For purposes of this Section, "fence" means a partition, structure, wall or gate erected as a dividing marker, barrier, enclosure or visual obstruction, but excluding buildings and bushes, hedges, trees and other living landscaping. 1320.02 Building Permits Required. A building permit is required for the construction or alteration of a fence, and for any additions to a fence. The permit must be obtained in the name of the owner of the property on which the fence is or will be located. Application must be made on forms provided by the City. The applicant must provide the Building Inspector with a set of plans and specifications for the fence. Permit fees must be paid in accordance with the Uniform Building Code. 1320.03 Requirements. Subd. 1. Location. Any fence constructed or altered after June 3, 1982 must be located entirely upon the private property of the owner to whom the building permit was issued. Ownership of the permit passes with ownership of the property. The fence must be set back a distance from the owner's property line sufficient to avoid encroachment onto adjoining private or public property or a public right-of-way. Subd. 2. Abutting Public Property. If a fence is or is to be adjacent to a street, alley, public right-of-way or other public property, the City may require the applicant for the permit to locate and mark the property line abutting the public property by having a registered surveyor place permanent survey pins or stakes on the property line. If the survey information is not available and the applicant elects not to establish the property line by survey, the permit will not be issued unless the applicant signs an affidavit stating that the applicant is the owner of the premises upon which the fence exists or is to be located. The proposed changes are as follows: Subdivision 2 1. Height of ground signs increase from 5 feet to 8 feet. Subdivision 3 1. One copy surface - 34 square feet 2. Two copy surface, 68 square feet 3. Two copy surface, 80 feet for one structure with two or more businesses. 4. Removed those provisions relating to bonuses. Miscellaneous changes • CITY OF'ST. ANTHONY CODE OF ORDINANCES The City Council of the City of St. Anthony hereby ordains: Section 1. Section 1400.00 Signs will be amended as follows: 1400.04 Definitions. For the purposes of this Chapter, the following terms have the meanings given them in this Section: Subd. 11. Ground Sign. Subd. 1. ,Al2plication. An owner of property with an existing structure which does not comply with the Zoning Code, or of property on which such a structure is proposed to be constructed, may apply for a variance upon payment of the fee speca.fied in Subsection 615.07. Subd. 2. Council A�or� Variances to the dimensional provisions of the Zoning Code may be granted by the Council upon recommendation of the Board of Adjustments and Appeals, after a hearing is held by the Board of Adjustments and Appeals. Variances will not be granted with respect to uses. A majority affirmative vote of Council members present is required to approve a variance. Subd. 3. Evidence. No variance will be granted unless the evidence presented discloses all of the following facts: (a) The subject matter of the application is within the scope of this Subsection. (b) Strict enforcement would cause undue hardship because: (1) The property cannot be put to a reasonable use without the variance. (2) The circumstances causing the hardship were not created by the owner. (3) The variance, if granted, will not alter the essential character of the locality. (4) Economic considerations alone are not the basis of the hardship. (c) The circumstances causing the hardship are unique to the individual property under consideration. (d) The granting of the variance is in keeping with the spirit and intent of the Zoning Code. Subd. 4. Planning Commission Recommendation. The Planning Commission will consider the application at a public hearing at any regular or special meeting. Notice for the hearing will be given in accordance with Section 115. The Planning Commission, sitting as the Board of Adjustments and Appeals, will make a recommendation to the Council as follows: (a) Recommend that the variance application be granted because the evidence considered at the meeting supports each of the findings required under Subdivision 3 of this Subsection. 1647 (b) Recommend that the variance application be denied because the applicant did not present sufficient evidence for the Planning Commission to make all of the findings required under Subdivision 3 of this Subsection. Subd. 5. Council Consideration. After the minutes of the Planning Commission meeting have been forwarded to the Council, the Council will consider the application and recommendation of the Planning Commission. Within 60 days after its first consideration, the Council will by motion grant or deny the application according to the provisions of Subdivision 3 of this Subsection and will make a record in the minutes stating its conclusions with respect to each of the findings required under Subdivision 3 of this Subsection. Subd. 6. ExR!ration of Variance. If a variance is granted but the building or other structure permitted by the variance is-not constructed within one year from the date the variance is granted, the variance will expire and will be of no further force or effect. 