A RESOLUTION ESTABLISHING A POLICY FOR
THE USE OF CITY RIGHT-OF-WAY FOR
RESIDENT GATHERINGS
WHEREAS, the City Council desires to establish a policy for the use
of City rights-of-way for legitimate purposes ,
NOW, THEREFORE, BE IT RESOLVED, that the use of City rights-of-way
is permitted subject to the following rules and regulations :
(1) The use of the right-of-way is permitted on a request basis ,
made at .least 30 days prior to the requested date , and subject
to City Council approval, by permit.
(2) A petition, signed by 4/5th's of the property owners abutting
the right-of-way must be presented to the City Clerk..
(3) Evidence of adequate insurance, naming the City of St. Anthony
as a Named Insured, shall be submitted to the City Clerk.
(4) Streets may be closed during daylight hours only or not after
10 : 00 -PF:M.
• (5) The right-of-way closing shall not exceed '6 hours in a 24
hour period.
(6) The use of any County road, M.S.A. road or other right-of-way
carrying sufficient volume, as determined by the Public Works
Director, shall be prohibited.
(7) The consumption of alcoholic .beverages in the right-of-way
is prohibited.'
(8) If non-resident attendance is anticipated, a .parking plan shall
be required.
(9) Applications are to be made by a sponsor who resides in a
dwelling abutting the right-of-way on such forms as may be
provided by the City and accompanied by a clean-up deposit
of $50 . 00 .
The applicant shall be responsible for the conduct of the
group and for the clean-up of any cans , bottles or debris
left by the .group. The clean-up deposit shall be returned to
the applicant only if the City is satisfied that all cans,
bottles and other debris from the activities of the group
were properly disposed of or removed.

(10) In granting or denying the permit, the Council shall consider
the type and size of the group for which the permit is
requested, the extent to which the group involves St. Anthony
residents and their use of City , right-of-way, the anticipated
effect upon other users of the right-of-way . and .upon adjacent
residential properties, the . likelihood of damage to public
and private .property, and any o.ther. facts' relevant to the
health, safety and .general welfare of the residents of
St. Anthony. The Council reserves the right to deny any per-
mit or to add conditions- to any. permit which it grants .
(11) Any permit granted .under this resolution shall*..be .subject to
immediate suspension or revocation for any false statement on
the application, for violation .of this or any City ordinance,
or for- other cause..
