VILLAGE OF ST. ANTHONY
PLANNING BOARD MINUTES
NOVEH3SR 18, 19,65,
1 . CALL TO ORDER
The regular meeting of the St. Anthony Village Planning Board was called to
oder by Chairman Fro--tem, Springer on Thursday, November 18, 1965 at 6:50 P.M.
2. ROLL CALL
The following members were present :
Springer, Englund, Howitz, Mesenbring, DiCarlo (in at ]:10 P,H. )
Absent:
Coulter, Emond
also present was acting Planning Board Secretary, James Shaughnessy
3. MINUTES
Upon motion by Howitz seconded by Mesenbring, it was moved to waive reading
and to approve minutes of the regular meet1 ng of October 19, 1965 and the
special meeting of November 9, 1965•
All in favor. Motion Carried.

5. ORDINANCE VARIATIONS
a. Mr„ Dan 3urrill from the State Bank of St. Anthony Village presented
his request to erect an U' x 20 non-conforming billboard sign on the triangular
parte, of land on Kenzie Terrace between between St. Anthony Firestone garage
and the American Legion building. (The parcel is zoned residential ).
Mr,. Burrill explained the sign he wants to erect has been removed from a
plot the highway right-of-way recently took.
Moved by Howitz seconded by Englund to recommend to the Council to deny
the request on the basis that a commercial sign would tend to establish a
comn;ercial use and trend on a lot presently zoned residential .
All in favor. Motion Carried.

b.
2-b. Mr. Sohoroajick of Rodney Billman Inc. presented a request for a 1 foot
. variance in overhang length on a house at 3005 - 36th Avenue. The house has
a 5 foot side yard and a normal 2 foot overhang but also has a 2 foot extension
of the normal overhang. If the extension is removed, it could possibly destroy
the semetrics of this house.
Mr. Dillman uas informed by a letter dated September 17, 1965 from the
wilding Inspector than the house is in violation.
Mr. Sohorowic!< further pointed out the structure on the adjoining property
is approximately 60 feet from this common property line. Adjoining property
owner, Dan Burrill , displGyed his disapproval of granting a variance.
Moved by DiCarlo seconded by Englund to recommend to the Council to approve
the variance request of 1 foot in overhang length.
Voting on the motion:
Aye: DiCarlo, Englund, Mesenbring
Nay: Howitz
The motion carried.
c. Mr. Leo Hertog presented for Ronald Hertog his request or a 15 foot
asministrative platting variance in corner lot frontage and an eight foot
variance in back yard requirements at 2615 - 32nd Avenue N.E. Mr. Hertog is
requesting to divide Lot 3 (50' x 150' )in half adding 25 feet to Lots 2 and 4,
Block 6, Clark and Kings Hennepin Garden. This would result in two 75 foot x
150 foot lots replacing these 50 x 150 foot lots.
Mr. Hertog feels a 75 foot lot is in keeping with the neighborhood and an
0 foot back yard variance is the minimum possible variance while maintaining
30 foot corner lot street set backs and a 17 foot back yard.
Moved by Howitz seconded by DiCarlo to recommend to the Council to grant a
15 foot variance in corner lot frontage and an 8 foot bac!: yard variance.
All in favor. Motion Carried.
A recess was declared at 7:40 P.ii.
The joint meeting of the Village Council - Planning Board commenced at 8:00 P.M.
Council members present:
McNulty, Bailey, Erickson, Dougherty
Absent: Sorenson

Mr. Ronald Kaliszewski, a representative of the Department of Business
Development which administers the 701 Planning Program, was in attendance to
explain 701 Federal Grants and their possible application to St. Anthony Village.
Mr. Kaliszeviski outlined proper procedures including interviewing of
Planning Consultants, establishment of wort: programs, financing, submitting
of work programs, and cost for approval, etc.
Mr. Kaliszewski further explained the limitations and coverage of 701
Grants, and the wide range and variety of needs that can be satisfied under a
comprehensive plan. The comprehensive plan is not limited to but may include
land use studies, traffic studies, population studies, municipal services and
program studies from which the Planning Board and Council can be guided to
make sound decisions.
A question and answer period followed.
The joint meeting was adjourned at 9:30 P.M.
At 9:34 P.M. the regular meeting of the Planning Board reconvened.
Moved by Englund seconded by Howitz to recommend to the Village Council
to initiate a 701 program by interviewing at a joint Planning Board-Council
meeting representatives of Midwest Planning and Research Inc. and of Mason,
Law, Wihrman, and Knight.

h. ZONING VARIATIONS
None
7. OLD BUSINESS
James Shaughnessy, Building Inspector, presented revised rough draft copy
of proposed sign ordinance.
Moved by Howitz seconded by Di Carlo for for the members to take copies of
sign ordinance home for individual attention and to attend a special meeting
for the ordinance discussion. The meeting is to be held Tuesday, November 23rd
at 7:pp P.M.
All in favor. Motion Carried.

