RESOLUTION 87-017
A RESOLUTION REGARDING A STREET WIDTH VARIANCE
GRANTED BY THE MINNESOTA DEPARTMENT OF
TRANSPORTATION TO THE CITY OF ST. ANTHONY
WHEREAS, the City of St. Anthony desires to reconstruct St.
Anthony Boulevard (MSAS 106 ) south from the BNRR Bridge to
Ridgeway Parkway with a 32 foot street section; and
WHEREAS, on April 2, 1987 a variance was granted by the
Commissioner of Transportation from the Minnesota Rule 8820.9912
to permit such a 32 foot street width with no parking instead of
the required width of 36 feet with no parking; and
WHEREAS, said variance was conditioned upon the City holding the
State harmless from any claims that arise as a result from such
variance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of St. Anthony that the City of St. Anthony hereby indemnifies,
saves and hold harmless the State of Minnesota and all its agents
and employees of and from -any and all claims, demands, actions or
• causes of actions of any nature or character arising out of or by
reason of , in any manner, the reconstruction of St. Anthony
Boulevard (MSAS 106) from a point south of the Burlington
Northern Railroad Bridge to Ridgeway Parkway in any other manner
than as a 36 foot wide street with no parking in accordance with
Minnesota Rule 8820.9912 and further agrees to defend at its sole
cost and expense any action or proceeding commenced for the
purpose of asserting any claim of whatsoever character arising as
a result of granting this variance.
