5 The meeting was called to order at 8:00 P.M. The Pledge of Allegiance was dispensed with due
6 to the fact that the American Flag was being used at the polling place.

11 Motion by Marks, second by Enrooth to approve the Council Agenda for September 13, 1994,

17 VII. REPORTS. •
18 A. Mayor,
19 1. _ Meeting Regarding Crime Prevention, Mayor Ranallo outlined a meeting he and Police
20 Chief Engstrom attended regarding crime prevention. There were 22 mayors and 40 community
21 representatives in attendance. He informed the Council that the head of the Juvenile Division of
22 the St. Paul Police reported that there has been an increase in violent crimes but not in regular
23 crimes, and that 87% of crimes are committed by juveniles with 90%being males. The main
24 reason for the increase in juvenile crimes is attributable to lack of parental supervision.
25 Fleming was concerned that if the problem was lack of parental supervision, why was funding in
26 the recently signed Crime Bill being designated to hire additional police officers. Mayor Ranallo
27 agreed. He stated that it is estimated that the money included in the Crime Bill, which was
28 , signed today,will be used within 6 years. One of the recommended uses is a Statewide Share
29 Information Program which would make information on criminals available to all police offices
30 in the state of Minnesota. Mayor Ranallo stated he will continue to attend and report on these
31 meetings.
32 2. Cabe TV. Mayor Ranallo indicated a survey was done to establish the number of people
33 who would watch Council meetings, if televised. In St. Anthony only 2% of the population
34 responded to the survey. Of the 30%of the residents in St. Anthony who subscribe to cable, only •
35 2% said they would be interested in watching the broadcast.

1 3. Proclamation of Kiwanis Peanut Day, Councilmember Wagner requested that the date be
2 changed from September 23 to September 30, 1994.
3 Motion by Marks, second by Wagner to proclaim September 30, 1994 as St. Anthony Kiwanis
4 Peanut Day.
5 Motion carried unanimously.
6 4. St. Anthony Friends of the Library. Since he will be unavailable, Mayor Ranallo asked
7 Councilmember Wagner to attend the Thursday night Friends of the Library meeting at the St.
8 Anthony branch. It was noted that the new Hennepin County Library Director, Charles Brown,
9 will be in attendance. Wagner accepted.

I1 B. Council.
12 Councilmember Wagner related his attendance at the Community Service Advisory Council
13 Meeting. He stated that they are having a membership drive. The C.S.A.C. is interested in an
14 update on the progress with CUB Foods and Apache Plaza, and complimented the City Council's
progress. They also expressed concern regarding decisions on the new location of the City Hall
building.
17 Councilmember Wagner announced that he attended an Open House for Trenditions this
18 afternoon. He stated he was very impressed with the staff and environment of this facility which
19 will house Alzheimer patients.
20 C. Cil, Manager.
21 City Manager Morrison reported that 3 Hennepin County Assessors are reviewing properties in
22 St. Anthony. They have already visited 100 homes and the response from the homeowners has
23 been favorable.
24 VIII. PUBLIC HEARING -None.
25 IX. NEW BUSINESS
26 A. Approve Contractor for Sidewalk Approach Ramps.
27 Motion by Marks, second by Enrooth to award the bid for sidewalk ADA approach ramps
28 located at Kenzie Terrace and St. Anthony Boulevard/Coolidge Street at Kenzie Terrace,to
29 Norsk Concrete Construction for$5,280.

