2 6. PUBLIC HEARINGS:

4 A. 7:35 P.M. Nedegaard Construction for Evergreen Townhomes,
5 3412 Silver Lane, sign variance.

7 The hearing was opened at 7:35 with no one present reporting failure to
8 receive the notice of hearing or objecting to its content.
9
10 Assistant to the City Manager VanderHeyden reported the Evergreen
11 Townhomes signs have been reduced in size and the Nedegaard Company is
12 asking to place one sign each on four different monuments. In addition, if
13 approval is recommended of the four signs, the consideration would be for
14 -the aggregate sign surface area allowed which is 150 sq. ft., Nedegaard is
15 requesting 200 sq. ft.

17 With regard to monuments and sign height, City Attorney, Bill Soth, said that
18 if the. monument were not approved as a sign they would then have to be
19 considered as part of the fence. VanderHeyden met with City Manage Tom
20 Burt and Public Works Director, Larry Hamer, and reported that Nedegaard
21 was allowed to build the monuments originally because of the Parade of
22 Homes with the understanding that unless a sign variance was given, it
23 would be the Company's responsibility to remove or move them. Nedegaard
24 agreed.
25 Whether they are allowed a sign variance will be decided at the City Council
26 meeting next week.

28 Regarding the fence height, VanderHeyden said she, Burt and Hamer called it
29 a front yard setback. She added that it should not have been called a front
30 yard setback because it does not sit on the front yard of any townhome, it is
31 on the side yard and back yard. In addition, by calling it a front, back or
32 side yard setback or a setback from the right-of-way, she said it is all a 30
33 foot setback: therefore, it does not change what was necessary. It is serviced
34 by an internal roadway. All the way around it is outside. It is a back or side
35 yard setback and not a front yard setback.

37 For clarification, Hansen sketched his.interpretation of front yard.
38 VanderHeyden commented that the roadway is a private drive. Discussion
39 continued regarding the decision of whether the area in question is a "front
40 yard." VanderHeyden said that she, Burt and Hamer made the
41 determination because of the way the fence runs along the back and side
42 yards and in no way physically runs along the front of one of the
43 townhomes. VanderHeyden also confirmed that that issue is not before

1 them during this meeting; but that the three would meet again to review the
2 problem.

4 Madden asked if Burt decided not to attend Planning Commission meetings.
5 VanderHeyden confirmed that was the understanding.when she was hired.

7 Brownell added that sig months ago there was lengthy discussion regarding
8 the determination of "front yard."

10 Faust wanted to know whether the fence issue had ever been brought up
11 before. Madden said he brought up the issue that there was a significant
12 drop-off from street level down to the grade inside the townhouse complex.
13 His concern was for pedestrians who could be endangered. Because the
14 basement was put in incorrectly, there was a variance request for setback.
15 Madden suggested that a fence be added. VanderHeyden said that a fence is
16 required by the State Housing Code.

18 Brownell clarified that the request is.for a sign and the structure is a sign.
19 VanderHeyden said that this is referred to as the sign surface area. In this
20 case, Brownell pointed out, the facia of this monument is considered the
21 surface area--not the other three sides.

23 Hansen said the only other single side examples would be signs on surfaces
24 of buildings.

26 Public hearing opened at 7:47.

28 David Newman from Nedegaard Construction Co. said the signs are aesthetic
29 and attractive in appearance. To his knowledge no one opposes the signs.
30 Newman maintained that the hardship exists with 37 property owners who
31 should have signs at the two driveways entering the property. The signs
32 will not be lit. Because the monuments are distinctive, Newman said they
33 are part of the effort to achieve a neighborhood effect.

35 Madden reminded Newman that addresses should not be included.on signs
36 at the entrances of the horseshoe roadway. He said that should a request
37 come back asking for addresses, the initial variance would then be null and
38 void. Newman said that from his experience, there is no need for addresses.

40 Werenicz found a discrepancy in measurements. Newman assured the
41 Commissioners that the Company would prefer to be a bit under what was
42 stated in- size. Werenicz said the importance of whether the measurement is
43 50 or 43 sq. ft. for the plans makes a difference in whether the discussion is

1 about 4 monuments, 3 monuments: and I or 2 variances to grant. If the 4
2 are not allowed, it may not even be an issue.

