Section 3, Subd. 1 of Appendix I to the 1973 Code of Ordinances is amended to read as follows: 1. Residence Districts a. R-1 Single Family Residence b. R-1 A Single Family Lake Shore Residence C. R-2 Two Family Residence d. R-3 Townhouse Residence e. R-4 Multiple Family Residence Section 3. Appendix I to the 1973 Code of Ordinances is amended to add a new Section 4A to read as follows: Subdivision 1. Purpose The purpose of this district is to create and maintain lakeshore areas for single family detached residences which, due to the natural amenity of the lake, and the topographic characteristics, call for zoning regulations somewhat different from other single family districts and designed for the preservation of natural areas. Subdivision 2. Permitted Uses Within an R-1 A Residence District, no building or land may be used for any purpose other than a single family detached dwelling and permitted conditional uses and accessory uses. Subdivision 3. Permitted Conditional Uses Within an R-1 A Residence District, only the following uses may be permitted by Conditional Use Permit: 1. Essential service structures including but not limited to buildings such as telephone exchange sub-stations, booster or pressure regulating stations, wells and pumping stations, elevated tanks and electrical and electrical power sub-stations. 2. Public municipal buildings including fire and police stations and other municipal service buildings not considered industrial. Subdivision 4. Permitted Accessory Uses Within an R-1 A Residence District, the following uses shall be permitted subject to the following and to the provisions of Section 12: 1. Private garages, parking spaces, accessory buildings for automobiles, recreational vehicles and trucks as permitted under Section 730:00, Subds. 2 and 3 of this Code. 6 2. Swimming pools as regulated by Section 335 of this Code which also comply with the following: (a) No part of a swimming pool shall be located within 10 feet from the side yard lot line and 50 feet from the natural high water elevation of the lake as determined by the Minnesota Department of Natural Resources. (b) No swimming pool may be located in a front yard. (c) The filter unit, pump, heating unit and any other mechanical equipment must be at least 25 feet from any neighboring residential structure, at least 10 feet from any side yard lot line and at least 50 feet from the natural high water elevation of the lake. 3. Tennis Court. 4. Decorative landscaping features including but not limited to pools, arbors and terraces. 5. Lawn, garden, boat house and utility building. 6. Patios, covered and uncovered porches, gazebos and picnic shelters. Subdivision 5. Building Height, Lot Area, Bulk and Placement 1. Height-No dwelling hereafter erected or structurally altered shall exceed the lesser of two stories or 25 feet. 2. Area and Width-No dwelling shall be constructed or place on an interior lot less than 9,000 square feet in area, or less than 75 feet in width at the building setback line or on a corner lot less than 11,000 square feet in area or less than 90 feet in width at the building setback line. 3. Floor Area Ratio-The area ratio within the district shall not exceed 0.3. 4. Minimum Floor Area-Each dwelling must contain no less than the following minimum floor areas on the first floor: One story dwellings 1,100 sq. ft. One and one-half story dwellings 900 sq. ft. Two story dwellings 750 sq. ft. 5. Front Yard-The front yard must have a depth of at least 30 feet. 7 6. Side Yards a. Each dwelling must have two side yards, each having a width of at least 5 feet and having a combined width of at least 15 feet. b. Any side yard adjacent to a street must be at least 30 feet in width. 7. Rear Yard a. The rear yard of any lot abutting the lake must be at least 75 feet from the natural high water elevation of the lake as determined by the Minnesota Department of Natural Resources. b. The rear yard of any lot not abutting the lake must be at least 20% of the depth of the entire lot but in no case less than 25 feet. 8. All structures and detached accessory uses referred to in this Section must meet all setback requirements of this Section and have the approval of the Rice Creek Watershed District. Subdivision 6. General Regulations Additional regulations are set forth in Section 12. Section 4. Effective Date. ANTHONY RESOLUTION 91-028 A RESOLUTION CONCERNING ENACTMENT OF A LOCAL SALES TAX BY THE HENNEPIN COUNTY BOARD OF COMMISSIONERS WHEREAS, the 1991 Legislature established a one-half cent optional sales tax that may be adopted by counties or cities within counties to augment local government property tax relief and create a dedicated two-cent revenue stream called the Local Government Trust Fund; and, WHEREAS, if Hennepin County fails to adopt the optional sales tax, the sales tax for Hennepin County will remain at 6 percent, and the county's 1.5 cent share of the revenue stream will be distributed to other cities and counties; and WHEREAS, counties and cities within counties failing to adopt the optional tax lose all of