Some of the 40 participants viaited the City and took part in a parade, did some- 4-1 ome41 shopping at Apache Plaza with gift money they had received and a 42_ few went fishing at Silver Lake. 43 44 All of the participants, their families and their coaches 45 expressed aincere appreciation for the amenities shown than by 46 residents of St. Anthony . 47 48 Those who hosted the participants received pins from them in the 49 shape of St. Vincent and some have indicated an interest in 50 visiting later this year or next. 15, 52 S3 .4 1 REGULAR COUNCIL NEE'!'ING 2 JULY 30, 1991 3 PAGE 6 4 5 6 Mayor Ranallo .felt, a special thanks should be given to George and 7 Audrey for all of their effort on behalf of the Special 8 Olympians. 9 10 The Mayor requested ataff to try to gather the names of all of 11 the St . Anthony residents who worked with the Special Olympics so 12 they could be publicly recognized and thanked. 13 14 Members of the Council felt the metro media coverage of the 15 Special Olympics .+ere very poor and lacking. 16 17 Councilmember Wagner -advised that funds were donated for use by 18 the Special Olympics participants by the Kiwanis Club, the Apache 19 Merchants Association and private citizens. Approximately 9200.00 20 was sent back with the Olympians for use in a special needs 21 school . He noted that the welcoming banner which was placed 22 across Silver Lake Road was sent back with the athletes. 23 24 The Kiwania Club was commended for its very active participation 25 on the Special Olympics. The Club made a tape of the events and 26 it is presently being edited . 27 28 Katie Timmer, a resident of St . Anthony, participated in the 29 Special Olympics and received numerous medals and . honors. Mayor 30 Ranallo presented her with a plaque recognizing her achievements. 31 32 NORTH4'_S7 SUBURBA'+ YOUTH SERVICES BUREAU REPORT 33 34 Dean Meschka, a Boardmember of the Bureau , referred the Council 35 to an information packet each member received with current 36 information and background material regarding the Bureau. _37 38 Maschka noted that the allocations of the Bureau have not been 39 revised in ten years . The allocations are based on population and 40 most of' the ten cities serviced have representatives on the Board 41 of Directors. 42 43 A twelve minute video of the services provided by the Bureau was 44 shown . The video addressed all of the services available and 45 indicated that a cross sectic•n of the population was served, not 46 )uat youth . 47 48 Maschka advised that no new programs have been instituted in 1991 49 that were not fee based . 50 51 5� 53 5-: RECULI AR C-.0'JJNCIL KEET_►.t:. 2 JU:..Y ?C , 194_ 3 PAGE 7 S 6 Shelly Freexan, represents the St . Anthony School District on the 7 Board of Directors . She advised Is t`.at of the Bureau are still provided at the Wilshire 19 Park Sc`,001 , the N,iddle School and at the High School . 2. Freeman . who has served on the Board for one year, has noticed 22 that the clientele in the 'City is changing. She feel& the 23 addition of the Health Center is a real plus to the operation. It 24 was her opinion that residents of St. Anthony should be making 25 better use of 'the services available at the Bureau and has been 26 working closely with the Police Chief. ,!�7 S Kay Andrews, Executive Lirector, Of the Youth Services Bureau, 29 advised that the Bureau provides intervention/treatment 'services 30 whereas the D.A.R.E. Program provides prevention services. This 31 comment was in response to a question regarding funding available 32 for these types of services. 33 34 Councilmember Marks observed that the record of repeat offenders 35 is very impressive as there are very few. He was particularly 36 impressed with the teen suicide program which helped friends of 37 those who had committed suicide. 38 39 Xeyor Ranallo indicated his concern with the longevity of the 40 programs of the Bureau and questioned what is bring considered 41 for financial sources in the: future. 42 43 Andrews responded that no new programs have commenced that were 44 not fee based and fees can be earned through the Youth Employment 45 Program. 46 47 Andrews told the Council of a pilot volunteer program recently 48 started by Firatar Bank of Now Brighton . Employees of the bank 49 have adopted the agency and will supply forty employeea .who will 50 offer their volunteer services to the Bureau . She noted that the 51 Bureau is still receiving some corporate and local donations but 52 these have decreased in amount. 