5 The meeting vas called to order at 7:00 P.M. followed by the Pledge of Allegiance led by Mayor

9 Motion by Wagner, second by Enrooth to approve the following claims:

22 In response to Enrooth, Mornson indicated the Council has not received monthly reports from the
23 prosecuting attorney recently due to the City's change of prosecuting attorney. He indicated the
24 Councilmembers should be receiving a report in the near future.
25 Motion carried unanimously.
26 VII. REPORTS.
27 A. Mayor,
28 Mayor Ranallo commended Richard Enrooth and George Wagner for their excellent work
29 with Village Fest. He reported Village Fest was a huge success.and thanked all the
30 people`who had been involved with the celebration. Ranallo announced everyone who
31 was involved with Village Fest was invited to a meeting at his home on Friday, August
32 11, 1995. He indicated this would-be posted at the City Hall. He reported he had an
33 interesting evening with the Lindqvists of Salo, Finland and very much enjoyed their
34 company. •

2 Enrooth reported revenues for Village Fest were up from previous years.
3 Wagner reported there was record attendance at the Kiwani's pancake breakfast on
4 Sunday. He also reported the Kiwani's Golf Tournament had been a success. He
5 indicated it was the I st Annual Memorial Golf Tournament for Elmer Iverson and it
6 appears this tradition may continue.
7 There was Council consensus to postpone Agenda Item C. as Mr. Nedegaard had not yet
8 arrived.
9 VIII. PUBLIC HEARING - None.
10 IX. NEW BUSINESS
1 I A. Resolution 95-043. re: Emergency Water Plan.
12 Motion by Enrooth, second by Wagner to approve Resolution 95-043, adopting the City
13 of St. Anthony Emergency Portable Water Plan.

There was Council consensus to direct City Manager to discuss the addition of fire
5 hydrants to the emergency water plan with the Fire Department.
16 Motion carried unanimously.
17 B. Resolution 95-044. re: CDBG Subrecipient Agreement.
18 Motion by, Enrooth, second by Wagner to approve Resolution 95-044, authorizing the
19 Mayor and City Manager to execute Subrecipient Agreement with Hennepin County for
20 the year 1995 (Year XXI) Urban Hennepin County Community Development Block
21 Grant Program.
22 Motion carried unanimously.
23 X. UNFINISHED BUSINESS -None.
24 VII. REPORTS (CONTINUED)
25 C. City Manager,
26 1. Bruce Nedegaard's Request for Modification of the Final Plat for the Village
27 Commons.
City Manager Morrison reported at the time of the final plat approval for this project,
q there were four property owners involved in the transaction. Since that time, one
30 property owner has reneged on the sale of their property. Mr. Nedegaard is intending to

1 close on the other three properties at the end of this week. Morrison explained Mr.
2 Nedegaard is present to request modification to the final plat approval of June 27., 1995.
3 Morrison reported the City Attorney indicated the Council can approve the request
4 without referring the matter back to the Planning Commission or holding another public
5 hearing; as the amendment would be deleting land, rather than adding land, to the plat.
6 Mr. Bruce Nedegaard, Nedegaard Construction, reported he does have a signed purchase
7 agreement from Mr. Schroeder but not signed by Mrs. Schroeder. He indicated he does
8 intend to pursue the issue but he is unsure of the final outcome. He stated at this point, all
9 other property owners are ready to close. He explained without the purchase of the
10 Schroeder's land, there will be a 67 foot piece of property between the Reed and
11 Schroeder property, which will stay as an outlot. There will also be a 30 foot piece of
property between the Schioeder property and the road. He`stated if an`agi=ee
meet can not
13 be reached with the Schroeders, he intends to donate this piece of property to the City and
14 berm it heavily.
15 Motion by Enrooth, seconded by Fleming to allow Mr. Bruce Nedegaard,Nedegaard
16 Construction, to delete Lots 15 and 16 from the original final plat of Village Commons,
17 as necessary.
18 Motion carried unanimously.
19 Mr. Nedegaard reported he hopes to close on the project this week with construction
20 beginning in two weeks. Mr.Nedegaard indicated there are presently five lots sold out of
21 the twelve proposed twinhomes.
22 City Manager Mornson reported Arnie Gregory will tentatively be closing on the property
23 included in his project on August 18, 1995 and it may be appropriate to conduct the
24 groundbreaking ceremony for the Gregory project and the Nedegaard project together.
25 He reported the American Monarch project is scheduled to close on September 15th.with
26 the new business moving in the beginning of October.
27 There was Council direction for City Manager to include the tax base of the Nedegaard,
28 Gregory and American Monarch projects in their respective news releases.
29 In response to Wagner, Morrison reported the parties involved in the Gregory project
30 easement issue met last night and will be meeting again tomorrow. He indicated the
31 seller and buyer appear optimistic the issue will be resolved.
32 Morrison reported the School Board will be meeting next Tuesday to finalize their
33 decision in regards to the extended care at the Community Center and to discuss the issue
34 of day care. There was Council consensus for the'architect to proceed with advertisement
35 of bids once the plans and specifications were completed.

