HomeMy WebLinkAboutRES 85-016 REOSLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT NO. 2 PURSUANT TO THE PROVISIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMENT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 273.1 TO 273.78 INCLUS Meeting Sheet IIIIIIVIIIVIIIVIIIVIIIVIII IIIIIIII 102438 I Box: 23 Folder: RES 1985 Document: RES 85-016 REOSLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT NO. 2 PURSUANT TO THE PROVISIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMENT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 273.1 TO 273.78 INCLUS RESOLUTION 85=016 • A RESOLUTION TO DESIGNATE AND ESTABLISH A REDEVELOPMENT/HOUSING DISTRICT NO. 2 PURSUANT TO THE PROVISIONS OF SECTION 462 OF THE MINNESOTA STATUTES AND ESTABLISH A TAX INCREMENT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 273.71 TO 273.78 INCLUSIVE OF THE MINNESOTA STATUTES (.CHAPTER 322, LAWS OF MINNESOTA, 1979) AND ADOPTING A REDEVELOPMENT PROGRAM AND FINANCE PLAN FOR SAID REDEVELOPMENT/HOUSING AND TAX INCREMENT FINANCE DISTRICT WHEREAS, the City Council of the City of St. Anthony, Minnesota, has determined that it is necessary and desirable in the public interest to designate, establish., develop and administer a Redevelopment/Housing District in the City of St. Anthony, Minnesota, pursuant to the provisions of Section 462 of the Minnesota Statutes; and WHEREAS, the St. Anthony Housing and Redevelopment Authority, (HRA) has now prepared a Redevelopment Plan for an urban renewal project of the Old Highway Eight Redevelop- ment Area, dated January 3, 1985, ,(.the Plan) , part of which plan contains a tax increment financing plan for a housing/redevelopment district; and WHEREAS, the Plan has been prepared by the H.R.A. with the cooperation and assistance of the appropriate City departments and the community task force; and WHEREAS, the H.R.A. , by resolution duly adopted at a meeting held on February 12, 1.985, did approve the Plan and did authorize application to the City Council of the Plan, including a statement of the method proposed for financing the project proposed by the Plan, and a written opinion of the Planning Commission of the City of St. Anthony, dated January 15, 1985; and • WHEREAS, the application for approval of the Pl-an has now been made to the City Council , and the Plan, a statement of the method proposed for financing the project proposed by the Plan, and the written opinion of the Planning Commission have now been duly submitted to the City Council , and the City Council , on January 8, 1985, duly held a public hearing on the plan pursuant to published notice, all as required by Minnesota Statutes 462.521 and 273; and WHEREAS, the H.R.A. may not proceed with the Plan unless the City Council , by resolution,. .makes certain findings with respect to the project area and the tax increment plan and approves the Plan; and WHEREAS, the City Council of the City of St. Anthony has determined that tax incre- ment financing will be necessary to finance the public costs associated with the redevelopment/housing project within the tax increment district, pursuant to Minnesota Statutes 273.71 to 273.78, inclusive; and WHEREAS, the H.R.A. has fully informed the members of said School Board and Board of County Commissioners of -the fiscal and economic impl-i,cation's of the proposed housing/redevelopment district and tax increment district; and WHEREAS, at said public hearing, all persons and parties were given full opportunity to present written or oral testimony, comments, objections, suggestions, and other matters, all of which were duly considered by the City Council; and • WHEREAS, the HRA-is prepared for the relocation of individuals, families and businesses that may be displaced as a result of carrying out of this project; and i WHEREAS, the-.tax-increment financing plan will afford maximum opportunity consistent • with the sound needs of the municipality a's a whole for the redevelopment of the district by private enterprise; and WHEREAS, the tax increment- financing plan- conforms to the general plan for .the redevelopment- of the Old Highway Eight Redevelopment area and municipality as a whole; . and WHEREAS, the City Council of the City of St. Anthony, Minnesota_, finds that the proposed tax increment financing district is a housing or redevelopment district; NOW, THEREFORE, BE IT RESOLVED by the City Council of the.:.,City of St. Anthony, does hereby designate and establish Redevelopment District Number 2 and Housing District Number 2 and a tax increment district, adopts, a Finance Plan .and Develop- ment Program for said tax increment housing/redevelopment district and finds: 1 . That the project comprising the proposed tax increment financing district is a redevelopment project and/or housing project intended for the purpose of: Ca). housing project, providing occupancy, in part, by persons or families of low and moderate income .as defined in Chapter 462A, Title II of the National Housing Act of 1934, the National Housing Act of 1959, the United States Housing Act of 1937, as amended, Title V of the Housi.ng Act of 1949, as amended, any other .similar present or future Federal , ..-State or Municipal legislation, or t-he regulations promulgated-under any of these acts. Cb) a redevelopment project, for the reason the land within this district is • predominantly occupied by buildings, streets, 'uti'lities, or-..other- improve- ments and where 20% of_the buildings have been found to be structurally substandard and where an additional 30% of the buildings have been found to require substantial renovation or clearance in order to remove such existing conditions as: inadequate street layout; incompatible uses of land or land use relationships; overcrowding. of buildings on the land; obsolete buildings not suitable for improvement or conversion; and other identified hazards to the health, safety and general well-,=being of the community as a whole. 2. That the proposed redevelopment, in the opinion of the City of St. Anthony City Council would not occur solely through private investment within the reasonable foreseeable.future and, therefore, the use of tax increment financing is deemed necessary; 3. That the tax increment financing plan conforms to the general plan for the development or redevelopment of the municipality as a whole; 4. That the tax increment financing plan will afford maximum opportunity consistent with the sound needs of the City of St. Anthony as a whole for the development of the district by private enterprise; 5. That the City of St. Anthony elects the method of tax increment computation set forth in Section 6, Subdivision 3, Clause B. AND, FURTHERMORE, that .the City Council approves .the tax increment financing plan. -3- Adopted this 1 a day of F�ru.a rJ 1985.
