CALL TO ORDER/ROLL CALL. 5 The meeting was called to order at 7:00 P.M. followed by the Pledge of Allegiance led by Mayor 6 Ranallo.- 7 II. Midwest Asphalt. Inc. in the amount-of$235,990.93 for 1995 Street and Watermain 28 Improvements. 29 30 Motion carried unanimously. 31 VII. REPORTS. 32 A. Mayor, 33 Mayor Ranallo reported he had been contacted by Twin City Arsenal regarding the 34 initiation of restoration of-ground-water-that has not yet been cleaned up. They would City Council Regular Meeting Minutes June 27, 1995 • Page 3 1 like a representative from the cities of St.Anthony,New Brighton, Arden Hills and 2 Shoreview. 3 Motion by Marks, second by Fleming to appoint Richard Enrooth as the official 4 representative to Twin City Arsenal. 5 Motion carried unanimously. 6 Ranallo reported the City has the plans for the Community Center. The School Board has 7 agreed to contribute $96,000 per year rental, $86,000 for the community service section 8 and $10,000 for the gym. The School Board has asked there be an open forum to discuss 9 these plans with the community. There was Council direction to place a copy of the plans 10 on a wall at City Hall and also have a copy available at the St. Anthony Library for 11 residents to view. Ranallo indicated the Sports Boosters will use the gym every night for 12 five months of the year and Community Service will use part of the gym during the day 13 for smaller programs. 14 Enrooth indicated he had met with the Sports Boosters last week and they have agreed to 15 contribute approximately $50,000 for the next five years. This figure is based on 42% of their total net profit. 17 B. Council. 18 Enrooth reported Village Fest plans are proceeding well. The Committee will meet 19 Thursday, June 27th and each Thursday thereafter until August 5th. 20 Ranallo stated Village Fest will include a golf tournament on Friday; family activities, 21 parade, entertainment, band and fireworks at dusk on Saturday; and Kiwani's pancake 22 breakfast on Sunday. 23 Marks reported the Sister City Committee is still working on preparations for the arrival 24 of the Lindquists on August 1, 1995. He invited anyone who would like to participate in 25 a group who will be meeting the Lindquists at the airport at 2:14 p.m. He reported there 26 is a picnic scheduled for August 4th which City Council and other various groups will be 27 invited to and dinner with the City Council is scheduled for August 1 st. It is also 28 anticipated the Lindquists will be making a trip to the North Shore. 29 Marks suggested Mr. Charles Glotzbach, who was Company Commander in World War 30 II, be honored in conjunction with the 50th Anniversary Celebration. He indicated he 31 would distribute copies of a Newsweek article which was written regarding his service. City Council Regular Meeting Minutes June 27, 1995 Page 4 • 1 C. City Manager. 2 City Manager Mornson reported his attendance at a meeting of the North Suburban Cable 3 Commission. It was recommended by their attorney that the ten cities involved draft a 4 telecommunications ordinance. 5 Mornson reported he had met with the Superintendent of Schools to discuss the fall 6 election. This will be the first time the school and City will be on the same ballot due to 7 changes in the Legislature. At a future meeting he will present a resolution for joint 8 funding of the election and authorizing the City to run the School Board election. 9 Mornson reported the City of Falcon Heights would like the Mayor and City Council to 10 attend an open house it is planning for the new police contract. It will be held on a 11 Tuesday in September from 5:00 to 6:30 p.m. He indicated he will have more specific 12 information in July. 13 Mornson indicated there will not be a work session next week as it is the Fourth of July. 14 The next work session will be August 1, 1995. 15 Mornson reported there will be a new restaurant manager at the Stonehouse. He indicated • 16 two major changes were taking place, the outside of the building was being painted and 17 the restaurant will now have Saturday hours for meals. 18 Ranallo reported he and Mornson had held discussions with First Bank and CUB Food 19 Stores and CUB was still interested in locating in Apache Plaza. 20 VIII. PUBLIC HEARING. 21 Mayor Ranallo opened the public hearing at 7:27 p.m. 22 A. Resolution 95-041. re: Modification of Redevelopment-Plans and Tax Increment 23 FinancingPlans. 24 Mr. Gilligan, Dorsey& Whitney, explained this was a proposal to modify the existing 25 redevelopment plan for the City of St. Anthony. This action would pool the various areas 26 of redevelopment on the master plan and add additional property to the redevelopment 27 plan. It will permit expenditures to aide the redevelopment. He reported the plan also 28 will authorize expenditure of the TIF from Chandler Place and Kenzie Terrace. He stated 29 this modification would authorize but not appropriate funds. He indicated this 30 modification also included an amendment to Evergreen Townhomes to authorize an 31 additional $150,000.00 for soil correction and will also authorize use of TIF funds for the 32 Community Center. 