ANTHONY • RESOLUTION 86-014 A RESOLUTION ESTABLISHING PUBLIC IMPROVEMENTS ASSESSMENT POLICY FOR THE CITY OF ST. ANTHONY BE IT RESOLVED, that the City Council of the City of St. Anthony hereby authorizes the establishment of ,a public improvements assessment policy (attached to this resolution) for the City. ANTHONY PUBLIC IMPROVEMENTS ASSESSMENT POLICY February, 1986 In .order to insure that costs of public improvements such as streets, curb and gutter,;and `sewer_-_spare, char..ged:.i n .the most fair and equitable manner, the City Council of the City of St. Anthony has determined the following to be the Assessment Policy for the City. Section 2.1 . Curb, Gutter The cost of construction of curb and gutter will be charged in total on a per foot basis against the abutting property owner. Section 2.2. Streets All streets shall be assessed to abutting property owners on the following basis : Residential Streets a. Eight C8). foot width on the basis of the cost of a five (.5) ton • per axle capacity bituminous street', assessed directly to abutting property owner and anything over the eight (8) foot width or the five C.51 ton per axle capacity bituminous basis will be paid by the City of St. Anthony. b. The general method of assessment will be on a per front foot basis. In order to assure that costs are equitably assessed, however, it may be necessary for the City Council to assess on a per lot or square footage basis when special circumstances require it, i .e. , odd shaped lots on cul -de-sac or winding streets! c. The cost of street intersections and those portions of the street which abut alley right-of-way will be paid by the City of St. Anthony. Corner Lots On residential properties, the cost of street pavement will be paid by the property owner on the long side of said corner lot. The shorter side will be paid for by the City of St. Anthony. Non- residential corner lots will pay for both sides. Section 2.3. Sanitary Sewer Costs for sanitary sewer will be paid out of the sanitary sewer fund. Section 2.4 Watermains Costs for watermains will be paid for out of the water fund. �w Page 2 Section 2.5 Alleys The cost of construction or reconstruction of alleys shall be assessed to the abutti6g , property owner on aper foot basis. Section 2.6 Storm Sewers Costs for storm sewers will be assessed to the property owner on a square footage basis within the drainage area as established by the City Engineer. Section 2.7 General a. The assumed life expectancy of curb and gutter, and street surface shall be for a period of 20_ years_. ,_The City shall be responsible for general repair and maintenance, which is not a result of negligence of the property owner, during that time, but overlays of bituminous materials periodically required shall be assessed using this policy. b. The above policy statements supersede all previous assessment policy and will be in effect upon adoption by the Council and all storm and sanitary sewers, curb and gutter, and streets will be deemed to be new construction commencing upon the date they were originally installed. • c. In all new additions, all improvements shall conform with pro- visions of Section 330 of the City Code and all costs shall be borne by the developer. d. This is a policy guideline only and shall not constitute by reason of public knowledge or otherwise a contract or agreement binding upon the City of St. Anthony. e. The City within the extent permitted by law shall have full power to modify, change or abrogate any part or portion of these policy standards. f. It is the policy of the City that assessments shall be based on the special benefits to the properties assessed. Costs of public improvements will be assessed according to the provisions of this assessment policy only to the extent that the assessment on any property does not exceed the special benefit to that property. •
