HomeMy WebLinkAboutRES 82-030 RESOLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT NO. 1 PURSUANT TO THE PROVSIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMEMNT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 273.71 TO 273.78 INCLU Meeting Sheet IIIIII VIII VIII VIII VIII VIII IIII IIII 102590 Box: 23 Folder: RES 1982 Document: RES 82-030 RESOLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT NO. 1 PURSUANT TO THE PROVSIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMEMNT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 273.71 TO 273.78 INCLU RESOLUTION 82-030 A RESOLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT • NO. 1 PURSUANT TO THE PROVISIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMENT DISTRICT PURSUANT TO THE PRO- VISIONS OF SECTION 273 . 71 to .273 . 78 INCLUSIVE .OF THE MINNESOTA STATUTES (CHAPTER 322 , LAWS OF MINNESOTA, 19791 AND ADOPTING A REDEVELOPMENT PROGRAM AND FINANCE PLAN FOR SAID REDEVELOPEMENT/HOUSING AND TAX INCREMENT FINANCE DISTRICT WHEREAS , the City, .Council of the City of St. Anthony, Minnesota, has determined that - it is necessary and desirable in the public interest to designate , establish,. develop and administer a Redevelopment/Housing District in the City of St. Anthony, Minnesota, pursuant to the provisions of Section 46.2 of .the Minnesota Statutes ; and WHEREAS,, the Housing and Redevelopment Authority of St. Anthony, Minnesota (HRA)_. has now prepared. a Redevelopment Plan .for an urban renewal project for the. Kenzie Terrace area of St. Anthony, Minnesota (Project Area), .entitled Kenzie .Terrace Revitalization Program, dated May- 1981, and subsequent amendments. d.ated .June 1982 (the Plan) , part of which plan contains a .tax increment financing plan for a housing/ redevelopment district; and WHEREAS, the Plan has been prepared by the HRA with the cooperation and assistance ofthe appropriate City departments and the community task force; and WHEREAS , the Authority , by resolution. duly adopted at a meeting held • on June 28, 1982 ,. did approve- the Plan and did authorize application to the City Council of the Plan, including a statement .of the method proposed for financing the project proposed by the Plan; and a written opinion of the Planning Commission of the City of St. Anthony, dated June 15 , 1982; and WHEREAS , the application for -approval of the Plan has now been made to the .City Council, and the Plan, a. statement of the method proposed for financing the project proposed by the Plan, and the written opinion. of the Planning Commission have. now been duly submitted to the .Ci-ty. Council , and the City Council , on June 28, 1982 ,. duly held a .public hearing .on. the plan pursuant to published notice , all as required by Minnesota Statutes 462 . 521 and 273; and WHEREAS , the HRA may not proceed with the Plan unless the City Council , by resolution, makes certain findings with respect to. the project area and the tax increment plan and..approves the Plan; and WHEREAS, the City Council of the City of St. Anthony has determined that tax increment financing will be necessary to finance the public costs associated with the redevelopment/housing project within the tax increment district, pursuant to Minnesota Statutes 273. 71 to 273 . 78 , inclusive; and WHEREAS, the HRA has fully informed the members of said School Board • and Board of County Commissioners of the fiscal and economic implica- tions of the proposed housing/redevelopment district and. tax increment district; and -2- WHEREAS , at said public hearing, all persons and parties were given full opportunity to present written or oral testimony , comments , • objections , suggestions , and other matters , all of which were duly considered by the City Council; and WHEREAS,- the HRA is prepared for the revocation of individuals , families and businesses that may be displaced as a result of carrying out of this project; and WHEREAS , the tax increment financing .plan will afford maximum opportunity consistent with the sound needs of the municipality as a whole for the redevelopment of the district by private enterprise; and WHEREAS , the tax increment financing plans conforms to the general plan for the redevelopment -of the Kenzie Terrace areaand municipality as a whole; and WHEREAS , the City. Council of the City of St. Anthony , Minnesota, finds that the proposed tax increment financing district is a housing or redevelopment district, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. ANTHONY, does hereby designate and establish -Redevelopment District Number 1 and Housing- District Number 1- and a tax increment district, adopts a Finance Plan and Development - Program for said tax increment housing/redevelopment district and finds : (1) That the project comprising the proposed -tax increment financing district is a redevelopment project and/or housing project intended for the purpose of : (a) housing project, providing occupancy, in part, by persons or families of low and moderate income as defined in Chapter 462A, title II of the National Housing Act of 1934 , the National Housing .Act..of 1959 , the United . States Housing Act of 1937 , as amended , title .V of the Housing Act of 1949 , as amended, any other .similar present or future Federal , State or Municipal legislation, or the regulations promulgated under any of these acts . (b) a redevelopment project, , for the reason the land within this district is predominantly occupied by buildings , streets , utilities , and other improvements and where 200 of the build- ings have been found to be structurally substandard and where an . additional 300 of the buildings have been found to require substantial renovation or clearance in order to remove such existing conditions as : inadequate street layout; incompatible uses of- land or land use relationships ; over- crowding of buildings .on the land; obsolete buildings not suitable for improvement or conversion; , and other identified hazards to the health, safety and general well-being of the community as a whole. -3- (2)_ That the proposed redevelopment, in the opinion- of the City of St. Anthony City Council would - not occur solely through private investment within the reasonable . foreseeable future and, there-- fore , the use .of tax increment financing is deemed necessary; (3) That the tax increment financing plan conforms to the general plan for the development or redevelopment of the municipality as a whole; C41 That th.e tax increment financing plan will afford maximum opportunity consistent with the sound needs of the City of St. Anthony as a whole . for the development of the district by private enterprise; (5) That the City of St. Anthony -elects the method of tax increment computation set forth in Section 6 , . Subdivision 3 , Clause B. AND, - FURTHERMORE, that the ,City Council approves the tax increment financing plan. ADOPTED.
