had an appraiser from Hennepin County view the
11 home in 1991 and the value was reduced to $143 , 100 . This
12 year the value has increased $5, 000 . Areal tor placed' the
13 value of her home at $142 , 000 .

15 Motion by Wagner, second by Marks to direct the Hennepin
16 County Appraiser to review the home at 2520 Pahl, Avenue
17 Northeast and report back to the Council ..

22 A . John Myslicki - 3401 Belden Drive

24 Mr . Myslicki stated that the value of his home ; has
25 increased $5, 000 . The present value is placed at $99, 400 .
26 He feels this is too high as no improvements have been
27 made.
aMotion by Marks , second by Enrooth to have the home
30 located at 3401 Belden Drive Northeast viewed by the
31 Hennepin County Appraiser.

37 e. Bruce Holton - 2909 Rankin Road

39 Mr. Holton appeared at the 1991 Board of Review
40 questioning the value placed on his home at that time. He
41 noted he was tardy for the Board of -Equalization and did
42 not pursue action in the Tax Court , although he felt the
43 valuation was $25,000 too high.

45 The valuation for this year is the first one which
46 addressed full market value. The estimated market value
47 decreased $2 , 000 to $130, 000 for 1992 .

49 He had documentation in the form of a construction
50 statement and comparables and the appraisal from -the
51 mortgage company and its comparables.

When Mr. Holton contacted Hennepin County Appraisal
office, it was suggested that another appraiser view the

6 property. Mr. Holton felt this would not be beneficial
7 and is not requesting another reviewal .

9 Busitzky felt reviewing the new documents with Mr. Holton
10 may be helpful .

12 Mr. Holton suggested that there also be a reduction
13 ; because of the location of the home. Busitzky advised
14 that a three percent credit was given for location. This
15 percentage is the usual allowance.

17 Motion by Marks , second by Fleming to direct Busitzky to
18 meet with Mr. Holton to view his documentation and return
19 a recommendation to the City Council .

25 f . Sandra Nephew-Rose - 2709 St : Anthony Boulevard

27 Ms . Nephew-Rose has owned her home for one year. When she
purchased the home, she was advised by the realtor that
40 the water problems which had been experienced in her
30 neighborhood were being solved by the City. She has since
31 been made aware that this may not be the case.

33 The City Manager advised her that there is a May 5th
34 _meeting scheduled where the water problems and possible
35 `solutions will be discussed. He noted that the City
36 Council has not made any decisions regarding this
37 situation, but has been given four solutions to consider.
38 He stated that the four solutions range from a very
39 expensive improvement to doing nothing..

41 The May 5th meeting will address options to reduce the
42 risk of flooding. The City Manager suggested he meet with
43 Ms. Nephew-Rose to review all of the options .

45 Mayor Ranallo encouraged her to attend the May 5th
46 meeting. He noted that designating a "flood plane" in her
47 neighborhood will be a consideration, but there have been
48 some serious concerns with taking this action as it would
49 lower property values.

5.1 The City Manager observed that the remarks made by Ms.-
52 Nephew-Rose' s realtor were made before the City had
53 received the study done by Barr Engineering regarding the
tflooding'.

7 Mayor Ranallo inquired if it is her intention to seek a
8 lower valuation. She responded that this was not her
9 intention, but rather to seek solutions to potential
10 water problems . She will be attending the May 5th meeting
11 and also indicated she will meet with the City Manager.

13 Busitzky observed that her appearance at this Board of
14 Review retained Mrs . Nephew-Rose' s right to appear at the
15 Board of Equalization .

17 Motion by Marks, second by Wagner to recognize that
18 Sandra Nephew-Rose, 2709 St . Anthony Boulevard, appeared
19 at the April 14 , 1992 St . Anthony Board of Review .

24 g. Charlotte Olson - 1938 Skycroft

26 A letter was received from Ms . Olson indicating she felt
7 her property valuation was too high. She requested she be
called regarding this matter .
30 Motion by Fleming, second by Enrooth to affirm Ms .
31 Olson ' s right to appear at the Board of Equalization
32 based on the letter she sent to the St . Anthony Board of
33 Review.
34 Motion carried unanimously

37 The reconvened Board of Review must be held within twenty days
38 of the first Board of Review.

4.0 April 28 , 1992 at 7 : 00 p.m. was selected as the time and date
41 for the reconvened Board of Review.

46 Board of Review.