33 Ranallo stated this was a method to encourage redevelopment in the City. City Council Regular Meeting Minutes June 27, 1995 . Page 5 1 Michelle Lewis, Lowry Grove Mobile Park, asked what type of redevelopment the City 2 was interested in. She also asked if there would be a change in the zoning ordinance for 3 Lowry Grove Mobile Park. 4 Ranallo indicated currently there was the Arnold Development and redevelopment at the 5 Village Commons. He stated they hoped to redevelop the American Monarch building. 6 He indicated there may be a zoning change in the Lowry Grove area. At the current time, 7 funds have been set aside to install a holding pond in that area. 8 Motion by Marks, second by Fleming to close the public hearing at 7:40 p.m. 9 Motion carried unanimously. 10 11 Motion by Marks, second by Enrooth to approve Resolution 95-041, approving master 12 modification to redevelopment plans and tax increment financing plans and making 13 findings with respect thereto. 14 Motion carried unanimously. B. Resolution 95-042, re: Amending Redevelopment Plan and Tax Increment Financing 16 Plan for District#2, Ramsey County. 17 Motion by Marks, second by Fleming to approve Resolution 95-042, approving 1995 18 amendment to redevelopment plan Project No. 2 (Ramsey County)and the tax increment 19 financing planfor tax increment financing District No. 2. 20 Motion carried unanimously. 21 IX. NEW BUSINESS 22 A. Award Bid for Sewer Repairs on 33rd Avenue N.E. 23 Motion by Marks, second by Enrooth to approve the quotation from Insituform for 24 $21,700.00 to install a liner in the 536 feet of sewer on 33rd Avenue N.E. 25 Motion carried unanimously. 26 B. Resolution 95-040, re: Operating Agreement with a Food Service Mana eg ment 27 Consultant at the Stonehouse Restaurant. 28 Motion by Marks, second by Fleming to approve Resolution 95-040, approving an 29 Operating Agreement and Authorizing the Mayor and City Manager to Execute Said 30 Agreement. 6 Motion carried unanimously. 32 X. UNFINISHED BUSINESS. City Council Regular Meeting Minutes June 27, 1995 Page 6 1 A. Arnie Gregory for 2926, 2930, 2938, and 3004 Old Highway 8 (The Arbors at St. 2 Anthony Village. 3 Ranallo reported he had received a letter from Roger and Andrea Braun, 3001 Rankin 4 Road, advising the Council there had not been an agreement on the resolution of the 5 easement issue. They indicated they have not been offered an acceptable solution to 6 allow them access into and out of their garage. This letter is on file with the City Clerk. 7 1. Rezoning Request(3rd readingl. 8 City Attorney Soth indicated the rezoning could be approved if the Council felt it would 9 be appropriate zoning for the parcel regardless if the plat is approved. 10 Marks indicated the rezoning would recognize the actual current usage of the parcel. 11 Motion by Marks second by Enrooth to approve the third reading and adopt rezoning of 12 2938 Old Highway 8, 3004 Old Highway 8, and 2926/2930 Old Highway 8, from R-2 to 13 an R-3 zoning district. 14 Motion carried unanimously. 15 2. Final Plat. • 16 City Attorney Soth advised that all the issues in his letter dated June 5, 1995 had been 17 resolved except for the easement issue. He indicated the Council could approve the final 18 plat subject to evidence of clear title to the parcel. 19 Motion by Marks, second by Fleming to approve the final plat for 2938 Old Highway 8, 20 3004 Old Highway 8, and 2926/2930 Old Highway 8 subject to City Attorney's review 21 and approval. 22 Motion carried unanimously. 23 B. Bruce Nedegaard, For XXXX Fordham Drive (The Village Commons), 24Mayor Ranallo asked the public if anyone would like to address the Council on this issue. 25 No one came forward to do so. 26 1. Rezoning Request(3rd reading). 27 Motion by Marks, second by Fleming to approve the third reading and adopt the rezoning 28 of XXXX Fordham Drive, The Village Commons, from an R-1, Single Family District to 29 R-2, Two Family District. 30 Motion carried unanimously. 31 32 2. Final Plat, 33 Motion by Enrooth, second by Fleming to approve final plat for XXXX Fordham Drive, 34 The Village Commons subject to City Attorney's final review and approval. Ordinance 1995-001. re: Lot Coverage 3rd readingyL 9 Motion by Marks, second by Enrooth to approve the third reading and adopt Ordinance 10 1995-001, relating to lot coverage, amending sections 1615, Subd. 8; and 1620, Subd. 8 11 of the 1993 St. Anthony code of Ordinances. 12 Motion carried unanimously. 13 E. Ordinance 1995-005. re: Adult Uses (3rd reading . 14 Motion by Fleming, second by Enrooth to approve the third reading and adopt Ordinance 1995-005,relating to adult uses and sexually oriented businesses, amending.Chapter 16 of the City Code to add a new section 1670; amending section 1605.01 to add certain new 17 definitions; and amending subsection 1635.03(a). 18 Motion carried unanimously. 19 F. Ordinance 1995-006, re: Building Code (2nd readingl. 