their Local Government Aid and Homestead and Agricultural Credit Aid; and 1 WHEREAS, counties and cities within counties may make up for the lost LGA and HACA funds by raising property taxes or cutting services, or a combination of both. NOW,THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony does support and request that the County Board of Commissioners of Hennepin County does adopt the optional one-half cent sales tax by July 1, 1991, as stipulated in Session Laws Chapter 291. ANTHONY RESOLUTION 1991-00# AN RESOLUTION PROMOTING THE USE OF MATERIALS WITH RECYCLED CONTENT IN PUBLICLY FUNDED CONSTRUCTION AND REMODELING PROJECTS WHEREAS, pursuant to Hennepin County Board of Commissioners Resolution 90-11- 842R1, by July 1, 1991, an additional 10% financial incentive is offered to municipalities which have adopted comprehensive procurement policies and specification policies for publicly funded construction or remodeling projects which give equal or preferential consideration to materials with recycled content; and NOW, THEREFORE BE IT RESOLVED, that to ensure, wherever practical.and appropriate, that materials with recycled content are used in the construction or remodeling of municipal facilities, for the City of St. Anthony, the council requires the following: 1. Within twelve months, subsequent to the effective date of this policy, the City Manager or his/her designee of the City of St. Anthony conduct a review of existing construction or remodeling projects and service specifications to determine whether such specifications promote or exclude the use of recycled products, reusable products, or products designed to be recycled, for use by department agencies, offices, boards, and commissions. 2. In the event that such specifications prohibit or otherwise exclude the use of recycled products, such exclusions or requirements should be eliminated unless the operating department or entity can reasonably demonstrate that the recycled product would be impractical, is unproven, or would not achieve necessary performance or design standards. 3. Within the same 12 month period, all City departments and agencies must make recommendations to the City Manager or his/her designee to ensure that performance standards and specifications for products used in construction or remodeling of municipal facilities do not prohibit the use of products with recycled content. Departments are to initiate or recommend policy changes to ensure that specifications incorporate a requirement which promotes use of materials and products with recycled content wherever practical and appropriate, or they must reasonably demonstrate that either the performance requirements of the product will be compromised or that a product with recycled content is impractical or will otherwise negatively impact health, safety or operational efficiency. 4. Contractors bidding to provide products or services to the City, must meet the intent of requirements described in Paragraph 3. 5. The City will cooperate with neighboring City, County, and State governments in an effort to develop consistent, and effective procurement efforts which promote the use of recycled products in construction materials wherever practical and appropriate. , 6. - All related City departments and agencies will work cooperatively to further - - - the purposes of the Resolution. The City's economic development process will incorporate the "goal" of promoting the use of recycled material. 7. The City Manager or his/her designee shall submit an Annual Report, to be filed with the City Clerk, with a copy to the Clerk of the Hennepin County Board, which overviews the use of construction materials recycled content which are used in the construction or remodeling of municipal facilities. ANTHONY RESOLUTION 1991-00# A RESOLUTION APPROVING SUBMITTAL OF THE 1991 HENNEPIN COUNTY YARD WASTE REBATE APPLICATION WHEREAS, on January 1, 1990, yard waste was banned from disposal in landfills or resource recovery facilities by State Law; and, WHEREAS, Hennepin County, by no longer providing yard waste compost sites, requires cities to handle the collection and disposal of yard waste; and, WHEREAS, Hennepin County is providing rebate money for cities to handle the collection and disposal of yard waste; and, WHEREAS, the City handles the collection and disposal of yard waste by requiring its licensed haulers to provide yard waste collection; and, WHEREAS, the City desires to receive these County funds to rebate its residents through a utility billing method. ANTHONY ORDINANCE 1991-003 AN ORDINANCE REGULATING THE SURFACE USE OF THE WATER OF SILVER LAKE LOCATED WITHIN THE BOUNDARIES OF THE CITY OF ST. ANTHONY; AMENDING THE 1973 CODE OF ORDINANCES TO ADD A NEW SECTION 1500:00 The City Council of the City of St. Anthony, Minnesota, ordains: Section 1. The 1973 Code of Ordinances is amended to add a new Section 1500:00 to read as follows: Section 1: PURPOSE, INTENT AND APPLICATION: As authorized by M.S. § 378.32 (459.20), Subdivision 1 as now in effect and as hereafter amended, this Ordinance is