HomeMy WebLinkAboutRES 85-038 RESOLUTION RATIFYING ACTION OF CITY MANAGER, MAYOR AND SPECIAL COUNSEL IN PREPARING AND PRESENTING A CLAIM UNDER FEDERAL TORTS CLAIMS ACT AND NOTICE OF CLAIMS UNDER VARIOUS FEDERAL ENVIORNAMENTAL STATUTES Meeting Sheet IIIIIIVIIIVIIIVIIIVIIIVIIIIIIIIIII iozais Box: 23 Folder: RES 1985 Document: RES 85-038 RESOLUTION RATIFYING ACTION OF CITY MANAGER, MAYOR AND SPECIAL COUNSEL IN PREPARING AND PRESENTING A CLAIM UNDER FEDERAL TORTS CLAIMS ACT AND NOTICE OF CLAIMS UNDER VARIOUS FEDERAL ENVIORNAMENTAL STATUTES RESOLUTION 85-038 • A RESOLUTION RATIFYING ACTION OF CITY MANAGER, MAYOR AND SPECIAL COUNSEL IN PREPARING AND PRESENTING A CLAIM UNDER FEDERAL TORTS CLAIMS ACT AND NOTICE OF CLAIMS UNDER VARIOUS FEDERAL ENVIRONMENTAL STATUTES WHEREAS, the City of St. Anthony (."City") water supply has been determined to be contaminated by hazardous chemicals by the Minnesota Department of Health; and WHEREAS, the City has been directed by the Minnesota Department of Health to discontinue use of contaminated wells and to provide non-contaminated water to its citizens; and WHEREAS, the City has complied with the directions of the Minnesota Department of Health by closing a well and arranging for alternative water supplies; and WHEREAS, the City has expended City monies in responding to the groundwater con- tamination problem within the City and anticipates further related expenditures; and WHEREAS, federal statutes require notices of the City's claims to be made as a condition precedent to subsequent litigation relating to said claims; and WHEREAS, the City's attorneys in this matter, working with its Mayor and City Manager, have prepared and presented such notices of claims; and • WHEREAS, the Council has been advised of the extent of the groundwater problem as well as certain studies and investigative efforts undertaken by the Minnesota Pollution Control Agency and the United States Environmental Protection Agency indicati 'n'g -that the Twin City Army Ammunition Plant is a likely source of the contaminants found in the City's water supply; NOW, THEREFORE, be it resolved by the City Council of the City of St. Anthony hereby ratifies the actions of its attorneys, Briggs and Mortan, P.A.,, its City Manager, David M. Childs and its Mayor, Robert J. Sundland, in preparing and presenting a Claim and Notice of Claims on or about August 9;`, 1985 with regard to this matter.
