Anthony , on May 11 , 1982 , reviewed the St. .Anthony Industrial . Park 2nd Addition Plat for - compliance with the. City 's platting regulations and so finding, a motion to approve the plat was carried unanimously. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony'- does approve by Resolution, St. Anthony Industrial Park 2nd Addition Plat. Adopted this day of 121Q 1982 .. St. Anthony City erk • • MEMORANDUM TO: Mayor, City Council and City Manager . of the City of St. Anthony RE: Proposed Plat of ,St. Anthony Industrial Park 2nd Addition DATE: May 10, 1982 We have reviewed the proposed plat of _St. Anthony .Industrial Park 2nd Addition and the title to the property being platted, as shown by Owner ' s. Duplicate Certificate of Title No. 401452, a copy of Certificate of Title No. 605481, and a title opinion from Lindquist & Vennum dated May 6, 1982 . The following are our conclusions with respect to the title and the plat: 1. TITLE. Based upon an examination of the plat and the above described evidence of .title, we conclude that: a. The record fee owners of the property described in the plat are Loren E. Swanson and Arlene M., Swanson, husband and wife. The plat correctly shows. them as owners. Certificate of Title No. -605481 covers Lot 4, except the southwest 45 feet thereof, Block 1 , St. Anthony Industrial Park, Certificate of Title No. 401452 covers Lot 5, Block 1 , . St. Anthony Industrial Park, and the title opinion covers the balance of the property (which is not Torrens) . b. Lot 5 was subject to a mortgage in favor of Mutual Trust Life Insurance Company and the mortgage appears as an encumbrance on Certificate of Title No. 401452 . We have examined a fully executed release of that mortgage, and have delivered it to the attorney for Mr. and Mrs. Swanson for registration. The mortgagee is not shown on the plat and need not be so long as the release is filed prior to the filing of the plat. C. Lots 4 and 5 are subject to certain restrictions and covenants relating to the land in' St. Anthony Industrial Park. d. Lot 5 is subject to an agreement dated June 9 , 1981, filed August 11 , 1981 as Document No. 1435923 between the City and the owners relating to main- tenance of an unopened portion of the street. • e. As shown in the Lindquist & Vennum title opinion (a copy of which is attached) , a portion of the most northerly parcel comprising the property being platted is subject to certain easements in favor of Northern States Power Company. f . We do not have completed information on real estate taxes and special assessments, but the owners will not be able to file the plat if there are any delinquencies . 2. PLAT CONTENT. We have the following comments with respect to the -proposed plat in consideration of the platting requirements of Minnesota Statutes, Chapter 505 , Section 330 of .the City' s Subdivision Ordinances, and, the requirements of Section 10 of the City' s Zoning Ordinance: a. The plat dedicates certain drainage and utility easements, and we assume that the City' s Public Works Department is satisfied that these. are adequate for the City' s purposes. b. Both lots meet the minimum lot size and lot frontage requirements. • c.. Staff indicates that the existing building on Lot 2 meets the required setback from the -north- easterly ortheasterly line of Lot 1. d. All of the property, including the triangular parcel at the north end of the plat, is zoned Light Industrial. e. When the proposed plat has been approved, it must be recorded by the owners within 30 days. A copy of the recorded plat should be furnished to the City, as required by the City's platting ordinance.