enacted for the purpose and with the intent to control and regulate the use of the waters of Silver Lake in Ramsey County, Minnesota, said bodies of water being located within the boundaries of St. Anthony, to promote its fullest use and enjoyment by the public in general and the citizens of St. Anthony in particular; to insure safety for persons and property in connection with the use of said waters; to harmonize and integrate the varying uses of said waters; and to promote the general health, safety and welfare of the citizens of St. Anthony, Minnesota. Section 2: ADOPTION AND INCORPORATION BY REFERENCE OF MINNESOTA WATERS AND WATERCRAFT SAFETY LAWS, AND BOAT AND WATER SAFETY RULES PROMULGATED BY THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES: The Minnesota Waters and Watercraft Safety Laws, M.S. § 361.01-361.29, as they now exist and are hereafter amended by the State of Minnesota Department of Natural Resources, Minn. Rules parts 6110.0100-.2300 as the same now exist and are hereafter amended, are hereby adopted, incorporated herein by reference, and made a part hereof as if set forth in their entirety. At least three copies of said Waters and Watercraft Safety Laws and Boat and Water Safety Rules and Regulations, so adopted, shall be marked as official copies and filed in the office of the City Auditor along with this Ordinance. Section 3: VIOLATIONS OF THE MINNESOTA WATERS AND WATERCRAFT SAFETY LAWS, AND BOAT AND WATER SAFETY RULES PROMULGATED BY THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES: Any person violating the Minnesota Waters and Watercraft Safety Laws, and the Boat and Water Safety Rules and Regulations promulgated by the Minnesota Department of'Natural Resources, adopted and incorporated herein by reference, shall be guilty of a misdemeanor. 2 Section 4: RESTRICTIONS DURING CERTAIN HOURS: Between the hours of 11:00 A.M. and 3:00 P.M. and between the hours of 7:00 P.M. and 8:00 A.M. on each and every day of the week, no motorboat shall be operated at a speed in excess of five (5) miles per hour. At all other times during each and every day of the week, motorboats shall be subject to no speed limit and may be operated at unrestricted speeds. Section 5: DIRECTION OF TRAVEL DURING UNRESTRICTED SPEED TIMES: During the hours in which unrestricted operating speeds are permitted, all motorboats shall travel and be operated in a counterclockwise direction around Silver Lake. Section 6: NONSANCTIONED RACING PROHIBITED: Racing, that is the participation of two (2) or more operators of motorboats operating their motorboats in a competition of speed,shall be prohibited on the waters of Silver Lake unless the same takes place as part of a scheduled or public race, regatta, tournament or other competition or exhibition duly sanctioned by the county sheriff pursuant to Section 361.20 of the Minnesota Statutes, as amended. Section 7: ENFORCEMENT: The enforcement of this Ordinance shall be the primary responsibility of the Ramsey County Sheriffs Department, and the City of St. Anthony's peace officers. Other licensed peace officers including Conservation Officers of the Department of Natural Resources of the State of Minnesota are also authorized. Section 8: All authorized Resource Management, Emergency and Enforcement Personnel, while acting in the performance of their assigned duties are exempt from the foregoing restrictions. Purpose The purpose of this district is to create and maintain areas due to the natural amenity of the lake, topographic characteristics, and the preservation of natural areas. This district is best suited for single family detached residences. Subdivision 2. Permitted Uses Within an R-1A Residence District, no building or land shall be used except for the following uses: 1. Single family detached dwelling. Subdivision 3. Permitted Conditional Uses Within an R-1 A Residence District, no structure or land shall be used for the following uses except by Conditional Use Permit: 1. Essential service structures including but not limited to buildings such as telephone exchange sub-stations, booster or pressure regulating stations, wells and pumping stations, elevated tanks and electrical and electrical power sub-stations. 2. Public municipal buildings including fire and police stations and other municipal service buildings not considered industrial. Copy #3 DRAFT Subdivision 4. Permitted Accessory Uses Within an R-1 A Residence District, the following uses shall be permitted subject to the following and to the provisions of Section 12: 1. Private garages, parking spaces, accessory buildings, recreational vehicles and trucks as regulated by section 730:00, Subdivision 2 and 3 of the Code of Ordinance, City of St. Anthony. 