NOW, THEREFORE, BE IT RESOLVED that the- Mayor and City Manager are here- by authorized to execute the Amendment to Contract No. 32300-11839, reimbursing the City of St. Anthony in the amount of $26,509.21 for costs incurred for the "Roseville Connection". Mayor ATTEST: City Clerk Reviewed for administration: /v CA �( Ing. ac: -it-on: City Manager ,l J MINNESOTA POLLUTION CONTROL AGENCY NOT TO EXCEED $26,509.21 • City of St. Anthony AMENDMENT TO CONTRACT NO. 32300-11839 WHEREAS, on July 23, 1984,. the Minnesota Pollution Control Agency (STATE) and the City of St. Anthony (LOCAL UNIT) entered into an agreement identified as Contract No. 32300-11839 under which St. Anthony would construct an interconnection between the City of Roseville water supply system and the City of St. Anthony water supply system to restore the lost water supply from a contaminated St. Anthony municipal well ; and WHEREAS, Contract No. 32300-11839 provided $125.,000 to the LOCAL UNIT for the water supply interconnection; and WHEREAS, St. Anthony has incurred additional costs totaling $26,509.21 in supervision and construction of the water supply interconnection; and WHEREAS, the U.S. Environmental Protection Agency has approved the additional costs and has provided the STATE these funds through the fourth Cooperative Agreement. NOW, THEREFORE, it is agreed by and between the STATE and LOCAL UNIT that Contract No. 32300-11839 dated July 23, 1984 shall be amended as follows: Paragraph D.4 is amended to read: The LOCAL UNIT shall submit an invoice for the amount of the costs overruns incurred by the LOCAL UNIT for the water supply interconnection with the City of Roseville water supply system. The total obligation of the STATE for all compensation and reimbursements to the LOCAL UNIT shall not exceed twenty-six thousand five hundred nine dollars and twenty-one cents ($26,509.21). Paragraph F.3 is amended to read: This agreement shall be effective on the date it is executed as to • encumbrance by the Commissioner of Finance and shall be in effect until all payments of cost overruns have been paid. i -2- • IN WITNESS WHEREOF, the parties have caused this Amendment to Contract No-. 32300-11839 to be duly executed intending to be bound thereby.
