SPECIAL MEETING OF THE CITY COUNCIL.
November 25, 1998
1 The meeting was called to order at 4:00 PM by Mayor Ranallo.

3 Councilmembers present: Faust, Thuesen, Marks, Cavanaugh, Ranallo

5 Councilmembers absent: None.

7 Also present: City Manager Michael Mornson; Peter Willenbring and Todd Hubmer from
8 WSB & Associates, Inc.

10 Mayor Ranallo turned the meeting over to Mr. Willenbring. Willenbring distributed a
11 memorandum which outlined the results of a meeting which took place earlier in the day with
12 the Richard Knutson Incorporated company. The Knutson company had been awarded the bid
13 to do the construction work on the redevelopment of Silver Point Park. The Knutson company
14 expressed concerns about the possibility of a change in conditions at the Silver Point Park
15 project area, a Change Order costing an additional $230,000 for the project.
16 Mr. Willenbring reviewed the terms which had been negotiated with Richard Knutson
18 Incorporated. The conditions of the proposed Change Order are as follows:

20 1. Richard Knutson will agree to excavate, screen, sort from the demolition material any
21 unclassified material that cannot be disposed of as demolition materials and remove
22 from the site all remaining material for an additional cost of$160,350.

24 2. Richard Knutson will agree to resume work in earnest on Monday, November 30' and
25 take full responsibility for completing the work. They do request a 14 day time
26 extension to the June 30, 1999 completion date. It is also understood that if weather
27 conditions permit and the excavation work is completed in December, this time
28 extension will not be necessary.

30 3. Richard Knutson is requesting the allowable working hours be changed from 7:00 AM
31 to 7:00 PM M. nday through Friday to 7:00 AM to 8:00 PM Monday through Saturday
32 until this excavation work is complete.

34 4. It is understood that the City will be required to pay for the disposal of unclassified
35 materials. This includes materials such as tires, selected types of pipe, and/or other
36 hazardous materials.

5 Willenbring noted that Knutson's two requests are not a deal breaker. The only change in the
6 hours request which differs from the City's ordinance is Saturday's hours. The ordinance
7 states Saturday hours as 9:00-AM to 8:00 PM.

9 The Mayor asked about the high end cost. Willenbring stated that the contract was never a
10 lump sump contract. It was based on unit prices and quantities which are not absolute until the
11 work is done. He put the high end at another $25,000 because there are items which cannot be
12 quantified.

14 Cavanaugh asked what might be found in the subgrade. Willenbring responded that if the
15 subgrade was poor, the City may want to put good material on top as a better base for trails,
16 etc. Cavanaugh then wanted to know about the characteristics at the bottom of the park.
17 Hubmer responded that the City would want to give that a good foundation.

19 Faust commented that while he can accept certain change orders, i.e., there were change
20 orders when the City Hall was built, he is not pleased at not being made aware of the
21 possibility that this large a change order may be needed. He stated he doesn't mind
2 committing money to get quality, but he does not like surprises of this magnitude. He noted
that this is about a 17%increase. Willenbring responded that he understood Faust's feelings on
24 this matter.

26 Ranallo repeated that the high end figure could mean an increase of as much as $25,000 over
27 the $160,350, in addition to the costs to remove the hazardous materials.

29 Cavanaugh remarked that the City will remove whatever has to be removed to make it a good
30 park and prevent any pollution problems, etc.

32 Ranallo felt that WSB should have been up-front about the possibility of what occurred,
33 however it is very important that the park project is completed. Cavanaugh agreed and said it
34 is the end product that truly matters.

36 Marks also agreed and added that the worth of the project will be told if another 100 year
37 rainfall occurs and flooding is prevented.

39 Thuesen remarked that it is a must that the park be done right - even the play equipment is of
40 utmost importance to the residents.

42 Motion by Marks, seconded by Thuesen to approve Change Order #1 for the Silver Point Park
43 project, and including the four conditions as listed above, in the amount of$160,350.
Motion carried unanimously.

5 Ranallo asked about the fence around the park and Hubmer responded that it was already
6 installed. Ranallo extended his appreciation to Willenbring and Hubmer for negotiating down
7 the original cost of$250,000. Willenbring assured the Council that WSB will do all they can
8 to prevent anything like this from occurring again.

10 Motion by Faust, second by Marks to adjourn the meeting at 4:25 PM.