2. Swimming pools as regulated by Section 335, Code of Ordinance and the following: (a) No part of a swimming pool shall be located within 10 feet of any side lot line and 50 feet from the high water elevation of the lake (the high-water elevation shall be determined by the Department of Natural Resources): nor within 10 feet of any principal structure or frost footing. No swimming pool shall be located in the front yard. ? The filter unit, pump, heating unit, and any other mechanical equipment shall be located not less than 25 feet from and adjacent or nearby neighboring residential structure and not closer that 10 feet from any side yard lot line and 50 feet from the high water elevation of the lake. 3. Tennis Courts 4. Decorative landscaping features including but not limited to pools, arbors and terraces. 5. Lawn, garden, boat houses and utility buildings. 6. Patios, covered and uncovered porches, gazebos and picnic shelters. Subdivision 5. Building Height, Lot Area, Bulk and Placement Regulations. 1. Height-No dwelling hereafter erected.or structurally altered shall exceed the lesser of two stories or twenty-five feet except as provided within this Ordinance. 2. Area and Width-No dwelling shall be constructed or place on an interior lot less than 9,000 square feet in area, or less than 75 feet in width at the building setback line or on a corner not less than 11,000 square feet in area or less than 90 feet in width at the building setback line. 3. Floor Area Ratio-The area ratio within the district shall not exceed 0.3. Copy #3 DRAFT 4. Minimum Floor Area-Each dwelling shall contain the following minimum floor areas on the First floor: One story dwellings 1,100 sq. ft. One and one-half story dwellings 900 sq. ft. Two story dwellings 750 sq. ft. 5. Front Yard-There shall be a front yard having a depth of at least thirty feet from the front lot line. 6. Side Yards a. Dwellings shall have two side yards the total width of which shall not be less than fifteen feet with a minimum side lot width of five feet. b. A side yard adjacent to a street shall not measure less than thirty feet in width. 7. Rear Yard a. All lots abutting the lake shall be a rear yard measuring in depth of at least seventy-five feet from the high water elevation of the lake (the high water elevation shall be determined by the Department of • Natural Resources). b. All lots zoned R-1 A not directly abutting the lake shall have a rear yard measuring in depth a distance equal to 20% of the depth of the entire lot but in no case less than twenty-five feet. 8. All structures, and detached accessory uses defined in this section must meet all setback requirement of this section and have the advance approval of the Rice Creek Watershed District. ANTHONY ORDINANCE NUMBER 1991-005 AN ORDINANCE REQUIRING MULTIPLE DWELLING PROPERTY OWNERS TO PROVIDE RECYCLING OPPORTUNITIES TO THEIR TENANTS; AMENDING SECTION 530 OF AND ADDING A NEW SECTION _ TO THE 1973 CODE OF ORDINANCES The City Council of the City of St. Anthony ordains: Section 1. Section 530:00, Subd. 5 of the 1973 Code of Ordinances is amended to read as follows: Subd. 5. Residence: Any building(s) zoned R-1, R-2, or R-3. Section 2. Section 530:00, Subd. 6 of the 1973 Code of Ordinances is amended to read as follows: ® Subd. 6. Multiple Dwelling: Any building(s) zoned R-4. Section 3. Section 530:05, Subd. 1 of the 1973 Code of Ordinances is amended to read as follows: Subd. 1. It is unlawful for any person to haul garbage, refuse, recyclables, or yard waste without the. appropriate license issued by the City under Sections 400 and 530 of this Code, unless the person is hauling from his or her own residence, multiple dwelling, or commercial establishment. Section 4. Section 530:05, Subd. 3 of the 1973 Code of Ordinances is amended to read as follows: ( �— Subd. 3. The following categories of haulers must be separately licensed: (a) Haulers collecting recyclables and any non-recyclables from residential areas. (b) Haulers collecting recyclables and any non-recyclables from commercial establishments and/or multiples dwellings. (c) Haulers of recyclables only. Each application for a license and each license issued shall identify the type of license and the specific vehicles to be used by the licensed hauler. Section 5. The St. Anthony 1973 Code of Ordinances is amended to add a new Section :00 to read as follows: Subd. 1. Property owners must provide for collection or self-haul of recyclables to a licensed recycling center at least monthly by July 1, 1991. Subd.2. Containers for storage or recyclables shall be kept in the same location and • same manner as is designated by Ordinance for refuse containers. Subd. 3. Collection of recyclables from multiple dwellings by a hauler must be selected and paid for by an owner or governing association of a multiple dwelling. The hauler must be duly licensed by the City under Ordinance No. 1989-0001 of the City and other then applicable ordinances of the City of County. Also such collection shall be done in compliance with all other applicable ordinances of the City now or hereafter in effect. Subd. 4. Recyclables collected or self-hauled must be the same required of the City's municipal curbside collection program, Ordinance No. 1989-0001, Section 530:00, Subd. 3. The city retains the right to require the collection or self-haul of additional materials as markets develop. Section 6. Effective Date.