1 Mornson indicated he would provide the Council with updates at each City Council
2 meeting.
3 Ranallo indicated it is crucial to keep to the time schedule due to the price of construction
4 this year versus next year and the interest rates.
5 Mornson reported the Cable Commission is encouraging all cities to develop a
6 telecommunication ordinance in response to the House and Senate passage of the
7 Teleconununications Bill later this year.
8 Mornson indicated the City had received information on the-new Metropolitan Council
9 Livable Community Grant. He indicated a representative from the City will be attending
10 the meetings to determine if St.Anthony will qualify. He indicated he did not think St.
11 Anthony would qualify, as the City is currently fully developed. -
12 Mornson indicated the budget for 1996 was complete and a copy was included in
13 Councilmember's packet. He stated this would be discussed at the work session
14 scheduled for October 3rd but encouraged anyone with questions to contact himself or
Roger Larson.
16 Mornson reported there would be one last piece of capitol equipment purchased this year
17 and that was a front end loader for the Public Works Department. This is included in the
18 capitol equipment budget.
19 There was Council consensus to have some type of opening celebration for American
20 Monarch. There was Council consensus to hold a special meeting to approve the bids for
21 the community center if necessary.
22 Ranallo reported the celebration at the St. Anthony Shopping Center is scheduled for
23 August 19th from 12:00 to 4:00 p.m.
24 XI. ADJOURNMENT.
25 Motion by Enrooth, second by Wagner to adjourn the meeting at 7:45 P.M.

BACKGROUND
Mr. Leslie E. Formell, CEO for Formell & Associates Architects has submitted a Petition
for Variance to the City for a shoreline variance on Kiwanis Island in Silver Lake. Mr.
Formell has submitted the petition for the Salvation Army Camp, which is requesting to
be allowed to construct an open-sided picnic shelter on Kiwanis Island. Currently, the
island has a swingset, a barbecue pit and can only be accessed by a walking trail. The
picnic shelter would provide weather protection for recreational activities on the island.
The Salvation Army Camp is proposing to construct the picnic'shelter in the middle of the.
island. This proposed site will require a 125 foot variance from the southeast corner of the
• structure to the shoreline and a 100 foot variance from the northwest and northeast
corners of the structure to the shoreline. The zoning ordinance states that a structure in a
recreational/open space district must adhere to a lakeshore setback of 200 feet. The
proposed structure otherwise meets the permitted uses restriction of the ordinance in that
it will be an outdoor recreational facility that is operated by a nonprofit service
organization, (Sec. 1645, subsection 1645.02). The current Department of Natural
Resources regulations require a 75 foot lakeshore setback for structures on shoreline
property.
RECOMMENDATION
Staff recommends approval of the petitioner's request for setback variances. This
recommendation is based on the hardships addressed in the Petition for Variance submitted
to the City in order to construct an open-sided picnic shelter. Conditions that exist to
create hardships are the following:
• The shape of the island prevents the construction and placement of the picnic
shelter within the City's requirement for a 200 foot setback for lakeshore structures.
• The City's Zoning Ordinance requires that a structure in the recreation/open
district be setback 200 feet from the lakeshore; the Department of Natural
Resources requires only a 75 foot setback for lakeshore structures. If the shelter is
• constructed, it would meet the DNR's 75 foot setback requirement for lakeshore
structures. The City's ordinance is a cause of hardship in this situation.

