ANTHONY PLANNING COMk4ISSION MINUTES • June 15 , 1982 The meeting was called to. order by Judy Makowske., Chairman Pro Tem, at 7 : 30 P.M. Present. for roll call: . Zawislak, Makowske, Bjorklund, and Sopcinski . Absent.: Jones , Bowerman, Peterson. Also present:, Ron Berg, Administrative Assistant. The following- was an addition to .the minutes for the May 18th Commission meeting: Page 1, para. 13 : Insert "was opened by Chairman Jones" at the end of the paragraph. Motion by Mr. Bjorklund. and' seconded by Mr. . Zawislak to approve as amended the minutes for the P.lanning .Commission meeting held May 18 , 1982 . Motion carried unanimously . Mr. Zawislak will..represent the Commission at: the next Council meeting , • June 22nd. Mr. Berg distributed ..a copy of the letter he had written to Craig Morris stating Mr. "Morris ' non-compliance .to his agreement to have his shop at 3909 Silver Lake Road- lit only during business hours and said he had attached ,all pertinent. minute references. to this letter. Mr. Peterson arrived at 7 : 34 P.M. At 7: 35 P .M. , the Chairman. Pro Tem: -opened the public hearing, which had been rescheduled, on the -Thompson variance request for a garage addition at ..3302 Belden Drive. Mr.. Berg confirmed that the notice of the hearing had been remailed . to all affected property owners within 200 feet of the property in question and- the applicant had paid an additionalfee of $15 to .cover ..the renotification,- costs . No one was present to report failure to,- receive the .notice or to object to its contents . Orville and Phyllis Thompson .were .present ..to discuss the garage addition they propose to construction the .sou.th.: side .of their existing home and to give the reasons they believe justify the granting of a seven foot frontyard setback variance to the ordinance requirement for 30 foot frontyards which are in alignment with other homes on the same street for the addition. • In the statement which accompanied his application for a variance, Mr. Thompson- had .cited the extraordinary: circumstances. he believes satisfy the conditions set by City Ordinance for- granting such vari- ances . He reiterated that his plans had been drawn in an attempt to -2- remain- as close as possible to .the Ordinance requirements and, at the same time , replace his existing one car garage with another which will • accommodate both a full and a compact size vehicle andwill make his home more .livable . . The applicant said -he had . showed the plans for the project to the neighbbrs on -either side of him and neither had expressed opposition to his proposal. . Mrs . - Thompson added that an existing bath- room on the same. side of the ,hous.e as the garage prevented them from building the garage into the existing structure . It.was noted- by those present that there was a discrepancy between the 1956 survey of this property and the actual. measurements taken in Mrs . Makowske ' s presence because the- survey. indicated .there should only be. 45 feet between the existing garage and the curbline _on Belden where the measurement was 54 feet for the same distance. Mr. Sopcinski wondered -whether, with the survey figures , .the Thompsons might need more .than a seven foot variance for the .sixteen foot addition- and Mr... Zawislak speculated that, if the survey is accurate,. Belden might not have. been centered correctly when it was built. He asked Mr. Thompson how he would react to losing between - nine to, 15 . feet of front yard, if the City should decide to center Belden when - that street is resurfaced. Mr. Bjorklund said he lives a block away on .Roosevelt Street and has the only two-car garage on that .street,* He perceives that, if any of his neighbors should decide to ..use the Thompson precedent to enlarge their own- garages , these protrusions . might ruin his .view down the street and could diminish the value of his property. However , Mr. Bjorklund later conceded that in the case of Belden , the natural curvature of the .street -might prevent .the, proposed garage from inter- fering .with the sightline for- Mr.: Thompson's neighbors '.. Mr. Zawislak • reported he had visited the site .and a casual. siting .down the block had convinced him,_that-. thengarage-:addition; as proposed, would cause no visual problems for the -Thompsons ' neighbors . Mr. Thompsonresponded by indicating he believes "each variance should stand on its own merits However,, he indicated hewouldnot be happy to lose from nine to 15 feet of - front yard in the event Belden is relocated. The hearing was closed at 8:20 P.M. Mr. Sopcinski and Mr. _Peterson .then attempted to write a motion of approval which would address the confusion over the actual measure- ments of the Thompson-' s front .yard and .the. City ' s right-of-way along Belden. They included the conclusion that the- circumstances might be unique because "on a curvature, of the- nature o.f ' this one , the effect of a protruding addition is less 'detrimen.tal to the adjacent property than on a straight street" . The meeting was - recessed .at 8 : 35. P.M. and when: reconvened at 8 : 50 P.M. , Mr. Thompson indicated he agreed that it' would :be reasonable to have staff help him take accurate measurements using a stake to the rear of the property as a reference point, before .the Commission .makes a final decision related to a recommendation to the Council. Mr. Sopcinski , with concurrence of the second., withdrew his motion -and moved to table the request instead. -3- Motion by Mr. Sopcinski and seconded -by Mr. Zawislak. to .table action on the request from Orville Thompson.. for a. seven. foot front yard setback • variance to the City Ordinance requirements until the discrepancies .in the measurements ,for Lot 13 , Block 1 , Belden Terrace Second Addition have been cleared up. Motion carried unanimously. Copies of the general .construction .specifics submitted .by Teleprompter in their bid to provide'. Cable T-.V. service. to St. Anthony had been included in the. agenda packet by Mr. Berg who reported the appearance of the Teleprompter representative before the Commission had been rescheduled for July. 20th. The.. Administrative Assistant will have a portion. of the proposed Sign .Ordinance retyped for that meeting. Dick Krier of Westwood Planning and Engineering , Inc. ,. the firm who had been awarded - the contract to serve as the management consultants for the Kenzie Terrace Revitalization Program, reported the latest" legislation governing ..the establishment of Tax Increment Financing districts .which goes into-effect July 1st.. He told the Commission he believes it would be to the City ' s advantage to- declare the T.I .F. districts before that date and suggested more than one- district be declared fbr the properties involved. Mr._ Krier told the Commission members the .only -action required .of them at that time was to formally accept the Redevelopment Plan. as. conforming- to the City 's Comprehensive Plan and the consultant distributed copies of the proposed resolution which will accomplish.. that-, He also confirmed that . creating more than one T. I.F. district would cost the City no more than one . Motion by Mr. Bjorklund .and seconded by Mr. Sopcinski to adopt Resolution PC-82-.01 with two of the sections rewritten as follows : 4 .- The project .area is subject to .conditions: that have prevented private development or redeve'lopmen_t• without governmental assistance and financial. aid proposed by the Plan; 6 . The objectives and .purpose of the -plan conform to, and are consistent with, the City of St. . Anthony ' s .Comprehensive. Plan .and planning objectives previously, from. time to- time , established by the Planning Commission of the City .of St. Anthony for the development of the project area. Motion carried unanimously.
