NORTH AREA) WHEREAS, the Cities of St.. Anthony and- Roseville desire to study the feasibility of storm. sewer improvements to a drainage area located in both cities in the vicinity of Anthony Lane North. Now, - Therefore; Be It Resolved -that the Mayor and City Manager are authorized.-to execute the Joint -Powers Agreement for Storm Sewer Feasibility Study on- behalf of the--City (attachment "All) Be It Further Resolved that the City Manager is directed. to obtain an acceptable proposal for engineering servicesto undertake the study, subject to approval by the City Council. Mayor ATTEST: ` C rk Reviewed for administration: Cit anager "A Attachment " JOINT POWER AGREEMENT FOR STORM SEWER FEASIBILITY STUDY THIS AGREEMENT, made and -entered' into .this day of , 1980, by and between the CITY OF ST. ANTHONY, a municipal corporation under the laws of the State of Minneso- ta, (hereinafter referred to as "St. Anthony") and the CITY OF ROSEVILLE, a municipal corporation under the laws of the State of Minnesota (hereinafter referred to as "Roseville" ) . RECITALS: 1. Roseville has issued a building permit to M-M Development-Corporation to construct an office/warehouse complex in Roseville on a portion of a tract of land in the South half of Section -5 , Township 29 , Range 23 lying North of Ramsey County Road C and adjoining the Easterly border of St. Anthony. 2. Storm water, run-off from the land to be developed is discharged into a ditch on the North side of Anthony Lane North in St. Anthony as it extends through the plat of St. Anthony Industrial Park. 3 . Development of said land will result in reduced ponding of storm waters on the land . in Roseville and may increase dis- charge of storm water to the adjoining property in St. Anthony. 4 . The parties deem it advisable to engage a consulting engineer to conduct a preliminary engineering study and to pre- pare a feasibility report as to the need for, and estimated cost of, a storm sewer system to deal with the run-off from • the land to be developed in Roseville and from other land in the same drainage area in both Roseville and St. Anthony • (hereinafter referred to as the "Feasibility Study") . 5.. It is the desire of Roseville and St. Anthony to obtain the Feasibility Study jointly, with St. Anthony coordi- nating the study and the cost thereof being shared equally by the two Cities. . 6. This agreement .sets forth the agreement between Roseville and St. Anthony for the Feasibility Study pursuant to the Joint Power Act, Minn. Stat. § 471.59. NOW, THEREFORE, in consideration of the mutual covenants herein contained, it is agreed by and between Roseville and St. Anthony, as follows : 1. Engineering work for the Feasibility Study shall be • done by a''mutually agreed upon consulting engineering firm. 2 . After agreement as to. -the engineering firm, St. Anthony shall forthwith cause the Feasibility Study to be conducted and an appropriate report to be prepared, and ,shall thereafter sub- mit the same to the City Councils for review as soon as possible. 3. Roseville and St. Anthony will supply all necessary information to the consulting .engineer for the completion of the Feasibility Study and will cooperate with the consulting engineer and each other to obtain the report as soon as possible. 4 . Each City' s decision to participate in the project shall be subject ,to any necessary public hearings and Council approvals. Neither City binds itself to proceed with a storm sewer project after the Feasibility Study -is completed. -2- 5. St. Anthony and its Public Works Department shall • act as the coordinator for the Feasibility Study. 6. ' All costs of the Feasibility Study shall be paid equally by Roseville and St. Anthony. 7 . . If the Citys proceed with a storm sewer project, a new joint powers agreement, or a supplement to this agree- ment , will be executed to cover the allocation of costs of the project. 8 . James Fornell for the City of St. Anthony and Charles Honchell for the City of Roseville are designated as the principal contact persons for the Citys. ANTHONY, MINNESOTA ANTHONY LANE STORM DRAINAGE BASED ON JOINT POWERS AGREEMENT WITH ROSEVILLE, MINNESOTA OUR FILE NO. 80100 City of St. Anthony , 3301 Silver Lake Road St. Anthony, Minnesota x Attention: Mr. Larry Hamer, Superintendent of Public Works j Pursuant to our recent conference with Mr. Larry Hamer, Superintendent of Public Works and Mr. Charles Horchell , Director of Public Works, Roseville; we are p'eased to submit herewith our proposal for engineering services for • investigation, study and report of surface drainage, located in both the cities of St. Anthony and Roseville. We are advised that this work is being performed for both St. Anthony and Roseville, authority being embraced in an inter-municipal joint powers agreement with St. Anthony functioning as the contracting agency therefor. The specific area of study i�, Anthony Lane within the City of St. Anthony and the drainage area within Di nage District 8 W (from Roseville 1962 Master Plan for Storm Sewers) discharging into St. Anthony. The area in Roseville lies- generally east of the city of St. Anthony, north of County Road "C" and west of. Williams Pipeline Company -storage farm. This- area is also southeasterly of Mn/DOT T.H. 88. STORM DRAINAGE - JOINT POWERS AGREEMENT The proposed engineering services consist of the investigation and study of surface drainage, storm water detention ponding and storage and underground conveyance tributary to an existing storm sewer located in County Road "C". • The proposed storm water detention pond is to be located within the city of 3 200 HILLSBOROUGH OFFICE BLDG 2353 RICE STREET • S-. PAUL, MINNESOTA 55113 PHONE (612) 484-0272 ,i t City of St. Anthony • July 7, 1980 Page 2 Roseville and any underground conveyance is to be located on Anthony Lane within the city of St. Anthony. The foregoing plan is to be presented in a bound report form with complete discussion, preliminary drawings, substantiating data, design basis and cal- culations together with cost estimates for the proposed facilities; including suggested proportion of cost sharing by each community. Our compensation for the above services shall be on the basis of 2.30 times payroll cost, mileage and out of pocket expenses. The hourly charge-out rate shall be based upon the attached schedule. 1 We estimate that the cost on the foregoing basis for services of this proposal to be Five Thousand Dollars ($5,000.00). It is understood that if the work to be performed is not completed upon reach- ing the cost estimated above, we will advise you as to the cost to complete the work. Under this proposal , St. Anthony and Roseville agree to make available to us and furnish us with all existing improvement information in the way of maps, records, plans, contours., profile studies, etc. which are available in respect to work undertaken herein. During the course of this study and investigation we are to attend any and all conferences deemed desirable and proper regarding this matter with officials of the city, state, and Rice Creek Watershed District, when authorized. It is to be specifically understood that engineering services in this proposal do not include the cost of laboratory analysis, the cost of boundary surveys or underground exploration of the subsurface conditions. No work in conjunction with plans and 1� specifications will be undertaken without further authorization. r ,II It is to be specifically understood that if we are authorized to make this study and report that work shall be completed within 90 days of notification to proceed with the work unless the scope of the work is enlarged and/or another completion date is mutually agreed upon. In summary, we shall consider this proposal an agreement between us upon its acceptance by you and your notification in writing to proceed therewith.