In answer to the three questions which are part of the'petition for Variance° on the above
tproject please accept the following comments:
1. The Kiwanis Island is presently used for summer and winter camping activities. There is
a swing set and a fire pit located on the island now. The island is large enough to
facilitate these type of activities at the present time and is a delightful location for these
activities. It is the desire of the Owner to further enhance these activities by
constructing an environmentally friendly open air shelter to provide some additional
weather protection for dining and meeting activities in this setting. The island is
basically long and narrow and the topographical condition is such that a 200 foot set
back prevents the construction of the facility even in the very center of the island. The
configuration of the parcel of land therefore is the cause of this hardship.
2. This property is very unique because it is an island and a long and narrow island. There
is no income derived from this parcel and this variance would not make the parcel more
valuable or income potential of the parcel. The parcel is owned by the Salvation Army
and the proposed structure is to be donated by the Downtown Minneapolis Kiwanis Club.
3.' the hardship of this parcel is caused strictly by the fact that the Ordinance requires a .
200 foot setback, which is arbitrary by the Village of St. Anthony although appropriate in
an overall general sense. The parcel is part of the larger tract of land owned by the
Salvation Army but is formed by the natural condition of Silver Lake without influence in
any way from man.

• MEMORANDUM OF UNDERSTANDING
WHEREAS, the City of St. Anthony (the "City") and the St. Anthony/New Brighton
School District No. 282 (ISD #282), in compliance with "Laws of
1995, Chapter 8" of the Minnesota State Legislature, and to better
coordinate local General Elections, desire to combine the elections of
the City Council and School Board and to hold said combined elections
on the first Tuesday after the first Monday in November in odd
numbered years beginning with the local General Election in 1995; and
WHEREAS, to accomplish the combined elections and pursuant to Minnesota State
Statutes, Section 205A.04, the School Board 'of ISD #282 has elected
to hold its General Elections to coincide with City Council General
Elections on odd numbered years. In addition, the School Board has
established a schedule for School Board members' terms to be
lengthened to expire on the January 1 st following the date on which
the, terms would otherwise have expired.
NOW, THEREFORE, BE IT RESOLVED that:
• 1) the City Clerk will conduct all local General Elections;
2) City-owned voting equipment will be used;
3) for the 1995 combined General Election, ISD #282 will reimburse the City on
a 60/40% split, 60% City, 40% School District, and a fee for costs
associated with future local elections will be negotiated when appropriate;
4) whenever there is an ISD #282 election without City items on the ballot, ISD
#282 may either conduct the election on its own or contract with the City
for the services of the City Clerk to conduct the Special Election in the
manner in which the combined local General Elections are conducted;
5) the City will pay the full cost of any local General Elections for which ISD
No. 282 has no item on the ballot;
6) ISD #282 will hold harmless the City in the conduct of elections.

Attached arecopiesof two letters from Zack Johnson, the architect for the School District
addressing the issue of parking for Wilshire Elementary School and the Middle/High
School because of the proposed expansions at both sites. The ordinance requires that
parking needs be adequate if the proposed expansions will bring in additional people to the
schools, and that the Council will set the parking requirements (Sec. 1650.05, Subd. 1, (e),
(11) is attached).
Mr. Johnson indicates in his letter that the only proposed expansion to be done at the
Middle/High School will be to the library. Since there is no anticipated increase in staff or
students as a result of this expansion, no additional parking is thought to be necessary.
The proposed expansion of classrooms, library and multi-purpose room at Wilshire
Elementary School will add enrollment to the school, which will necessitate increased
parking spaces. Currently, Wilshire Elementary School has 77 parking spaces and Mr.
Johnson is proposing to add 13 spaces, which will increase the parking capacity to 90
spaces. The school administration feels that this will be adequate to serve the future
parking needs of between 60 - 70 staff members and 15 - 20 visitors on any given day.
(� Breezeways, covered or uncovered porches, patios, steps, stoops and picnic
shelters in a rear yard which are not closer than five feet from any property
line.
(g) Non-window mounted air conditioning units which extend no more than
six feet into any required yard other than the front yard, and which are at
least 15 feet from any property line.
(h) Eaves, gutters and downspouts which project no more than five feet into any
required yard, which are at least 30 inches from any property line, and which
do not drain onto neighboring property.
1650.04 Height Limit Exceptions. In determining height limitations, the following items
will be excluded if they do not adversely affect adjoining properties and their inclusion
would not cause a structure to exceed 75 feet in height: belfries, chimneys, church spires,
cupolas and domes which do not contain usable space, elevator penthouses, fire and hose
towers, flag poles, monuments, antennas, and transmission and receiving towers for
which a conditional use permit has been issued.
1650.05 Parkin .
Subd. 1. On-Site Parking. All property in the City must comply with the following
on-site parking requirements:
(a) Parking spaces must be at least 9 feet by 19 feet and those in the R-4, B,
C and LI Districts must be clearly marked and outlined.
(b) The total area of a parking lot, including all parking spaces, drive
aisles, islands and landscaping must be no less than the required
number of parking spaces multiplied by 300 square feet.
(c) All vehicles, as defined in Subsection 1605.01, parked on any lot in an
R-1, R-1A, R-2 or R-3 District must be parked on a surface paved with
asphalt or bituminous material, concrete, cement, brick, or other
paved surface, or on a gravel driveway located in the front yard.
(d) Any vehicle without a current state registration must be parked in a
garage-or other building.

