Report of Councilmember Marks
5 Councilmember Marks commented on the "water quality" of
6 the Dunk Tank at the Village Fest . He had volunteered to
7 be a "target" in the Tank .

9 The St . Anthony Civic Orchestra will be leaving on August
10 14th for Salo, Finland, St . Anthony' s Sister City.
11 Counc11member Marks and his wife will be travelling with
12 the Orchestra to Salo and then will be continuing on to
13 Moscow and other areas . Before the Council Meeting was
14 convened, Mrs . Marks brought an engraved silver bowl and
15 a scrapbook of St . Anthony photos for the Counqil to
16 view. These items will be presented to the Orchestra' s
17 hosts in Salo.

20 Councilmember Marks felt Councilmember Wagner and his
21 wife, Audrey, should be thanked for their hospitality
22 shown to the women from Wisconsin who volunteered to stay
23 with the Special Olympic athletes from St . Vincent for
24 all of the ten days they were participating. Members of
25 the Council agreed that these volunteers should be
26 recognized.

Columbus Day Celebration
Mayor Ranallo reported on a meeting held at Apache Plaza
30 by parties interested in having a celebration for the
31 500th Anniversary of Columbus Day. He noted that members
32 of the Apache Merchants Association had expressed
33 interest in participating as had Barb Olsonoski , Manager
34 of Apache Plaza .

36 There will be events for the whole month of October . On
37 October 6th thirty portraits of Columbus memorabilia and
38 documents will be on display at the Shopping Center . On
39 Sunday, October 27th from Noon to 5: 00 p.m there will be
40 "The World' s Largest Spaghetti Feed. " This will be hosted
41 by an Italian group and the Knights of Columbus . The
42 Mayor noted that the liquor store will supply the wine
43 for this meal .

45 B. City Manaaer ' s Report

47 The City Manager advised that the City' s liquor
48 advertisement will appear on Channel 23 . It is scheduled
49 to run around 10 : 05 p.m. but the City Manager noted that
50 is seldom the time certain .

52 Rosie' s Restaurant contacted the City Manager regarding
a wrestling match it is sponsoring on August 25th. He
noted that permission was not needed for this event . He

6 stated his concerns to the sponsors regarding parking and
7 restroom facilities . The City Manager noted that a
8 rainout date has been selected. It is August 26th and the
9 event will be held at the St . Anthony Shopping Center .

18 A. Resolution No . 91-035 ; Re: Participation in a storm water
19 program with the City of Minneapolis

22 The City Manager advised that the EPA has put in some
23 very strict guidelines for storm water handling for
24 cities over 100 , 000 population . He noted that one percent
25 of St . Anthony ' s storm water is located in Districts #6
26 and V . If corrections are needed it could cost the City
27 about $5 , 000 . There are no costs for a permit only if any
28 corrections are needed. •

30 It was the consensus of the Council that the City take no
31 action in light of the fact that most of the City' s water
32 drains into the Rice Creek Watershed District . The City
33 Manager observed that if there are any contaminants in
34 the City they would most likely have come from an
35 industrial area . Industries are responsible for their own
36 clean up of contaminants .

41 B. Resolution No. 91-036 ; Re: Paper Procurement Policy
42 Hennepin County requires municipalities to adopt
43 procedures the same or similar to its policy for paper
44 procurement in order to remain eligible for funding under
45 the Hennepin County Funding Assistance Policy for
46 Recycling.

48 Urbia explained the procurement policy and advised that
49 recyclable paper costs a little more .

51 Motion by Marks , second by Wagner to approve the adoption
52 of Resolution No. 91-036 which approves a paper
53 procurement policy for the City of St . Anthony.

8 C. Resolution No. 91-037 ; Re: Early retirement incentive for
9 City employees
10 The City Manager advised' that PERA is supporting this
11 incentive program to encourage retirement of high
12 salaried employees . He noted that there are four
13 employees on the St . Anthony staff who qualify and two
14 have indicated their intention to retire. This retirement
15 incentive is being offered for one year.

17 Motion by Marks , second by Enrooth to adopt Resolution
18 No. 91-037 being a resolution of non-precedence for early
19 retirement incentive for City of St . Anthony employees .

