A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER
TO EXECUTE THE PRELIMINARY ENGINEERING AGREEMENT
BETWEEN THE CITY OF ST. ANTHONY AND THE CITY OF
COLUMBIA HEIGHTS FOR STREET IMPROVEMENTS
WHEREAS, it has been determined that the intersection of 37th Avenue N.E.
and Stinson Boulevard N.E. is in need of certain street repairs; and
WHEREAS, said location lies within the Cities of. St. Anthony and Columbia
Heights; and
WHEREAS, it is advantageous to St. Anthony and Columbia Heights to share
the cost of such plans and repair.
NOW, THEREFORE, BE IT RESOLVED, the City Council hereby authorizes the
• Mayor and City Manager to execute the Agreement for Preliminary Engineering
between the City of St. Anthony and the City of Columbia Heights for street
improvements at the intersection of 37th Avenue N.E. and Stinson Boulevard
N.E. on behalf of the City of St. Anthony.

AGREEMENT FOR PRELIMINARY ENGINEERING
THIS AGREEMENT made and entered into this day
of , 1985 , by and between the City of Columbia
Heights , Minnesota, a municipal corporation , hereinafter called
"Columbia Heights" , and the City of St . Anthony, Minnesota, a
municipal corporation, hereinafter called "St . Anthony" .
WITNESSETH:
WHEREAS Columbia Heights has the facilities through its
Engineering Department to make complete surveys , prepare plans , and
prepare specifications , together with the necessary soil studies for
the proposed concrete panel replacement , slab jacking and joint/
crack sealing of the intersection of 37th Avenue North East and
Stinson Boulevard North East , and
WHEREAS it is advantageous to St . Anthony and Columbia Heights
to share the cost of such plans ,
NOW THEREFORE , it is hereby agreed :
( 1 ) Columbia Heights , in consideration of the provisions herein
contained , shall , through its City Engineer, make the necessary
engineering surveys and studies , assemble the necessary data, and
• prepare plans for the replacement of concrete panels , slab jacking
and joint/crack sealing of the intersection of 37th Avenue North
East and Stinson Boulevard North East .
(2) St . Anthony and Columbia Heights shall share the cost of
such plans based upon the percent of paved area in the intersection
contained within each city.
(3 ) That the estimated cost of the St . Anthony share of such
preliminary engineering is $500 .00 based on 1 .2% of the work being
in St . Anthony. The maximum cost of such preliminary engineering
will not exceed the M.S.A .S . guidelines establishing the maximum
reimbursable preliminary engineering costs . If it appears that the
actual cost of such preliminary engineering will exceed said
estimated cost , Columbia Heights shall immediately notify St .
Anthony in writing thereof. The City Council of St . Anthony agrees
to act on said notice 15 days of receipt , and after approval by the
City Council of St . Anthony and notification thereof to the City
Council of Columbia Heights , said action will have the effect of
amending this agreement so as to include a new estimated cost of
such preliminary engineering.

(4 ) St . Anthony agrees to pay its share to Columbia Heights in
the following manner :
(a) Partial payments shall be made not oftener
than once each month up to ninety percent
(90%) of St . Anthony share during the
progress of the work , covering the proportion
of the job completed in the previous month. The first
payment shall include the cost of work for preliminary
engineering completed between September 1 , 1985 , and
the signing of this agreement .
(b ) Final payment shall be made upon completion
of the work and its acceptance by the Minnesota
Department of Transportation , Director of State Aid .
(5 ) Before this agreement shall become binding and effective ,
it shall be approved by Resolution of the City Council of the City
of Columbia Heights and shall also be approved by Resolution of the
City Council of St . Anthony as the law may provide .
(6 ) If separate plans are needed for traffic signal repairs
• and/or installations along with any street lighting installations
said work shall be handled by resolution of each City Council .
(7 ) Each City Council shall approve construction plans and an
agreement for payment of construction costs including construction
engineering according to State Aid guidelines prior to commencement
of construction.
(8 ) Amendments to this agreement shall be approved by
resolution of each City Council .
(9) St . Anthony shall be liable only to Columbia Heights for
the share of preliminary engineering costs provided for in this
agreement . St . Anthony, its City Council , and the agents and
employees of the City, shall not be liable to the engineers or to
any other person , firm, or corporation for any claims , demands ,
damages , actions or causes of action arising out of this agreement .
Columbia Heights will hold St . Anthony and its City Council and the
agents , officers and employees of St . Anthony, harmless from all
claims , damages , demands , actions or causes of action arising out of
this agreement , together with all costs , disbursements and expenses
of defending the same .

IN TESTIMONY WHEREOF , the parties hereto have caused this
agreement to be executed in their behalf respectively, by their
proper officers thereunto duly authorized , and have caused their
corporate seals to be hereunto affixed as of the day and year first
above written .