(e) Minimum Number of Spaces:
(1) Single-family detached units must have at least two hilly
enclosed parking spaces.
(2) Two-family dwellings, townhouses, apartments and
condominiums must have at least two parking spaces per unit, at

Ieast one of which is enclosed. There must be a fire Hall "ith a
rating of at least one hour separating every four parking stalls. •
(3) Churches, clubs and restaurants must have a number of parking
spaces which is no less than the total designed seating capacity of
the structure divided by 2.5, plus one parking space for each
employee on the largest shift.
(4) Convalescent or nursing homes must have at least one space for
every five beds, plus one space for every employee on the largest
shift.
(5) Retirement homes must have at least one parking space for every
three living units.
(6) Uses in the C District must have at least one parking space for
every 300 square feet of gross floor area.
('n Light industrial, manufacturing, testing and research uses must
have one space for every employee on the largest shift or one
parking space for every 350 square feet of floor area, whichever is
greater.
(8) Warehousing, transfer and storage uses must have at least one
space per employee on the largest shift plus one parking space per
company vehicle.
(9) Animal hospitals must have at least four parking spaces for every
veterinarian, plus one space for every employee on the largest
shift.
-(10) Medical and dental offices-must have at least five parking spaces
for every doctor or dentist, plus one space for every employee on
the largest shift.
(11) The parking requirements in the R/O District will be set by the
Council according to the expected demand for a particular facility.
(12) Fast food, take out, and convenience restaurants must have at
least one parking space for every 50 square feet of gross floor area,
plus one parking space for every three seats, plus one parking
space for every employee on the largest shift.
(f) The number of existing on—site parking spaces on a property may not
be reduced below the number required under paragraph (e) of this
Subsection.

We, appreciated the opportunity to meet with you and Larry Flamer to discuss this ..
building addition. Our currentunderstanding is that this work will not require a •
formal setback variance,conditional use permit, landscaping plan review,nor site plan
reviews or public hearings.
As a result of that meeting, and on behalf of the School Board, 1 am submitting this y
request for City Council approval of the required parking allotment at their meeting
of August 22, 1995.
The project consists of a 4,4(x) square foot,single story addition to the North side of
the classroom portion of the building. As we.discussed, the City Council must review
the parking requirements for this project. The additional building space will be used
as a library and is not intended to increase the enrollment of the facility.
The site currently has 176 parking spaces. During the next several years, the student
enrollment is expected to be 650.700 (of wluch only 220-230 are High School
students of driving age), with go-100staff on-site at any one time during the day.
The school has a parking permit system for student drivers and can limit the number
if necessary. In recent years, it has not been an issue since they have only had a
request for approximately 70 permits.
As we offered, we have researched what similar facilities in other cines are required
to provide. We obtained parking requirements from Columbia Heights, Fridley,
Falcon Weights, New Brighton, Mounds View and Arden Hills. All of these cities
treat elementary *schools and middle schools the same ;incl at a much lower
requirement because the students are younger than the legal driving age. Most of
