RESOLUTION VACATING A PART OF TWO STREETS
AND A PORTION OF EASEMENT
After discussion of a motion by Councilmembers
to vacate a part of Wilson Street, a part of Coolidge
Street and certain easements located in a portion of vacated
Harding Street, but to retain drainage and utility easements
in the portion of Coolidge Street vacated, it was deemed
in the interest of the public to grant the vacations. Council
member Ranallo introduced the
following resolution and moved its adoption:
BE IT HEREBY RESOLVED by the City Council of the City
of St. Anthony that the following described properties
are hereby declared and ordered vacated and discontinued:
(1) That part of Wilson Street as dedicated
in "St. Anthony Village Commercial Center
Addition No. 1" lying between the extensions
across it of the south line and Northwesterly
line of Block 5 in said plat.
(2) That part of Coolidge Street as dedicated
in "St. Anthony Village Commercial Center
Addition No. 1" described as follows :
Beginning -at the Southeast corner of Lot 3,
Block 4 in said plat; thence on an assumed
bearing of east on the easterly extension
of the south line of said Lot 3 a distance
of 30. 00 feet to the centerline of said
Coolidge Street; thence North 0 degrees
34 minutes 00 seconds West along said
. centerline 51. 32 feet; thence North 32
degrees 59 minutes 23 seconds West to the
West line of said Coolidge Street; thence
South -0 degrees 34 minutes 00 seconds East
along said west line to the point of
beginning; excepting, and reserving and
retaining unto -the City of St. Anthony,
an easement for drainage and utility purposes
in, under and across that part of Coolidge
Street herein described.
( 3) That part of the utility easement as described
in Document Nos. 3447185, 3483350 and 3184.160
and modified by Document No.. 5076605 lying
• within vacated Harding street and lying north
of the north line of Lowry Ave. N.E. and lying
south of the following described line: Commencing
at the intersection of the centerline of Coolidge
Street N.E. and the easterly extension of
the south line of Lot 3, Block 4, "St. Anthony
Village Commercial Center Addition No. 1" ;
thence North O degrees 34 minutes 00 seconds.
West along said centerline 51. 32 feet; thence
North 32 degrees 59 minutes 23 seconds West
288.06 feet; thence North 62 degrees 17 minutes
37 seconds West 89. 12 feet to the actual point
of beginning of the line to be herein- described;
thence South 51 degrees 26 minutes 00 seconds
West 88. 70 feet; thence North 38 degrees 34
minutes 00 seconds- West 85.99 feet and there
terminating;
provided, however, that vacation of the utility
easement referred to in this paragraph (3)
shall not be effective until the granting
of a new utility easement acceptable to the
City and relocation of a sanitary sewer line
from the vacated easement to the new easement.
And that the City Clerk be directed to prepare and present
to the proper county offices notice of said vacations.
The motion for adoption of the foregoing resolution
was seconded by Councilmember Marks
and upon . a .vote being taken, thereon, the following
voted in favor thereof: Ranallo Marks Su dl
and Makowske , and the following voted
against same: none
Whereupon the resolution is duly passed and adopted.
Adopted this 22nd day of Novem er 1988.
