PLANNING COMMISSION MINUTES
October 15, 1985
1 The meeting was opened at 7:35 P.M. by Chair Pro Tem Hansen with less than the
2 required number of members to make a quorum.

4 Present for roll call: Hansen, Bowerman, and Madden.

6 Absent: Bjorklund (.who arrived at 7:41 -P.M. ) , Jones, Wagner and Franzese.

8 Also -present: David Childs, City Manager.

l0 The Manager indicated all matters to be considered that evening required only con-
11 cept reviews and therefore informal question and answer procedures would probably
12 be in order. Commissioner Bowerman said he perceived the parliamentary procedures
13 related to order of speaking might eliminate confusion, but agreed the Commission' s
14 usual procedures related to the development of motions might not be necessary.

16 Commissioner Madden will report the minutes of the Commission meeting to the Council
17 at their October 22nd meeting.

19 Commissioner Madden, noting the lack of a quorum, said he hoped he wouldn't have
20 to sit through a repetition of the same ,information in this case as he had the time
21 he had attended a special work session called by the Council an hour before a
22 regular Planning Commission meeting to provide an opportunity for all interested
23 parties to question the developer about proposed changes in the Kenzington project,
24 and the Commission said, had to sit through an exhaustive repetition of the same
25 materials for..the benefit of some Commissioners who had failed to attend the
26 special hearing. Commissioner Bowerman indicated he perceived this case might be
27 a little different because the Commissioners had been alerted to the matters which
28 would be considered through their agenda packets where he knew some of the Com-
29 missioners the evening in question had failed to attend the -special session just
30 because they had overlooked the tag attached to their agendas which informed them
31 that special meeting was scheduled.

33 The Commissioners had been advised in..the Manager' s October 11th memorandum that
34 representatives of the Nativity Lutheran Church across Silver .Lake Road from the
35 City Hall would be seeking the Commission' s initial reactions to the church's
36 expansion plans which were scheduled to be given a formal hearing by the Commission
37 in November. Mr. Childs had mistakenly given the wrong deadline for application
38 so that the notice of hearing on the project could be publicized in a timely manner,
39 thus delaying any official hearing until November. Since the agenda had been
40 mailed to the Commission, the plans had been modified to meet the concerns of the
41 closest neighbor to the church in such a manner as to require only a conditional
42 use permit for the project.

44 Commissioner Bjorklund arrived at 7:41 P.M. , just as the informal discussion with
45 the project proponents had begun.

1 The Manager had. advised in his memorandum the concerns of Richard Porter, whose
2 home at 3329 Belden Drive is located immediatelyadjacent to the parking lot
3 behind the church about the City- granting a variance for a vestibule and entry-
4 way addition which would encroach beyond the required 25 foot setback closest
5 to his own property. Mr. Porter was present and indicated the plans had been
6 redrawn. to avoid that encroachment. He said .he would be agreeable to the proposed
7 addition-as long as runoff from the .new -str.uctures is diverted down to Belden and
8 away from his property, saying with the structure- standing 16 feet higher than his
9 property, he would probably have more problems with the drainage from the church's
10 property than he had ,in the past when at one time he had ended up with three or
11 four inches of mud in his basement.

13 Mr. Porter also said he hoped the church would require no stronger lighting than
14 is now provided by the floodlight he perceives provides adequate security for that
15. area now.

17 John Hensel , 3317 Belden Drive and -another churchmember, Richard Carlson, 3509
18 Maplewood Drive, the contractor, along with the architect, Paul Erickson, 4901
19 Olson Highway, answered questions put to -them by the Commissioners related to the
20 new addition, the elevator which-Mr. Hensel said would take impaired parishioners
21 to the second level , and the 60 space parking lot whichthe -church plans to con-
22 struct on the property .it owns south of the church on Silver Lake Road from the
23 existing older home would be removed.

25 Mr. Carlson told Mr. Porter .the church was also interested 'in providing_ a drain-
26 age system which would protect their -lower-'f,l;oorr rooms"from:any seepage. Mr.
• 27 Hensel said the plans had been modified to maintain at least the required 25 foot
28 setbacks all around the building. He also. said the church .pastors were hoping
29 the improvements on the back of the building and provision for parking along
30 Silver Lake Road would encourage those parishioners (who some Commissioners had
31 indicated were adding to the congestion in the Park View parking lots evenings
32 when there are a lot of activities including official City meetings going on in
33 that building) to park across the street where they could avoid having to cross

36 There were some suggestions from Commissioners on how the curb cuts for the parking
37 lot could be relocated to enhance the use of 33rd Avenue for an exit but Commissioner
38 Bowerman indicated he perceived three stacking spaces before the stop sign would
39 be adequate.