1 B. 1993 Uncollectible Checks.
2 Motion by Marks, second by Wagner to approve writing off$5,707.85 of uncollectible checks
3 for by the municipal liquor operations 1993.
4 Motion carried unanimously.
5 C. Resolution 94-044. re: Charges for Special Street Lighting_
6 Motion by Fleming, second by Wagner to adopt Resolution 94-044, Re: Charges for special
7 street lighting requested by residents on Skycroft Drive.
8 Motion carried unanimously.
9 D. Resolution 94-046. re: Proposed Tax Levy and 1995 City Budget,
10 Mayor Ranallo explained that the Council is scheduling a 1995 Budget work session on October
11 4, 1994, to invite the public to express their opinions. This will allow adequate time before the
12 first hearing on November 30, 1994,to make changes to the budget. The operating budget, as
13 proposed,results in an increase of 2.84%. The Street Improvement Budget increase is 2.59%,
14 resulting in a total increase of 5.43%.
15 Motion by Marks, second by Enrooth to adopt Resolution 94-046, Re: Proposed tax levy and
16 1995 City budget.
17 Motion carried unanimously.
18 E. Resolution 94-047.re: Revocation of Hennepin County State Aid Road Designation on
19 Stinson'Boulevard,
20 The City Manager explained that in 1974 the District Court found this part of the road to be
21 under the jurisdiction of the Minneapolis Park Board and,therefore, lost its MSA designation.
22 However, the court order was never actually filed. At this time, Hennepin County is asking for a
23 resolution of concurrence.
24 Motion by Marks, second by Ranallo to adopt Resolution 94-047, Re: Revocation of Hennepin
25 County State Aid Road Designation on Stinson Boulevard.
26 Motion carried unanimously.
27 F. Ordinance 1994-004. re: Military Leave(1st reading).
28 Motion by Marks, second by Wagner to approve first reading of Ordinance. 1994-004, Re:

5 H. Discussion of Barber Shop Lease
6 Mayor Ranallo reported he received a call from Phil LaMere regarding his lease of space at the
7 2900 Kenzie Terrace used for his barber shop business. Due to illness, Mr. LaMere can no
8 longer operate his business and is forced to sell it. To make the business mo"re saleable, Mr.
9 LaMere has asked if the City will either extend his lease or write a new lease for new tenants. It
10 was noted that two years remain on a four year lease and that the new lessee must be approved by
11 the Council.
12 Motion by Marks, second by Wagner that upon sale of property, the City Manager is authorized
13 to negotiate an extension of the existing lease or create a new lease with the new owner.
14 Motion carried unanimously.

There is an existing pole at that location and N.S.P. has indicated the location is
acceptable to them.

The proposed changes are as follows:

The City Council of the City of St. Anthony hereby ordains:
Section 1. Section 1400.00 5jgn.� will be amended as follows:
1400.04 Definitions. For the purposes of this Chapter, the following terms have the
meanings given them in this Section:
Subd. 11. Ground Sign. Any sign which is freestanding by virtue of being
structurally independent of any structure or object, and is affixed to the ground
by means of a base with no visibility between the bottom of the sign and the
base on which it is attached, and may fnake use of landseaping lan caped_to

Subd. 5. Design and Location:
(1) Signs must maximize the use of natural materials in construction and
should conform to the material design of the principal structure.
(2) Signs must be located at least 15 feet from any street or other easement.

least equal to the sign width.
(4) The principal structure of a parcel of land will be allowed one ground
sign, regardless of the number of tenants in the structure.

Notice is hereby given that the Planning Commission of the City of St. Anthony will hold a
public hearing to consider proposed amendments to the sign ordinance on Tuesday, September
20, 1994, at 7:05 P.M.; or as soon thereafter as possible. Public Hearings are held in the

Section 1320 - FENCES
1320.01 Definition. For purposes of this Section, "fence" means a partition,
structure, wall or gate erected as a dividing marker, barrier, enclosure or visual
obstruction, but excluding buildings and bushes, hedges, trees and other living
landscaping.
1320.02 Building Permits Required. A building permit is required for the
construction or alteration of a fence, and for any additions to a fence. The permit
must be obtained in the name of the owner of the property on which the fence is or
will be located. Application must be made on forms provided by the City. The
applicant must provide the Building Inspector with a set of plans and specifications
for the fence. Permit fees must be paid in accordance with the Uniform Building
Code.
1320.03 Requirements.
Subd. 1. Location. Any fence constructed or altered after June 3, 1982 must be
located entirely upon the private property of the owner to whom the building
permit was issued. Ownership of the permit passes with ownership of the
property. The fence must be set back a distance from the owner's property
line sufficient to avoid encroachment onto adjoining private or public
property or-a public right-of-way.
Subd. 2. Abutting Public Property. If a fence is or is to be adjacent to a street,
alley, public right-of-way or other public property, the City may require the
applicant for the permit to locate and mark the property line abutting the
public property by having a registered surveyor place permanent survey pins
or stakes on the property line. If the survey information is not available and
the applicant elects not to establish the property line by survey, the permit
will not be issued unless the applicant signs an affidavit stating that the
applicant is the owner of the premises upon which the fence exists or is to be
located.