20 Motion by Marks, second by Fleming to approve the second reading of Ordinance 1995- 21 .006, adopting the Minnesota State Building Code as revised and providing for its 22 application, administration, and enforcement; and providing for the repeal of all 23 inconsistent ordinances. 24 Motion carried unanimously. 25 XI. ANTHONY • ORDINANCE 1995-006 AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE AS REVISED AND PROVIDING FOR ITS APPLICATION, ADMINISTRATION, AND ENFORCEMENT; AND PROVIDING FOR THE REPEAL OF ALL INCONSISTENT ORDINANCES The City Council of the City of St. Anthony hereby ordains: Section 1. Section 1305 shall read as follows: SECTION 1305 - HOUSING CODE AND STATE BUILDING CODE 1305.01 State Building Code Adopted, The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B.59 through 1613.75 and published in Minnesota Rules Chapters 1300 through 1370 and incorporating the Minnesota Plumbing Code and the Minnesota Energy Code, Chapters 4715 and 7670 respectively of Minnesota Rules, is hereby adopted as the building code for the City of St. Anthony, and is incorporated into this ordinance as if set out in full subject to the following specifications: • Subd. 1 Mandatory Enforcement Provisions. The following chapters of Minnesota Rules shall be enforced and administered without change by the City as mandatory' provisions of the Minnesota State Building Code: (a) Chapter 1300 - Minnesota State Building Code (b) Chapter 1301 - Building Official Certification (c) Chapter 1302 - Construction Approvals (d) Chapter 1305 - Amendments to the Uniform Building Code (UBC) (Adoption of the 1994 Uniform Building Code). The adoption of this chapter specifically includes UBC Appendix Chapters: 3, Division I "Detention and Correctional Facilities"; 12, Division II "Sound Transmission Control"; and 29, "Minimum Plumbing Fixtures". The adoption of optional UBC Appendix chapters under Section 1305.0020 shall be as indicated in Subd. 2 of this ordinance (e) Chapter 1307 - Elevators and Related Devices (f) Chapter 1315 - Electrical Code (Adoption of 1993 National Electrical • Code - NEC) • Ordinance 1995-006 Page 2 (g) Chapter 1325 - Solar Energy Systems (h) Chapter 1330 - Fallout Shelters (i) Chapter 1335 - Floodproofing; Except Sections 1335.0600 through 1335.1200 which are optional and shall be enforced as adopted in Subd. 2 of this ordinance (j) Chapter 1340 - Facilities for the Handicapped (k) Chapter 1346 - Uniform Mechanical Code (1) Chapter 1350 - Manufactured Homes (m) Chapter 1360 - Prefabricated Buildings (n) Chapter 1365 - Snow Loads • (o) Chapter 1370 - Storm Shelters (p) Chapter 4715 - Minnesota Plumbing Code (q) Chapter 7670 - Minnesota Energy Code Subd. 2 Optional Enforcement Provisions. (a) The following Appendix Chapters of the 1994 Uniform Building Code, representing optional provisions of the Minnesota State Building Code as provided in Chapter 1305.0020 of Minnesota Rules, are hereby adopted by the City and shall be enforced and administered by the City without change, except to the extent that the City may adopt revised fee schedules and bonding requirements under UBC Appendix Chapter 33, as part of the State Building Code for the City: (1) UBC Appendix Chapter 3, Division III - Requirements for Group R, Division 3 Occupancies (2) UBC Appendix Chapter 15 - Reroofing • (3) UBC Appendix 19 - Protection of Residential Concrete Exposed to Freezing and Thawing • Ordinance 1995-006 Page 3 (4) UBC Appendix 31, Division H - Membrane Structures (5) UBC Appendix 33 - Excavation and Grading 1305.02 Application Administration and Enforcement. The application, administration, and enforcement of the Minnesota State Building Code in the City shall be in accordance with Minnesota Statutes Chapter 16B and Minnesota Rules Chapters 1300 and 1305. The-City Council, pursuant to Minnesota Statutes 16B.65, shall appoint a Building Official who shall attend to all aspects of Building Code administration. Additional members of a City Building Department shall be'authorized by the City Council as needed. Organization of the City's Building Department shall be as established by Chapter 1 of the 1994 Uniform Building Code, as amended by Minnesota Rules. The Minnesota State Building Code shall be enforced within the incorporated limits of the City. 1305.03 Permits. Inspections. and Fees. Permits shall be issued, inspections conducted, and fees collected as provided for in Minnesota Statutes 16B.62, Chapter 1 of the 1994 UBC, and Minnesota Rules 1305.0106 and 1305.017. • 1305.04 Surcharge, In addition to the permit fee required under Section 1305.03 above, the applicant for a building permit shall pay a surcharge to be remitted to the Minnesota Department of Administration as prescribed by Minnesota Statutes 16B.70. 1305.05 Repeal. Section 1305 of the 1993 St. Anthony Code of Ordinances and all ordinances in conflict or inconsistent with the provisions of this ordinance are hereby repealed. Section 2. This ordinance shall be in effect as of the date of its publication.