41 A poll of the Commissioners indicated all would generally favor the project as
42 presented and Commissioner Bjorklund said he especially appreciated having the
43 church address a perceived parking problem.

45 Motion by Commissioner Bjorklund and seconded by Commissioner Bowerman to approve
46 as submitted the minutes of the Planning Commission meeting held September 17,
47 1985.

49 Motion carried unanimously.

51 The Commission gave no encouragement to Kenneth and Charleene Johnson, 1927
•
52 Simpson, Roseville, to proceed with their suggestion that the existing signage on
53 the Hardee's Restaurant they own at 4004 Silver Lake Road be replaced with a larger
54 pylon sign. The Johnson's were instead urged to gett -a more current version of the
55 City Sign Ordinance than they had that evening which, Commissioner Bowerman said,
56 had been madewrittento be more restrictive to keep Silver' Lake Road from becoming

1 a "si.gn heaven" like Central Avenue and. to -consider a- typeof ground hugging,
2 monument-like sign similar to those the City had granted variances for in the same
3 business area.

. 5 Mr. Johnson indicated he would consult a sign company regarding a sign which might
6 beater conform to the City Ordinance, and at the same time, would provide the
7 instant identification a fast food operation needs to .compete.

9 Eddie Fuerstenberg of King's Brian Construction Company, who is .building homes in
10 the Johnson Manor Addition was present and Mr. Childs indicated had been referred
11 back to the Planning Commission by the Council members the contractor had con-
12 tacted 'regarding a two foot tradeoff between two of the newly platted lots.
13 The Manager said he was seeking Commission direction related to the possibility of
14 transferring two feet of land from Lot 9, which is 80.95 feet wide to Lot 8 which
15 is 75 -feet -wide,, to provide -a better. fit.for the house Dan. Kramer. wants Mr.
16 Fuerstenberg to bui-ld on the latter .lot. No final agreements had been signed with
17 the prospective buyer for Lot 9 who had sent away for a house pl�an,"_ th_e contractor
18 said and Mr. Childs indicated he would be. consulting the City Attorney to see what
19 the City could do to expedite matters so the Kramer house could be started before
20 winter sets in.

22 Motion by Commissioner Bowerman and seconded by Commissioner Bjorklund to indicate
23 to the Council that the Commission is in agreement with the concept of transferring
24 two feet of land from Lot 9 in the Johnson proje- ct 'to Lot 8 being cognizant that
25 the Council would have to take any serious objections to the split, which might
26 be raised at the public hearing, into consideration before approving it.

28 In accepting this concept, the Commission finds that: (1 ) the proposed lot
29 split would result in lots of more equal, size in the project.; ,(2) the change would
30 only bea minor one; and, (3)- by permitting the lot split, the City would be
31 expediting the redevelopment of this tornado damaged addition.

33 Motion carried unanimously.

35 Commissioners Hansen and Madden indicated an interest in attending the Annual
36 Planning Institute for Planning Commissioners and elected officials November 22nd
37 and the Chair Pro Tem' said Chair Franzese had told him.she might also be interested-
38 in going to another institute having found the first one so informative. The
39 Manager said there was also an advanced institute planned for next spring and
40 invited the Commissioners to let him know if they wanted him to make reservations
41 for the fall seminar.

43 There was a short discussion of the progress being made on numerous building pro-
44 jects throughout the City, including the Chandler Place apartments which, Mr.
45 Childs said, would hopefully start November lst. ' He also reported the Commissioners
46 would be considering at their November meeting the zoning- changes necessary for
47 Bernard •Blanske to construct townhomes on the corner of Silver Lake Road and
48 Silver Lane.

50 The Chair Pro Tem reported the Legion had signed papers transferring their building
51 to the Kenzington developers and Mr. Childs speculated that the meeting the Council
• 52 had scheduled with Arkand and META might shed light on their intentions about the
53 use of that property.

55 Motion by Commissioner Bowerman and seconded by Chair Pro Tem Hansen to adjourn the
56 meeting at 8:59 P.M.
