Childs, City Manager - P ------------------------------------------------------------------------ SUMMARY DISCUSSION OF SUBJECT: This is a reques for P.U.D. approval from Arkell Developmen ;ar,& Walker-Methodist Homes for a 4 unit 202 Senior Rental Project to be located o 55,00 square feet south of Kenzie Terrace on the present site of g the Mimosa Restaurant. This proposal must comply with both the P.U. D. ordinance and the minimum improvements section of our Redevelopment Agreement with Arkell Develop- s ment. Areas of non-compliance with the Redevelopers Agreement include: t 1 . Wood, rather than brick exterior. 2. Building is not sprinkled. l 3. 15 parking spaces rather than 45 are provided. These items do not .conform because in the Redevelopers Agreement , the concept was originally for a 5 story building. Because of HUD regulations, the building must be designed as presented 'without a number of extra amenities to be eligible for funding. Review with respect to the P.U.D. requirements shows that a 17' setback is provided on the southeast side of the building (25 ' is required) . Density is 35 units per acre (much less than Phase 1 ) . 45 units are proposed and without P.U.D. approval, 23 would be allowed in R-4 zoning. The building meets the height and parking require- ments of the ordinance. Unit size is 540 square feet, which is less than the 650 square feet required in R-4 zoning. RECOMMENDATION: Staff recommends approval of the P.U.D. as proposed unless the Com- mission has modifications they wish to recommend. ATTACHMENTS : X PlanApplication Form X Mailing List. Although he has enough parking, the spaces on the north side (40 spaces) must be at least 20 feet from the abutting property, so a variance would be needed. Three persons have called and/or written. Two are against. One who seems favorable sent the attached letter. RECOM:IENDATION: The general plan provides for this to be mid-density residential . Although the conditional use could be granted, I do not recommend approval of the change in zoning, which effectively presents the project, if zoning is denied.' ANTHONY NOTICE OF MEETING The Planning Commission of the City of St. Anthony will meet at 8 :00 P.M. , Tuesday, April 3, 1984 in the Council Chambers in the St. Anthony Village Community Center, 3301 Silver Lake Road (enter northeast door) to consider a revised site plan regarding . the Good Luck Cafe, located at the corner of 27th Avenue N.E. and Coolidge Street. Mr. Simon Kwong proposes remodeling and expanding the current restaurant facility to a restaurant containing 2 ,440 square feet • with seating for 84 persons. The existing canopy will be removed and 29 parking stalls wil-1 be provided. The applicant requests a zoning change from R-1 (Single Family Residential) to C (.General Commercial), for the north half of his property. The southern half is already a commercial zone. The applicant also requests approval of a conditional use permit which is required for the establishment or major expansion of a restaurant located within 250 feet of a residential structure or zone. In addition, provision of seating for .84 persons requires 39 spaces and the applicant proposes 29 spaces, but has indicated the desire to reduce the seating design capacity of the building to 64 seats , which would mean - that adequate parking is available. NE St. Anthony, MN 55418 Dear Mr. Childs: Within the past week the enclosed arrived by mail. It would appear that Mr. Kwong continues to be serious with his plans to expand the Good Luck Cafe. When the last proposal for remodeling was presented to the Planning Commission and the City Council, I wrote, as a • concerned neighborhood property owner, to voice my objections to the zoning varience required to allow the expansion and remodeling. Since I see nothing in Mr. Kwong' s new proposal to im- prove the potential situation, I am writing to again urge that the zoning varience be denied. Expansion of the Good Luck Cafe will encroach, by phys- ical proximity, by cooking odors, by refuse production, and by increased traffic , on adjacent residential property and the residential tranquility and stability thereof. The in- clusion. in this newest proposal, for the sale of beer and wine bodes further ill for the neighborhood. Such introduces the potential for introduction of a disruptive element. I continue to be unimpressed with the volume of business done by the establishment -in question. Again, I must raise the spectre of an abandoned premisis should the expanded oper- ation fail. The erection of a sign on the roof of the remodeled build- ing will provide visual pollution that the neighborhood does not need. Mr. Kwong points out that a portion of the current premi- ses lies within residential zoning. Perhaps the better alter- native is rezone the commercial portion of the property as residential regardless of the consequences. 2. Approving the requested zoning varience to allow -expan- sion of the Good Luck Cafe will inevitably decrease property values in the neighborhood and will work to the detriment of the majority. I must strongly encourage the Planning Commission and the Council to deny any varience. After the last Planning Commission meeting I was able to research some of the suggestions made during that meeting. 1 . Word processor for City Planning records, etc. (not fundable) . 2. Know Your City booklet (OK only if majority of booklet deals with information and programs available only to low and moderate income persons) . 3. Sidewalks (Based on discussions with county staff, it would be extremely difficult to prove direct benefit to low and moderate income persons on 37th Avenue from Silver Lake Road to Stinson or on Stinson from 39th to Apache Medical Center. 4. Entrance signs to the City (again difficult to prove direct benefit to low and moderate incomes) . I. have met with representatives of Walker-Methodist Homes , the sponsor Arkell has chosen for the Kenzie 202 Elderly Rental Housing Project: They have requested that the $29,600 available be allocated to a no interest loan to them to allow them to, provide amenities in the building to make it more in keeping with the architecture of the community. H.U.D. will find a basic, bare-bones project, so the $30,000 would be welcome assistance to Walker-Methodist.