26 D. Resolution No . 91-038 ; Re: Opposing "Police Bill of
27 Rights" legislation
Mayor Ranallo observed that this legislation would
curtail any meaningful police supervision . The City
30 Manager noted that it would also create bureaucratic
31 paperwork . He said there was no discussion regarding this
32 legislation when * it was passed by the Senate and it
33 presently is in the House of Representatives .

35 It was felt that perhaps this legislation was a reaction
36 to the situation in Los Angeles or really an
37 "overreaction. "

40 No. 91-038 , a resolution opposing "Police Bill of Rights"
41 legislation.

47 A. Ordinance No. 1991-006 ; Re: Construction Moratorium
48 (Third reading)
49 The City Manager has received calls from three members of
50 the Planning Commission. They all stated that the
51 Citizens ' Committee should include residents from all
52 areas of the community, not just those from the area
addressed in the Moratorium.

6 Motion by Marks , second by Enrooth to adopt Ordinance No.
7 1991-006 being an ordinance relating to a moratorium on
8 issuance of permits for construction of new buildings and
9 certain alterations in a defined area north of Kenzie
10 Terrace and south of St . Anthony Boulevard; amending the
11 1973 Code of Ordinances by adding a new Section 360 .

Dear Ms. VanderHeyden:
We completed the Canada goose capture and translocation in the Metropolitan Area in
mid-July. A total of.2,822 geese (1,144 adults and 1,683 young) were trapped at 56 sites
and transported elsewhere. Oklahoma took 400 adults and Mississippi 744 for release
on their wildlife areas. The goslings were transported to Minnesota sites, mostly in
the north, and released.
The crews trapped 95% of the geese they attempted to capture. In spite of the hot
weather. mortality during capture and transport was very low (3 birds) and similar to
previous years.
The locations, dates, and number of geese captured at Silver Lake were:

Late August through October is the time when auditors of local government's are setting
work schedules for auditing 1991 financial information. Also, this is the time when many
Cities request these certified government auditors for bids or request for proposals to
determine auditing costs for the upcoming year.
In reviewing the performance of our current auditor (Stuart J. Bonniwell) I am very pleased
to report to the City Council that he has done an admirable job in auditing St. Anthony's
general operating, liquor and H.R.A. financial information.
Mr. Bonniwell's auditing procedures and testing methods fully comply with generally
accepted accounting methods/principles. Also, he is well respected by the Finance
Department based on his ability to complete the audit in a most efficient manner.
The 1990 audit took approximately 200 hours to complete which is less 40 hours less than
I expected. I feel a major factor in less than expected billable hours is that Mr. Bonniwell
is well experienced with the techniques and record keeping procedures used by the City
Staff.
In the near future, I feel it important for the City of St. Anthony to initiate the competitive
bidding process to insure the Community is getting the best possible service for the dollars
being spent. I support the concept of shopping keeps the price competitive, however, I just
as much support efficiency saves dollars.
With that thought in mind I feel it important to designate Stuart J. Bonniwell to perform the
1991 audit. I have a concern the recent computer conversion (in-house processing) could
produce an increase in billable hours if a new auditor was selected at this time.
In 1991, six months of the City's accounting records were processed through PPI and the last
six months are being processed in-house. Being this a split year of record keeping, I feel the
least auditing billable hours will result by designating Stuart J. Bonniwell to complete the
1991 audit. By relying on his past experience of auditing St. Anthony's books, the City will
spend the least amount of money possible for the service it needs.
Recommendation:
Designate Stuart J. Bonniwell to audit the City of St. Anthony's 1991 general operating,
liquor and H.R.A. financial information at the following cost:
1) General fund $ 4,250
2) Utility 2,000
3) Liquor 32750
4) H.R.A. 1,550
Total $119550
This amount fits within the 1992 operating budget and represents a 4.8%decrease compared
1990's auditing costs.