1648 STAFF REPORT DATE: August 12, 1994 TO: Mayor and Councilmembers FROM: Michael Morrison, City Manager ITEM: PUBLIC HEARING-REDEVELOPMENT PLAN FOR 3111 SILVER LAKE ROAD Minnesota State Statute 469.028 requires an application by the HRA with a redevelopment plan, a statement of the method proposed for financing the project, and the written opinion of the Planning Commission. Before approving the redevelopment plan by resolution, the City Council shall hold a public hearing. The application, redevelopment plan, and method of financing is included with this report. The written opinion of the Planning Commission is from the minutes of their September 20, 1994 meeting, and the minutes are included with this report. The public hearing notice, published on , within the 10 day minimum and 30 day maximum required parameters. Resolution 94-0 has been submitted for your approval. Staff believes the land in the project area would not be redeveloped by the market place alone. City staff will make a request for proposals (RFP) from private developers to acquire and redevelop in the project area. The difference between the acquisition price paid by the developer and the $42,800 plus closing costs paid for by the City is HRA financing that enabled the project. The plan is consistent with the needs of the community and conforms to the general plan for the development of the community, as the City is striving to maintain or improve housing stock in the community. • PROCESS FOR 3111 SILVER LAKE ROAD 1. ANTHONY HOUSING AND REDEVELOPMENT AUTHORITY REDEVELOPMENT PLAN FOR 3111 SILVER LAKE ROAD The City of St. Anthony Housing and Redevelopment Authority 'SAHRA' formally applies to the St. Anthony City Council the following redevelopment plan: Proceed with the acquisition of the substandard house and land at 3111 Silver Lake Road in order to facilitate the process whereby a private developer will demolish the current house and construct a single family home in the manner the City prescribes. The process to acquire, demolish, and construct is consistent with the SAHRA policy to ensure the housing stock in the City is maintained and upgraded, and that instances of blight and substandard housing is renovated or redeveloped. ANTHONY RESOLUTION 94-XXX A RESOLUTION APPROVING THE ST. ANTHONY HOUSING AND REDEVELOPMENT AUTHORITY PLAN FOR 3111 SILVER LAKE ROAD AND AUTHORIZING THE USE OF H.R.A. FUNDING WHEREAS, the land in the project area would not be made available for redevelopment without the.financial aid to be sought; and WHEREAS, the redevelopment plan for the project area will afford maximum opportunity, consistent with the needs of the City of St. Anthony as a whole; for the redevelopment of the project area by private enterprise; and WHEREAS, the redevelopment plan conforms to a general plan for the development of the City of St. Anthony as a whole. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony hereby approves the St. Anthony Housing and Redevelopment Authority plan for 3111 Silver Lake Road and authorizes the use of H.R.A. financing not to exceed $42,800, plus closing costs. RESOLUTION 1994-XXX A RESOLUTION APPROVING THE SALE OF PROPERTY KNOWN AS 3111 SILVER LAKE ROAD WHEREAS, on October 11, 1994, the St. Anthony City Council approved the plan for 3111 Silver Lake Road and authorized the use of the St. Anthony Housing and Redevelopment Authority financing, not to exceed $42,800. NOW, THEREFORE, BE IT RESOLVED, that the St. Anthony Housing and Redevelopment Authority hereby approves the sale of the property known as 3111 Silver Lake Road. Chair Reviewed for administration: Executive Director REQUEST FOR PROPOSALS REDEVELOPMENT OF PROJECT AREA/3111 SILVER LAKE ROAD The City of St. Anthony Housing and Redevelopment Authority is in the process of acquiring the property of 3111 Silver Lake Road. The current home is substandard, yet situated on a buildable lot (66' X 160' -- 10.560 square feet). The City's H.R.A. is seeking proposals from private developers to acquire the property and construct a.single family home that meets the following conditions: (1) valued at a minimum of$125,000, including lot cost; and (2) will comply with the City's Zoning Ordinance, except for lot size area and width requirements, where the City will review variances; and (3) a minimum of a two car garage; and (4) will be designed in such a way to minimize privacy concerns from the neighbor; and (5) will be built within one year at time of closing, and if not, the City will have recourse; and (6) driveway will come off Townview Avenue N.E. According to the Ordinance, a corner lot should be 11,000 square feet, but 3111 Silver Lake Road is 10,560 square feet. ► The proposed structure cannot be more than 28 feet wide to fit on the lot. i ► The proposed structure would require two variances one for the front and one for the back. ► The proposed structure, with a 28 foot width, would face Townview and set forward to the adjacent homes. ► This lot is similar to the Mercil property at 2922 Townview(old 3112 Silver Lake Road). It appears the same variances would be required. No dwelling may be constructed or placed on (a) an interior lot of less than 9,000 square feet, or less than 75 feet in width at the building setback line, or (b) a corner of less than 11,000 square feet or less than 90 feet in width at the building setback line. Subd. 3. Floor Area Ratio. The floor area ratio within the R-1 District may not exceed 0.3. Subd. 4. Minimum Floor Area.