'6 Hansen said the issue is the way the signs are placed, not the number of
7 signs. These signs are not visible at night and are difficult to see. He feels
8 he is being asked to approve a monument which may violate the fence
9 height. He also disagrees with the neighborhood identification and is more
10 inclined to like the open space. Although Hansen is not opposed to the 4
11 signs and square footage,. he is also opposed to the way the signs will be
12 placed and their interpretation as a sign. In fact, he said they could be a
13 safety hazard because of poor visibility.

15 Faust said he reviewed the questions and supports the variance. First, the
16 variance is not going to be detrimental to anybody. Second, while it may not
17 be a hardship to the Company, the residents probably want the area marked.
18 Third, with regard to being unique to this project, Faust said that the
19 arrangement is aesthetically correct.

21 Werenicz said it is not unique and he is totally opposed to 4 signs. He also
22 believes the other driveway needs to be marked. He does agree that it is
23 aesthetically pleasing. Autumn Woods only needed 2 signs because theirs
24 were angled.

26 Brownell said he had the same problem with 4 signs and agreed with 2 signs.
27 However, then he said there would be a question as to what to do with the
28 other sides of the monument.

30 Murphy agreed with Faust that the 3 conditions are present for granting a
31 variance.

33 Madden agreed that the monuments are pleasing, symmetrical and meet the
34 3 conditions.

36 VanderHeyden clarified that if only 2 signs are approved, the monument
37 would have to be dealt with as part of the fence.

39 Motion by Madden , second by Faust.that the Planning Commission
40 recommend to the Council that Nedegaard Construction Company, 1814
41 Northdale Blvd., Coon Rapids, be granted a variance to put up 4 signs, 50" x
42 20" for a total of 8.65 sq. ft. each, total sign surface area being 34.6 sq. ft.
43 which is below the 50 sq. ft. allotted by the City Ordinance, finding that no

1 one appeared in opposition and finding further that the 3 questions required
2 by the Ordinance have been answered correctly. In addition, if the owners
3 should come back for an additional variance for more signs, that the
4 additional variance be declared null and void and that the Company be
5 required to make a new application.

9 Motion failed.

11 Werenicz said his idea would be a compromise. He cannot see having 2
12 identical monuments at another driveway one block away that is half,the
13 width of that driveway. He would not mind a third, angled monument being
14 placed there.

16 Hansen said there is a better sign and that is why he disagrees with the
17 proposal. The signs cannot be seen and they are virtually impossible to see
18 at night.

20 Werenicz said that 2 entrances do not justify 4 monuments 10 ft. high.

22 Faust did not agree with using Autumn Woods, a much larger complex, as a
23 comparison. He said the proposal is good with the 37 full-time residents and
24 has an inviting application to the City because it borders on New Brighton.
25 He does not think it would add any balance to have 3. In fact, Faust said one
26 at the second entrance would make it appear as a lower or service entrance
27 vs. a main entrance. He did agree that the measurements need to be
28 corrected.

30 Murphy said 2 signs is the variance. The question, he said, is whether the
31 community is being harmed in any way by approving the 2 additional signs.

33 Hansen said there is a difference between granting 2 or 4 signs and likened
34 driving through downtown Crystal with the Las Vegas strip. He also said
35 that this same developer came back to the City for an additional variance.

37 Madden said that the positioning of the signs should be the privilege of the
38 developer.

40 Murphy questioned whether the Company would consider coming back with
41 other plans.

1 Brownell suggested the compromise of moving the monument without the
2 sign to the far eastern end of the property to satisfy the hardship question.
3 Madden said this would not change his mind from his original position.

5 Werenicz said he still believes the vote is 3/3. Madden indicated he did not
6 believe 3 signs would look as nice; but he would consider compromising on 3
7 signs. Faust said that 3 are good, four are better.

9 7. MISCELLANEOUS

11 Planning Institute
12 The Planning Institute will be held on January 26 at the Holiday Inn, North.
13 Murphy,or Madden, Brownell, Werenicz and Faust will attend.

15 Cellular Phones
16 Franzese reported to Madden that there is a problem in some suburbs with
17 aerials being put up for celluar phone systems. Without protections, these
18 suburbs are finding high aerials erected that they did not know were going
19 up. VanderHeyden said she would check whether the City had any
20 protections or-permissions regarding this issue.

22 Agenda
23 Chairman Madden said that he preferred not to have approval of the
24 Agenda. He would like the Commissioners to add any item at any time to the
25 Agenda.

27 Marquette Bank sign
28 Brownell asked if there was a sign request from Marquette Bank.
29 VanderHeyden said-that the City has been contacted for information.

