A. DESCRIPTION OF 2005 RESIDENTIAL RECYCLING PROGRAM
1. In 2005, will any collection services be provided under a contract? Yes No_X_

2. How will the municipality assure materials are collected in 2005 from those households that wil 06
not receive recycling collection services under a municipally-arranged contract? (e.g.,ordinance
provisions, licensing requirements, other mechanism) What materials are required to be
collected,and at what frequency?
By an ordinance requirement, whereby residential haulers are required to provide curbside
recycling services to single-family residential customers at no cost. Recyclable items collected
include newspapers, glass, plastic bottles,aluminum,and tin cans. Pick-up is arranged once per
week by the hauler of a resident's choice(BFI, Waste Management, or Walter's Rubbish).
It should be noted that while recycling services are not mandated in the City Code for multiple
family residential units, it appears that recycling services are available to the majority of those
residences.
Staff has driven the City and found there are just a few cases where recycling is not available.
The majority of St. Anthony residences have recycling services available to them.
3. How will the municipality assure that all recyclables collected from residential properties are
recycled, whether collected by the municipality's contracted vendor or another service provider?
The City can assure that it is occurring at single-family residences because of the ordinance
requirement for recycling. However, city staff cannot assure that it is occurring at multiple-
family residences as that is not an ordinance requirement. However, in the majority of the cases
it is anyway.
4. What changes are planned or anticipated for 2005?
None are anticipated.
5. How are recycling services in 2005 to be paid for, beyond any use of SCORE funds? What long-
term funding source is in place for recycling services?
The City picks up what SCORE funds don't. Ramsey County SCORE funds have covered the
following in past years: administration costs,Clean-Up Day associated costs, city newsletter
production, printing,and mailing costs,and recycling bins. The City plans to have similar costs
covered by Ramsey County SCORE funds in 2004.
In terms of long-term, the City would pay for expenses out of the General Fund reserves and any
applicable portion of the Hennepin County SCORE grant funds.
6. Describe the municipality's source reduction and recycling promotional efforts. List types of
materials to be used, intended audiences,and method and frequency of distribution.
City Newsletter, Vi//age Notes- published quarterly; St Anthony Ramsey (and Hennepin)County
residents and businesses are the intended audiences.
City Cable Channel 16 - information related to recycling is posted here on the bulletin board; St.
Anthony residents are the audience.

City Web Site: recycling information and related links are posted online at www.ci.saint-
anthony.mn.us.
In addition, the City has flyers available in the City Hall information rack and handouts are given
to new residents when they or anyone else picks up their recycling bins. The City also organizes
and promotes its annual Spring Clean-Up Day. The Recycling Coordinator works with the local
newsletters and community groups to encourage and maintain recycling efforts throughout the
City.
7. What measurable goals do you have for source reduction and recycling activities in 2005? (At
least ONE measurable goal must be listed.) Please describe how you will measure progress
toward those goals and how activities will be evaluated.
The City of St. Anthony proposes to use Ramsey County SCORE funds to maintain and increase
recycling participation and tonnage collected. One measurable goal is to increase promotional
efforts for recycling. The City will continue to add recycling information to the City's web site.
8. If any activities will be conducted by a contractor or subcontractor, what provisions will be made
to monitor and audit those activities?
City staff reviews the recycling volume/numbers that come in from the three residential haulers.
The City requires regular reporting and monitors the reports.

B. SCORE GRANT REQUEST
1. Please describe how a SCORE grant would enhance or improve source reduction and recycling
efforts in your community. List specific activities for which SCORE funding would be used.
City Administration of Recycling: to prepare recycling reports and disseminate recycling
information to Ramsey County residents. In addition, the plan will be to continue put
information on the city cable channel bulletin board.
City Promotion of Recycling: to pay for the production, printing, and mailing of the recycling
section of the quarterly city newsletter, Village Notes,that goes to Ramsey County
residents.
Recycling Bins: to purchase recycling bins for residents to be able to pick up at City Hall.
Clean-Up Day: to cover costs associated with the collection of recyclables and the bins,
equipment, etc. for the City's annual Clean Up Day, held the first Saturday of May.
2. Please show how you intend to allocate your 2005 SCORE grant. Detail how you intend to use
SCORE funds within each applicable budget area. Attach a copy of your 2005 municipal budget
for all recycling activities, including all funding sources. (If the budget has not been adopted
by your governing body,attach the most current draft budget.)