• RESOLUTION 91-039
A RESOLUTION SETTING PROPOSED 1992 TAX LEVY,
1992 BUDGET AND PUBLIC HEARING DATES IN COMPLIANCE
WITH THE TRUTH IN TAXATION ACT
WHEREAS, the Truth in Taxation Law requires that the City of St. Anthony provide
Hennepin and Ramsey Counties with a proposed 1992 Tax Levy and
Budget; and
WHEREAS,_ the information required .for the City Council to make a definitive tax levy
cannot be determined until the City of St. Anthony holds its public hearings;
and
WHEREAS, the furnishing of this proposed tax levy is made contingent on any revisions
being allowed if the current law is modified.
NOW, THEREFORE, BE IT RESOLVED that:
1) the proposed tax levy for 1992 is:
General Fund Levy $1,522,479
Housing and Redevelopment Authority Levy $ 20,000
Certificate of Indebtedness 76,205
$1,618,684
2) the proposed 1992 operating budget is: $4,425,565
BE IT FURTHER RESOLVED that:
1) the hearing date for the 1992 proposed budget be set at November 26,
1991, 7:30 P.M. and if necessary be reconvened on December 4, 1991,

RESOLUTION 91-040
A RESOLUTION URGING CONGRESSIONAL RELIEF
FROM APPLICATION OF SUPERFUND STATUTE
WHEREAS, the City of St. Anthony, Minnesota, strongly supports the general concept of
the Superfund statute (Comprehensive Environmental Response,
Compensation, and Liability Act) which makes parties who have created,
transported, managed or disposed of.hazardous waste liable for the cost of
hazardous waste cleanup; and
WHEREAS, under the Superfund statute, hazardous waste site polluters acquire the right
to sue fellow polluters to share the cleanup expense; and
WHEREAS, polluters have discovered a means of attempting to shift the costs of
hazardous waste site cleanup to taxpayers of the nation by suing city
governments for their volume of municipal solid waste placed in landfills,
thereby causing enormous legal costs and potentially unfair economic effects
on city governments throughout the nation; and
WHEREAS, the Superfund statute does not and should not focus on municipal solid waste;
and
WHEREAS, the Environmental Protection Policy recently adopted an Interim Municipal'
Settlement Policy that it would not routinely pursue local governments under
Superfund, acknowledging that only a tiny fraction of municipal solid waste
may be toxic; and
WHEREAS, that policy does nothing to stop polluters from launching expensive and often
frivolous lawsuits against city governments, many of whom have only arranged
for or licensed the pickup and hauling of municipal solid waste from within
their respective borders; and
WHEREAS, such lawsuits are beginning to yield results whereby the nation's cities, school
districts, very small businesses, and potentially its citizens are prospects to be
sued by polluters; and
WHEREAS, the City of St. Anthony has recently been targeted by polluters under the
Superfund statute as a potentially responsible party; and

WHEREAS, the 1976 Resource Conservation and Recovery Act and its amendments, along
with EPA's regulations thereunder, treat household wastes according to non-
hazardous solid waste standards.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of.St. Anthony,
Minnesota, to urge its congressional representatives to support:
1. Amending the Superfund statute to clearly provide that municipal solid waste
is not a hazardous substance in the same fashion as provided under the
Resource Conservation and Recovery Act.
2. Empowering only the Federal Government to sue local governments for cost-
sharing under the Superfund statute if such local governments may have
handled any truly hazardous waste.
3. Clearly defining that the degree of toxicity, not the volume of waste, should
be the prime factor in assessing any liabilities under the Superfund statute.

A RESOLUTION ACCEPTING BID IN THE MATTER OF

WHEREAS, pursuant to an advertisement for bids for the improvement of Chandler Drive
from County Road D to Foss Road, bids were received, opened and tabulated
according to law, and the following bids were received complying with the
advertisement:

Thomas and Sons Construction, Inc. $1601830.50
Advance Concrete, Inc. $166,773.50
Palda and Sons, Inc. $168,976.51
WHEREAS, it appears that Progressive Contractors, Inc. of Osseo, Minnesota, is the lowest
responsible bidder.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of St. Anthony, Minnesota
1. The Mayor and City Manager are hereby authorized and directed to enter
into the contract with Progressive Contractors, Inc. of Osseo, Minnesota, in
the name of the City of St. Anthony for the improvement of Chandler Drive
according to the plans and specifications approved by the City Council and on
file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all
bidders the deposits made with their bids,except the deposits of the successful
bidder and the next lowest bidder shall be retained until a contract has been
signed.
