8 I. CALL TO ORDER.
9 The meeting was called to order at 6:31 P.M.
10 II. ROLL CALL.
11 Councilmembers Present: Mayor Ranallo, Marks, Enrooth, Wagner and Faust.
12 Also present: Kim Moore-Sykes, Management Assistant; Connie Kroeplin, City
13 Clerk; Brian Thuesen, Councilmember-Elect; Brian Rice, Esq., Best & Flanagan Law
14 Firm.
15 III. APPOINT RECOUNT OFFICIAL.
16 Mayor Ranallo reported on the events since the November 4th City elections. He
17 indicated that on the afternoon of Wednesday, November 5, 1997, Councilmember
18 Wagner met with the City Clerk to request a recount of Tuesday's election results.
The Mayor said that that request set into motion the process to recount the ballots
20 from the City election. Marge Christianson, Director of Hennepin County
21 Elections and Val Splichal, Supervisor of Elections for Ramsey County were
22 notified. Ms. Kroeplin notified the Council members, the City Attorney and the
23 City Council candidates from Tuesday's election that a recount of the ballots had
24 been requested. She secured the Council Chambers for tonight's special meeting to
25 appoint a recount official, canvassing board and to establish the date, time and
26 place for the recount. The Mayor also reported that the City Attorney was notified
27 of the recount and was requested by the Council to be in attendance at the recount
28 of the election ballots.
29 The Mayor made a suggestion that the City Clerk be appointed as the Recount
30 Official. Councilmember Marks asked about the ballot recounting process. The
31 Mayor invited the City Clerk to respond to Councilmember Marks' question. The
32 City Clerk reported that two tests need to be conducted as part of the recounting
33 process. She said the first test has to be done using 50 ballots that have been
34 marked and will be used as the test deck to insure that the tabulator is functioning
35 properly. Ms. Kroeplin indicated that she will suggest that the test be conducted for
36 all three precincts. She then indicated that the second test involves hand counting
37 the 50 test ballots for each of the precincts. Ms. Kroeplin said that once the
38 election judges are satisfied that the tabulator is functioning properly, they will then
�9 open the sealed ballot boxes and observe the tabulation of the cast ballots.
1 The City Clerk advised that she wanted two election judges, one from each political
party to attend at the recounting of the ballots. She said that two election judges
3 are not required by law.
4 Motion by Faust, second by Marks to appoint Connie Kroeplin, City Clerk for the
5 City of St. Anthony as the Recount Official for the elections that were held on
6 November 4, 1997.
7 Motion carried unanimously.
8 IV. DISCUSS CANVASSING BOARD.
9 The Council discussed the composition of the Canvassing Board. Councilmember
10 Wagner asked that Dale Gunderson, 3525 Chelmsford Road NE, be appointed to
1.1 replace him-on the Canvassing Board. He stated that because he had requested the
12 recount of the cast ballots, he felt he should not personally serve on the Canvassing
13 Board for the recount. Councilmember Enrooth indicated that he did not ask
14 anyone to represent him on the Canvassing Board. Mayor Ranallo reported that
15 the City Attorney is available Monday, November 10, 1997 at 2:00 p.m. for the
16 recounting procedure.
17 Brian Thuesen, candidate for City Council, requested a clarification of the duties of
18 the Canvassing Board. Mayor Ranallo responded that the Canvassing Board for the
69 recounting of the cast ballots will observe the recounting and convene after the
�j recount is completed to vote to accept or not accept the results of the recounted
21 ballots. The impartiality of the Councilmembers sitting as the Canvassing Board
22 was questioned. Mayor Ranallo stated that Councilmembers Faust, Marks and he
23 would they realize a benefit from the results of the recount, simply because they
24 had not been candidates in this City election.
25 Brian Rice, Best & Flanagan Law Firm, stated to the Council that he will be
26 representing Mr. Thuesen in the recount. He agreed that City Councils are the
27 Canvassing Boards for elections. He questioned the issue of Councilmembers
28 appointing someone to sit on the Canvassing Board. Mr. Rice suggested that the
29 City may want to verify this with the City Attorney. He said he knew of no other
30 issue where a councilmember can appoint a replacement.
31 The City Clerk indicated that she had already talked with the Hennepin County
32 Director of Elections and it was her suggestion that this could be done. Mr. Rice
33 indicated that he knew Ms. Christianson and acknowledged that she is very
34 knowledgeable about elections but felt that the City should seek the City
35 Attorney's counsel on this issue.
36 Mayor Ranallo advised the Councilmembers that if they planned to appoint a
37 representative for the recount, they should do so by Monday and advise the City
48 Clerk.
Councilmember Marks asked if they were only required to be a quorum at the
recount and the City Clerk indicated that that was so.
3 V. SET TIME/DATE/PLACE FOR NOVEMBER 4, 1997 CITY ELECTION
4 RESULTS RECOUNT OF VOTES.
5 Mayor Ranallo asked each Councilmember if they could be available for the recount
6 if it were scheduled for Monday at 2:00 p.m. Only Councilmember Marks
7 indicated that his availability at that time on Monday would be questionable.
8 Motion by Marks, second by Faust for the Canvassing Board to convene and meet
9 at 2:00 p.m., Monday, November 10, 1997, in this place for the purpose of
10 recounting the cast ballots from the November 4, 1997 City elections.
11 Motion carried unanimously.
12 VI. OTHER BUSINESS.
13 The City Clerk indicated that she will notice the Council, the Councilmember
14 candidates, judges, and City Attorney of the date, time, and place of the recounting
15 of cast ballots from the November 4th elections. This notice will be hand delivered
16 to the four councilmember candidates on Friday, November 7, 1997. „
17 VII. ADJOURNMENT.
8 Motion by Enrooth, second by Marks to adjourn the meeting at 6:50 p.m.