3 :54 I REGULAR COUNCIL MEETING 2 JULY 30, 1991 3 PAGE 8 4 5 6 Mayor Renallo thanked the representatives of the Youth Services 7 Bureau for their taking the time to attend the Council Keating. 8 9 7. REPORTS 10 11 A. Report of Councilmember Fleming 12 Councilmember Fleming noted that there is a School Board 13 Keating on August 6th which is the sane night as the 14 National Night Out is being observed. 15 16 B . Report of Councilmember Wagner 17 Councilmember Wagner had nothing further to report as he had 18 given a report on the Special Olympics. 1.9 20 C. Report of Councilmember Enrooth 21 Councilmember Enrooth recently returned from Edmonton where 22 the Edmonton Mall is located. This mall was built and is 23 operated by the same developer who is building the Mall of 24 America in Bloomington. 25 26 Councilmember Enrooth noted that the Edmonton Kell is seven 27 million dollars behind in its taxes and the City is 28 considering taking over the operation of the Mall. The Mall 29 has seven hundred shops under one roof. 30 31 The Village Fest hes had no recent meeting and it appears 32 most of the plans are in place. 33 34 The Mayor noted that the Firstar Bank of St. Anthony donated 35 $500.00 to the Village Fest. 36 37 D. Report of Councilmember Marks 38 Councilmember Marks is preparing for a trip to Salo, Finland 39 with members of the City's Orchestra. They will leave on 40 August 14th. He plans to continue on and travel to Russia. 41 He requested to take a picture of the Council at the end of 42 this meeting to present to the City leaders in Selo. 43 44 E. Report of Kayor Ranello 45 The Mayor reported that Joe Spielman won an award from the 46 Board on Aging . He requested that this individual be invited 47 to attend a future Council meeting . Spellman is in sixth 48 grade. 49 50 The Mayor chaired the first meeting of the League of 51 Minnesota Cities' Federal Legislation Committee. He noted 52 that some of the items discussed were of importance to St . 53 Anthony . Storm water management was also 7 discussed . Many cities like St. Anthony haves lake within 8 its boundaries. Kany of those lake& are polluted and because 9 of overbuilding in the area, Lakeshore residents are 10 experiencing problems with water in their basements. The it Mayor advised that .grant funding will be sought to conduct a 12 study of the problems. Restriction of construction in the 13 area of bodies of water may be a consideration. 14 15 Mayor Ranallo related some of the experience& he and his 16 family had while hosting a Special Olympian and her family -17 in his home. He viewed the entire experience as one which 18 all involved enjoyed and benefitted from. 19 20 REPORT OF THE CITY MANAGER 21 22 A . Comprehensive Plan Revision& and Corridor Study 23 The City Manager advised that a summary of the Comprehensive 24 Plan was included in the agenda packet. He noted that a 25 Citizens Committee would be used as a resource for the 26 Planning Commission. 27 _ g The City Manager reviewed his plan for the use of a 3 Planner's services. He noted that it may take about a year 30 to complete the Corridor Study . 31 32 B. August 6th Work Seasion/National Night Out 33 The August 6th Council Work Session will start at 6:00 p.m. 34 to avoid interfering with' Counclmembers' attendance at 35 National Night Out block parties. 36 37 8. PUBLIC HEARINGS 38 39 There were no public hearings. 40 41 9. NEW BUSINESS 42 43 A . Resolution No. 91-034; Be: Community Development block 44 Grant Subrecipient Agreement 45 46 Motion by Marks, second by Enrooth to approve Resolution No. 47 91-034 being a resolution authorizing the Mayor and City 48 Manager to execute aubrecipient agreement with Hennepin 49 County for the Urban Hennepin County Community Development 50 Block Grant Programa. 51 52 Motion carried unanimously 53 B. Mirror Lake Spillway Improvements I REGULAR COUNCIL MEETING 2 JULY 30, 1991 3 PAGE 10 4 5 6 Motion by larks, second by Wagner to redesignate Fund 509 to 7 be used for street and other improvement pro3acts. 8 9 Fund 509 . is the Revolving Improvement Fund. The estimated 10 cost of the spillway improvement is 060,000-00- 11 12 Motion carried unanimously 13 . 14 Motion by Marks, second by Wagner to approve using the 15 services of Barr Engineering to prepare the plans and 16 specification& for this project. 17 18 Motion carried unanimously 19 20 The City Manager indicated it is hoped this pro3eet will be 21 completed by this Fall . 