Adopted this a 3sl day of � � , 1980 . ayor ell ATTEST: City Clerk Reviewed for administration: City Yanager • JOINT POWER AGREEMENT FOR RAILROAD SIGNAL THIS AGREEMENT, made and ent3red into this day of , 1980 , by and between the CITY OF ST. ANTHONY, a municipal corporation under the laws of the State of Minneso- ta, (hereinafter referred to as "St. Anthony" ) and the CITY OF -COLUMBIA HEIGHTS, a municipal corporation under the laws of the State of Minnesota (hereinafter referred to as "Columbia Heights" ) . RECITALS: A. The centerline of Stinson Boulevard extends along the boundary between St. Anthony and Columbia Heights (hereinafter referred to as the "Cities" ) . B. A railroad line which is located in both Cities extends across Stinson Boulevard near its intersection with 37th Avenue N.E. C. For traffic safety reasons, it is in the best interests, of both Cities to arrange for the installation of a new railroad signal with gates at the railroad crossing on Stinson Boulevard (hereinafter referred .to as the "Project" ) . D. . The cost of the Project is to be financed by federal funds for 90% of the cost and municipal funds for 10% of the cost. E. The Minnesota Department of Transportation (hereinafter referred to as .' DOT" ) is to enter into all contracts for the • Project and is to coordinate the Project. F. It is the desire of the Cities to obtain the Project jointly, with DOT coordinating .the Project and with 10% of the cost thereof being shared equally by the two Cities. G. This agreement sets forth the agreement between the Cities for the Project pursuant to the Joint Power Act, Minn. Stat. 471 . 59 . NOW, THEREFORE, in consideration •of the mutual covenants herein - contained, it is agreed by and between the Cities , as follows: 1 . The Project shall be installed by DOT as soon as possible and in accordance with the plans and specifications identified on Exhibit A attached hereto. 2 : The Cities will supply all necessary information to, and will cooperate with, DOT and each other to have the Project installed as soon as possible. 3 . DOT shall act as the coordinator for the Project. 4 . The loo municipal share of the cost of the Project shall be divided equally between- and shall be paid. equally by Columbia Heights and St. Anthony.
