Present: Dougherty, Skovran, Hansen, Rosinek, Coulter,, Di.Carlo Absent: Rocks The Chairman announced that this was the time and place to hold a public hearing on the request for the rezoning of the property described as follows: An area bounded on the Horth by 34th Ave. N.E., on the South by 33rd Ave. N.E., on the Westlb-y Stinson Blvd, and on the East by the West Line of Registered Land Survey No. 2119 excluding the following described par'- cels: Registered Land Survey No. 196; the South 228.3 feet of the West 198 feet of the Northwest 1/4 of Section 69 the North 150 feet of the South 660 feet of the West 133 feet of the Northwest 1/4 of Section 6. The requested change is from- the present contercial zoning to multiple dwelling zoning. , Also ,requested is. a variance, from_ the ,land area requirements in Ordinance No. 66. Mr. Wargo, representing Century Capital, Inc., presented the proposed de- velopment. The Chairman opened the hearing for discussion. Twenty-two property owners who were within 100 feet of the, area in question, were notified of the hearing. Of the twenty-two, eleven- were opposed to the rezoning,. 10 were not present at the hearing, and one was deceased. After .hear ing ail the continents from the floor the hearing was closed. It was moved by Coulter to recommend the Council grant the request for the area requirement variance and the .request for the zoning variance on the following basis: 1. The property in question is presently zoned commercial. The request to change the zoning to ,mu.ltiple dwelling would ,be a substantial up-grading of the use of this p-1.rrerty. A multiple dwelling complex such as the one proposed by . Century Cap--*.al, Inc. would constitute. the highest and best use for this property and would'be more 's.n keeping with the surrounding development. 2. A multiple dwelling complex of this size would be of great benefit to the over all Village tax structure. 3. The proposed complex. would be a marked improvement over the present. • use of this property. 4. The fireproof construction of these buildings would decrease the possibility of fire even in this complex with a _higher density of 'units. Page 1 of 2. 9 • 5. The complex uses only 19% of total land area for building purposes, which leaves 81% to be used for parking and recreation area. This appears to be more than adequate to permit a substantial distance between buildings to provide ventilation and sizable yard areas. The motion was seconded by DiCarlo. Voting: Aye: DiCar10, Coulter, Rosinek, Skovran, Hansen Nay: Dougherty Motion Carried Keith Harstad appeared with a revised preliminary plat of Harstad's Addition on the Northwest corner of Silver Lake Road and Silver Lane. The revised plat contained lots which were all larger than .the minimum size as set forth in Platting Ordinance No. 62. Mr. Harstad presented a petition for rezoning the two lots fronting_ on Silver Lake Road from R-1 Single Family zoning to R-2 Two Fami IV. It was moved by Coulter and seconded by DiCarlo to hold a public hearing on the proposed rezoning at the regular Planning Board meeting of May 20; 1963. • All in favor. Motion Carried The Board examined the revised proposed plat of the .Truchinski Addition, located on 37th Ave. N.E. between Belden Drive and Coolidge St. N.E.. All the lots were of the minimum size as required by Platting Ordinance No. 62. It was moved by Hansen, seconded by Coulter to approve the preliminary plat of the Truchinski Addition. All in favor. Motion Carried Moved by DiCarlo, seconded by Hansen to adjourn. All in favor. Motion Carried Stanley A. Peickert Secretary
