A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER
TO EXECUTE THE ACCESS AGREEMENT BETWEEN THE
MINNESOTA POLLUTION CONTROL AGENCY' AND THE.
CITY OF ST. ANTHONY
WHEREAS, the Minnesota Pollution Control Agency wants to install.
monitoring wells and sample ground water on the City property;
and
WHEREAS, the City is desirous of cooperating with the Agency in
the Agency' s effort to investigate ground water contamination.
NOW, THEREFORE, BE IT RESOLVED, the City Council hereby authorizes
the Mayor and City Manager to execute the Access Agreement Between .
the Minnesota Pollution Control Agency and the City of St. Anthony
• on behalf of the City.

ACCESS AGREEMENT
BETWEEN
MINNESOTA POLLUTION CONTROL AGENCY
CITY OF ST. ANTHONY
WHEREAS, the Minnesota Pollution Control Agency (Agency) has statutory
authority to enter upon public and private property for the purpose of
conducting surveys and investigations; and
WHEREAS, the Agency is conducting an investigation into ground water
contamination in the area of City of St. Anthony (City) property; and
WHEREAS, the Agency wants to install monitoring wells and sample ground
water on the City property; and
WHEREAS, the City is desirous of cooperating with the Agency in the Agency's
effort to investigate ground water contamination.
• NOW, THEREFORE, the Minnesota Pollution Control Agency and the City hereby
agree as follows:
1. The City of St. Anthony agrees:
a. That the Agency may have access to its property located at T29N,
R23W Sec 6 DDC for the purpose of conducting a ground water investigation.
b. That the Agency may install one (1) well on the City property
described above.
C. That the Agency may enter the City's property at reasonable hours
to conduct routine monitoring at the wells.
2. The Agency agrees:
a. That it shall not select sites for the monitoring wells on the
City property that unduly interfere with the City's normal use of the property.
b. That it shall notify the City at least three days in advance of
• the installing of any wells and of the location of such wells.

C. That it shall maintain all monitoring wells during the
investigation.
d. That it shall , upon expiration of this agreement or upon
completion of the investigation, whichever occurs first, abandon the wells in
accordance with the Minnesota Department of Health Well Code.
e. That it shall defend, indemnify and hold the City harmless from
any claims, suits or causes of action caused by or arising out of activities,
actions or inactions of the Agency, its agents, contractors or employees in the
construction, operation, maintenance or abandonment of the wells.
f. That it shall restore any grounds or property damaged or altered
in connection with the construction, operation, maintenance or abandonment of
the wells including, but without limiting the foregoing, the replacement of sod,
• removal of spoils, and restoration of grade.
3. This Access Agreement may be amended in writing upon agreement of the
parties.
4. This Access Agreement shall expire upon completion of the
investigation, although the Agency may elect to terminate the agreement at an
earlier data by giving written notice to the City and upon abandonment of the
wells.