Please describe the recycling program for materials generated at municipal facilities, per
requirements in Minn. Stat. Sec. 115A.151. List materials collected and service provider(s). If any
materials are brought to a drop-off center or otherwise not handled by a collection service, list
those materials and describe how they are transferred.
St. Anthony city facilities (City Hall, Public Works,and the Fire Station) have in-house recycling
programs for four broad types of materials (paper, metal,glass, plastic,and textiles). The City's
hauler is Waste Management. The recycled materials go to the MRF in northeast Minneapolis.
D. RESOLUTION
Please attach a resolution from your governing body requesting the funding allocation or a certified
copy of the official proceedings at which the request was approved. SCORE grants agreements
cannot be issued without such an attachment.

A RESOLUTION APPROVING SUBMITTAL OF THE 2005 RAMSEY
COUNTY SCORE FUNDING GRANT APPLICATION AND
ENTERING INTO A CONTRACT FOR THIS PROGRAM
WHEREAS, Ramsey County has made a portion of its SCORE funding grant revenues
available to the City of its municipal source-separated recyclables program; and
WHEREAS, the City of St. Anthony has completed the required grant application; and
WHEREAS, the fund would be used for the City's source-separated recyclables program.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
hereby approves the submittal of the 2005 Ramsey Score funding Grant Application and enter
into a contract for this program.

RE: Vacation of Portion of Apache Lane
At its meeting on November 91h the City Council will be holding a public hearing on the
vacation of a portion of Apache Lane. As part of the for sale and rental housing development
occurring in connection with the redevelopment of Apache Plaza, a portion of Apache Lane will
no longer be required for public access under the re-platted property. The Redevelopment
Agreement, dated December 19, 2003, provides that the City will consider the Developer's
application, in accordance with state law and City ordinances, in a time frame consistent with
development of the first housing phase.
We have prepared a resolution vacating a portion of the public right-of-way and
recommend that the City Council adopt this resolution.

VACATING STREET RIGHT-OF-WAY
WHEREAS, on November 9, 2004 the City Council held a public hearing on a proposed
vacation of a street right-of-way; and
WHEREAS, two weeks published and posted notice of said hearing was given and at the
hearing all persons desiring to be heard were given an opportunity to be heard thereon; and
WHEREAS, the Council deems it to be in the best interest of the City and of the public
that said vacation be made; and
WHEREAS, the Council considered the extent the vacation affects existing easements
within the area of the vacation and the extent to which the vacation affects the authority of any
person, corporation, or municipality owning or controlling electric, telephone or cable television
poles and lines, gas and sewer lines, or water pipes,mains, and hydrants on or under the area of
the proposed vacation to continue maintaining the same, or to enter upon such area or portion
thereof vacated to maintain, repair, replace, remove or otherwise attend thereto;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St.
Anthony,Hennepin and Ramsey Counties,Minnesota, that the following described public right-
of-way is hereby vacated:
That portion of the public right-of-way of Apache Lane extending
south from the southern boundary of 39th Avenue in the City of
Saint Anthony, Hennepin County, Minnesota.
BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to cause a
notice of completion of proceedings to be prepared, entered in the transfer record of the Ramsey
County Auditor, and filed with the Ramsey County Recorder, in accordance with Minnesota
Statutes, Section 412.851.

MANAGER'S REVIEW:
In the development agreement approved by the City on December 16, 2003, the
developer was to enter in to an agreement by May 31, 2004, with the HRA to construct
Phase II development. Due to some spent developing Phase I the Developer asked for
an extension in May 2004. This was approved in May with the deadline being
December 31, 2004.
Because of the extensive time expediting Phase I the Developer is requested an
extension to July 1, 2005.
Recommendation:
Council Approval of Resolution 04-071 for an extension of Time Line of Phase II of
Silver Lake Village development.

Redevelopment
On May 5, 2004, the City Council and Housing and Redevelopment Authority (HRA)
approved an amendment to the Development Agreement with Apache Redevelopment LLC for
an extension on the timeline for redevelopment of Phase II. The extension dates approved
were October 15, 2004 for submittal of a proforma and plan information (received) and
December 31, 2004 for execution of a contract addendum (separate contract for Phase II
development).
As you recall, the Phase II development is comprised of the senior condo/co-op, the high-end
town homes and additional stacked flats and were to be located on the properties located along
Stinson Boulevard and the existing 39`x' Avenue. Due to the extensive time that the Developer
has needed to expend on expediting and finalizing all the components of Phase I of the
development and additional time required to obtain appraisals and negotiate acquisition of the
Phase II properties, they are requesting an extension of the above-mentioned timeline for
execution of the contract addendum (Phase II contract).
The Developer is still interested in completing Phase II of the development and is requesting
that the City Council and HRA approve an extension for completion of the Phase 11
Development Agreement to July 1, 2005.