TO EXECUTE LEASE ON BEHALF OF THE CITY

approves the Lease between the City and St. Anthony/New Brighton School
District No. 282 and authorizes the Mayor and City Manager to execute said
Lease on behalf of the City.

LEASE
This Lease is entered into as of November 1, 1994, by and between the CITY OF ST.
ANTHONY, a municipal corporation under the laws of the State of Minnesota ("Landlord")
and ST. ANTHONY/NEW BRIGHTON SCHOOL DISTRICT NO. 282, a Minnesota public
school district ("Tenant").
Landlord, in consideration of the rents and covenants herein, does hereby demise, lease and let
unto the Tenant, and the Tenant does hereby hire and take from the Landlord the following
described premises located in the County of Hennepin and the State of Minnesota:
That portion of the building (the "Building") located at 3301 Silver Lake Road
and legally described on Exhibit 2 attached hereto and made a part hereof(the
"Property"), which leased portion of the Building is shown crosshatched on
Exhibit 1 attached hereto and made a part of(the "leased premises").
TO HAVE AND TO HOLD THE PREMISES, without any liability or obligation on the part of
Landlord of making any alterations, improvements or repairs of any kind on or about the leased
premises except as provided herein, for the term of fourteen (14) months commencing

The City Council of the City of St. Anthony hereby ordains:
Section 1. Section 540.02 Definitions, to read as follows:
Subd. 1. Alarm. A mechanical, electrical or electronic device designed to detect
unauthorized entry, but excluding such a device affixed to a motor vehicle.
Section 2. Section 540.06 Fees. to read as follows:
Subd. 4. Responses to False Alarms.
(a) Fees for false alarms must be paid to the City by the alarm user in accordance
with this Subdivision. If fee is not paid to the City in accordance with this
Subdivision, fee will be added to the alarm user's utility bill by the City Finance
Director. No fee will be charged for a response to a false alarm where not
more than two false alarms occur within a 12 month period.
(b) The sum of$75.00 must be paid to the City by the alarm user for each false
alarm response after the second response within a 12 month period. This fee
increases by $25.00 for each subsequent alarm thereafter in the same period.

ORDINANCE 1994-002
AN ORDINANCE RELATING TO PERMITTED CONDITIONAL
USES IN A "C" GENERAL COMMERCIAL DISTRICT;
AMENDING SECTION 1635.03 OF THE 1993
ST. ANTHONY CODE OF ORDINANCES
The City Council of the City of St. Anthony hereby ordains:
Section 1. Section 1635.03, Permitted Conditional Uses. is amended to add the following:
(t) Hardware and building material supply store with outdoor lumber yard where
(i) the lumber yard is screened in a manner approved by the City Council, and
(ii) the hardware and building material supply store building contains at least
30,000 square feet of space.
Section 2. Effective Date. This ordinance shall be in effect as of the date of its publication.

ORDINANCE 1994-005
AN ORDINANCE RELATING TO ELECTIONS; AMENDING
SECTION 210 OF THE 1993 ST. ANTHONY CODE OF ORDINANCES
The City Council of the City of St. Anthony hereby ordains:
Section 1. Section 210.03 shall be added to Section 210 - Elections, and will
read as follows:
210.03 Absentee Ballot Board, An Absentee Ballot Board may be established
for an election and shall incorporate Minnesota State Statutes, Chapter 203B.13
in its entirety.
Section 2. Effective Date. This ordinance shall be in effect as of the date of its
publication.