31 Action requested on unsafe house
32 Hansen wants something to be done with Pirino's house that was moved into
33 the neighborhood. The house is not safe; and they are not conforming to City
34 codes. VanderHeyden said letters have been sent and the building inspector
35 has been working with them. Hansen is also concerned because they were
36 given a certificate of occupancy which means the house is safe for living.

39 Correction to Council minutes
40 Faust said that in the October 23 Regular Council Meeting minutes, he did not
41 go to the Meeting and make the comment on page-5, line 18. Tom Burt made
42 the comment and agreed to make the correction.

SIGN VARIANCE
TO WHOM IT MAY CONCERN:
Notice is hereby given that there will be a public hearing by the Planning Commission of the
City of St. Anthony on Tuesday, February 19, 1991 at 7:35 P.M.. Public Hearings are held
in the Council Chambers of the City Hall, 3301 Silver Lake Road (enter northeast corner
of the building). The Planning Commission will meet to:
Consider a request by Marquette Bank, Sixth and Marquette, Minneapolis, MN 55480, for
a variance to the City Sign Ordinance to allow two additional signs at the bank located at
3928 Silver Lake Road.
Each sign is 4.75 feet X 25.58 feet for a total of 121.5 square feet. The variance.request for
the two additional signs totals 243 square feet.
Anyone wishing to be heard with reference to the above matter will be heard at said time
and place. Questions regarding this matter may be referred to the City Manager, 789-8881.

Marquette Bank of.N4inneapolis is requesting a variance to the St. Anthony sign ordinance to place
two additional signs at the bank located at 3925 Silver Lake Road (formerly Midwest Federal).
Each sign is 4.75 feet X 25.55 feet or 121.5 square feet. The variance request for the two additional
signs totals 243 square feet. The City sign ordinance allows for one identification sign, up to 150
square feet, per commercial establishment.
Midwest Federal had three signs at the location previous to the current sign ordinance. The
building was damaged by the tornado and Midwest.Federal was therefore allowed to replace the
three signs \,.ithout obtaining a variance.
Marquette Bank believes the three signs are necessary because of the bank's location on a corner
and the building's round structure.
If Marquette Bank obtains approval of the variance, the total signage at the Bank \\ill.be 364.5
square feet.
Staff Recommendation
Staff believes two signs would adequately identify the bank location.

Manager, may erect and maintain a r-aximum of three directional
signs on municipal rights-of-way ; provided, that no church may
erect or maintain more than one such sign at any intersection.
b. The following signs are allowed in a "B" Service Office Limited
Business District and "C" Comercial Districts and may be
erected after obtaining a permit and paying required license
fee as duly set by the Council from time to time :

1 . )One identification sign per co,-nercial establishment , having
not more than 2 square feet of surface area per lineal foot
of business frontage, up to a maximum of 1.50 square feet ;
provided that the total area of all wall signs affixed to a
wall shall not exceed 15% of the total area of that wall .
2. A gasoline station shall be allowed, in addition to all other
authorized signs , one pylon sign to identify the gasoline
brand, which shall not exceed 30 feet in height and which shall
have a mininum clearance of 12 feet from the basic grade
level to the lowest element of the sign surface and which
shall not exceed 50 square feet in sign surface area. Such
an estallishr,ent shall also be allowed one price sign , not
to exceed 8 square feet in sign surface area, for each
frontage having a curb cut. Such freestanding sign and
price signs shall be in addition to those signs allowed in
Part b. (1 ) of this Subdivision.
3. Subject to approval of the Council . a shopping center may
be allowed a pylon sign not exceeding 300 square feet in
sign surface area.
4. A commercial establishment located within a shopping center,
having no outside frontage, shall be allowed a surface sign
area of one-half of that which it would be allowed if it
had outside frontage.
5. Cornercial establishments shall be allowed, in addition to
all other authorized signs , one historical identification
symbol , not exceeding 5 square feet in sign surface area.
c. The fol ]owing signs are permitted in a Light Industrial District
and may be erected after obtaining a permit and paying re-
quired license fee as duly set by the Council from time to time.
1 . One business or identification canopy or wall sign per tenant
as regulated In part b. (1 ) of this Subdivision or one
freestanding sign as regulated and permitted in 430:40,
Subd. 6.
2. In a district zoned for light industrial businesses , signs
containing one square foot for every 100 square feet of
ground floor space shall be allowed up to a total sign
surface area of 150 square feet.