22 23 C. 37th Avenue/Stinson Boulevard - Street Lights 24 The City Manager advised this project is being designed by 25 Hennepin County personnel. Worthern States Power will move 26 the light poles and the Soo Line has been contacted 27 regarding the disposition of their tracka. Funding for this 28 pro3ect will be corning from the State of Minnesota. The 29 project should begin in the Sprinq of 1992. 30 31 There is a Joint Powers Agreement in place with Columbia 32 Heights so the pedestrian crossing . at 39th Avenue should be 33 done at the same time as the aforementioned protect. 34 35 10. UNFINISHED BUSINESS 36 37 A . Estimated Assessments on Chandler Drive 38 Only commercial properties will be assessed on this project. 39 The Maier Stewart firma will be preparing the assessments. 40 The curve in the rood on the City-owned side of the Drive 41 will be smoothed out by City crews to meet the state 42 standards. 43 44 The Public Hearing and awarding of the bid for this project 45 will take place at the same time. 46 47 B. Ordinance No. 1991-006; Re: Moratorium 48 The City Manager advised that the only changes in the 49 ordinance since it had its first reading were on pages 2 and 50 3 regarding the effective date of the ordinance. 51 52 The City Attorney has reviewed the ordinance and copies of 53 the ordinance will be sent to members of the Planning 54 Commission for their consideration. Anthony. Mr . ANTHONY RESOLUTION 91-035 A RESOLUTION REGARDING PARTICIPATION OF THE CITY OF ST. ANTHONY IN A STORM WATER PROGRAM WITH THE CITY OF MINNEAPOLIS WHEREAS, the City of Minneapolis is concerned about the quality of storm water which is being discharged to rivers and lakes within its city limits; and WHEREAS, the City of Minneapolis has proposed that if the outfall structure is within Minneapolis' city limits, then the entire area which contributes to that drainage system should be permitted, independent of ownership of storm drain or jurisdiction of drainage area; and WHEREAS, approximately 593 acres of St. Anthony discharges into the Mississippi River within the City limits of Minneapolis and is approximately 1.2% of the total Minneapolis drainage area; and WHEREAS, it is agreed by both cities that St. Anthony may choose to become a co- applicant with Minneapolis and,.in addition, that co-applicant does not imply co-permittee. NOW, THEREFORE, BE IT RESOLVED, that the City of St. Anthony desires to become a co-applicant in a storm water program with the City of Minneapolis. BE IT FURTHER RESOLVED, that the City of St: Anthony desires to decide at a later date whether to become a co-permittee with the City of Minneapolis or to negotiate a separate permit with the Minnesota Pollution Control Agency. Distribution of Cost Participation Among Co-Applicants * Calculation based on a simple percentage of total drainage area. * Total storm water runoff drainage area of Minneapolis is still being calculated. Preliminary estimate is 35,000 acres. 3. Total Cost to St. Anthony * St. Anthony may choose to file a separate application or become a co-applicant with Minneapolis. * Co-Applicant does not imply Co-Permittee. St. Anthony may be a co-applicant with Minneapolis, and decide at a later date to negotiate a separate permit with the MPCA. * Cost for permit application: Minneapolis has estimated a cost of$200,000 to $500,000 to put together the permit application (in 1991 and 1992). * Cost to meet conditions in permit: In 1992, it is the responsibility of the co-applicants.to propose programs (and estimate the cost) which will improve the quality of storm water runoff. ANTHONY WHEREAS, Hennepin County,in resolution 89-12-962,requires municipalities to adopt the same or similar procedures for paper procurement in order to remain eligible for funding under the Hennepin County Funding Assistance Policy for recycling; and WHEREAS, the City of St. Anthony supports the use of recycled paper, as its use by the City will contribute the further creation and expansion of markets for recycled paper; and WHEREAS, the following provisions are hereby adopted as the paper procurement policy for the City of St. Anthony: 1. The policy of the City will be to use recycled paper containing at least 40% recycled fiber/post-consumer material. Exceptions to the policy may be granted after review by the St. Anthony Recycling Committee. 2. Recycled content paper should be used in all convenience copiers throughout the City for one-sided copying. 3. All paper utilized in computer printers should be recycled paper including form-fed and laser printers. 