WHEREAS, the City of St. Anthony(the "City") and the St. Anthony Housing and

SECOND AMENDMENT TO
REDEVELOPMENT AGREEMENT
THIS SECOND AMENDMENT TO REDEVELOPMENT AGREEMENT("Second
Amendment") is made and entered into this day of November, 2004,by and between '
the CITY OF SAINT ANTHONY, MINNESOTA, a Minnesota statutory city(the "City"), the
HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT
ANTHONY,MINNESOTA, a public body corporate and politic organized and existing under
the laws of the State of Minnesota(the"Authority"), and APACHE REDEVELOPMENT,
LLC, a Minnesota limited liability company(the "Developer").
RECITALS
WHEREAS, the Developer, the City and the Authority have previously entered into a
Redevelopment Agreement dated as of December 19, 2003 (the"Redevelopment Agreement")
and the capitalized terms used in this Second Amendment shall have the meaning given them in
the Redevelopment Agreement;
WHEREAS,pursuant to the Redevelopment Agreement, the Developer agreed to
develop a Development located in the Project Area in two Phases;
WHEREAS, under Section 8.1 of the Redevelopment Agreement, the Developer and the
Authority agreed to resolve certain issues concerning Phase II by negotiating and entering into a
Phase II Contract Addendum by May 31, 2004;
WHEREAS, through a First Amendment to Redevelopment Agreement, dated May 13,
2004, the Developer, the City and the Authority extended the original deadline, under Section
8.1, for completion of the Phase II Contract Addendum of May 31, 2004, until December 31,
2004, and the deadline for providing pro formas,more detailed site plans and other Project
Element information to October 15, 2004; and
WHEREAS, the Developer has requested that the current deadline for completion of the
Phase II Contract Addendum be extended until June 30, 2005, and that the deadline for providing
pro formas,more detailed site plans and other Project Element information be extended to
April 15, 2005.
NOW,THEREFORE, in consideration of the premises and the mutual obligations of the
parties hereto, each of them does hereby covenant and agree with the other as follows:
1. Section 8.1 of the Redevelopment Agreement is hereby amended to read as
follows:
"Section 8.1 Phase II Timing, General Contract Structure. The Developer has been
approved by the Authority to undertake Phase II of the Development, however the parties
acknowledge that certain issues remain to be resolved prior to commencement of Phase II. The
Developer has agreed to the Developer Fee Hold Back as provided in Section 11.5, as
consideration and evidence of Developer's good faith intent to proceed with Phase H. The
Parties shall proceed to resolve these issues and agree to enter into a supplement to this

Agreement (the"Phase II Contract Addendum") to establish all terms of the Phase II portion of
the Project not otherwise provided for herein. The Developer and Authority shall enter into the
Phase H Contract Addendum as expeditiously as practical after further technical, financial and
legal analysis by the City Consultants of the Phase II Development, but in no event later than
June 30, 2005. Developer shall provide pro formas and more detailed site plans and other
Project Element information not later than April 15, 2005, for at least the Phase IIA Senior
Housing Element and the Phase IIB Townhouse Element to allow finalization of this negotiation.
The dates herein shall be subject to extension by up to sixty(60) days on the Developer's
request, but any further extension shall be solely at the Authority's discretion. The Authority
and Developer agree that the Phase IIA Senior Housing Element and the Phase IIB Townhouse
Element shall be the first priority Elements to be undertaken in the Phase II Development."
2. Except as herein amended, other terms and provisions of the Redevelopment
Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the City, the Authority and Developer have caused this
Second Amendment to Redevelopment Agreement to be duly executed in their names and on
their behalf, all on or as of the date first above written.

Subject: Extension of Time Line for Phase II Development—Northwest Quadrant
Redevelopment
On May 5, 2004, the City Council and Housing and Redevelopment Authority (HRA)
approved an amendment to the Development Agreement with Apache Redevelopment LLC for
an extension on the timeline for redevelopment of Phase H. The extension dates approved
were October 15, 2004 for submittal of a proforma and plan information (received) and
December 31, 2004 for execution of a contract addendum (separate contract for Phase II
development).
As you recall, the Phase II development is comprised of the senior condo/co-op, the high-end
town homes and additional stacked flats and were to be located on the properties located along
Stinson Boulevard and the existing 39th Avenue. Due to the extensive time that the Developer
has needed toexpend on expediting and finalizing all thecomponents of Phase.I of the
development and additional time required to obtain appraisals and negotiate acquisition of the
Phase II properties, they are requesting an extension of the above-mentioned timeline for
execution of the contract addendum(Phase II contract).
The Developer is still interested in completing Phase II of the development and is requesting
that the City Council and HRA approve an extension for completion of the Phase II
Development Agreement to July 1, 2005.