The Planning Board's acting secretary, James Shaughnessy, indicated he left
messages for Mr. Anderson of the New Brighton Planning Commission regarding
Ngw Brighton's invitation for St. Anthony 's attendance at the Group No. S
;rater-Community Planninc Group. The New Brighton meeting was scheduled for the
same day and time as the reoular St. Anthony Planning Board meeting.

ORDINANCE NO.
• AN ORDINANCE REGULATING AND PRESCRIBING
PROCEDURE FOR ISSUANCE OF SIGN PERMIT.
PURPOSE
The purpose of this ordinance is to provide for necessary visual communica-
tion to preserve and promote a pleasant physical environment to protect public
and private property, and to encourage safety upon the streets and highways
within the Village of St. Anthony, by regulating the type, number, structure, size,
location, height, lighting and the erecting and maintenance of all sign and
sign structures within said Village.
DEFINITIONS
Advertising Sign
A sign which attracts attention to any person, place, service, item or
activity.
Billboard Sign
An advertising sign located off the premises where the advertised product
is sold or offered.
Business and Identification Signs
Any sign which directs attention to an occupancy entertainment, service,
profession, business, or activity conducted upon the premises.
Banner Sign
To include all banners pennants, or similar display
signs.
Identification Sign
A sign, the primary function of which is to identify a
commercial , industrial , or public or semi-public use located upon the premises
where such sign is located, or to which such sign is affixed. Signs identifying
commercial uses may call attention to the product, service, or activity that
is sold or offered upon the premises. Signs identifying industrial uses may
call attention to the product, goods or material which is produced, processed,
assembled or stored upon the premises.
Pylon Sinn
Any free standing sign not attached or affixed in any manner to any structure
or object.
Roof Sign
Any sign projecting above th.e eave line of a structure to which it is
affixed.
Illumina�—'d Siqn
A sic^ illuminated in any manner either internally, externally, or re-
flectively, so as to attract attention by producing a greater degree of
illuminaAion than nature.
Flashing Sign
Any illuminates: sign on which the artificial light is not maintained
constant in intensity and color at all times when such sign is in use.

Directorial Sign
• A sign for the purpose of marking specific commercial , industrial or public
locations known as to assist in finding these locations.
Portable Sign
A sign so designed as to be movable from one location to another, and
not permanently attached to the ground or any structure.
Painted Siqn
A sign which is painted directly on the face of buildings, fences, or
other structures as opposed to a message painted on a sign surface.
Temporary Sign
A sign which is erected or displayed for a limited period of time.
Sign Structure
The supports, uprights, bracing, and frame work for a sign including the
sign surface itself.
In the case of a sign structure consisting of two or more sides, when the
angle formed between any of the sides exceeds 15 degrees each side shall be
considered a separate sign structure.
Sign, Gross Surface Area Of
The entire area within a single continuous perimeter enclosing the extreme
limits of the complete message of any sign, which limits shall include the
surface on which the message is affixed unless the individual letters of the
message are affixed directly to the surface of a wall in which case the maximum
height and width shall apply. Such perimeter shall not include any structural
elements lying outside the limits of the sign surface which do not form an
integral part of the sign message. In the case of a free-standing or projecting
sign with two back: to back surfaces, each surface may equal the allowable
gross sign area.
Walt Sian
A sion which is affixed to the front, rear, or side wall of a building and
lies parallel to the building wall .
GENERAL PROVISIONS
A. General Requirements Pertaining to all Districts
1 . The time limit for the display of temporary signs shall be eight weeks
unless otherwise provided for by this ordinance or by determination of the
Village Council . In general , the criteria for the Council to determine such time
limit shall be an equitable balance between the need for the sign and the general
. welfare of the community.
2. The owner, leasee, or manager of any ground sign for which a permit has
been issued, and the owner of the land on which the same is located, shall
keep grass or weeds and other growth cut, and debris and rubbish cleaned up and
removed from the on which the sign is located.
3. Any sign or Sinn structure which may be, or may hereafter become, rotted,
unsafe or unsightly shall be repaired or removed by the licensee, owner, or
manager of the property upon which the sign s'-ands upon written notice of the
Building Ir;spector or Village Police Off icer.