4. All one-time-use-only (such as memo paper, note pads, telephone message pads and notebook paper) should be recycled paper. 5. All stationary and business cards should be printed on recycled paper. 6. The City should maintain in-house stocks of papers commonly used by the City with a. minimum of 40% recycled fiber/post-consumer material and process orders for printing on recycled paper in a routine manner. 7. Any new contract(s) for convenience copiers should require the capability of handling two-sided.copying on recycled paper. 8. Any new high-speed duplicators to be purchased by the City should be capable of handling recycled paper. 9. All paper should be manufactured using little or no chlorine bleach or chlorine derivatives when practicable. 10. All ink used for print on paper should be soy-based when practicable. 11. ANTHONY EMPLOYEES WHEREAS, the 1991 State Legislature approved an early retirement incentive package for Public Employees; and WHEREAS, all Public Employees Retirement Association (P.E.R.A.) pension members who are age 55 and have completed 25 years of service may retire early; and WHEREAS, this is a voluntary act for the City of St. Anthony; therefore, a non-precedence resolution; and WHEREAS, this resolution is subject to change if the State Legislature modifies the requirements for early retirement; and WHEREAS, to qualify the employee must retire between July 1, 1991 and October 1, 1991. NOW, THEREFORE, BE IT RESOLVED, that 1) the City of St. Anthony will provide post-retirement Single.Health Coverage for all P.E.R.A. ANTHONY RESOLUTION 91-038 A RESOLUTION OPPOSING "POLICE BILL OF RIGHTS" LEGISLATION WHEREAS, the U.S. Congress is considering adoption of legislation that would pre-empt state and local laws and require cities to impose federal standards on the conduct of internal investigations of police misconduct by the city while providing.police officers subject to such discipline the right to sue cities for monetary and other damages, including full reinstatement; and WHEREAS, these provisions restrict the authority and ability of the Police Chief to investigate allegations of police misconduct or use of excessive force; and WHEREAS, definitions provided in the legislation are so unclear that interpretations could prevent any measures without the need for formal hearings; and WHEREAS, restrictions raise the issue of whether police officers would no longer be subject to normal supervision; and WHEREAS, provisions raise the conduct of such disciplinary investigations to the level of criminal proceedings; and WHEREAS, "Police Officers Bill of Rights" imposes the will of the federal government on matters that are clearly state and local labor relations issues; and WHEREAS, some states, including Minnesota, have adopted similar requirements, while others have rejected such legislation; and WHEREAS, the legislation directly interferes with local processes governing provision of police services; and WHEREAS, provisions appear to disallow local appointment of civilian review boards and require that the entire investigative file be open to the police officer under investigation while not providing personnel file information on such officers to those investigations; and WHEREAS, congress has failed to hold any hearings or to investigate the views of police officials and others who would be adversely affected by such restrictions; and WHEREAS, this proposal is unrelated to local government efforts to fight crime, control drug abuse and reduce violence, therefore should not be included in federal anti-crime legislation. 2 NOW,THEREFORE, BE IT RESOLVED, that the City of St. Anthony opposes the federal imposition of a "Police Officers Bill of Rights' or other similar legislation. BE IT FURTHER RESOLVED, that the City of St. Anthony urges Congress to hold hearings on this issue in both the House and Senate to solicit views of city officials charged with ensuring the public safety of our neighborhoods and the responsibility for management of local police department affairs. The 1973 Code of Ordinances is amended to add a new Section 360 to read as follows: Section 360 Moratorium Ordinances Section 360:10. Purpose. The St. Anthony City Council believes that certain inconsistencies may exist between existing land uses in the City and the City's Comprehensive Plan. The Council further_believes that it may be appropriate to make certain changes in the City's Comprehensive Plan and in the zoning classifications of certain properties or areas within the City pursuant to a modified Comprehensive Plan.