A RESOLUTION APPROVING EXTENSION OF TIME LINE FOR PHASE II
DEVELOPMMENT—NORTHWEST QUADRANT
WHEREAS, the City of St. Anthony(the"City") and the St. Anthony Housing and
Redevelopment Authority(the "HRA")have executed a Development Agreement with Apache
Redevelopment LLC for the redevelopment of the Northwest Quadrant.
WHEREAS, on May 5, 2004, the City of St. Anthony(the "City") and the St. Anthony
Housing and Redevelopment Authority(the "HRA") extended the timeline for redevelopment of

SECOND AMENDMENT TO
REDEVELOPMENT AGREEMENT
THIS SECOND AMENDMENT TO REDEVELOPMENT AGREEMENT ("Second
Amendment") is made and entered into this day of November, 2004,by and between
the CITY OF SAINT ANTHONY,MINNESOTA, a Minnesota statutory city(the"City"), the
HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT
ANTHONY, MINNESOTA, a public body corporate and politic organized and existing under
the laws of the State of Minnesota(the"Authority"), and APACHE REDEVELOPMENT,
LLC, a Minnesota limited liability company(the "Developer").
RECITALS
WHEREAS, the Developer,the City and the Authority have previously entered into a
Redevelopment Agreement dated as of December 19, 2003 (the"Redevelopment Agreement")
and the capitalized terms used in this Second Amendment shall have the meaning given them in
the Redevelopment Agreement;
WHEREAS,pursuant to the Redevelopment Agreement, the Developer agreed to
develop a Development located in the Project Area in two Phases;
WHEREAS, under Section 8.1 of the Redevelopment Agreement, the Developer and the
Authority agreed to resolve certain issues concerning Phase II by negotiating and entering into a
Phase II Contract Addendum by May 31, 2004;
WHEREAS, through a First Amendment to Redevelopment Agreement, dated May 13,
2004, the Developer, the City and the Authority extended the original deadline, under Section
8.1, for completion of the Phase II Contract Addendum of May 31, 2004,until December 31,
2004, and the deadline for providing pro formas, more detailed site plans and other Project
Element information to October 15, 2004; and
WHEREAS, the Developer has requested that the current deadline for completion of the
Phase II Contract Addendum be extended until June 30, 2005, and that the deadline for providing
pro formas, more detailed site plans and other Project Element information be extended to
[April 151, 2005.
NOW,THEREFORE, in consideration of the premises and the mutual obligations of the
parties hereto, each of them does hereby covenant and agree with the other as follows:
1. Section 8.1 of the Redevelopment Agreement is hereby amended to read as
follows:
"Section 8.1 Phase II Timing, General Contract Structure. The Developer has been
approved by the Authority to undertake Phase II of the Development,however the parties
acknowledge that certain issues remain to be resolved prior to commencement of Phase II. The
Developer has agreed to the Developer Fee Hold Back as provided in Section 11.5, as
consideration and evidence of Developer's good faith intent to proceed with Phase II. The
Parties shall proceed to resolve these issues and agree to enter into a supplement to this

Agreement (the "Phase II Contract Addendum") to establish all terms of the Phase II portion of
the Project not otherwise provided for herein. The Developer.and Authority shall enter into the
Phase II Contract Addendum as expeditiously as practical after further technical; financial and
legal analysis by the City Consultants of the Phase H Development, but in no event later than
June 30, 2005. Developer shall provide pro formas and more detailed site plans and other
Project Element information not later than [April 15], 2005, for at least the Phase IIA Senior
Housing Element and the Phase IIB Townhouse Element to allow finalization of this negotiation.
The dates herein shall be subject to extension by up to sixty(60) days on the Developer's
request,but any further extension shall be solely at the Authority's discretion. The Authority
and Developer agree that the Phase IIA Senior Housing Element and the Phase IIB Townhouse
Element shall be the first priority Elements to be undertaken in the Phase II Development."
2. Except as herein amended, other terms and provisions of the Redevelopment
Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the City, the Authority and Developer have caused this
Second Amendment to Redevelopment Agreement to be duly executed in their names and on
their behalf, all on or as of the date first above written.