B.
3-B. Prohibited Signs
• 1. Signs that, by reason of position, shape or color, would interfere with
the proper function of a traffic sign or signal, or otherwise constitute a
traffic hazard.
2. Signs within the public right-of-way or easement except for traffic control
signs.
3. Signs that resemb a any official marker erected by a governmental agency or
that display such words as "Stop" or "Danger".
4. There shall be no use of revolving beacons, zip flashers, flashing signs
or similar device that would distract automobile traffic as to constitute
a safety hazard.
5. Pennants and stringers except for grand openings and then not to exceed two
continuous weeks.
6. Signs that are tacked, posted, painted or otherwise affixed to the wells of
buildings or on trees, fences, poles or other structures not considered
to he sign structures.
7. Billboard signs.
C. Permitted Siqns Reguirinq 'No Permit
l: Free-standing political signs for a period of not more than sixty (60) days
before and ten (10) days after an election provided such signs are less than
fifteen (15) square feet in area.
2. Signs located on, above or beside entrances or exits to buildings, or
driveways that direct pedestrians such as "employees entrance", "exit only",
and 'office" provided that such signs are less than five (5) square feet in area.
3. Signs denoting the architect, engineer or contractor when placed upon
work under construction and not exceeding twenty five (25) square feet in
area,
4. Memorial signs or tablets, names of buildings and date of erection when cut
into any masonry surface or when constructed of bronze or other non-
combustible material and be attached to the building, providing such signs are
less than 4 square feet.
5. One name plate sign for each dwelling which shall not exceed one and one
half square feet ( 1-1/2) in area per surface and no sign shall be so constructed
as to have more than two surfaces. Such sign may indicate the name of occupant,
address of the occupant and the type of occupation.
6. Traffic control sic:ts, non-commercial municipal signs, legal notices, and
temporary non-advertising danger or emergency signs.
7. Bannars in co;ivtiercially zoned areas not to exceed fcur ;4) weeks duration.
8. Temporary advertising signs painted on a display window or attached/Ehereto
in commercial or industrial zoned areas.
9. Flags, or insignia of any government or governmental agency, or of any
civic, charitable, religious, patriotic, fraternal or similar organization.
10. Real Estaie ,signs ;as . fol iow r
a. Temporary signs for the purpose of selling or leasing individual
lots or residential buildings provided that such signs are less than
five (5) square feet. Such sign or signs shall be no closer than ten (10)
fees_ to side lot line,.
b. One temporary sign for the purpose of leasing non-residential or
multiple family development space less than sixteen (16) square feet in
area, providing that such sign shall be not closer than ten (10) feet
to any lot line.

ST_GNS REQUIRING A PERMIT
Areas zoned commercial
One sign peg- store or business frontage.
One small sign below canopy.
30 sq. ft. plus : sq. ft. for each ICO sq. ft, of retail floor area
for all other business signs, height not to exceed 6 feet above highest
outside or parapet, with a maximum sign size of 130 sq. ft.
Areas zoned Light industrial
1 sq. ft. for every 100 sq. ft. of ground floor space up to 300 sq. ft.
of total sign area with not over 1 per frontage with a maximum heighth
of 6 feet above highest outside wall, or parapet.
A sign not to exceed fifty (50)ft. shall be permitted 20 feet in front
of the building.
STANDARD FOR VARIANCES AND NON-CONFORMING USES
Standard for Variances
The Village Council may vary the regulations of this ordinance when support-
ing evidence in each specific case indicates that:
1. A particular hardship to the owner would resu It if the strict letter of the
regulations viere carried out.
2. The conditions upon which the petition for a variance is based are unique
to the parcel of land for which the variance is sought and one not applicable,
generally, to other property within the same land use classification.
3. The granting of the variance will not be detrimental to the public welfare
or injurious to other property in the neighborhood
Non Conforming Signs
Signs legally existing on the effective date of this ordinance which do not
conform to the requirements set forth in this ordinance shall become a non-
conforming use.
1 . Non-conforming temporary signs shall comply with the requirements of this
ordinance within 12 months.
2. Non-conforming permanent signs shall be allowed to continue but shall not
be rebuilt, altered or relocated without being brought into compliance
with the requirements of this ordinance.
i 3. Any new signs for non-conforming land uses, where sign permits are re-
quired, shall be a special use and must conform to the requirements for
a special sign permit.
ADMINISTRATION
Responsible Official
It shall be the responsibility of the Building Inspector to cause the
requirements of this ordinance to be properly enforced and to administer the same.
Records
1. The Building Inspector shall maintain a record of all signs now existing
or hereafter erected for which a permit is required under this ordinance.

Permits:
1 . Ho sign shall hereafter be erected, re-erected or altered unless a permit
for the same has been issued by the Building Inspector except as provided
by this ordinance. In addition, electrical permits shall be obtained for
electric signs .
2. Application for a sign permit shall be made in writing upon forms furnished
by the Building Inspector. Such application shall contain the location by
street and number of the proposed sign structure, as viell as the name and
address of the owner and the sign contractor, or erector. The Building
Inspector may require filing of plans or other pertinent information where,
in his opinion, such information is necessary to insure compliance with
this ordinance.
Inspections
All signs for t•ihich a permit is required shall be subject to inspection by
the Building Inspector or his duly authorized representative who, upon presenta-
tion of proper credentials, may enter at reasonable times any structure or
premises within the Village to perform his duty.
1 . Footing inspections shall be required for all free-standing signs
before erections.
2. Electrical inspections shall be required for all electric signs before
erection.
3. The Building Inspector shall make a periodic inspection of all signs to
insure compliance with this ordinance.
